CALL TO ORDER Mayor Gerwig called the meeting to order at 4:00 p.m. Councilmembers present: Anne Gerwig, Mayor; John T. McGovern, Vice Mayor; Michael Drahos, Councilman; Michael Napoleone, Councilman; and Tanya Siskind, Councilwoman. Advisors to Council: Paul Schofield, Manager; Laurie Cohen, Esq., Attorney; Jim Barnes, Assistant Manager; Tanya Quickel, Director of Administrative and Financial Services; and Chevelle D. Nubin, Village Clerk. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. REVIEW OF COUNCIL AGENDA Mayor Gerwig said the Girl Scouts would be attending the meeting tomorrow night to provide the Pledge of Alliance. Mayor Gerwig asked to observe a moment of silence at the beginning of tomorrow night's meeting for the first anniversary of the Pulse Nightclub tragedy. Council agreed to have a moment of silence at the beginning of the meeting. A. 17-1258 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETING OF MAY 23, 2017 Mr. Schofield introduced this item. This item is for the Minutes of the Regular Wellington Council Meeting of May 23, 2017. There were no changes recommended. Village of Wellington Page 1 Village Council Workshop Action Summary - Final June 12, 2017 B. 17-0944 AUTHORIZATION TO AWARD MULTIPLE CONTRACTS FOR VEHICLE TOWING AND STORAGE SERVICES Mr. Schofield introduced this item. This item is for the authorization to award a primary contract to West Way Towing, Inc. and a secondary contract to Blake's Towing and Transport, Inc. to provide vehicle towing and storage services for the Village. Mr. Schofield said staff's recommendation is to award the service to West Way Towing. He explained the towing company will have to comply with an existing agreement with PBSO fixed tow rate of $173.50. He said the Village will obtain $67 in revenue for each tow, and the mileage rates for Wellington residents and guests will decrease since West Way Towing, Inc. recently established their primary place of business in Wellington. Mayor Gerwig said currently there is a rotation system in effect, a car can be towed to Boynton Beach or Riviera Beach. Mr. De La Vega said 23 miles will be the longest point of the tow. Mayor Gerwig said the agreement will save the residents money if they are towed and asked if the fee listed is a higher rate than the current fee. Mr. De La Vega stated the fees are fixed rates and are the same but the residents will not be charged the mileage fee since the location where the cars will be towed is located at the Industrial Park. Councilman Drahos asked if the Village received rebates in the past. Mr. Schofield explained receiving rebates is a new procedure for towing companies. He noted that Delray Beach uses the same towing company and they are satisfied with their services. Mr. Schofield said the Village expects revenues to increase by approximately $42,000 annually. Councilman Drahos asked how the revenue will be tracked and will a report be submitted to the Village for each tow. Mr. De La Vega explained a monthly report will be provided to staff which will include the number of tows and the monthly revenue based on $67 per tow. He explained, currently the towing companies keep the full amount of $167 for each of the tows. Councilman Drahos asked if West Way Towing, Inc. will indemnify the Village for any claims that arise from the towings regarding property damage. Mr. De La Vega replied affirmatively. Mr. De La Vega noted staff's recommendation is to award a primary and a secondary vendor; West Way Towing, Inc., located in the Industrial Park, two miles away from Village Hall, as the primary vendor. The secondary vendor would be Blake's Towing and Transport, Inc., which will provide a $69 rebate instead of the $67 rebate that West Way Towing will provide. There were no changes recommended. Village of Wellington Page 2 Village Council Workshop Action Summary - Final June 12, 2017 C. 17-1207 AUTHORIZATION TO AWARD A CONTRACT TO PROVIDE A HOUSING AND ECONOMIC IMPACT STUDY Mr. Schofield introduced this item. This item is for authorization to award a contract to Strategic Planning Group, Inc. to provide the Village with a housing and economic impact study, in the amount of $103,000. Vice Mayor McGovern joined the meeting at this point. Mr. Schofield said the study will provide information regarding short and long range housing projections and the economic impact of the equestrian industry within Wellington. He explained studies completed in the past were based on Palm Beach County and its entirety and were not specific to the Village. He said a strength and weakness opportunity analysis will be included along with economic developmental potential findings which will set performance measures. Mayor Gerwig asked if the consultants will be focusing on the