APPROVAL OF MINUTES to approve the minutes of the regular meeting of May 23, 2006 and recess meeting of June 6, 2006 A motion was made by Ald. Sengstock, seconded by Ald. Dobrowski, to approve the minutes of the regular meeting of May 23, 2006 and recess meeting of June 6, 2006. The motion carried. C1. CLOSED SESSION A closed session was not held. D. NEW AND PREVIOUS MATTERS 1. 2006-0342 Summons and Complaint in the matter of the complaint against Top Gun Saloon, Inc., Angela M. Robinson, Agent for the premises located at 1100 S. 60 St., d/b/a Top Gun Saloon (2005-2006 Class B Tavern License no. 88). Attorney Barry Books informed the Committe that he has not had the opportunity to review the necessary files and requested 30 days to do so. The Committee, Attorney Books and Attorney Roger Pyzyk agreed to a July 24, 2006 meeting at which time a hearing date may be set. Appearance by Anne M. Neitman. Ms. Neitman stated that she would be working part-time at Jim Henry's Oval Bar, 9141 W. National Ave. Ald. Czaplewski discussed Ms. Neitman's police report and informed her that rules and restrictions need to be followed. Ms. Neitman agreed. Ald. Sengstock explained the Weed & Seed program to Ms. Neitman. A motion was made by Ald. Dobrowski, seconded by Ald. Sengstock, that this matter be Recommended For Approval. Second nonappearance of Sara O'Leary. Ms. O'Leary did not contact the Clerk's Office. A motion was made by Ald. Sengstock, seconded by Ald. Czaplewski, that this matter be Recommended for Denial. Ms. Wolfmeyer informed the Committee that she will be working at Dopp's, 1022 S. 60 St. Ald. Czaplewski informed Ms. Wolfmeyer of increasing problems in the neighborhoods surrounding the tavern and advised her call police if problems were to occur. Ald. Sengstock explained the Weed & Seed program. A motion was made by Ald. Czaplewski, seconded by Ald. Sengstock, that this matter be Recommended For Approval. Appearance by Thomas D. Wirsbinsky. Mr. Wirsbinsky informed the Committee that he will be working at Lynch's, 2300 S. 108 St., on an as needed basis. A motion was made by Ald. Madison St. She added that a court date is pending regarding a police incident. Ald. Czaplewski explained the Weed & Seed program to Ms. Zirnhelt. A motion was made by Ald. The Committee requested that Mr. Heiden be ordered to appear at the next scheduled License & Health meeting. 16. 2006-0374 2006-2008 Package Goods Operator License renewal application no. 567 of Jacob J. Kuchta. Appearance by Jacob J. Kuchta. Ald. Dobrowski questioned Mr. Kuchta about his police report. Mr. Kuchta informed the Committee that the case was dismissed. Ald. Sengstock informed Mr. Kuchta of the Weed & Seed program. A motion was made by Ald. Sengstock, seconded by Ald. Dobrowski, that this matter be Recommended For Approval. Cass, d/b/a Needle Inn, for premises located at 7100 W. National Ave. (new-existing location) Appearance by Sandra L. Cass and Robert Jesion. Ald. Czaplewski stated Ms. Cass's police report is clear. A motion was made by Ald. Czaplewski, seconded by Ald. Sengstock, that this matter be Recommended for Approval subject to the necessary requirement(s). Mr. Lien informed the Committee that he is applying as the new owner of the premises. A motion was made by Ald. Sengstock, seconded by Ald. Dobrowski, that this matter be Recommended for Approval subject to the necessary requirement(s). Bennett, Agent, d/b/a Bennett's for premises located at 1902 S. 68 St. Appearance by David M. Bennett and Clarence M. Keller. Mr. Bennett stated that he is in the process of selling the business to Mr. Keller. Mr. Keller informed the Committee that he has been in the food and beverage business for 30 years. Mr. Keller was informed that Bencor, Inc. would need to withdraw the renewal application and surrender the license prior to a new license being issued. This Matter was Recommended for Approval subject to the necessary requirement(s) on a Block Vote. 21. 