III. APPROVAL OF MINUTES- Ms. Denes requested an amendment to the Fire District appointment: Denes, Alternate. Mr. Wells requested grammatical correction in amendment. Motion by Denes, 2nd by Wells to approve the minutes of previous meeting as amended. Vote was taken, motion carried with all voting "aye". IV. COMMUNICATIONS FROM MAYOR, COUNCIL AND VILLAGE OFFICIALS: ƒ Mayor O’Keefe- Village Emergency- Mayor O’Keefe thanked the Village Public Works Department, the Electric Department, the Water/Sewer Department, Police Department, Wellington Fire District, South Lorain Ambulance District, the Red Cross and everyone involved in the gasoline leak this weekend. The quick response of those involved prevented a serious environmental issue. She also thanked the patience of the displaced residents and ensured them everything possible is being done to ensure their safety. Mayor O’Keefe gave a special thanks to Village Manager Steve Pyles for his daily updates. ƒ Candidate for County Commissioner-Councilman Schneider introduced the two term Amherst Councilman Phil VanTreuren, a candidate for Lorain County Commissioner. Mr. VanTreuren noted that his family has been in Lorain County since for more than a century and he is very proud of that. He is running for County Commissioner because he feels the present county leaders should lead by example when it comes to being fiscally responsible. They are facing a $10.5 million deficient in 2013 and should not be spending tax payer’s money unless absolutely necessary. ƒ Police Chief Rollins-no report ƒ Clerk-Treasurer Webb- no report ƒ Law Director Bond- no report ƒ Village Manager Pyles - Staff Reports - Staff reports were included in the council packet. Florescent Light Bulb Coupons- Mr. Pyles informed residents that they will be receiving a flyer in their utility bill with coupons for energy saving florescent light bulbs. VI. REPORTS OF COMMITTEE ƒ Finance/Audit Committee- Councilman Hyde reported that the Finance Committee will meet this evening after the Council Meeting. The next meeting will be on February 21, 2012 after the Council Meeting. ƒ Wellington Fire District- Mr. Hyde noted that the next meeting will be held the first Wednesday of February at 7:00 p.m. at the Kelly Street Station. ƒ Planning Commission Meeting- Councilman Hyde announced a Planning Commission Meeting on January 25, 2012 at 8:30 a.m. in Council Chambers. ƒ Police Committee- Councilman Maurer reported that the next meeting will be held on February 6, 2012 after the Council Meeting in Council Chambers. ƒ South Lorain County Ambulance Board- Mr. Maurer announced an Ambulance Board Meeting on February 14, 2012 at 7:00 p.m. at Ambulance Headquarters. ƒ Public Works Committee- Councilman Schneider reported that at the last meeting the Committee discussed the Main Street Grant, Town Hall handicap access improvements, and Courtland Street project. The next meeting will be held on January 3, 2012 at 6:00 p.m. in Council Chambers. ƒ Utility Committee- -Councilwoman Denes reported that the Committee met this evening before the Council Meeting. The Committee heard a presentation by Solid Waste District Director, Keith Bailey. The updated solid waste plan was reviewed. Legislation approving the plan is on the agenda this evening. ƒ Main Street Board- Ms. Denes reported the Board met this morning. The annual Chocolate Walk will be held on February 4th from 10:00 a.m. to 4:00 p.m. with wine tasting at Forts Tavern from 2:00 p.m. to 5:00 p.m. tickets are $10.00. The Main Street Annual Meeting will be held on January 26, 2012 at 7:00 p.m. at the Kelly Street Fire Station. The Wellington Main Street was selected at a National Main Street Community for the 12th consecutive year. ƒ Ordinance Committee- Councilman Wells reported that the next Ordinance Committee meeting will be held Page 2 of 4 Village of Wellington Council Meeting Minutes  on February 6, 2012 after the Police Committee Meeting. Mr. Wells thanked everyone for their friendship and support during his recent surgeries. Ms. Denes reminded Mr. Wells that Ordinance 2012-02 relative to personal information systems was forward to the Ordinance Committee. VII. ORDINANCE AND RESOLUTIONS • RESOLUTION NO. 2011- 50 A RESOLUTION TO ADOPT THE SOLID WASTE MANAGEMENT PLAN FOR THE LORAIN COUNTY SOLID WASTE MANAGEMENT DISTRTICT 3rd Reading nd Motion by Wells, 2 by Denes to bring Ordinance 2011-50 back on the table. Vote was taken, motion carried with all voting “aye”. Motion by Schneider, 2nd by Denes to approve the third reading of Resolution No. 2011-50. Vote was taken, motion carried with the following votes: Denes, yes; Hyde, yes; Maurer, yes; Schneider, yes; and Wells, no. • ORDINANCE NO. 2012-01 AN ORDINANCE FOR THE ISSUANCE OF PAYMENTS FOR THE SETTLEMENT OF WELLINGTON’S FINANCIAL CONTRIBUTION TOWARDS THE AMERICAN MUNICIPAL POWER GENERATING STATION. 