CALL TO ORDER Mayor Gerwig called the meeting to order at 4:00 p.m. Council Members in Attendance: Anne Gerwig, Mayor; John McGovern, Vice Mayor; Michael Napoleone, Councilman; Michael Drahos, Councilman and Tanya Siskind, Councilwoman. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. REVIEW OF COUNCIL AGENDA Mr. Barnes introduced the agenda for the September 28, 2021, Regular Council Meeting for review. A. 21-4646 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETINGS OF AUGUST 10, 2021 AND SEPTEMBER 13, 2021 Mr. Barnes introduced the item. He said that this is the Council Approval of the Minutes of the Regular Wellington Council Meetings of August 10, 2021 and September 13, 2021. He said that if they have any comments about the minutes, please get them to the Clerk's office. B. 21-4412 AUTHORIZATION TO AWARD A CONTRACT FOR THE PURCHASE AND DELIVERY OF SPORTS UNIFORMS Mr. Barnes introduced the item. He stated that this was the Authorization to Award a Contract to Scotty's Sport Shop, Inc. for the Purchase and Delivery of Sports Uniforms, in the amount of approximately $69,217.00 Annually. Mr. Barnes explained the item. C. 21-4595 AUTHORIZATION TO UTILIZE MULTIPLE CONTRACTS FOR THE PURCHASE AND DELIVERY OF A VEHICLE AND EQUIPMENT; AND AUTHORIZATION TO DISPOSE OF EXISTING SURPLUS EQUIPMENT Mr. Barnes introduced the item. He said that this is the Authorization to Utilize Florida Sheriff's Association (FSA) Contract FSA20-VEL28.0 and Florida Sheriff's Association (FSA) Contract FSA20-EQU18.0, as Basis for Pricing, for the Purchase and Delivery of a Vehicle and Equipment in the amount of $192,371.00; and Authorization to Dispose of Existing Surplus Equipment pursuant to Village Disposition Policies. D. 21-4599 RESOLUTION NO. R2021-47 (WELLINGTON HISTORICAL SOCIETY AGREEMENT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AN AGREEMENT FOR HISTORICAL SERVICES BETWEEN THE VILLAGE OF WELLINGTON AND THE WELLINGTON HISTORICAL SOCIETY, INC.; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He said that this is the Approval of the Agreement for Historical Services between Wellington and the Wellington Historical Society, Inc. Ms. Cohen explained the item. Mayor Gerwig asked if this was similar to what we do with the American Legion. Mr. Barnes explained that this is what we would like to do with all of our community partners and there is no money involved. Mr. Barnes and Ms. Cohen answered the questions that Council had regarding the property, the process, the Library and other items. E. 21-4635 AUTHORIZATION TO AWARD CONTRACTS WITH MULTIPLE FIRMS FOR: 1) WATER AND WASTEWATER TREATMENT ENGINEERING; 2) UTILITY GENERAL CIVIL, WATER DISTRIBUTION AND STORAGE, AND WASTEWATER COLLECTION ENGINEERING; 3) CIVIL ENGINEERING; 4) TRAFFIC ENGINEERING; AND RELATED CONSULTING SERVICES Mr. Barnes introduced the item. He said that this is the Authorization to Award Contracts to Multiple Firms for: 1) Water and Wastewater Treatment Engineering; 2) Utility General Civil, Water Distribution and Storage, and Wastewater Collection Engineering; 3) Civil Engineering; 4) Traffic Engineering; and Related Consulting Services. Mayor Gerwig recused herself from the item as her firm does work with Engenuity Group. Mr. Barnes explained the item. The Mayor was called back in and Ms. Cohen explained the reasoning for the Mayor leaving the room completely. Village of Wellington Page 2 Village Council Workshop Action Summary - Final September 27, 2021 F. 21-4636 AUTHORIZATION TO EXECUTE A GUARANTEED MAXIMUM PRICE (GMP) AMENDMENT FOR THE WATER TREATMENT PLANT (WTP) STORAGE TANK CLEANING AND INSPECTION SERVICES PROJECT Mr. Barnes introduced the item. He stated that this is the Authorization to Execute a Guaranteed Maximum Price (GMP) Amendment to Wharton-Smith, Inc. for the Water Treatment Plant (WTP) Storage Tank Cleaning