REGULAR MEETING
A. CALL TO ORDER
The meeting was call to order by Mayor Devine at 4:10 p.m.
B. ROLL CALL
Present 3- Mayor Dan Devine, Wayne Clark, and Pati Concha
Others present: City Clerk Steve Braatz, Assistant City Attorney Nick Cerwin, Health
Commissioner Sally Nusslock

18-00641 Dangerous Dog Order for Appeal by Andrea Brown of 1569 S. 76th St.

The following were sworn in:
1. Sally Nusslock, Health Commissioner
2. Andrea Brown, Appellant
Nusslock reported that the dog in question, named Gerald, had bitten a person. Gerald
was taken into a rabies quarantine and it was determined that the rabies vaccination was
current. Gerald completed the rabies quarantine and the victim was notified.
Appellant Andrea Brown testified. A letter was submitted in defense of her dog, named
Gerald. Verbal testimony included the following:
1. Gerald was not bred to be aggressive by the breeder.
2. Gerald has never harmed another dog while at Camp Bow Wow or at local dog parks.
3. Gerald was not being tormented at that specific time, but neighbors consistently
torment him.
4. Gerald took the interaction with her neighbor as trespassing and acted to protect his
mom.
5. Gerald has never attacked anyone inside the home.
Motion made by Clark, seconded by Devine, that this Order be upheld. The
appellant is given until June 30, 2019 for an update and potential removal of the
order. The insurance requirement is waived. The City Attorney will work with
the Police Department to determine an appropriate registration fee. Motion
carried by the following vote:
Aye: 2- Mayor Devine, and Clark
No: 1- Czaplewski

For items 18-00639 and 18-00640:
Due to his involvement in one of the incidents, Czaplewski recused himself. Chair
Devine called up Alternate Concha to fill the vacant seat. Atty Cerwin advised the Board
to hold off on the hearings until counsel for the appellant is present.
Motion by Clark, second by Concha, to postpone items 18-00639 and 18-00640 until a
future date. The Clerk and Attorney will determine the date of the future meeting and
schedule. Motion carried.
D. ADJOURNMENT
Motion by Clark, second by Czaplewski, to adjourn the meeting at 5:03 p.m.
Motion carried.