health care industry. Mr. O'Dell said the health care industry will be part of the business section of the study. Councilman Drahos asked when will the consultant start and complete the study. Mr. O'Dell said if Council approves the agenda item tomorrow night, the consultant will start shortly thereafter and the completion date will be February 2018. Mr. Schofield noted as part of the study, the consultants will be interviewing each councilmember. There were no changes recommended. Village of Wellington Page 3 Village Council Workshop Action Summary - Final June 12, 2017 D. 17-1228 AUTHORIZATION TO UTILIZE A LAKE COUNTY SCHOOL BOARD CONTRACT, AS A BASIS FOR PRICING, FOR THE PURCHASE, DELIVERY, AND INSTALLATION OF A DIGITAL RADIO SYSTEM Mr. Schofield introduced this item. This item is for the authorization to utilize Lake County contract #3990DB, with Radio One, Inc., as a basis for pricing, for the purchase, delivery and installation of a Motorola digital radio system, at a cost of $261,926.21. Mr. Schofield said the existing system is approximately eleven years old and the manufacturer, Motorola, no longer supports the equipment. He explained staff is recommending the Motorola replacement in order to have the capability for the Village to patch into Palm Beach County's EOC and PBSO's radio systems especially during emergencies events. He noted the cost of $261,926.21 will include a trade-in credit of $45,500 for the Village's existing radios. Mayor Gerwig asked how important were radios if everyone carries cell phones. Mr. Wright said radios are very important especially during emergencies. Mr. Schofield noted most of the field staff do not carry cell phones and the majority of in-house communications are via radios. He stated the Village's past experience especially during storms when cell phones go down, is that the radio service works very well. He explained each radio has a GPS tracker, encrypted communication, private channel communications, background noise cancellation and other user safety features included. Councilman Drahos asked for the amount of radios being purchased. Mr. Wright said 275 radios will be purchased. Councilman Drahos asked for the shelf life of the radios. Mr. Wright said Motorola informed staff that the platform will not be changing for 10 years. Mr. De La Vega said each radio comes with a 3 year warranty. Vice Mayor McGovern asked if the shelf life on the noted model is at least ten years. Mr. Wright replied affirmatively and explained the digital radios are software driven and as new updates are released, changes can be made to the radios due to the versatility of the equipment. Mayor Gerwig said when necessary, the Village will be able to tap into Palm Beach County's system. Mr. Schofield said the radios will work with 900 MHZ and will need to be programmed to patch into the correct channel which is software driven. Vice Mayor McGovern said Mr. Wright stated there is a possibility to patch into Palm Beach County's system and Mr. Schofield stated in order to patch in to their system, the radios only needed to be programmed. He said he wanted to know who was correct. Mr. Wright said Motorola advised him that the Village will be able to patch into Palm Beach County's system. Mayor Gerwig said the radios will definitely operate among all the Village staff users. Mr. Wright replied affirmatively. Councilman Napoleone asked staff to confirm the interaction of the radio service with Palm Beach County. Mr. Wright said he would contact Palm Beach County and report back to council. Village of Wellington Page 4 Village Council Workshop Action Summary - Final June 12, 2017 Mr. Wright explained currently Village staff communicates with Palm Beach County by using 800 MHZ radios that also need replacement because the county is moving to a different radio system. He said by purchasing the Motorola radios, the Village will be able to patch into their system and staff will not have to replace the current radios and save money. Vice Mayor McGovern asked when is the county going to the new system. Mr. Wright said the new system was B25 but he was not sure when they would be changing but he was advised that the new Motorola radios will be able to patch into their system. Mr. Schofield said after doing extensive research regarding the recommended radio system, he explained once the county changes their radio frequency, the Village's radios frequency can be electronically reprogrammed by using a computer which is a very simple task. Vice Mayor McGovern asked if the reprogramming process will be done before a storm in case the Village loses power. Mr. Schofield replied affirmatively and noted several of the radios will always be pre-programmed to the county's frequency. Councilman Drahos