CALL TO ORDER Mayor Gerwig called the meeting to order at 4:00 p.m. Council Members Present: Anne Gerwig, Mayor; Michael Napoleone, Councilman; and Tanya Siskind, Councilwoman. Counilman McGovern arrived at the meeting during the discussion of Agenda Item E: Authorization to Award a Contract for New Nanofiltration Membranes for Reverse Osmosis Plants 1 and 2. Council Members Not in Attendance: Michael Drahos, Vice Mayor. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. REVIEW OF COUNCIL AGENDA Mr. Schofield presented the agenda for the April 9, 2019 Regular Wellington Council Meeting for review. A. 19-2781 APPOINTMENT OF VICE MAYOR Mr. Schofield introduced the agenda item. He explained that this was the appointment of Vice Mayor of the Village of Wellington. B. 19-2672 PRESENTATION OF THE AMERICAN PUBLIC WORKS ASSOCIATION (APWA) RE-ACCREDITATION AWARD TO THE VILLAGE OF WELLINGTON PUBLIC WORKS DEPARTMENT Mr. Schofield introduced the agenda item. He explained that this was the presentation of the American Public Works Association (APWA) Re-accreditation Award to the Village of Wellington Public Works Department. C. 19-2818 NATIONAL DONATE LIFE MONTH PROCLAMATION Mr. Schofield introduced the agenda item. He explained that this was a Proclamation declaring April as National Donate Life Month in Wellington. Ms. Maureen Budjinski, Life Alliance UM Ambassador for Donate Life will be in attendance to accept the proclamation. D. 18-2320 AUTHORIZATION TO CONTINUE UTILIZING A SOUTHEAST FLORIDA COOPERATIVE CONTRACT FOR THE PURCHASE AND DELIVERY OF SWIMMING POOL CHEMICALS Mr. Schofield introduced the agenda item. He explained that this was authorization to continue utilizing a Southeast Florida Cooperative Village of Wellington Page 1 Village Council Workshop Action Summary - Final April 8, 2019 contract with Commercial Energy Specialists (CES), for the purchase and delivery of swimming pool chemicals, in the amount of approximately $37,000 annually. Mr. De La Vega addressed Council questions. E. 18-2356 AUTHORIZATION TO AWARD A CONTRACT FOR NEW NANOFILTRATION MEMBRANES FOR REVERSE OSMOSIS PLANTS 1 AND 2 Mr. Schofield introduced the agenda item. He explained that this was authorization to award a contract to Aerex Industries, Inc. to furnish and install new nanofiltration membranes for reverse osmosis plants 1 and 2, in the amount of $629,410.00. Councilman McGovern arrived at the meeting at this time. Ms. LaRocque explained the details of the agenda item, and responded to Council questions. F. 19-2641 AUTHORIZATION TO RENEW EXISTING CONTRACTS FOR THE PURCHASE OF SOD Mr. Schofield introduced the agenda item. He explained that this was authorization to renew existing contracts for the purchase of sod in the amount of approximately $220,000.00 annually. Mr. Barnes addressed Council questions. G. 19-2642 AUTHORIZATION TO RENEW EXISTING CONTRACTS FOR DISASTER DEBRIS RECOVERY SERVICES Mr. Schofield introduced the agenda item. He explained that this was authorization to renew existing contracts with a primary (TAG Grinding Services) and secondary (DRC Emergency Services) vendor for disaster debris recovery services. Mr. Schofield addressed Council questions. H. 19-2753 AUTHORIZATION TO AWARD TASK ORDERS FOR THE WATER TREATMENT PLANT RENEWAL AND REPLACEMENT PROJECT Mr. Schofield introduced the agenda item. He explained that this was authorization to award task orders to Kimley Horn and Associates, Inc. in the amount of $68,520 for the Water Treatment Plant Renewal and Replacement Project. Ms. LaRocque explained the details of the agenda item, and responded to Council questions. Village of Wellington Page 2 Village Council Workshop Action Summary - Final April 8, 2019 I. 19-2764 AUTHORIZATION TO AWARD A CONTRACT FOR THE VILLAGE PARK BASEBALL AND SOFTBALL FIELD DUGOUT REPLACEMENT PROJECT Mr. Schofield introduced the agenda item. He explained that this was authorization to award a contract to E & F Florida Enterprises, Inc. D/B/A Creative Contracting Group for the Village Park baseball and softball field dugout replacement project, in the amount of $187,000.70. Mr. Barnes explained the details of the item. Mr. Lundeen and Mr. Barnes addressed Council questions. J. 19-2749 RESOLUTION NO. R2019-14 (INTERLOCAL AGREEMENT WITH PALM BEACH COUNTY TO LEASE FUEL DISPENSING EQUIPMENT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE A FUEL CONTROL EQUIPMENT AGREEMENT WITH PALM BEACH COUNTY; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced the agenda item. He explained that this was the approval of Resolution No. R2019-14 authorizing the execution of the Second Amendment to the Interlocal Agreement between the Village of Wellington and Palm Beach County to lease a fuel dispensing system. Mr. Schofield and Mr. Barnes addressed Council questions. K. 19-2838 RESOLUTION NO. R2019-16 FOR THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION GRANT FUNDS AND RESOLUTION NO. R2019-17 FOR A BUDGET AMENDMENT