2006-0354 2006-2007 Class B Tavern License application no. 1104 of Stefano's Inc., Clarence M. Keller, Agent, d/b/a Mugshotz for premises located at 1902 S. 68 St. (new-existing location) Appearance by Clarence M. Keller. See Legislative File no. 2006-0383 This Matter was Recommended for Approval subject to the necessary requirement(s) on a Block Vote. Passed The Block Vote Aye: 4- Kopplin, Sengstock, Czaplewski, and Dobrowski No: 0 22. 2006-0263 2006-2007 Class B Tavern License renewal application no. 810 and Dance Hall License renewal application no. 812 of Dog House, Inc., Thomas L. Lipp, Agent, d/b/a The Dog House, for premises located at 1641 S. 68 St. Appearance by Thomas L. Lipp. Mr. Lipp stated he was unaware of any police issues still outstanding. Ald. Sengstock informed Mr. Lipp that anything regarding a citation would need to be addressed with the police department. A motion was made by Ald. Sengstock, seconded by Ald. Dobrowski, that this matter be Recommended for Approval subject to the necessary requirement(s). The motion carried by the following vote: Aye: 4- Kopplin, Sengstock, Czaplewski, and Dobrowski No: 0 23. 2006-0341 2006-2007 Class B Tavern License renewal appl. no. 635 and Dance Hall License renewal appl. no. 638 of Columbus Club of West Allis, Inc., Dale F. Millikin, Agent, d/b/a Columbus Club of West Allis for premises located at 1800 S. 92 St. Appearance by Dale F. Millikin. Discussion was held regarding Mr. Millikin's police report. Mr. Millikin stated that he will be appearing in Municipal Court on June 14, 2006. A motion was made by Ald. Sengstock, seconded by Ald. Dobrowski, that this matter be Recommended for Approval subject to the necessary requirement(s). Kopplin informed the Committee that Days Inn's Banquet facility has been operating under Pallas Restaurant's Liquor License. He added that since this is a separate premise, a separate license is needed to serve alcohol. Monica Schultz, Assistant City Clerk, informed the Committee that the municipal quota for Class B Liquor Licenses is 128 and currently there are 127 issued. Ald. Sengstock advised Mr. Itsines to apply for a Class B Liquor License if he wishes to serve alcohol at the Days Inn Banquet facility. A motion was made by Ald. Sengstock, seconded by Ald. Czaplewski, that this matter be Recommended for Approval subject to the necessary requirement(s). The motion carried by the following vote: Aye: 4- Kopplin, Sengstock, Czaplewski, and Dobrowski No: 0 25. 2006-0397 2006-2007 Class B Tavern License renewal application no. 637, Dance Hall License renewal application no. 640 and Instrumental Music License renewal application no. 664 of Magoo's of West Allis, Ltd., Thomas J. Beckmann, Agent, d/b/a Magoo's Sports Bar & Grill for premises located at 8911 W. National Ave. Appearance by Thomas J. Beckmann. Lt. Novy discussed the police report with the Committee and reminded Mr. Beckmann to be a responsible server. Ald. Czaplewski added that police are to be called if problems arise. Mr. Beckmann agreed. A motion was made by Ald. Dobrowski, seconded by Ald. Sengstock, that this matter be Recommended for Approval subject to the necessary requirement(s). Crivello, Agent, d/b/a Scotty's West Allis, premises located at 6500 W. Greenfield Ave. (new-existing location). Appearance by Peter D. Crivello. Ald. Kopplin questioned Mr. Crivello regarding plans on opening. Mr. Crivello informed the Committee that he will be reapplying as a new Limited Liability Corporation and stated that Scott Jesion withdrew his application. 27. 