asked if the Motorola representative confirmed the Village will be able to connect with the county's system. Mr. Schofield replied affirmatively. Councilman Drahos asked staff to obtain the confirmation in writing. Mr. Wright said he would obtain the information and report back to council. There were no changes recommended. E. 17-1229 RATIFICATION OF EXPENDITURES FOR PUMP REPAIRS AND RECONDITIONING Mr. Schofield introduced this item. This item is for the ratification of expenditures for pump repairs and reconditioning, with FPI Pumps, Inc., in the amount of $28,838. Mr. Schofield said Pump Station 2 was the oldest pump station in the Village. There were no changes recommended. Village of Wellington Page 5 Village Council Workshop Action Summary - Final June 12, 2017 F. 17-1260 AUTHORIZATION TO NEGOTIATE ANNUAL CONTRACTS FOR: 1) CIVIL ENGINEERING; 2) TRAFFIC ENGINEERING; 3) WASTEWATER PROCESS AND RECLAIMED WATER ENGINEERING; 4) ELECTRICAL, INSTRUMENTAL, AND CONTROL ENGINEERING; AND 5) HYDROGEOLOGICAL ENGINEERING, AND RELATED CONSULTING SERVICES Mr. Schofield introduced this item. This item is for the authorization to negotiate contracts with multiple firms for: 1) Civil Engineering; 2) Traffic Engineering; 3) Wastewater Process and Reclaimed Water Engineering; 4) Electrical, Instrumental, and Control Engineering; and 5) Hydrogeological Engineering, and related consulting services. Mr. Schofield explained the selection committee evaluated, scored and ranked proposals from ten civil engineering firms, four traffic engineering firms, four wastewater process and reclaimed water engineering firms, three electrical engineering firms, and one hydrogeological engineering firm. Mayor Gerwig said she may need to recuse herself due to having a conflict with one of the firms, Engenuity Group, Inc. She explained the firm that she works with may have worked with them within the past 24 months. She said she would check further. Mr. Schofield said if Mayor Gerwig needed to recuse herself, the item would be removed from Consent Agenda and be placed under Regular Agenda as 8B. She said the firm she works with may have done work with Pinder Troutman Consulting, Inc. but she would contact Mr. Schofield with her findings. Mr. Schofield explained staff recommendations are to award: 1) Traffic Engineering to Pinder Troutman Consulting, Inc. and Simmons and White, Inc.; 2) Wastewater Process and Reclaimed Water Engineering to Hazen & Sawyer, P.C.; and 3) Electrical, Instrumental, and Control Engineering to Hillers Electrical Engineering, Inc. Vice Mayor McGovern asked how many of the listed firms have worked with the Village. Mr. Schofield said the Village has used Engenuity Group, Inc. and Pinder Troutman Consulting, Inc. Mr. Barnes said the Village has a pending contract with Pinder Troutman Consulting, Inc. and a previous contract with Engenuity Group, Inc. Vice Mayor McGovern asked which firm has the current contract for civil engineering work. Mr. Lundeen said currently the work is being done by Mock Roos & Associates, Inc., Kimley Horn and Associates, Inc., Keshavarz & Associates and the Wantman Group. Mr. Barnes said their contracts are ongoing and valid but two of them submitted their bids and afterwards withdrew the bids for the project in order to maintain their existing contracts. Vice Mayor McGovern asked why there are there two contracts for the same work. Mr. Barnes explained there are two contracts due to a large load of work needed and to provide staff with the availability to have a wide scope of consultants available. Mr. De La Vega said the only firm that has an annual contract is for the Civil Engineering services. Village of Wellington Page 6 Village Council Workshop Action Summary - Final June 12, 2017 G. 17-1166 ORDINANCE NO. 2017-07 (CONGREGATE LIVING FACILITY TYPE 2B ZONING TEXT AMENDMENT) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL; APPROVING A ZONING TEXT AMENDMENT [PETITION NUMBER 17-37 (2017-25 ZTA)] TO AMEND THE VILLAGE OF WELLINGTON LAND DEVELOPMENT REGULATIONS ARTICLE 6, CHAPTER 4, SECTION 6.4.4.30 CONGREGATE LIVING FACILITY (CLF) RELATED TO THE SEPARATION REQUIREMENT FOR TYPE 2(B) CLF TO ALLOW A MAXIMUM OF FOUR (4) TYPE 2(B) CLF WITHIN A HALF (1/2) MILE RADIUS; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced this item. This item is for the approval of Ordinance No. 2017-07, a Zoning Text Amendment. Mr. Schofield said this was the second and final reading for the ordinance. At this point, Councilman Drahos explained he needed to leave because he had a 4:30 P.M. telephone appointment. He said as soon as he completed the call he would re-join the meeting. Mr. Schofield asked Mr. Basehart if there were any changes from the last hearing. Mr. Basehart said there were no