CALL TO ORDER Mayor Gerwig called the meeting to order at 7:00 p.m. via communications media technology. Council Members present remotely: Anne Gerwig, Mayor; Tanya Siskind, Vice Mayor; John McGovern, Councilman; Michael Drahos, Councilman; and Michael Napoleone, Councilman. Advisors to the Council: Paul Schofield, Manager; Laurie Cohen, Attorney; Jim Barnes, Assistant Manager; Tanya Quickel, Deputy Village Manager; and Chevelle D. Addie, Village Clerk. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. INVOCATION Deacon Pete Del Valle, St. Therese de Lisieux Catholic Church, Wellington, delivered the invocation. 4. APPROVAL OF AGENDA Mr. Schofield indicated staff recommended approval of the Agenda as amended. 1) Regarding Consent Item 6B, the annual contract amount was reduced from $75,000 to $50,000. A motion was made by Councilman McGovern, seconded by Councilman Napoleone, and unanimously passed (5-0), to approve the Agenda as amended. 5. PRESENTATIONS AND PROCLAMATIONS Mr. Schofield indicated there were no Presentations and Proclamations. 6. CONSENT AGENDA Mr. Schofield stated there were no comment cards on the Consent Agenda. Mr. Schofield indicated staff recommended approval of the Consent Agenda as amended. A. 20-3965 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETING OF AUGUST 25, 2020 This item approved on Consent. B. 20-3783 AUTHORIZATION TO AWARD A CONTRACT FOR LOBBYING SERVICES The annual contract amount was reduced from $75,000 to $50,000. This item approved on Consent. C. 20-3796 AUTHORIZATION TO CONTINUE UTILIZING A CITY OF PLANTATION CONTRACT WITH ALLIED UNIVERSAL CORPORATION FOR THE PURCHASE AND DELIVERY OF SODIUM HYPOCHLORITE This item approved on Consent. D. 20-3960 AUTHORIZATION TO AMEND A CONTRACT TO PROVIDE ENTERPRISE RESOURCE PLANNING (ERP) IMPLEMENTATION CONSULTING SERVICES This item approved on Consent. 7. PUBLIC HEARINGS A. 20-3905 FIRST PUBLIC HEARING FOR PROPOSED FISCAL YEAR 2020/2021 MILLAGE RATE, BUDGET AND ADOPTION OF THE FISCAL YEAR 2020/2021 CAPITAL IMPROVEMENT PLAN Mr. Schofield introduced this item. Ms. Quickel presented this item. Mr. Schofield provided comments regarding the budget. There was Council discussion regarding the budget. Council commended Ms. Quickel and staff for their work on the budget. Public Hearing A motion was made by Councilman Napoleone, seconded by Vice Mayor Siskind, and unanimously passed (5-0), to open the Public Hearing. Village of Wellington Page 2 Village Council Action Summary - Final September 8, 2020 There being no public comments, a motion was made by Councilman Napoleone, seconded by Vice Mayor Siskind, and unanimously passed (5-0), to close the Public Hearing. A motion was made by Councilman Drahos and seconded by Vice Mayor Siskind, and unanimously passed (5-0) to approve the budget for FY 2020/2021 at a millage rate of 2.47. B. 20-3961 ORDINANCE NO. 2020-07 (10-YEAR WATER SUPPLY UPDATE) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL, ADOPTING WELLINGTON’S WATER SUPPLY FACILITIES 10-YEAR WORK PLAN AND AMENDING WELLINGTON’S COMPREHENSIVE PLAN TO INCORPORATE THE WORK PLAN BY REFERENCE WITHIN THE INFRASTRUCTURE ELEMENT, AS REQUIRED BY FLORIDA STATUTE; AMENDING REFERENCES TO THE WORK PLAN IN THE FUTURE LAND USE, CONSERVATION, INFRASTRUCTURE, INTERGOVERNMENTAL COORDINATION, RECREATION AND OPEN SPACE, AND CAPITAL IMPROVEMENTS ELEMENTS; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced the item. Ms. Addie read the Ordinance by title. Mr. Schofield presented the item. Council gave brief comments. Public Hearing: A motion was made by Councilman Napoleone, seconded by Councilman McGovern, and unanimously passed (5-0), to open the Public Hearing. There being no public comments, a motion was made by Councilman McGovern, seconded by Vice Mayor Siskind, and unanimously passed (5-0), to close the Public Hearing. A motion was made by Councilman McGovern, seconded by Councilman Drahos, and unanimously passed (5-0), to approve Ordinance No. 2020-07 (10-Year Water Supply Update). 8. PUBLIC FORUM Mr. Schofield indicated no public comment cards were received. 10. ATTORNEY'S REPORT MS. COHEN: Ms. Cohen presented the following report: Ms. Cohen stated that there has been some discussion for an early mediation in the PR Raintree, LLC. litigation matter. She stated she received information on Friday that indicates the early mediation is less likely to be successful and asked, in case the parties do agree, that Council appoint a Councilmember to attend the mediation. There was Council consensus for Councilman Drahos to attend. Ms. Cohen stated if the mediation does occur she will brief Council in an attorney-client session. Councilman McGovern asked that Ms. Cohen give him a call regarding this matter. She stated will speak to each Council Member individually on this matter. 