D. PUBLIC HEARINGS 1. R-2013-0254 Resolution relative to determination of Special Use Permit for Michels Corporation for a batch plant and associated trucking operations on a portion the Quad Graphics site located at 555 S. 108 St. and 11000 W. Theodore Trecker Way. Sponsors: Safety & Development Committee Explanation by John Stibal, Director of Development. The Clerk's Office received six (6) communications regarding the Special Use with concerns and opposition and two (3) communications from Michels Corporation. Appearances: Pat Ruud, 820 S. 113 St., commented on dust, health, traffic concerns, taxes, and opposed the project. Joe Goetz, 738 S. 114 St., commented on noise, and opposed the project. Frank Weissenberger, 807 S. 109 St., addressed concerns regarding traffic, noise, trucks, parking, construction complaints, and opposed the project. Ronald Schnell, 818 S. 109 St., asked about the fill for the area and DNR comments. Christine Leonard, 735 S. 110 St., asked about existing batch plants and the tax impact. Suzanne Metzenheim, 1009 S. 111 Pl., addressed concerns regarding noise, air pollution, trucks, street usage, safety, and being clean. Nancy Parker, 727 S. 111 St., asked about the number of concrete plants and the reason why they are coming, and she opposed the project. Tom Balistreri, Colder's, 333 S. 108 St., addressed concerns regarding safety, impact on the community and company, respiratory problems, dust, customer experience, noise, trucks, traffic, road condition, company costs, HVAC system, showroom quality, inconvenience and taxes. Bob Garbutt, Colder's employee, 333 S. 108 St., addressed concerns regarding trucks, traffic backups, safety at the top of the roadway, odor, and noise. He said that Colder's is a viable business that supports the community. Helen Felker, 1330 S. 108 St., said that construction is difficult on a business, and that five years is too long. She addressed concerns regarding taxes, dust, air filters, furnaces, air conditioning systems, and intersection safety. She requested denial of the permit. Ken Dobberfuhl, 737 S. 113 St., addressed concerns regarding property values, dust, garbage, and taxes. He opposed the project. Ryan Murphy, Michels, 817 W. Main St., 53006, addressed the following: 1. Understanding the concerns mentioned, reaching out to the community regarding misinformation, and requested a community meeting. 2. Working with the Planner's Office, site plan mischaracterization, and unanswered questions by the Planning Department. 3. Unreasonable conditions, and the expense of paving. 4. Hours of operation. The Department of Transportation may require nighttime work. 5. Michels, as a renter, has an indirect tax payment. 6. Operational income and purchases. 7. History of not receiving complaints. Nicholas Hornyak, engineer, provided a pavement analysis, and commented on dust mitigation and noise. Tim Farris, Michels construction manager, reported on their last three sites. He commented on initial negative reaction and resistance, and said he received no complaints from the three major sites. Mike Debelak, Michels Vice President, commented on their past meeting experiences , and said that Michels Corp. does things differently. He addressed being a good neighbor, that a lot of work will be done in a short amount of time, bringing more business, safety, and efficiency. He said that no one asked to see their operation, and that there will be far less impact on this community rather than using Department of Transportation land. He addressed truck traffic, impact on surrounding communities, dust and noise control, indirect payment of taxes, and that the temporary use is allowed by ordinance. Tom Balistreri, Colder's, readdressed their concerns about the route, safety, traffic, egress and ingress, and the detriment to their business and customers.
