CALL TO ORDER Mayor Gerwig called the meeting to order at 7:00 p.m. 2. PLEDGE OF ALLEGIANCE The Girl Scouts from Troop 20097 led the Pledge of Allegiance. 3. INVOCATION Twig Morris, Chairman of the Wellington Garden Club, delivered the Invocation. 4. APPROVAL OF AGENDA Village Manager, Paul Schofield, stated that staff recommended approval of the agenda as presented. A motion was made by Vice Mayor McGovern, seconded by Councilman Drahos and unanimously passed (5-0), to approve the agenda as presented. 5. PRESENTATIONS AND PROCLAMATIONS A. 16-0124 PROCLAMATION OF THE VILLAGE COUNCIL OF WELLINGTON, FLORIDA RECOGNIZING CODY CLINE FOR HIS OUTSTANDING SWIMMING ACCOMPLISHMENTS Mr. Schofield introduced the item. Rachel Callovi, Acting Village Clerk, read the Proclamation into the record. The coach for Cody Cline provided comments on his character and swimming talent. The Council congratulated Cody and commended him for his accomplishments. B. 16-0159 PROCLAMATION OF THE VILLAGE COUNCIL OF WELLINGTON, FLORIDA RECOGNIZING MEGHAN STRAND, AMBERLY RODRIGUEZ, KAYLA DELLAMO AND HAYLIE WILES ON BEING AWARDED THE GIRL SCOUT BRONZE AWARD Mr. Schofield introduced the item. Ms. Callovi read the Proclamation into the record. A student representative from the Girl Scout Troop provided information about their project. The Council commended the Girl Scouts for their hard work and complimented them on their example of giving back. Ms. Callovi read the Proclamation into the record. Twig Morris spoke about the Garden Club's involvement in Wellington in celebration of Garden Week. The Council thanked the Garden Club members for their contribution to the community. D. 16-0172 PROCLAMATION RECOGNIZING ZA'KIARA O'NEAL FOR HER FOUR YEAR SCHOLARSHIP AWARD Mr. Schofield introduced the item. Ms. Callovi read the Proclamation into the record. Za'Kiara O'Neal thanked everyone that mentored, supported and assisted her in getting this scholarship. The Council congratulated Za'Kiara on her accomplishment. E. 16-0136 PRESENTATION BY THE PALM BEACH COUNTY COMMISSION ON ETHICS Mr. Schofield introduced the item. He introduced Mark Bannon and Gina Levesque from the Palm County Commission on Ethics (COE). Mr. Bannon provided information as to the responsibilities of the COE and the services offered. He also recognized Wellington's new captain. Mayor Gerwig asked Mr. Bannon to speak as to when it is appropriate to contact the IG and when it is appropriate to contact the COE. Mr. Bannon explained that the IG advises on matters having to do with waste, fraud mismanagement and contract issues. The COE handles matters involving the Palm Beach County Code of Ethics. 6. CONSENT AGENDA Mr. Schofield stated that staff recommended adoption of the Consent Agenda as presented. Robert Basehart, Planning & Zoning, explained the proposed voluntary annexation of a parcel comprised of 2.8 acres located at the south end of Flying Cow Road. PUBLIC HEARING: A motion was made by Vice Mayor McGovern, seconded by Councilman Napoleone and unanimously passed (5-0), to open public hearing. There being no public comments, a motion was made by Vice Mayor McGovern, seconded by Councilman Drahos and unanimously passed (5-0) to close public hearing. After discussion at the Village Council Workshop, it was his understanding that the Council would like this item remanded back to the Planning, Zoning & Adjustment Board (PZAB) for reconsideration and changes. The Council commented on this item going back to PZAB for involvement with the applicant, recommendations and refinement. He stated that staff recommends scheduling the public hearing for June 28, 2016. ATTORNEY'S REPORT Laurie Cohen, Village Attorney, informed Council of the lengthy special magistrate hearing concerning an interpretation of Florida Statute 604.50. 11. MANAGER'S REPORTS Mr. Schofield provided a list of upcoming meetings and announced the Village of Wellington Page 10 Village Council Action Summary - Final May 24, 2016 Village's closing for the Memorial Day Holiday. 12. COUNCIL REPORTS Councilwoman Siskind presented the following report: • Councilwoman Siskind commented on the survey results and said that the comments were helpful. Vice Mayor McGovern presented the following report: • Vice Mayor McGovern thanked the board and committee members for their service. He also thanked the applicants and congratulated the new members. He said that he hopes the boards and committees are used more effectively. • Vice Mayor McGovern inquired about a case between Polo West vs the Village of Wellington where a temporary injunction order was denied. Ms. Cohen explained that there was a hearing and the judge indicated that he would deny the temporary injunction order at the hearing. She said that the declaratory action is still pending. Vice Mayor McGovern asked if a trial has been set for the declaratory action. Ms. Cohen stated that a hearing for summary judgment has been scheduled in the month of June. • Vice Mayor McGovern mentioned the upcoming Splash Water Safety event. He commented on the importance of water safety. He congratulated Mayor Gerwig on being appointed to the Palm Beach County League of Cities. He commented on the Memorial Day festivities and congratulated all graduates. Councilman Drahos presented the following report: • Councilman Drahos said that he is pleased with the appointments. He addressed the permitting issue and fluoride. He mentioned an email from a resident having to do with traffic on Binks Forrest Drive. He asked that staff takes a more active and aggressive approach for traffic calming. Mr. Schofield stated that the traffic is a recurring problem. Mayor Gerwig presented the following report: • Mayor Gerwig said that she is the regular member on the Metropolitan Planning Organization (MPO) and would like an alternative representative. Councilman Napoleone stated that he will be the alternate. • Mayor Gerwig commented on attending upcoming graduation ceremonies. She commented on the individuals that received proclamations.