11. MANAGER'S REPORT MR. SCHOFIELD: Mr. Schofield presented the following report: The Next Regular Council Meeting will be held on Tuesday, September 22, 2020, at 7:00 PM. Mayor Gerwig asked if the partitions are in place for the next Council meeting. Councilman McGovern asked if the partitions and social distancing is still in place. Mr. Schofield explained the setup for the Council meeting. Mayor Gerwig asked if information regarding the budget had been put out on social media. Ms. Quickel stated budget information has been placed on social media and the website. She stated staff will focus on this again over the next few weeks. 12. COUNCIL REPORTS Village of Wellington Page 4 Village Council Action Summary - Final September 8, 2020 COUNCILMAN MCGOVERN: Councilman McGovern presented the following report: Councilman McGovern requested an update about the Wellington Community Center testing site. Mr. Barnes provided an update regarding the testing site. Councilman McGovern asked if children can be tested at the site. Mr. Barnes stated children 12 years and older can be tested. Councilman McGovern inquired as to how long Feeding South Florida will continue. Mr. De La Vega stated it will continue until the end of October. He stated they went through 900 more vouchers today and the event went very well. He stated the number has been at 900 vouchers for some time now. Mr. De La Vega stated whenever food is left over, the Community Services Department distributes it to residents. Mayor Gerwig stated there were good food choices today. Councilman McGovern stated Palm Beach County has entered into Phase 2 today. He stated schools will re-open two weeks from today. He reminded everyone that the virus is not over and there are people who still have needs in this community. Councilman McGovern stated he hopes everyone continues to stay focus and come together to take care of our neighbors. Councilman McGovern stated it is now down to the final three weeks for the completion of the census. He stated it is critically essential to the Wellington community to complete the census due to the tax revenue shortfalls from the impact of COVID-19. Mayor Gerwig stated persons have been encouraged to complete the census during Feeding South Florida. She stated the desire is for the entire area to be represented properly in the census. VICE MAYOR SISKIND: Vice Mayor Siskind presented the following report: Vice Mayor Siskind inquired if the County’s mask mandate will be extended beyond September 22, 2020. Village of Wellington Page 5 Village Council Action Summary - Final September 8, 2020 Vice Mayor Siskind reminded parents to go onto their student’s portal on the School District’s website to make the choice regarding whether their children will attend school virtually or in person. Vice Mayor Siskind stated the tower has been lit purple for Chiari Malformation Awareness Month and referenced the Palm Beach Post article. She stated Jordan Ray plans to attend the next Council meeting. COUNCILMAN DRAHOS: Councilman Drahos presented the following report: Councilman Drahos asked Mr. Barnes if the football field behind Wellington High School is ready for season and asked for an update regarding the rest of project. Mr. Barnes stated the football field is complete and the School District is discussing how they will proceed countywide with activities for the school year and fall sports at their meeting tomorrow evening. He said once this occurs, staff will have a better idea of how this will happen. He stated the field looks great and staff is coordinating with the School District regarding some sort of ribbon cutting or opening for the field. Mr. Barnes explained certain remaining aspects of the project and indicated that the rest of the project is on schedule for completion. Councilman Drahos commented regarding Winding Trails and asked when this project will be scheduled for second reading. Mr. Schofield stated the item will not be brought back to Council for second reading until staff receives the renderings for the project and provided a brief update regarding the