CALL TO ORDER Mayor Gerwig called the meeting to order at 7:00 p.m. Council Members present: Anne Gerwig, Mayor; Tanya Siskind, Vice Mayor; John McGovern, Councilman; Michael Drahos, Councilman; and Michael Napoleone, Councilman. Advisors to the Council: Paul Schofield, Manager; Laurie Cohen, Attorney; Jim Barnes, Assistant Manager; Tanya Quickel, Deputy Village Manager; and Chevelle D. Addie, Village Clerk. 2. PLEDGE OF ALLEGIANCE Councilman McGovern led the Pledge of Allegiance. 3. INVOCATION Rabbi Emeritus, Stephen Pinsky, Temple Beth Torah, Wellington, delivered the Invocation. 4. APPROVAL OF AGENDA Mr. Schofield indicated staff recommended approval of the Agenda as presented. A motion was made by Councilman McGovern, seconded by Councilman Drahos, and unanimously passed (5-0), to approve the Agenda as presented. 5. PRESENTATIONS AND PROCLAMATIONS A. 20-3764 PRESENTATION OF SCHOLARSHIPS AND CONTRIBUTIONS BY WASTE MANAGEMENT, INC. OF FLORIDA TO LOCAL AREA SCHOOLS Mr. Schofield introduced the item. Mr. Barnes introduced Dawn McCormick and Ellen Smith from Waste Management. Dawn McCormick, Director of Communications for Waste Management, spoke regarding the scholarships for students at Wellington and Palm Beach Central High Schools, and contributions for the purchase of books for Elbridge Gale and Panther Run Elementary Schools and Emerald Cove Middle School. Village of Wellington Page 1 Village Council Action Summary - Final May 26, 2020 Ms. Ellen Smith, Government Affairs Area Director for Waste Management, presented the $3,000 Park Sponsorship that they do every year for the athletic programs in the Village. Council gave comments regarding the scholarships. 6. CONSENT AGENDA Mr. Schofield indicated there were no comment cards on the Consent Agenda submitted from the public. However, there is one person who wishes to speak. Mr. Schofield indicated staff recommended approval of the Consent Agenda as presented. A motion was made by Councilman Napoleone, seconded by Vice Mayor Siskind, and unanimously passed (5-0), to approve the Consent Agenda as presented. Vice Mayor Siskind stated that Irv Slosberg would like to speak. Mr. Slosberg of Boca Raton presented his comments on his run for Florida State Senate. Public Hearing: A motion was made by Councilman McGovern, seconded by Councilman Napoleone, and unanimously passed (5-0) to open the public hearing. There being no public comments, a motion was made by Councilman Drahos, seconded by Vice Mayor Siskind, and unanimously passed (5-0) to close the public hearing. A motion was made by Councilman Napoleone, seconded by Councilman Drahos, and unanimously passed (5-0) to approve Ordinance No. 2020-07 (Adopting the Water Supply Facilities 10-Year Work Plan and Required Update of Wellington's Comprehensive Plan) on first reading. B. 20-3798 ORDINANCE NO. 2020-08 (SPECIAL MAGISTRATE APPOINTMENT POLICY AND PROCESS) AN ORDINANCE OF THE VILLAGE OF WELLINGTON FLORIDA AMENDING CHAPTER 2, ARTICLE IV, SECTION 2-203 OF WELLINGTON’S CODE OF ORDINANCES ENTITLED “SPECIAL MAGISTRATE” TO ELIMINATE THE TERM LIMITS PREVIOUSLY ADOPTED AND CLARIFY THE APPOINTMENT PROCESS AND QUALIFICATIONS FOR SPECIAL MAGISTRATES; PROVIDING FOR THE REPEAL OF ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH, INCLUDING ORDINANCE NO. 2012-18 AND RESOLUTIONS 2012-29 AND 2015-43; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING AN EFFECTIVE DATE. There being no public comments, a motion was made by Councilman Drahos, seconded by Vice Mayor Siskind, and unanimously passed (5-0) to close the public hearing. A motion was made by Councilman Drahos, seconded by Councilman Napoleone, and unanimously passed (5-0) to adopt Ordinance No. 2020-08 (Special Magistrate Appointment Policy and Process) on second reading. 8. REGULAR AGENDA A. 20-3809 RESOLUTION NO. R2020-20 RESOLUTION ADOPTING PRELIMINARY TRIM RATES FOR THE WELLINGTON SOLID WASTE COLLECTION AND RECYCLING ASSESSMENTS AS FOLLOWS: A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL ADOPTING THE PRELIMINARY NON-AD VALOREM ASSESSMENT RATES FOR SOLID WASTE COLLECTION AND RECYCLING SERVICE FOR TRUTH-IN-MILLAGE (“TRIM”) PURPOSES WITHIN THE JURISDICTIONAL BOUNDARIES OF WELLINGTON; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced the item. Ms. Addie read the Resolution by title. Ms. Quickel presented this item. No comment cards were received from the public. A motion was made by Councilman McGovern, seconded by Vice Mayor Siskind, and unanimously passed (5-0), to approve Resolution No. R2020-20 (Adopting the Preliminary Non-Ad Valorem Assessment Rates for Solid Waste Collection and Recycling Service for Truth-in-Millage (TRIM) Purposes within the Jurisdictional Boundaries of Wellington) as presented. Village of Wellington Page 4 Village Council Action Summary - Final May 26, 2020 B. 20-3817 COUNCIL APPOINTMENT OF BOARD AND COMMITTEE MEMBERS Mr. Schofield introduced the item. Council made appointments for the 2020-2022 term to the Architectural Review Board, Construction Board of Adjustments and Appeals, Education Committee, Equestrian Preserve Committee, Parks & Recreation Advisory Board, Planning, Zoning and Adjustment Board, Public Safety Committee, Senior Advisory Committee and Tree Board. 