TO ALLOCATE THE GRANT RESOLUTION NO. R2019-16: A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL TO ENTER INTO AN AGREEMENT WITH THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION FOR THE PURPOSE OF RECEIVING A GRANT UNDER PROVISIONS OF THE RECREATIONAL TRAILS PROGRAM FOR THE PEACEFUL WATERS PHASE II TRAIL IMPROVEMENT PROJECT NUMBER T1828; AND PROVIDING AN EFFECTIVE DATE. RESOLUTION NO. R2019-17: A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE FISCAL YEAR 2018-2019 CAPITAL FUND BUDGET FOR THE RECREATIONAL TRAILS PROGRAM FOR THE PEACEFUL WATERS PHASE II TRAIL IMPROVEMENT PROJECT NUMBER T1828; AND PROVIDING AN EFFECTIVE DATE. He explained that this was the approval of Resolution No. R2019-16 to enter into an agreement with the Florida Department of Environmental Protection for a $200,000 grant and Resolution No. R2019-17 to amend the budget for grant proceeds. Ms. Quickel and Ms. LaRocque addressed Council questions. L. 19-2846 RESOLUTION NO. R2019-18 (BUILDING DEPARTMENT BUDGET AMENDMENT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE BUILDING FUND BUDGET FOR FISCAL YEAR 2018-2019 BY ALLOCATING MONIES FROM BUILDING RESERVES TO THE OPERATING BUDGET FOR INSPECTION SERVICES AND ERP PROJECT SUPPORT THROUGH SEPTEMBER 30, 2019; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced the agenda item. He explained that this was Council approval of a contract increase for outside inspection services and associated budget amendment Resolution No. R2019-18 to assign $100,000 from Building Fund reserves to the Building department operating budget. Mr. Jacek Tomasik, Chief Building Official, addressed Council's questions. M. 19-2795 ORDINANCE NO. 2019-03 (NIGHTCLUB) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING ARTICLE 3 (DEFINITIONS); AMENDING ARTICLE 6, TABLE 6.4-1 (USE REGULATION SCHEDULE), TABLE 6.8-2 (PLANNED DEVELOPMENT DISTRICT USE REGULATION SCHEDULE), AND TABLE C (EOZD PERMITTED, CONDITIONAL AND PROHIBITED USES); AMENDING SECTION 6.4.4 (SUPPLEMENTARY USE STANDARDS) OF THE LAND DEVELOPMENT REGULATIONS OF THE VILLAGE OF WELLINGTON, FLORIDA, RELATING TO USES; TO REGULATE THE LOCATION OF NIGHTCLUB BUSINESSES AND CREATE OPERATION STANDARDS AND REQUIREMENTS; PROVIDING A CONFLICTS CLAUSE; PROVIDING FOR CODIFICATION; PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced the agenda item. He explained that this was the approval of proposed Ordinance No. 2019-03 Nightclub. Mr. Bob Basehart explained the agenda item, and addressed Council questions. Village of Wellington Page 4 Village Council Workshop Action Summary - Final April 8, 2019 N. 19-2839 ORDINANCE NO. 2018-10 (SMALL CELL WIRELESS ORDINANCE) AN ORDINANCE OF THE VILLAGE OF WELLINGTON AMENDING THE VILLAGE CODE BY REPEALING AND REPLACING CHAPTER 23, “COMMUNICATIONS FACILITIES RIGHTS-OF-WAY ORDINANCE”, TO PROVIDE FOR CERTAIN STANDARDS AND REGULATIONS RELATING TO THE LOCATION OF COMMUNICATION FACILITIES AND OTHER STRUCTURES WITHIN THE VILLAGE’S PUBLIC RIGHTS-OF-WAY, CONSISTENT WITH FEDERAL AND STATE LAW; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced the agenda item. The second reading of Ordinance No. 2018-10 was advertised in the Palm Beach Post for the April 9, 2019 Council Meeting. At this time, staff is requesting to postpone the item time certain to April 23, 2019 so that the community representative can be in attendance. Ms. Cohen explained the agenda item and addressed Council questions. 4. WORKSHOP There were no workshop items scheduled. 5. ATTORNEY'S COMMENTS Ms. Cohen said that Council had seen the complaint that was filed by Palm Beach Polo in Federal Court which was assigned to the insurance defense counsel. Ms. Cohen noted that she had sent a memo to Council in February regarding the Civil Rights Ordinance and would be meeting with Council individually. 6. MANAGER COMMENTS Mr. Schofield said that there were several things that he needed to talk to Council about, but he did not have sufficient information at this time. He would begin by meeting with Ms. Siskind the next day at 10:30 a.m. 7. COUNCIL COMMENTS Mayor Gerwig brought up the issue of the horse crossing and the flashing yellow lights at Pierson Road. She said that there was no indication that you have to stop when the lights are flashing, and asked if there was a good way to indicate that these are activated and you have to stop. Mr. Schofield said that they are looking at several things to help with that Village of Wellington Page 5 Village Council Workshop Action Summary - Final April 8, 2019 situation, i.e., change signage, striping on crosswalk, but he did not have enough information to speak to it at this time. Councilman Napoleone thought that there also needed to be education for the horse riders who are texting and not paying attention to the road because cars have the right-of-way when they are in the crosswalk. Councilwoman Siskind pointed out that since the accident the lights are flashing all of the time. 8.
