McGovern, Councilman Village Council Action Summary - Final June 23, 2015 1. CALL TO ORDER Mayor Margolis called the meeting to order at 7:00 p.m. 2. PLEDGE OF ALLEGIANCE Mayor Margolis led the Pledge of Allegiance. 3. INVOCATION Jay Carrero, Senior Pastor, Blueprints Church, Wellington, delivered the Invocation. 4. APPROVAL OF AGENDA Mr. Schofield presented the agenda recommending approval with two changes: (1) Postpone item 5A Presentation by Commissioner Melissa McKinlay, et al. This will be brought back at the start of the equestrian season. (2) Move the presentation by Monica Kallas on Genetically Modified Organisms (GMOs) from the Public Forum to Presentations and Proclamations. A motion was made by Councilman McGovern, seconded by Councilman Willhite, and unanimously passed (5-0) approving the agenda as amended. 5. PRESENTATIONS AND PROCLAMATIONS A. 15-467 PRESENTATION BY PALM BEACH COUNTY COMMISISONER MELISSA MCKINLAY, GLEN JERGENSEN, EXECUTIVE DIRECTOR, TOURISM DEVELOPMENT COUNCIL AND GEORGE LINLEY, EXECUTIVE DIRECTOR, PALM BEACH COUNTY SPORTS COMMISSION ILLUSTRATING THE ECONOMIC STUDY AND VALUE OF THE EQUESTRIAN INDUSTRY TO WELLINGTON AND THE COUNTY This item was postponed. B. 15-472 PRESENTATION OF THE PALM BEACH COUNTY SHERIFF’S OFFICE DISTRICT 8 WELLINGTON SEMI-ANNUAL REPORT Mr. Schofield introduced the agenda item. Captain Jay Hart presented the Palm Beach County Sheriff's Office District 8 Wellngton Semi-Annual Report. A. 15-461 MONICA KALLAS, SHARPSHOOTER MARKETING GROUP: LABELING OF GENETICALLY MODIFIED ORGANISMS (GMOs) Mr. Schofield introduced the agenda item. Ms Monica Kallas, Johnny Meier, My Community Pharmacy and his wife, Meadow gave a presentation to Council on Genetically Modified Organisms. Village of Wellington Page 1 Village Council Action Summary - Final June 23, 2015 The purpose of their presentation was to speak on transparency and the community's right to know what is in their food and consumer products. They spoke of the importance to obtain resolutions from municipalities supporting this effort. Mayor Margolis indicated that he would speak with Senator Abruzzo to determine what was happening with the Bill relating to GMOs in the Senate, and then would meet afterwards to see how the Village can move forward. 6. CONSENT AGENDA Mr. Schofield presented the Consent Agenda recommending approval as presented. There were no public comments on the Consent Agenda. A motion was made by Councilwoman Gerwig, seconded by Councilman McGovern, and unanmously passed (5-0) approving the Consent Agenda as presented. A. 15-447 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETING OF MAY 26, 2015 This iem was approved on Consent. B. 15-327 AUTHORIZATION TO RENEW A CONTRACT WITH SCOTTY’S SPORT SHOP FOR THE PURCHASE AND DELIVERY OF SPORTS UNIFORMS This iem was approved on Consent. C. 15-452 AUTHORIZATION TO UTILIZE A FLORIDA SHERIFF’S ASSOCIATION CONTRACT, AS A BASIS FOR PRICING, FOR THE PURCHASE AND DELIVERY OF TWO (2) GLOBAL ELECTRIC MOTORS (GEM) LOW SPEED VEHICLES This iem was approved on Consent. D. 15-465 AUTHORIZATION TO EXECUTE AN AMENDMENT TO AN EXISTING CONTRACT, TO ADD LANDSCAPE MAINTENANCE SERVICES AT THE NEW TENNIS FACILITY This iem was approved on Consent. 7. PUBLIC HEARINGS None 8. REGULAR AGENDA A. 15-85 APPROVAL OF TWO (2) SPEED HUMPS ALONG PRMROSE LANE ADJACENT TO PRIMROSE PARK Village of Wellington Page 2 Village Council Action Summary - Final June 23, 2015 Mr. Schofield introduced the agenda item. Mr. Riebe presented the staff report. This is a community-driven initiative to install two speed humps along Primrose Lane adjacent to Primrose Park. Council requested that staff monitor this to determine their effectiveness. They thought this might be an important tool to gauge if speed humps at other neighborhood parks may be warranted. Council also asked that staff look at how installing the speed humps at this location was impacting the other roadways in that area. Mr. Riebe indicated that they will start monitoring that area most likely when school starts, and then will report back to Council by the end of the year. Public Comments 1. Mr. Tim Eichner, 1609 Primrose Lane, Wellington. Mr. Eichner identified himself as the Neighborhood Watch Captain for Rye Terrace and was representing 28 homes in their Watch Group. He spoke of the speeding problems on Primrose Lane and the accidents that have occurred due to speed. He said that they were requesting that Council approve the installation of the speed humps. A motion was made by Councilwoman Gerwig, seconded by Mayor Margolis, and unanimously passed (5-0) approving the installation of two (2) speed humps on Primrose Lane adjacent to Primrose Park. 9. PUBLIC FORUM There were no publc comments. 