CALL TO ORDER Mayor Gerwig called the meeting to order at 4:00 p.m. Council Members in Attendance: Anne Gerwig, Mayor; Michael Napoleone, Vice Mayor; John McGovern, Councilman, and Tanya Siskind, Councilwoman. Council Members Absent: Michael Drahos, Councilman. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. REVIEW OF COUNCIL AGENDA Mr. Barnes introduced the agenda for the September 5, 2023 Regular Council Meeting for review. A. 23-5969 PRESENTATION OF 2023 WELLINGTON TOP COP AND TOP FIREFIGHTER AWARDS Mr. Barnes introduced the item. He stated that this was the Presentation of 2023 Wellington Top Cop and Top Firefighter Awards. He mentioned that Ms. Coates and representatives from the Public Safety Committee will be in attendance to present. B. 23-6065 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETING OF AUGUST 8, 2023 Mr. Barnes introduced the item. He stated that this was the Council approval of the Minutes of the Regular Wellington Council Meeting of August 8, 2023. He asked Council to provide comments, if any, to the Clerk's Office. C. 23-5724 AUTHORIZATION TO AWARD A CONTRACT FOR THE PURCHASE AND DELIVERY OF TWO DIESEL GENERATORS Mr. Barnes introduced the item. He stated that this was the Authorization to Award a Contract for the Purchase and Delivery of Two Diesel Generators. Mr. De La Vega explained the item. He noted that this was a sealed bid, low bid. Mayor Gerwig commented that this is completely covered by the grant. Ms. Panse responded to Mayor Gerwig's comment. D. 23-5730 AUTHORIZATION TO AWARD MULTIPLE CONTRACTS FOR UTILITY PROCESS CONTROL ANNUAL MAINTENANCE Mr. Barnes introduced the item. He stated that this was the Authorization to Award Multiple Contracts for Utility Process Control Maintenance. Mr. De La Vega explained the item. He noted that this was a seal bid, low bid released on June 27, 2023. He said that four (4) proposals were received on July 18, 2023. Mayor Gewig asked if this was telemetry. Ms. Panse answered a question from Mayor Gerwig. E. 23-5820 AGREEMENTS WITH FLORIDA POWER AND LIGHT COMPANY, CROWN CASTLE FIBER LLC AND HOTWIRE COMMUNICATIONS, LTD., TO PROVIDE OVERHEAD TO UNDERGROUNDING CONVERSION OF EXISTING FACILITIES Mr. Barnes introduced this item. He stated that this was the Agreements with Florida Power and Light Company, Crown Castle Fiber LLC and Hotwire Communications, LTD., to Provide Overhead to Undergrounding Conversion of Existing Facilities. Ms. Panse explained the item. Mayor Gerwig inquired if this would allow the Village to maintain the Well. Ms. Panse responded to Mayor Gerwig's inquiry. F. 23-6076 RESOLUTION NO. R2023-41 (THE LOCAL HOUSING ASSISTANCE PLAN FISCAL YEAR 2022/2023 - 2024/2025) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND ADOPTING AN AMENDMENT TO THE FISCAL Village of Wellington Page 2 Village Council Workshop Action Summary - Final August 31, 2023 YEAR 2022/2023 - 2024/2025 LOCAL HOUSING ASSISTANCE PLAN AS REQUIRED BY THE STATE HOUSING INITIATIVES PARTNERSHIP PROGRAM ACT, SUBSECTIONS 420.907-420.9079, FLORIDA STATUTES; AND RULE CHAPTER 67-37, FLORIDA ADMINISTRATIVE CODE; AUTHORIZING AND DIRECTING THE VILLAGE MANAGER TO EXECUTE ANY NECESSARY DOCUMENTS AND CERTIFICATIONS NEEDED BY THE STATE; AUTHORIZING THE SUBMISSION OF THE LOCAL HOUSING ASSISTANCE PLAN FOR REVIEW AND APPROVAL BY THE FLORIDA HOUSING FINANCE CORPORATION; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was the Resolution R2023-41 (The Local Housing Assistance Plan Fiscal Year 2022/2023 - 2024/2025). Mr. Stoops explained the item. Mayor Gerwig asked if the roofs were for homes that qualified. Mr. Stoops answered a question from Mayor Gerwig. Mr. Stoops continued to explain the item. Mayor Gerwig inquired about the rental assistance. Mr. Stoops responded to Mayor Gerwig's inquiry. There were comments and discussion regarding program requirements and roof repairs. Councilwoman Siskind mentioned the discussion at the Affordable Housing Advisory Committee (AHAC) regarding not having any rental assistance applications and shifting the amounts. Mr. Stoops mentioned the AHAC recommended