9. PUBLIC FORUM There were no public comments for Public Forum. 10. ATTORNEY'S REPORT MS. COHEN: Ms. Cohen presented the following report: Ms. Cohen stated that she has followed up with Florida Municipal Insurance Trust (FMIT) regarding potential coverage for the Pine Tree matter. She said that she has submitted all the information and has not heard back yet. Ms. Cohen stated she will update the Council when she hears back from them. 11. MANAGER'S REPORT MR. SCHOFIELD: Mr. Schofield presented the following report: The Next Regular Council Meeting will be held on Tuesday, June 9, 2020 at 7:00 PM in the Council Chambers. Mr. Schofield stated that the COVID-19 testing site only had 80 registered people and a few walk-ins that day. He said that the next day there were 30 registered people and he is assuming that by the end of the week, there would be lower numbers. The testing then would be held at Premier Health. He said that as long as there are County test kits, they will still schedule them through the Village portal. Mr. Schofield gave a brief update regarding Feeding South Florida and stated 800 vouchers will be the number of vouchers for each week. Mr. Schofield mentioned that on Friday, May 22, 2020, the Governor signed an order that opened up organized youth sports. He said that they are working on a plan to do that. There is no guidance on families attending. He said that the 50 person limit does not seem workable based on the fact that most teams have twelve players and three Village of Wellington Page 5 Village Council Action Summary - Final May 26, 2020 coaches, umpires and then family. There was brief discussion between staff and Council regarding this. 12. COUNCIL REPORTS COUNCILMAN DRAHOS: Councilman Drahos presented the following report: Councilman Drahos said that there has been increasing number of complaints regarding a certain company using aggressive door to door tactics in the neighborhoods. He is concerned because he said that companies have the right to go door to door, but the aggressive tactics that this company is using are very deceptive. He asked if code enforcement can intervene. Mr. Schofield stated that there is not a no soliciting ordinance in Wellington and they cannot adopt one. He suggested that the residents put up no soliciting signs. He said that he has placed a call into the company and Mr. Koch will be following up. He is going to have them advised not to use deceptive sales tactics and he will file the necessary complaints. Ms. Cohen stated that Mr. Schofield was correct in that Wellington cannot adopt a no soliciting ordinance as there are many cases stating that companies have the right to solicit and knock on doors. She said if a homeowner places a no solicitation sign, it may deter. If the homeowner has any issues with the solicitor not leaving after they have asked them to, then they can call the non-emergency line at the Palm Beach Sheriff’s Office (PBSO). COUNCILMAN NAPOLEONE: Councilman Napoleone presented the following report: Councilman Napoleone stated that it was very nice that they were able to do the virtual tribute on Memorial Day. Councilman Napoleone congratulated all the high school seniors who are graduating in a way that no one ever envisioned and celebrating their high school career. He asked the seniors not to look sadly on this as this is just a small slice of their life and they have so much more to experience. VICE MAYOR SISKIND: Vice Mayor Siskind presented the following report: Village of Wellington Page 6 Village Council Action Summary - Final May 26, 2020 Vice Mayor Siskind wished all the graduating seniors well. She mentioned that the last day of school is Friday and that they all made it through distance learning. Vice Mayor Siskind thanked all those that have served on the boards and committees and welcomed the new members. She said that it is a good problem to have more candidates than positions. She said that it really shows that the community is very active. She wanted to thank everyone for trying to get on a board or committee and for their service. COUNCILMAN MCGOVERN: Councilman McGovern presented the following report: Councilman McGovern asked Mr. Schofield how the plan was coming along for the 4th of July and fireworks. Mr. Schofield stated that the plan is to have a drive in fireworks display . They will arrange parking for the fireworks. Mr. Barnes is coordinating that to work between the Village facilities and the parking lot at the Mall at Wellington Green. He said that he is not sure that they will be able to accommodate the 10,000 - 12,000 that they normally do, but if they do, it will be in their cars. He said that they are looking for the FM system and those types of things to go along with it. Councilman McGovern thanked the Mayor for her visit to the Veteran ’s Memorial on Memorial Day. He thanked staff for the virtual Memorial Day tribute. He said that the soldiers have given their lives for a very long time in the history of this country to make sure that our democracy functions and our freedoms are secure. Councilman McGovern congratulated the graduates and wanted the graduates to know how