10. ATTORNEY'S REPORT Ms. Cohen presented the following report: 1. Regarding the order that came from the Appellate Division of the Circuit Court, she advised Council that she sent a memorandum to them explaining the case in more detail. She advised Council to contact her if they had any questions relating to this. 11. MANAGER'S REPORTS Mr. Schofield presented the following report: 1. The next Regular Wellington Council meeting was scheduled for Tuesday, July 14, 2015 at 7:00 p.m. in the Council Chambers. 2. Wellington's 4th of July celebration will start at 12:00 Noon at the pool and will continue all day ending with fireworks at Village Park. 3. He will be out of town on Wednesday and Thursday, and Mr. Barnes will be responsible in his absence. 4. Mr. Schofield addressed the series of emails received from the residents of the Rustic Ranches neighborhood of the Pine Tree Water Control District regarding the actions taken at their Annual Landowners Meeting. He said that he would be contacting them the next day. He noted that it might be time to ask the Pine Tree people if they wanted to reconsider their relationship with the Village and South Florida Water Management District. He noted that he provided Council with a copy of the Interlocal Agreement noting that it Village of Wellington Page 3 Village Council Action Summary - Final June 23, 2015 included an exit clause. 12. COUNCIL REPORTS Councilwoman Gerwig presented the following report: 1. She announced that she would not be attending the 4th of July celebration as she will be in Africa celebrating her 25th wedding anniversary. 2. Councilwoman Gerwig addressed Council's conversation regarding "standing" at the Agenda Review. She gave her perspective on why it was important to change this and how it could affect all of the property rights in Wellington. Vice Mayor Greene presented the following report: 1. He announced he would be attending the 4th of July celebration. 2. He noted that he had attended an Ethics Workshop with Mayor Margolis. He then addressed the Administrative Transmittal regarding legal reimbursement for ethics complaints. He expressed concern that the Village’s coverage for such complaints had been reduced to 50%. He felt that protection was needed when claims against Council have been cleared. Ms. Cohen indicated that Council had discussed the possibility of passing a reimbursement policy for those types of incidents. She said the policy is drafted and can be brought forward. She said that staff will be looking at why some claims were paid in full while others were not. Vice Mayor Greene indicated that he would like that policy to come back and be reviewed by Council. 3. He spoke about the current policy regarding Council emails which he believed should be reviewed again by Council. Ms. Cohen concurred and noted the Sunshine Violations that could arise from this. She thought that Council should revisit that policy and her recommendation would be that practice be abandoned. Mr. Schofield explained the previous practice where Council received hard copies of emails at the end of the week. He said that his preference would be that each Councilmember get their own emails which they each respond to, and then a copy is provided at the end of week. Mr. Schofield then addressed the insurance contract and explained that the Village's Code of Ordinances covers reimbursement which says if someone is found innocent of a charge, then the Village has the ability to reimburse them. He said he would meet individually with Council and then will bring back their comments. Vice Mayor Greene noted for the record that he did not have any outstanding legal expenses that he was asking to bring back in front of the Council. Ms. Cohen said that she would distribute the policy that was previously drafted. She said that Council could then each meet with Mr. Schofield and provide him their comments. Mr. Schofield said that they would also look at Ordinance 2-159 which is the governing ordinance. Councilman Willhite expressed concern that Council was never notified of the change in the reduction of the insurance policy. Staff indicated they were not aware of the change. Councilman Willhite questioned what the Village was paying for the 50% and perhaps there may be a potential savings for the Village to not pay for the policy. Councilman Willhite presented the following report: 1. He attended the Muscular Dystrophy Summer Camp which he felt is a great Village of Wellington Page 4 Village Council Action Summary - Final June 23, 2015 thing for the kids as well as for the parents. 