and Inspection Services Project at a cost of $250,000.00. Ms. LaRocque explained the item. She answered questions from Council regarding terms, location of the tanks and a few other items. Mr. Barnes asked Ms. LaRocque to give an update on the emergency Sanitary Sewer Line situation. Ms. LaRocque explained what happened, where it happened, how it was corrected and the pro-active movements that need to be done. Vice Mayor McGovern asked if there will be a phase three. Ms. LaRocque stated that there would be and it is already in the budget. G. 21-4650 RESOLUTION NO. R2021-51 (EMPLOYEE HEALTH INSURANCE) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL AUTHORIZING THE MANAGER TO (1) AWARD A CONSUMER DRIVEN HEALTH PLAN (CDHP) AGREEMENT WITH CIGNA HEALTHCARE TO PROVIDE HEALTH INSURANCE TO ELIGIBLE EMPLOYEES, DEPENDENTS, AND RETIREES, AND APPROVE HRA FUNDING FOR EACH ELIGIBLE EMPLOYEE TO COVER ALL COSTS ASSOCIATED WITH ANNUAL DEDUCTIBLES; (2) RENEW A CONTRACT WITH CIGNA TO PROVIDE DENTAL INSURANCE TO ELIGIBLE EMPLOYEES, DEPENDENTS, AND RETIREES; (3) RENEW A CONTRACT WITH HUMANA TO PROVIDE VISION INSURANCE TO ELIGIBLE EMPLOYEES, DEPENDENTS AND RETIREES; (4) RENEW A CONTRACT WITH CIGNA GROUP BENEFITS TO PROVIDE LIFE/AD&D AND DISABILITY INSURANCE; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He said that this is the Authorization to Approve Resolution No. R2021-51 to (1) Award a Consumer Driven Health Plan (CDHP) Agreement with CIGNA Healthcare to Provide Health Insurance to Eligible Employees, Dependents, and Retirees, at a cost of approximately $6,104,315.76 Annually, and Approve HRA funding for each eligible employee at a cost of approximately $691,500, to cover Village of Wellington Page 3 Village Council Workshop Action Summary - Final September 27, 2021 all associated Annual Deductibles; (2) Renew a Contract with CIGNA to Provide Dental Insurance to Eligible Employees, Dependents and Retirees at an Annual cost of approximately $354,792.00; (3) Renew a Contract with Humana to Provide Vision Insurance to Eligible Employees, Dependents and Retirees at an Annual cost of approximately $34,937.28; (4) Renew a Contract with CIGNA Group Benefits to Provide Life/AD&D and Disability Insurance, to Eligible Employees, at a Cost of approximately $244,280.27. Ms. Quickel explained the item. Mr. Barnes and Ms. Quickel answered questions from Council regarding deductibles, rate increase, the plans and a few other questions. H. 21-4433 SECOND PUBLIC HEARING TO ADOPT THE FY 2021/2022 MILLAGE RATE AND ANNUAL BUDGET FOR WELLINGTON I. RESOLUTION NO. R2021-58 (MILLAGE RATE) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL ADOPTING THE TAX LEVY AND MILLAGE RATE FOR WELLINGTON FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2021 AND ENDING SEPTEMBER 30, 2022; AND PROVIDING AN EFFECTIVE DATE. II. RESOLUTION NO. R2021-59 (WELLINGTON BUDGET) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL ADOPTING A BUDGET FOR THE VILLAGE OF WELLINGTON FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2021 AND ENDING SEPTEMBER 30, 2022; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He said that this is the Approval of the Proposed Fiscal Year 2021/2022 Millage Rate, Operating and Capital Budget Including Balances Brought Forward. This is the Second Public Hearing on the Proposed Budget and the Corresponding Ad Valorem Millage Rate in Accordance with the Wellington Charter and F.S. Chapter 200.065. Ms. Quickel explained that she will be doing a presentation at the next meeting and said that there were no changes from the previous meeting. I. 21-4586 ORDINANCE NO. 2021-10 (GOLF CARTS) AN ORDINANCE OF THE VILLAGE OF WELLINGTON, FLORIDA, AMENDING CHAPTER 62 OF THE CODE OF ORDINANCES BY CREATING NEW ARTICLE V, SECTIONS 62-41 THROUGH 62-47, AUTHORIZING THE OPERATION OF GOLF CARTS ON DESIGNATED Village of