approval with a unanimous vote (7-0) at the public hearing on August 9, 2023 for the proposed amendments. G. 23-6077 RESOLUTION NO. R2023-56 (2023 ANNUAL HOUSING INCENTIVES REPORT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL, APPROVING THE 2023 AFFORDABLE HOUSING ADVISORY COMMITTEE (AHAC) HOUSING INCENTIVES REPORT AS REQUIRED BY THE STATE HOUSING INITIATIVES PARTNERSHIP ACT, SUBSECTION 420.9076, OF THE FLORIDA STATUTES; AND PROVIDING AN EFFECTIVE DATE. He stated that this was the Resolution No. R2023-56 (2023 Annual Housing Incentives Report). Mr. Stoops explained the item. Mayor Gerwig commented on the required reporting. Mr. Stoops responded to Mayor Gerwig's comment. Mr. Stillings further explained the item. Mayor Gerwig asked if the Village has any affordable housing being constructed in Wellington. Mr. Stillings answered a question from Mayor Gerwig. H. 23-5885 RESOLUTION NO. R2023-54 (PALM BEACH COUNTY SHERIFF’S OFFICE VILLAGE OF WELLINGTON LAW ENFORCEMENT SERVICES PLAN (LESP) FOR FY23) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING THE LAW ENFORCEMENT SERVICES PLAN (LESP) FOR FISCAL YEAR 2023-2024; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was the Resolution No. R2023-54 (Palm Beach County Sheriff's Office VIllage of Wellington Law Enforcement Services Plan (LESP) For FY23). He noted that Lieutenant Humphrey is present if Council would like to speak about this item in detail. Mayor Gerwig asked if the item will be presented. Mr. Barnes answered a question from Mayor Gerwig. Mayor Gerwig asked Lieutenant Humphrey if he would like to present anything to Council. Lieutenant Humphrey answered a question from Mayor Gerwig. Mayor Gerwig commented about a resident inquiry regarding the Village not having their own police and not having enough officers on the street. She asked Mr. Barnes and Lieutenant Humphrey to clarify. Mr. Barnes responded to Mayor Gerwig's comment and question. Mr. Barnes responded to Mayor Gerwig's inquiry. Mayor Gerwig asked Lieutenant Humphrey if he sees any weakness so far. Lieutenant Humphrey responded to Mayor Gerwig's question. I. 23-5886 RESOLUTION NO. R2023-53 (PALM BEACH COUNTY SHERIFF’S OFFICE DISTRICT 8 WELLINGTON FY2024 BUDGET AND CONTRACT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND AUTHORIZING THE MAYOR AND CLERK TO EXECUTE THE LAW ENFORCEMENT SERVICES AGREEMENT WITH THE PALM BEACH COUNTY SHERIFF’S OFFICE FOR LAW ENFORCEMENT SERVICES FOR FY 2024; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was Resolution No. R2023-53 ( Palm Beach County Sheriff's Office District 8 Wellington FY2024 Budget and Contract). Ms. Quickel explained the item. J. 23-6005 RESOLUTION NO. R2023-55 (DROWNING PREVENTION COALITION “BUCKS” CERTIFICATE PROGRAM) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND AUTHORIZING THE MAYOR AND CLERK TO EXECUTE AN INTERLOCAL AGREEMENT WITH THE DROWNING PREVENTION COALITION OF PALM BEACH COUNTY TO PROVIDE FOR VOUCHERS FOR FREE SWIMMING LESSONS UNDER THE “BUCK” PROGRAM FOR FISCAL YEAR 2023-2024; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was Resolution No. R2023-55 (Drowning Prevention Coalition "Bucks" Certificate Program). Mr. De La Vega explained the item. He mentioned that Mr. Etter is present to discuss specifics if needed. Mayor Gerwig asked how did the Village get more kids to swim. Mr. Etter and Mr. De La Vega answered a question from Mayor Gerwig. Village of Wellington Page 5 Village Council Workshop Action Summary - Final August 31, 2023 Mr. Barnes noted that the Village of Wellington was one of the few facilities, if not the only one, that consistently provided swimming lessons during COVID-19. K. 23-6029 RESOLUTION NO. AC2023-05 (ADOPTION OF RATES AND RESOLUTION ADOPTING THE BUDGET FOR THE WATER AND WASTEWATER UTILITY BUDGET FOR FISCAL YEAR 2023/2024) A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE ACME IMPROVEMENT DISTRICT ADOPTING THE WATER AND WASTEWATER UTILITY BUDGET FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2023, AND ENDING SEPTEMBER 30, 2024; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was