2. He was happy to attend the Loxahatchee Grove ribbon cutting. 3. He announced he would be attending the Village's 4th of July celebration. He noted that he hoped there was a PA system at the park. Mr. Schofield said that it is being worked on. 4. Councilman Willhite said that he looked at the plans for the Wellington Community Center and was upset to see that the building did not look anything like he had approved. He thought the building was institutional, was not up to Village standards, and he did not believe it would garner the benefits to Wellington that they had envisioned. After seeing the plans, he thought that perhaps the Community Center project should come back to Council for review. Council agreed that this should come back to them for review. 5. He wanted to ensure that the Village is making everyone aware of the no fireworks in the equestrian area. Mr. Schofield said that was being done. 6. He asked that everyone be careful with fireworks and encouraged them to see the fireworks put on by the Village. He wished everyone a safe 4th of July. Councilman McGovern presented the following report: 1. He wished everyone a Happy 4th of July and announced he will be at the celebration. 2. He asked Mr. Schofield to present a status on Phase VI of the Canal Reclamation project. Mr. Schofield explained that all canal reclamation projects have been put on hold; however, work will be done on culverts if needed. Staff has met with Mock Roos and asked them to review the means and methods being used by Wellington and to provide alternatives. He will be meeting with the other drainage district that using amphibious excavators to see if can be potentially been used in the Village. Staff will come back with alternatives, but for the foreseeable future, the only vegetation on a canal that will be touched is that which sits over a water or sewer line or is an imminent danger. The projects will not be restarted without public notification and without the Council being fully informed. 3. He asked Mr. Schofield to explain the AT that was received regarding the Hawthorne Neighborhood proposal. Mr. Schofield said that area does not have a neighborhood park, it is not close to another one, and staff has identified a piece of property. Staff has looked at the cost which Council will see as a budgetary item. Because of the nature of this, staff will be looking to see if it can be funded through CDGB funds. 4. Councilman McGovern encouraged the public to participate in the Village's Budget Challenge which is available on line. 5. He reported he met the new Palm Beach School District's superintendent and he encouraged others to meet with him as he is making a tour around the County. 6. He congratulated the Village's three elementary schools for being recognized as three of the top ten elementary schools in Palm Beach County. Mayor Margolis presented the following report: 1. He said that he attended the Ethics presentation with Vice Mayor Greene last week to meet the State and County's requirements. He said that they were told that they no longer need to sign a form, but can check a box when the Financial Disclosure form is signed. He noted that he heard at the presentations that 96% to 97% of all complaints were politically motivated. He noted that the County can self-initiate while the State can't and explained how someone can look at a photo of an elected official attending an event, and they Village of Wellington Page 5 Village Council Action Summary - Final June 23, 2015 can go and check to see if a gift form was submitted or the ticket was paid for. He noted the number of commissioners that have resigned from that body, and thought they should look at the problems in their own entity. 13.
