Presentation Mayor Bell requested Council President Sengstock preside as Chair. Mayor Bell announced the Porch Contest winners for 2003. She invited the winners to receive their awards and recognition as follows: Paul and Leann Sommeres, 1542 S. 65 St., Most Homey Cynthia Hampton, 1965 S. 82 St., Most Inviting June Lynch, 2026 S. 94 St., Most Unique Lorraine Piering, Landmark Apartments, 69th and Orchard, Best Balcony Mary Yost, 2020 S. 79 St., Most Patriotic Henry and Helena Potecki, 6346 W. R-2003-0300 Resolution to confirm and adopt the report of the City Engineer containing the schedule of proposed assessments for improvement of W. Orchard St. from S. 76 St. to S. 82 St. and portions of intersecting streets by concrete reconstruction of the pavement with miscellaneous sidewalk repair, new driveway approaches, storm sewer, storm sewer relay, sanitary sewer relay, water main, water main relay, building services and utility adjustments. R-2003-0301 Resolution to confirm and adopt the report of the City Engineer containing the schedule of proposed assessments for improvement of W. Rogers St. from S. 53 St. to S. 60 St. and portions of intersecting streets by concrete reconstruction of the pavement with miscellaneous sidewalk repair, new driveway approaches, storm sewer relay, sanitary sewer relay, water main relay, building services and utility adjustments. Explanation of the proposed improvement by Mike Lewis, City Engineer. Appearances: Michael Tarasik, on behalf of Harriet Tarasik, 5831 W. Rogers St., questioned possible tree removal and commented on the assessment for a corner lot. He also stated his concerns regarding traffic and safety. Michele Koltermann, 5702 W. Rogers St., remarked her concerns regarding economic hardship. She inquired about the street problems, and is opposed to the project. Lisa Diaz Telles, 5706 W. Rogers St., opposed the project due to economical reasons. Diane Dorow, 5931 W. Rogers St., indicated that she has not seen anything wrong with the street. She inquired about concrete versus asphalt, payments on laterals, the vacant lot, and sidewalk improvements. She also commented on her parking and economic concerns. 3. 2003-0648 On the allocation and utilization of funds to the Local Law Enforcement Block Grant Program in the approximate amount of $25,077. Explanation of the allocation and utilization of funds to the Local Law Enforcement Block Grant Program by John Stibal, Director of Development. Appearances: Richard Siebenaller, 8719 W. Orchard St., questioned use of grant money for network communication for squad cars. E. CITIZEN PARTICIPATION Tony Rogewski, 1438 S. 71 St., opposed to the proposed adult video section of the Family Video Store at S. 76th St. and W. National Ave. He encouraged morality for the community. Robert Braun, 2160 S. 86 St., spoke on behalf of the Christian Civil Liberties Union and Save Our Children. He mentioned that other cities have stopped the x-rated section of the store. He stated that children will be in the store. Mr. Braun requested an injunction. He read a former Proclamation from 1992 announcing Pornography Awareness Week. He indicated that papers are being circulated for signatures. Pat Morris, 2001 S. 105 St., spoke on behalf of the Education Foundation and the West Allis Charities. She announced West Allis Community Night with the Milwaukee Wave for November 14th at the Cellular Arena, a reception at Irving School on October 21st celebrating Barbara Johnson, Wisconsin Teacher of the Year, and the Christmas Parade scheduled for November 18th. Tickets for community night are $14.00 and mentioned that group rates are available. He provided statistics on tax levies, consumer price index information, and City expenditures. He requests a zero tax levy increase. Tony Coupee, Franklin, attends church at S. 84 St. and W. Beloit Rd., and stated his concerns regarding the adult video section of the proposed Family Video Store. He commented that the store will draw perverts, and it will bring destruction to the children and community. Kris Werner, 1508 S. 75 St., #202, stated that she represents the elderly citizens that live at Carnegie Place and the Landmark. She grew up in West Allis and enjoyed the shops on W. Greenfield Ave. She expressed her feelings, and questioned the addition of pornography and how it impacts tourism. She commented on accountability. Michaeljon Murphy, 349 Joris Ave., Waukesha, attends church in West Allis. He believes the representatives of Family Video have not been genuine. He questioned the separation between the adult portion of the store from the rest of the store. He remarked that pornography is bad for the community. He expressed his discouragement, and asked the City leaders to vote no to the store's adult section. Griss Gesch, 10201 W. Appleton Ave., attends church in West Allis. He commented on the square footage of Family Video for adult material, and said the parking lot has children there. James Soderna, 1305 S. 105 St., said that a Plan Commission member's son works for Family Video in Madison. He asked for a vote of conscience. Steven Boehm, 2348 S. 79 St., referenced the State Statutes, and disagrees that no legal action can be taken regarding the adult portion of the proposed Family Video Store. He remarked that high moral standards should be encouraged. Joan Neibert, 7910 W. Burnham, opposes pornography. She remarked that she has children and grandchildren. Violet Braun, 2160 S. 86 St., relayed her interactions with patrons of other Family Video stores, and remarked that the Family Video Store is evil for West Allis. She is concerned about women and children. F. This Matter was Placed on File on a Block Vote. 5. 2003-0636 Acuity, A Mutual Insurance Company, communication on behalf of their insured Yolanda Gamazon, regarding vehicle damage in the amount of $995.35, which allegedly occurred at S. 124 St. & W. National Ave. on July 24, 2003. This Matter was Referred for Legal Action to the City Attorney on a Block Vote. 6. 2003-0642 Dowling & Blumenfield, LLP Law Offices communication on behalf of their clients Doreen Berg and Eugene Berg, regarding Notice of Injury which allegedly occurred at 2892 S. 98 St. on June 12, 2003. This Matter was Referred for Legal Action to the City Attorney on a Block Vote. 7. 2003-0659 George R. Kasica, N165 W20901 Glencoe Ln., Jackson, WI communication regarding vehicle damage allegedly sustained by hitting debris in the street at S. 77 St. and W. Oklahoma Ave., on October 8, 2003, in the amount of $238.73. This Matter was Referred for Legal Action to the City Attorney on a Block Vote. Passed The Block Vote I.