Resolution No. AC2023-05 (Adoption of Rates and Resolution Adopting the Budget for The Water and Wastewater Utility Budget for Fiscal Year 2023/2024). Ms. Quickel explained the item. She noted that this would have normally been included in the August Agenda but due to the rate increase the notices were sent out for each of the four (4) cycles to ensure that they were sent out in time. She said that a presentation will be conducted at the meeting. Mayor Gerwig commented regarding the presentation. Ms. Quickel responded to Mayor Gerwig's comment. Ms. Quickel mentioned the mini budget books provided to Council. She noted that there were a few minor adjustments and a summary included. She said that this information will be available on the website for the public. Mayor Gerwig asked if there is a 10% increase in Utilities. Ms. Quickel answered a question from Mayor Gerwig. L. 23-5880 FIRST PUBLIC HEARING FOR PROPOSED FISCAL YEAR 2023/2024 MILLAGE RATE, BUDGET AND ADOPTION OF THE FISCAL YEAR 2023/2024 CAPITAL IMPROVEMENT PLAN Mr. Barnes introduced the item. He stated that this was the First Public Hearing for Proposed Fiscal Year 2023/2024 Millage Rate, Budget and Adoption of the Fiscal Year 2023/2024 Capital Improvement Plan. Ms. Quickel said that there would be a full presentation at the meeting. M. 23-6061 ORDINANCE NO. 2023-12 (AMENDMENTS TO CHAPTERS 1, 2, 3, 9, 11, 20 AND 22 CODE OF ORDINANCES) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE WELLINGTON CODE OF ORDINANCES, MORE SPECIFICALLY, TEXT AMENDMENTS TO MODIFY CERTAIN PROVISIONS IN CHAPTER 1 (GENERAL PROVISIONS), CHAPTER 2 (ADMINISTRATION), CHAPTER 3 (ALCOHOLIC BEVERAGES), CHAPTER 9 (ENVIRONMENT), CHAPTER 11 (MORTGAGED PROPERTY REGISTRATION), CHAPTER 20 (STREETS, SIDEWALKS AND OTHER PLACES), AND CHAPTER 22 (TRAFFIC & VEHICLES) AS CONTAINED HEREIN; TO FACILITATE IMPROVED EFFICIENCY FOR THE CITATION METHOD OF CODE COMPLIANCE; FOR CLARIFICATION OF PROVISIONS BY ADDING, MODIFYING, OR ELIMINATING CONFUSING LANGUAGE, INCLUDING DEFINITIONS; MODIFYING PROVISIONS TO BE CONTEMPORARY OR TO COMPLY WITH CHANGES IN STATE LAW ADOPTED DURING THE 2023 LEGISLATIVE SESSION; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was Ordinance No. 2023-12 (Amendments to Chapters 1, 2, 3, 9, 11, 20 and 22 Code of Ordinances). Ms. Cohen mentioned that the version in the packet is not correct; a supplement has been provided to Council in the amendments folder. She said that there are no changes since First Reading. Mayor Gerwig inquired if there were typos. Ms. Cohen responded to Mayor Gerwig's inquiry. Mr. Basehart said that there are no changes. 4. WORKSHOP None. 5. ATTORNEY'S COMMENTS Mr. Barnes mentioned that Ms. Cohen has an item. Ms. Cohen explained the item. She mentioned a "walk-on" item for the 130 Violations and Dog Park Foreclosure cases. She said that the lien releases had been recorded and signed by Mr. Stillings. She stated that Palm Beach Polo's Counsel is asking that Council ratify the documents that were signed by Mr. Stillings. There were comments and discussion regarding the request to ratify the documents. Ms. Cohen mentioned the email received from Mr. Domb, Esq. She said that she would be happy to provide Council with a copy of the email as she does not think that it harms anything. She said that she does not think that it is necessary. Councilman McGovern commented that this is not a lien reduction. Ms. Cohen responded to Councilman McGovern's comment. Mayor Gerwig commented about forwarding the email. Ms. Cohen responded to Mayor Gerwig's comment. Vice Mayor Napoleone asked what is the status of resolving this case. Ms. Cohen answered a question from Vice Mayor Napoleone. Councilman McGovern asked if this is an appeal of the foreclosure for the 130 Violations case. Ms. Cohen answered a question from Councilman McGovern. Vice Mayor Napoleone asked what are the beginning stages. Ms. Cohen responded to Vice Mayor Napoleone's inquiry. She said that she would like to have a Village acknowledgement of her service. Mr. Barnes said that staff can put a proposal together. 8.
