PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Ald. Roadt. D. PUBLIC HEARINGS 1. O-2015-0041 Ordinance to amend the official West Allis Zoning Map by rezoning a portion of the property located at 932 S. 60 St. from RB-2 Residence District to C-3 Community Commercial District. Sponsors: Safety & Development Committee Two (2) letters of opposition were received in the Office of the City Clerk. Explanation by John Stibal, Director of Development. Appearances: Rosemary LeMoine, 5835 W. Walker St., supported development, but was not sure if this is the right one. Ms. LeMoine commented on the alley services, residents, asked about the setback, lower parking lot, fencing, the green space dimensions, and the permitted area for children to play. Richard Wichmann, 915 S. 57 St., commented on how the neighborhood is a stable residential area. Mr. Wichmann was concerned that a multi-family rent-based facility won’t have an investment in the neighborhood. He questioned the investment group building these homes with the current facility located on Main Street in Milwaukee City of West Allis Page 1 Printed on 9/2/2015 Common Council Meeting Minutes August 4, 2015 being low income townhouses, and does not enhance the area. He objected to the townhouses. He questioned who is paying taxes. Mr. Wichmann is concerned about the beginning of an influx with patients being placed in the neighborhood. Mr. Wichmann had an issue of the loss of an elementary school, that clinic could be placed anywhere in West Allis, and that this could be a magnet for criminal activity. Mr. Wichmann pointed out high density housing with twelve townhouses is a lot and would like to see five or six single family homes instead to enhance the neighborhood, and asked what the benefit is to the neighborhood. Elizabeth Rohde, 940 S. 58 St., asked if Capital Management is buying the entire lot and if MCFI is a low income program with county money. Ms. Rohde addressed concerns with the 60 Street exits, volume of traffic on Hawley Road, and the location of the facility. Peggy Wittman, 700 S. 56 St., spoke on her mother’s behalf, Ms. Audrey Brown. Ms. Wittman and Ms. Brown are concerned about rezoning to commercial and other homes in the future being taken to accommodate commercial rezoning. They have concerns over another mental health facility being in the neighborhood and expressed concerns about children and elderly safety; and also with losing a grade school on the east side of West Allis. Stephanie Kenth, 900 S 58 St., opposed the proposal and said a medical facility is not needed in the neighborhood, but agreed it is important to have these facilities. Ms. Kenth appreciated hearing the sale is contingent on the park staying; and she questioned why the school district didn’t pursue the space for educational organizations. Ms. Kenth would like to see it used as something useful to benefit the neighborhood, community, city, and surrounding area as possibly a community garden. Jill Jurena, 973 S. 58 St., agreed with everything that has been said. Ms. Jurena commented on not needing the proposal in the area, and addressed concerns regarding loss of property value and safety at night. Chris Kenth 900 S. 58 St., commented that he understands the school board wants to sell and reinvest, and generate property tax value. Mr. Kenth stated a behavioral health facility is not right for the area, would not be an improvement for the neighborhood, shouldn’t be located next to a playground, and commented on the future phase with Cardinal Capital. Dan Odya, 5811 W. Walker St., commented on Roosevelt School not being reopened. Mr. Odya was concerned about the play park area, traffic and accidents. Mr. Odya commented that a business will always want to increase in size in the future making it not a safe neighborhood. He favors development, but not this type. Kristi Czaplewski, 900 S. 57 St. asked about Cardinal’s plans. Ms. Czaplewski commented that the playground is viewable and neighbors watch it and the safety of the children. Ms. Czaplewski agreed with similar statements made tonight by other residents and objects to this type of development. Ms. Czaplewski questioned why the city can’t take that small parcel and always be guaranteed of having a green space for the children which people would help out with the maintenance. City of West Allis Page 2 Printed on 9/2/2015 Common Council Meeting Minutes August 4, 2015 Pat Clark, 903 S. 57 St., addressed that a lot of neighbors couldn’t make it and spoke to her about their concerns. One of the concerns was the treatment of pedophiles at the facility and children’s safety. Ms. Clark echoed everyone’s concerns that spoke and commented on not much of a police presence in their area and wants to keep the park. Raye Robinson, 5704 W. Walker, stated her husband and she are opposed to this development. Ms. Robinson was