Wellington Page 4 Village Council Workshop Action Summary - Final September 27, 2021 VILLAGE ROADS AND DESIGNATED MULTI MODAL PATHWAYS SUBJECT TO SPECIFIC RESTRICTIONS AND CONSISTENT WITH FEDERAL AND STATE LAW; PROVIDING FOR CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He said that this is the Approval of Ordinance No. 2021-10, a Code of Ordinances Amendment to Authorize the Operation of Golf Carts on Designated Wellington Roads and Designated Multi Modal Pathways Subject to Specific Restrictions and Consistent with Federal and State Law. Mr. O'Dell mentioned that he provided the red-lined changes to Council and the presentation available for the next meeting. The Council had a discussion on how important it was to discuss this and pushing this item as the residents want another transportation alternative with safety. This will require working with all schools, PBSO and all residents/businesses. It will be a learning process. .J. 21-4641 ORDINANCE NO. 2021-20 (SUBAREA F MAXIMUM STALL ALLOWED FOR UNIFIED LOTS) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE WELLINGTON LAND DEVELOPMENT REGULATIONS, MORE SPECIFICALLY, A ZONING TEXT AMENDMENT TO MODIFY SECTION 6.8.9.C, BARNS AND STABLES, TO MODIFY THE MAXIMUM STALLS ALLOWED FOR UNIFIED LOTS WITHIN SUBAREA F, AS CONTAINED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He said that this is the Approval of Ordinance No. 2021-20 to Modify Section 6.8.9.C - Barns and Stables, of Wellington's LDR to Maintain the Four (4) Stalls Per Acre and Allow a Maximum of 20 Stalls on Lots that are Unified and with Common Ownership within Subarea F of the Equestrian Overlay Zoning District (EOZD). Mr. Stillings mentioned that he had a full presentation for the next meeting and nothing has changed since last reading. Councilman Drahos mentioned that it says a 5-0 vote, but it was actually a 4-1 vote. Mr. Stillings stated he would correct that. Mr. Barnes introduced the item. He said that this is the Approval of Ordinance No. 2021-13 to Amend the Official Zoning Map for Wellington Updating its Presentation. Mr. Stillings explained the item. He said that he would have a full presentation at the next meeting. L. 21-4630 RESOLUTION NO R2021-48 VALERIE’S PLACE TYPE 2A CLF A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL, APPROVING A CONDITIONAL USE [PETITION NUMBER 2020-0001-CU] TO ALLOW A TYPE 2A CONGREGATE LIVING FACILITY FOR CERTAIN PROPERTY KNOWN AS VALERIE’S PLACE, CONSISTING OF 0.23 ACRE, MORE OR LESS, LOCATED AT 12450 GUILFORD WAY; IN A PLANNED UNIT DEVELOPMENT ZONING DISTRICT AND SUBJECT TO CONDITIONS OF APPROVAL; AS MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. M. 21-4700 AUTHORIZATION TO EXECUTE A LEASE AGREEMENT BETWEEN ACME IMPROVEMENT DISTRICT AND J. ALDERMAN FARMS, INC. FOR THE K-PARK SITE Mr. Barnes introduced the item. He said that this is the Authorization to Execute a Lease Agreement between ACME Improvement District and J. Alderman Farms, Inc., for the K-Park site, in the amount of $30,000 Annually. R2021-60 (ZONING IN PROGRESS FOR INSTALLATION OF ARTIFICIAL TURF FOR NON-GOVERNMENTAL USES) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL, IN ACCORDANCE WITH SECTION 1.8.1 OF WELLINGTON’S LAND DEVELOPMENT REGULATIONS, DECLARING A ZONING IN PROGRESS AND IMPOSING A MORATORIUM ON THE ACCEPTANCE AND PROCESSING OF NEW APPLICATIONS FOR THE INSTALLATION OF ARTIFICIAL TURF FOR NON-GOVERNMENTAL USES FOR A PERIOD OF 180 DAYS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. He stated that this is the Approval of Resolution No. R2021-60 Declaring a Zoning in Progress and Imposing a Moratorium on the Acceptance and Processing of New Applications for the Installation of Artificial Turf for Non-Governmental Uses. Mr. Stillings explained the item. He mentioned that he will have a presentation with pictures at the next meeting.