project. Councilman Drahos asked that Council and residents be kept informed regarding this item. Mayor Gerwig asked if Councilman Drahos was referring to the project in general or the addition of covered arenas. Councilman Drahos responded that he is referring to the covered arenas part of the project. COUNCILMAN NAPOLEONE: Councilman Napoleone presented the following report: Village of Wellington Page 6 Village Council Action Summary - Final September 8, 2020 Councilman Napoleone thanked Councilman Drahos for asking about the sports complex. Councilman Napoleone reminded everyone that although the playgrounds are open and the water slide is open, there are more activities to do as everyone enters into Phase 2. He stated the County is still in Phase 2 because a there is still a pandemic. Councilman Napoleone encouraged everyone to remain vigilant, social distance, wear masks where appropriate and do the smart things that need to be done to keep the positivity rate numbers down. Councilman Napoleone wished good luck to all of those involved with the school system (teachers, administrators, School Board, parents and students) in dealing with the reality of a hybrid of distance learning or in-person learning for the students. He stated everyone has to make the choice that is best for them and hopefully the School Board can deliver on robust teaching options to keep everyone moving forward. Councilman Napoleone stated Friday is 9/11 and the Village is doing a virtual memorial ceremony. He asked if there is information on how people can access the ceremony. Mr. Schofield stated he will provide the full details to Council tomorrow. Mr. Barnes stated it will be similar to what was done for Memorial Day. He stated staff’s recommendation is for it to be virtual given that it will be difficult to restrict access for an in-person event. He stated staff is trying to finalize a speaker for the ceremony and for each Councilmember to speak for the commemorative aspects of the event. Mayor Gerwig asked if there could be a waterproof speaker to play the audio of the virtual event. Mr. Barnes stated an employee would have to be placed at the site to monitor the equipment. He stated it will also be available on social media and Channel 18. Mayor Gerwig inquired about the documentary that was put together that showed the pieces of steel bring brought to Wellington. MAYOR GERWIG: Mayor Gerwig presented the following report: Mayor Gerwig commented about the fireworks being a legislative priority . She asked for input from the rest of Council. She stated she called the Village of Wellington Page 7 Village Council Action Summary - Final September 8, 2020 Florida League of Cities (FLC) and the Village would have to draft a letter by tomorrow and send it to Casey Cook for the League’s consideration for this to be added as a legislative priority. Mr. Schofield stated staff will draft the letter and provide it to Casey Cook. Mayor Gerwig commented regarding the process for the FLC legislative priorities. There was Council consensus to submit the letter to the FLC. Mayor Gerwig stated the Governor has requested that the Village report any fines that have been levied or any individual mandates in enforcing orders. Councilman McGovern stated that the Village has to report on the Village’s emergency order and feels the Village’s inspection program should be included. Mr. Schofield stated he will report regarding the declaration of the emergency order, the initial business inspections where staff visited the businesses to review their compliance, and the program the Village is now in with the County. Mayor Gerwig asked if anyone has been fined by the Village. Mr. Schofield stated warnings have been issued but no fines levied. Any business that received warnings complied. Brief discussion continued regarding what has been done as a community. Mayor Gerwig commented about an email received about spectators at practices and games for youth sports. She asked if this was a county order that the Village is enforcing. Mr. Schofield stated the county order still provides for 50 people with social distancing. Mr. Schofield stated he will provide an answer to the email in the morning. Mayor Gerwig referenced the annual evaluation forms for the Village Manager and the Village Attorney. She stated the process requires that these are done on an annual basis. Mayor Gerwig commented about distance learning for both school and college students. 13.