in favor of keeping of the green space and commented there is not enough bus traffic on Hawley Road to support this business. Jill Bratonja, 952 S. 57 St., stated she agrees with pretty much everything that was addressed tonight. Ms. Bratonja opposed the proposal and said it is a big risk. Mary Wetley, 3247 S. 105 St., commented on visiting the area and is happy to see development, and hopes the developer realizes green space is important. Ms. Wetley commented on the loss of a school and feels the battle was lost years ago. Charles Blank, 810 S. 58 St., commented on the closing of the school, stated this development is not the right one for this area, and that there isn't a need of multi-family housing. Mr. Blank suggested on making the area single family homes, and suggested the school administration building be located on S. 60 Street and the mental health facility be located in the current school administration building on S. 70 Street. Ray Molleson, 977 S. 58 St., objected to the proposal. Mr. Molleson is concerned about who is paying for the demolition and other changes. Mr. Molleson stated he would like to see single family homes developed if the school is going to be razed and was of the opinion that there are enough places for this facility just not at this location. Mr. Molleson also asked when the vote for this item will take place. John Chianelli, representing Whole Health Clinical Group, addressed the concerns presented and spoke about the use of the property for the future. Mr. Chianelli stated the building is intended to be a medical office building with physicians and nurses; the Whole Health Clinical Group is a division of MCFI. Mr. Chianelli explained that this expansion is a historical mission and to provide health care to the community. Mr. Chianelli spoke about primary care and providing services from pediatric to geriatric care, total health care, a healthier community, whole health, and in-home services. Mr. Chianelli addressed bringing more jobs to the area; and has been a partner with Cardinal Capital for many years. Stephanie Kenth, 900 S 58 St., asked if there were any complaints about shortage of medical facilities in the area, opposed the development in this area, and believed it should be put in a large commercial district. Mr. Schwenker stated Capital Management does not own Main Street Gardens but does the property management. Mr. Schwenker stated the City is asking for a provision to be made for the park, that it is open to everyone, monies will be invested into the park, and it has agreed to the maintenance of the park. R-2015-0168 Resolution relative to determination of Special Use Permit for the Corvina Wine Company, an existing wine tasting business, for a proposed outdoor private tasting area and interior expansion of use, located within a mixed-use building at 6038 W. R-2015-0173 Resolution relative to determination of Special Use Permit for Bottoms Up, a proposed tavern, to be located within the mixed use building at 7127 W. National Ave. Sponsors: Safety & Development Committee One (1) petition of opposition was received in the Office of the City Clerk. Explanation by John Stibal, Director of Development. Appearances: Lynn Gunderson, 1716 S. 72 St., requests denial of the license application and commented on the petition submitted from the neighborhood. Ms. Gunderson commented on various potential problems at this location. Ms. Gunderson stated that it has been peaceful since it’s been closed and wouldn’t mind a bakery, salon, deli, coffee shop, or another high class establishment at this location. Ms. Gunderson commented on the owner of the parking lot. Mary Wetley, 3247 S. 105 St., commented if the operator has revised the plan and asked about the location of a smoking area. David Borda, 1720 S. 72 St., commented on the lack of parking on the street because of patrons parking in front of his home, problem with rats, security of the facility, fights, and public urination. Mr. Borda requested a light in the alley and signage for no parking. David Nowalis, 1736 S. 72 St., commented that since the bar has been closed there hasn’t been any screaming or fighting, and that there are more than enough bars. Mr. Nowalis is against putting a biker bar in the city and said this would hurt the area. Donna Broughton, 1707 S. 71 St., stated that there are plenty of bars and we do not need more. Dolores Gunderson, 1716 S. 72, commented on the impressive presentation with the right choice of words to be convinced of the plan. Ms. Gunderson is concerned with problems such as parking, motorcycles, urination, vomiting, garbage, arson, loud visiting, house entry, and gunshots. Ryan Roth, 2891 S. 91 St., questioned how this fits into the National Avenue Corridor Plan and the signage. Mr. Roth stated this type of establishment may preclude other businesses from opening and this is