2nd READING Mrs. Webb pointed out that the Law Director has indicated that voting on the second read of legislation is not necessary. Mr. Wells recommended Council continue to vote on the second reading as they have done in the past. Motion by Maurer, 2nd by Wells to approve the second reading of Ordinance No. 2012-01. Vote was taken, motion carried with all voting “aye”. • ORDINANCE NO. 2012-02 AN ORDINANCE ENACTING A NEW CHAPTER 165 OF THE CODIFIED ORDINANCES RELATIVE TO PERSONAL INFORMATION SYSTEMS. 2nd READING Motion by Denes, 2nd by Wells to table Ordinance No. 2012-02 and forward to Ordinance Committee. Vote was taken, motion carried with all voting ‘aye”. • RESOLUTION NO. 2012 – 03 A RESOLUTION AUTHORIZING THE VILLAGE MANAGER TO APPLY FOR AN ODNR GRANT AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE 1st READING nd Motion by Wells, 2 by Schneider to suspend the rules. Vote was taken, motion carried with all voting “aye”. Motion by Wells, 2nd by Schneider to pass Resolution No. 2012-03 as an emergency. Vote was taken, motion carried with all voting “aye”. • ORDINANCE NO. 2012 – 04 AN ORDINANCE AUTHORIZING AN AGREEMENT WITH CREATIVE MICROSYSTEMS, INC. FOR COMPUTER SOFTWARE AND EQUIPMENT IN THE POLICE DEPARTMENT 1st READING VIII. Old Business- none IX. New Business- • Village Water Supply- Water/Sewer Superintendent Rosemark assured residents that the recent gasoline spill has not affected the Village water supply in any way. • Maple Street Gasoline Spill- Fire Chief Wetherbee thanked all agencies for working together on the recent gasoline spill. Chief Wetherbee introduced David Justin of Sunoco V.P. Logistics, Joe McGinn of Sunoco Communications, Trish Edwards of the U.S. Environmental Protection Agency, and Bob Gord of the Lorain County Health Department. Mr. Wells questioned the inspection of the gasoline lines. Mr. Justin explained that the pipeline was inspected in 2007 and was scheduled for another inspection next month. He noted that regulations require inspection once every five years unless other internal pipeline Page 3 of 4 Village of Wellington Council Meeting Minutes  problems are reported. Mr. McGinn informed residents that the pipeline entails a 25 foot right of way that is monitored by air. Mr. McGinn noted that an informational letter will be published in the local newspaper, The Enterprise, with additional information and contact numbers to their offices. Trish Edwards of the U.S. E.P.A. thanked the Village for their quick response to the leak. She said the local responders have been the best she has ever seen. Chief Wetherbee indicated that residents of Brookside Park will be allowed back into their homes when the Lorain County Health Department ensures the air quality is safe. • Emergency Shelter- Mayor O’Keefe noted that the Red Cross does not have the town hall listed as an emergency shelter. She requested Council designate the town hall as the emergency shelter. Motion by Schneider, 2nd by Maurer to designate the village town hall as the emergency shelter. Vote was taken, motion carried with all voting “aye”. • February Meeting- Motion by Maurer, 2nd by Schneider to move the February 20th meeting to February 21st because of Presidents’ Day. Vote was taken, motion carried with all voting “aye”. • AARP Tax Aid- Mayor O’Keefe reported AARP volunteers will be providing free tax service for low income and senior citizens from February 1st –April 15th. To make an appointment call Marla Lent at 647- 4626 Ext. #5. • HEAP- Mayor O’Keefe noted that Lorain County Community Action representative, Cindy Hicks, is available to see clients at the town hall. For further information and appointments call 647-6410. • Caring Fund- Councilman Denes inquired about Caring Fund grants. Clerk-Treasurer Webb reported that we have funded this year’s allowance of $1,200.00 with six grants of $200.00 each. Ms. Denes would encourage residents to opt into the round up program to help the less fortunate. X.