changes. Councilman Napoleone asked if there were any comments from the public regarding the ordinance. Mr. Basehart said there were no public comments since the first reading of the ordinance. Mayor Gerwig said Council in general has received many positive emails regarding the ordinance. There were no changes recommended. Village of Wellington Page 7 Village Council Workshop Action Summary - Final June 12, 2017 H. 17-1257 ORDINANCE NO. 2017-10 (PROHIBITING CONVERSION THERAPY ON MINORS) AN ORDINANCE OF THE VILLAGE OF WELLINGTON, FLORIDA, AMENDING CHAPTER 36; ADDING ARTICLE V (PROHIBITION OF CONVERSION THERAPY ON MINORS); ADDING SECTIONS 36-45, 36-46, 36-47, AND 36-48; TO PROHIBIT THE PRACTICE OF CONVERSION THERAPY ON PATIENTS WHO ARE MINORS; PROVIDING FOR CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced this item. This item is for the consideration of Ordinance No. 2017-10 adding Article V (Prohibition of Conversion Therapy on Minors) adding Section 36-45, 36-46, 36-47 and 36-48. Councilman Napoleone asked who the speakers were. Ms. Cohen said she believed that both Judge Rand Hoch and Dr. Hamilton will be presenting. Councilman Napoleone said both Mr. Hoch and Dr. Hamilton will be speaking in favor of the ordinance and asked if anyone on the opposing side will be speaking. Ms. Cohen said Dr. Hamilton is opposed to the ordinance and Judge Hoch is in favor of the ordinance. Mayor Gerwig asked for the allotted time for their presentation. Ms. Cohen said usually a presenter is provided with 15 minutes to speak. Council agreed to allotting 15 minutes to each side, plus time for any public comments. Mayor Gerwig asked for the selection method for the first speaker. Ms. Cohen said Council would have to decide. Councilman Napoleone said he felt the presenter suggesting the ordinance should go first. Mr. Schofield said that will be Judge Hoch. He noted there will be 3 minutes for public comments per person after their presentations. There were no changes recommended. Village of Wellington Page 8 Village Council Workshop Action Summary - Final June 12, 2017 I. 17-0708 AUTHORIZATION TO AWARD A TASK ORDER TO PROVIDE ENGINEERING CONSULTING SERVICES FOR A WASTEWATER LIFT STATION CONDITION ASSESSMENT Mr. Schofield introduced this item. This item is for the authorization to approve a task order to Mock, Roos and Associates, Inc. to provide engineering consulting services, for a Wastewater Lift Station Condition Assessment, at a cost of $189,066.00. At this point, Mayor Gerwig recused herself since the firm she works with works with Mock, Roos and Associates, Inc. Mr. Schofield said the service is to evaluate the condition of 106 lift stations valued at $21,000,000, which is part of the rate study to ensure compliance with current regulatory standards, evaluate the condition of existing mechanical, electrical and control equipment, review security, emergency power and access provisions. He explained the procedure is done every five years and the last time was in 2008. Ms. LaRocque said with proper maintenance lift stations could last up to twenty years. Vice Mayor McGovern said all of the lift stations will be assessed which will lead up to the rate study. Mr. Schofield said the process is part of the rate study and the capital plan. Ms. LaRocque explained every lift station will be visited and checked for regulatory requirements, mechanical components, structural components, hydraulic components and the prioritized list will be based on the needs of each lift station. She indicated that a detailed itemized list will be provided with the improvements needed and the list will be used to feed the capital plan for the next ten years. Mr. Schofield said a budget transfer is not needed because the funding for the work is available. Councilwoman Siskind questioned the amount of time to complete the task order. Ms. LaRocque said it will take four months to complete the task. Councilwoman Siskind asked for the average age of the Village's lift stations. Ms. LaRocque said the ages of the lift stations vary; from 6 months to 40 years old. Mr. Schofield said the average age of the lift stations is 25 years. There were no changes recommended. ATTORNEY'S COMMENTS Ms. Cohen explained the enforcement case was moved to the July 2017 docket with competing motions for summary judgement scheduled for August 2017. She said currently she is unaware of the scheduled date for the trial but if the trial is scheduled before the August hearing date for the summary judgment motion, she expects the court will hear the summary judgment motions prior to the trial. Ms. Cohen noted she filed a motion for contempt because the soccer games have continued in spite of the injunction that was entered prohibiting the games. She explained the