not who or how the City of West Allis should be portrayed. Rae Ann Register, 7123 W. National Ave., commented on how pleasant it has been without a bar and echoed the concerns of previous speakers about property damage, trespassing, biker bar concerns, smoking, loudness, litter, and parking on streets. Ms. Register is concerned for her Dad who is in rehab and how this will affect him. She requested a different business, not a bar, at this location. City of West Allis Page 5 Printed on 9/2/2015 Common Council Meeting Minutes August 4, 2015 Chaz Hastings, Agent for the proposed Bottoms Up, commented that this is not a biker bar and spoke about his other locations as family dining. Other Bottoms Up locations had bad reputations prior to his ownership and are now model bars. Mr. Hastings has given Police full access to security cameras, and security personnel are present on busy nights at his other locations. Mr. Hastings said that he will not have the same customers as Night Court’s. Mr. Hastings commented on the reputation of Milwaukee Harley. Mr. Hastings hears the concerns, and he will be a good neighbor with open communication. Mr. Hastings stated his investment is about $150,000 and he meets with his managers on a weekly basis. He also has access to the cameras, social media, and friends and guests that visit his establishments for feedback. Mr. Hastings commented on attempting to contact the owner of empty lot, but to no avail. He offered to spray the weeds on the empty lot. Todd Hall, works for Mr. Chaz Hastings and oversees all nine (9) of his bars. He stated the Mayors from the City of Butler and the City of South Milwaukee have given them letters of recommendations. For South Milwaukee, they have been asked to take over their parks department, and they are managing the concession stands at the request of the City of Butler Police Department with no complaints. Wade Register, 7123 W. National Ave., is concerned with his safety, parking, how Mr. Hastings can manage all his places, and commented on a situation with his dog. Mr. Register opposed the bar proposal. Public Hearing Held. 5. Appearance: Carol Graham, 1808 S. 63 St., was concerned about cars racing down the alley, wants a fence, and stated the alley was just repaved. Ms. Graham does not want dining, loud music in the neighborhood, objected to the hours, and outdoor dining. Ms. Graham does not appreciate the proposal and commented on the neighborhood impact. CITIZEN PARTICIPATION Judith Lee Tarbox, representing Village Playhouse located at 1500 S. 73 St. (in the Inspiration Studio’s) invited all to the performance of “Midsummer Night’s Dream”. Refer to their website (www.villageplayhouse.org) for schedule and ticket information. Carol Graham, 1808 S. 63 St., commented on special use permits and related landscaping and building maintenance. Ms. Graham would like the city to enforce the permits, and require living by the City's rules. Jim Morris, 866 S. 75 St., commented on traffic lights on Greenfield Avenue. Yuri Ksenidi, 1131 S. 89 St., shared a resource/application entitled “Pocket”. Cheryl Colgrove, 1361 S. 109 St., was available to answer any questions related to Piggy. F. ANNOUNCEMENT OF RECESS MEETINGS OF STANDING COMMITTEES Mayor Devine announced that the following Committees would meet during recess: Administration & Finance, Public Works, Safety & Development, License & Health, and Advisory. G. MAYOR'S REPORT Mayor Devine commented on the arts in West Allis, spoke about Inspiration Studio’s and Village Playhouse and he recommended supporting the Arts. Mayor Devine commented on the West Allis-West Milwaukee Forks and Corks to be held in late October. He thanked the Forestry Division for planting a tree at the Skate Park in memoriam of Patty Kompas, a former Police Department civilian employee. Ms. Kompas was an avid volunteer of C.A.A.D, the Recreation Department and did a lot to get the skate park to where it is today. Mayor Devine also reported on National Night Out events, thanked everyone who made the event at the Farmer’s Market a success and to those neighborhoods who participated. Mayor Devine commented on the opening of State Fair and to be aware of traffic. H. ALDERPERSON'S REPORT Ald. May commented on the neighborhood association programs: Rainbow Gardens had a camp out in a county park, Rosehill had a National Night Out block party for the entire neighborhood, Conner Gardens had little league playoffs, Lafollette will be hosting a movie night, and Woodlawn Manor Neighborhood will be hosting a neighborhood wide block party. Ald. Reinke shared the Mayor’s enthusiasm for promoting arts in the community and congratulated the West Allis Players’ production of "Wizard of Oz" and thanked them for promoting the arts. Ald. Reinke would like everyone to support the theater, arts, and encourage people to attend these performances.