much they mean to this community. He said that Wellington is driven by being a family community and the schools mean a tremendous amount to them. He said that congratulations not only goes to the high school graduates, but the 8th grade graduates, 5th grade graduates and kindergarteners. Councilman McGovern thanked all of the students, teachers, principals, and parents for getting through this time. Councilman McGovern stated that they need to remember that they have been blessed with having such a low number of cases of the COVID-19. He said that while they all do not agree on the things that have been done to keep the community safe, they have stood together as a community . He said that they have stood firm knowing that the actions of one can Village of Wellington Page 7 Village Council Action Summary - Final May 26, 2020 impact the life of another. He said that he hopes that things will get better. He thanked the staff for what they have done and reminded everyone that they are all still in this together. MAYOR GERWIG: Mayor Gerwig presented the following report: Mayor Gerwig thanked the rest of the Council for their participation with the Memorial Day tribute. She stated that she appreciated Mr. Schofield for going along with them. Mayor Gerwig asked for someone to fill her in on the parade. Councilman Drahos explained that he and Councilman McGovern, along with the entire Council, were invited to participate in a parade at Polo West that was honoring two veterans who had recently passed away. Councilman McGovern explained that they were World War II veterans. Mr. Barnes stated that it was for Julia Davis’ family. Councilman Drahos stated that they were members of Fire Rescue and other veterans participated as well. He stated that there were a number of Wellington residents. He said that it was very well organized and there were media outlets in attendance. Councilman McGovern said that there were people there from the American Legion, Palm Beach County Fire Rescue, Palm Beach County Sheriff’s Office and many residents of the Polo West community and the overall Village. He said they were all there as a way to say "Thank You" to those that have served. Mayor Gerwig mentioned that they had missed Relay for Life due to COVID-19. She stated that one of her favorite parts of that is putting the luminaries out. She said that she had discussed with Mr. Schofield having just a luminaria along the Promenade. She said that this is not an event and everyone will not be out at the same time. Mayor Gerwig stated that if everyone did come out, they would be able to walk from one end to the other and still stay six feet away from each other. She said that they would sell the bags and the money goes to the American Cancer Society. Mayor Gerwig stated that they are aiming for the date of June 22nd. She said that it would be nice for those who have not been out to the Promenade yet and it would also be a virtual experience. She wanted to make sure that the rest of the Council was on board before they did this. Councilman Drahos thought it sounded awesome. He said that Village of Wellington Page 8 Village Council Action Summary - Final May 26, 2020 unfortunately, he would be on vacation, but he may be able to make it since it is on the last day of his vacation. Vice Mayor Siskind asked how they could purchase the bags. Mayor Gerwig stated that the American Cancer Society will have the bags out and you can purchase from them. She said that they will not be real candles, they will be the battery operated lights. Mayor Gerwig stated that she misunderstood Ms. Edwards regarding the SWAG program. She said she thought they just could not find places to take the students, when in actuality it was because the school was not able to participate and identify students because of their programming . She said that she had a real outpour of local businesses that wanted to participate. She stated that she still thinks they are on the right track whether they can do it now or not. She said that the community is wanting to be a part of the next generation and mentoring them by teaching them a skill. Mayor Gerwig stated that they had a lot of interest in the program and does not want them to give up. She said that she would like to build on it and get every senior a job and a skill. Mr. Schofield stated the program this year was a more expanded program compared to the past years. He said that interview skills and resume building skills were offered to anyone who wanted them. He said that each school was to identify six students who would then go out for the internships. He said that they never got past the identifying of the students. Mr. Schofield stated that this was cancelled when all school programs were cancelled. Mayor Gerwig said that she feels this program is taking things to the next level to give the kids the opportunity for a fantastic future and possibly move back and be a part of Wellington. Mr. Schofield stated that this was the first year that they had asked trades to be involved. Mayor Gerwig stated that she was out at the Feeding site and knows that people are very appreciative. She said they will keep going as long as it is needed. 13.