applicant submitted some documentation towards obtaining a SUP but to her knowledge, they have not submitted the last required piece. Mayor Gerwig asked if the applicant has been notified of the required piece that was needed. Ms. Cohen said the applicant is very much aware of the needed requirement. She explained after filing the motion she had to move for a lengthy hearing and file a motion to obtain an order for the hearing which has been scheduled for June 30, 2017. Vice Mayor McGovern asked if the hearing was a special settlement or a calendar call for a docket. Ms. Cohen said the hearing was for a calendar call for a docket with a one hour hearing in front of Judge Barkdull. She said she felt the hearing would be placed towards the front of the docket. Village of Wellington Page 10 Village Council Workshop Action Summary - Final June 12, 2017 6. MANAGER COMMENTS Mr. Schofield explained the water levels in the Village are close to normal: 1) 13 for Basin A; and 2) 13 1/2 for Basin B. He noted most of the ground flooding is gone and the water levels are lowering in Section 24. He explained that as long as the Village receives a normal amount rainfall, by the end of the current week the water levels should reach normal rates and a full recovery will be obtained. He noted the only street that flooded is in Councilman Napoleone's neighborhood which is due to an obstruction in the line, possibly due to debris in the line. Mr. Schofield said mosquito spraying resumed last Thursday and staff was out double spraying and adding larvicide everywhere. Mayor Gerwig said fogging depends on the weather. Mr. Barnes explained staff can only fog when it is not raining. Mayor Gerwig said a brown bat died on her property. Mr. Barnes said bats eat the mosquitoes. Mayor Gerwig asked if the bat died because of the mosquito fogging. Mr. Barnes explained the fogging would not have killed the bat and it may have died due to natural causes. Mayor Gerwig said she has a bat house but has not installed it yet. Mr. Barnes said there were several bat houses in the preserve in the Emerald Forest area. Mr. Schofield said the county is resuming their aerial mosquito spraying in the western communities because the area has the worst mosquito problem. Mayor Gerwig said the county's aerial spraying will depend on the weather conditions. Mr. Barnes agreed with with Mayor Gerwig and said spraying will cease if it is raining. Vice Mayor McGovern asked if the county will be resuming their spaying the following night. Mr. Barnes replied affirmatively and said weather permitting. Mayor Gerwig said many residents have been sharing with her the different things that could be used to avoid being bitten. She stated the information was very important for human beings and pets because the mosquitoes carry many diseases. Village of Wellington Page 11 Village Council Workshop Action Summary - Final June 12, 2017 7. COUNCIL COMMENTS Vice Mayor McGovern said there is discussion that Council needs to have tomorrow night as a result of the last Western Communities Council (WCC) meeting. An updated report was provided relative to the SR 7 extension in which the administrative law judge denied all of West Palm Beach's protests and currently WCC was filing an appeal. He explained they could chose between the First DCA in Tallahassee or the Fourth DCA in West Palm Beach and chose to file locally in West Palm Beach. He stated after collective discussions at the meeting, the decision was to file a Friend of the Court brief with the Fourth District Court of Appeal. Ms. Cohen said she was aware of the available funding and WCC will have sufficient funding available for the brief if everyone joins together. She noted she should be receiving a flat fee quote shortly for the cost of the brief. Councilman Napoleone asked who would be filing the brief. Ms. Cohen said she contacted Bob Diffenderfer to handle the brief. Mayor Gerwig asked who was the prior attorney that was contacted. Mr. Schofield said they contacted John Furmero but he was not able to file the brief. Vice Mayor McGovern explained Mr. Furmero is representing DOT but is maintaining everyone up to date regarding the WCC issue. He explained the feeling and discussions held was pertaining to the selection of the brief being sent to Palm Beach County instead of Tallahassee because there could be an opportunity to potentially influence local judges that serve on the panel. Mayor Gerwig asked if that is an ethical process. Vice Mayor McGovern said if there are any ethical conflicts the judges will recuse themselves and explained the group felt it would be beneficial for our area of the county to weigh in on behalf of all the western municipalities and communicate that we all have a stake in the project and want to move forward. Mayor Gerwig asked if the county and the state are on the same side. Vice Mayor McGovern replied affirmatively and said the city is currently alone but that stance will potentially depend on the Ibis HOA and homeowners and how they move forward with MBS. Ms. Cohen said the Village is supporting the extension. Vice Mayor McGovern said the Village is supporting the extension and the ruling that was already issued by the administrative law judge which was the right decision. Vice Mayor McGovern explained if there is not enough funding, the cities might have to contribute. Mr. Schofield said that will be based on the legal filing and additional monies will need to be appropriated because not all of the areas of government have been responsive. The WCC's funds are coming primarily from Indian Trail and Wellington, and noted that many of the communities have limits on the funding amounts that they will be provide. Mayor Gerwig asked if Loxahatchee and Royal Palm Beach contributed funds. Mr. Schofield replied affirmatively. Village of Wellington Page 12 Village Council Workshop Action Summary - Final June 12, 2017 Ms. Cohen said Mr. Diffenderfer will be providing a flat fee quote in order for everyone to plan ahead. She explained the brief is not just a letter but a record that must be reviewed and is considered an appellate brief filing in support of one of the parties. Councilman Napoleone said writing a brief is a substantial undertaking. Mayor Gerwig asked for the amount of funding left. Ms. Cohen said she did not attend the meeting and currently is not aware of the amount of funding left. Vice Mayor McGovern said the meeting attendees did not go into that level of detail at the meeting. Ms. Cohen said Mr. Diffenderfer will provide them with an estimate. Vice Mayor McGovern asked Ms. Cohen to have all the specifics by tomorrow night because the appeal process is moving forward rapidly and the process has currently started. Mayor Gerwig asked for the amount the Village contributed. Mr. Schofield said the Village contributed $20,000 during the past couple of years. Mayor Gerwig agreed in obtaining the estimated cost of the briefing as soon as possible. Mr. Schofield explained WCC has funds in their litigation fund but no funding in the SR 7 Extension fund. Mayor Gerwig asked staff to research the funding amounts based on the number of residents. Vice Mayor McGovern said there was less of an impact for Wellington than the other communities. Mayor Gerwig said the extension is a major impact for all of the western communities and wanted the figures to be pro-rated based on the number of residents in the Village. Mr. Schofield said staff will provide the breakdown to Council. He said his recommendation is to add a portion of the Westlake Community build out amount because they stand to benefit more than the Village. Mr. Schofield announced that Vice Mayor McGovern was elected Chairman of the Western Communities Council last night. All present congratulated Vice Mayor McGovern on being elected Chairman of the Western Communities Council. Vice Mayor McGovern stated Council may need to make a decision to authorize Ms. Cohen to move forward. Ms. Cohen said obtaining the funding for services for Lewis, Longman and Walker will be decided by the WCC. Vice Mayor McGovern said Council will have to communicate the willingness to pay for the briefing. Mayor Gerwig said in the interim, the Village is standing together with DOT, Palm Beach County and the Army Corp of Engineers. Village of Wellington Page 13 Village Council Workshop Action Summary - Final June 12, 2017 Ms. Cohen said through the years she has written many briefs, the time spent is about one hour for each page. If the brief is forty pages long, approximately 40 to 50 hours is spent which is the general rule. She said the firm should find it fairly easy to provide a flat fee amount based on the type of the case and the fifty page limitation for the length of the brief. Mr. Schofield said he is expecting the cost to be $10,000 for all of the parties. Ms. Cohen agreed with the amount Mr. Schofield mentioned. Mayor Gerwig said the amount will be divided by all of the parties involved which could be $7,000. Councilman Napoleone said the amount of $10,000 is on the lower end for a brief. Mr. Schofield said the WCC has a limit on the amount to be paid and the attorneys have committed to maintaining the cost with the $200 an hour range. Ms. Cohen said the firm handling the brief is familiar with the issue involved. Vice Mayor McGovern said he mentioned the issue because he wanted Council to be aware of what is currently happening and said he will mention the issue once again at the end of tomorrow night's council meeting. 8.