2006-0351 2006-2007 Class B Tavern License renewal application no. 987 and Dance Hall License renewal application no. 988 of Iris Inc., LLC, Peter D. Crivello, Agent, d/b/a Scotty's of West Allis for premises located at 6500 W. Greenfield Ave. Appearance by Peter D. Crivello. See Legislative File no. 2005-0548. Uebelacker, Agent, d/b/a Ubie's Double Vision for premises located at 5501 W. Burnham St. Appearance by Robert A. Uebelacker. Ald. Czaplewski stated that Mr. Uebelacker was dishonest when answering questions regarding the number of violations that occurred at his establishment. He added that Mr. Uebelacker is responsible for what happens outside of his establishment as well as inside. He cautioned him to be more truthful and to handle problems as they arise. A motion was made by Ald. Dobrowski, seconded by Ald. Czaplewski, that this matter be Recommended for Approval subject to the necessary requirement(s). Greenfield Ave., LLC, Thomas A. Miller, Agent, d/b/a Mykonos for premises at 8201 W. Greenfield Ave.(new-existing location). Appearance by Thomas A. Miller. Chair Kopplin questioned Mr. Miller on the status of the business and stated that he is still receiving complaints regarding the vacant building. Mr. Miller informed the Committee that he has applied for transfer of the liquor license to 7240 W. Greenfield with the intention of opening a banquet facility. He added that he currently has a prospective buyer for the 8201 W. Greenfield Ave. location, but they are waiting to hear if a hotel will be constructed at the Fair Park. Ald. Sengstock questioned Mr. Miller on the Building & Zoning status of the 8201 W. Greenfield Ave. property. Mr. Miller stated he is in the process of cleaning up the property and that a reinspection is scheduled for July 1, 2006. 30. 2006-0091 2005-2006 Class B Tavern License renewal appl. no. 127 of 8201 W. Greenfield Ave., LLC, Thomas A. Miller, Agent, d/b/a Mykonos for premises at 8201 W. Greenfield Ave. Appearance by Thomas A. Miller. See Legislative File no. 2004-0620. 31. 2006-0352 2006-2007 Class B Tavern License renewal application no. 990 of 8201 W. Greenfield LLC, Thomas A. Miller, Agent, d/b/a Mykonos for premises located at 8201 W. Greenfield Ave. Appearance by Thomas A. Miller. See Legislative File no. 2004-0620. 32. 2006-0090 2005-2006 Class B Tavern License renewal application no. 100 of Frank L. Altenbach, d/b/a Steel Horse for premises at 6215 W. National Ave. Appearance by Frank L. Altenbach. Ald. Sengstock questioned Mr. Altenbach regarding the status of the property. Mr. Altenbach stated that he may sell the property otherwise, he may consider some financial reorganization and reopen. Ald. Czaplewski stated that the property has been vacant since July 2005 and would require a special use permit in order to reopen. The Committee requested this item be held and referred to the City Attorney's office for direction. See Legislative File no. 2006-0353. 34. 2006-0389 Police Department Report involving Dopp's Tavern, 1022 S. 60 St. (2005-2006 Class B Tavern License no. 86, Dance Hall License no. 63, Instrumental Music License no. 29 and Cigarette License no. 38 of Doppleganger's, Inc., Tammy Dopp, Agent, Incident Date: April 5, 2006). Appearance by Tammy L. Dopp. Ald. Czaplewski stated that there has been an increase in problems at this location and reminded Ms. Dopp that the police need to be called. Ms. Dopp stated that she is aware of the problems and does not serve those causing problems. This Matter was Recommended to be Placed on File on a Block Vote. 35. 2006-0390 Police Department Report involving Dopp's Tavern, 1022 S. 60 St. (2005-2006 Class B Tavern License no. 86, Dance Hall License no. 63, Instrumental Music License no. 29 and Cigarette License no. 38 of Doppleganger's, Inc., Tammy Dopp, Agent, Incident Date: April 9, 2006) Appearance by Tammy L. Passed The Block Vote Aye: 4- Kopplin, Sengstock, Czaplewski, and Dobrowski No: 0 37. 2006-0391 Police Department Report involving Dicken's Bar & Grill, 9646 W. Greenfield Ave. (2005-2006 Class B Tavern License no. 35, Dance Hall License no. 25, Instrumental Music License no. 12 and Cigarette License no. 74 of R&D Krueger Enterprises, Inc., Diane M. Krueger, Agent, Incident Date: April 13, 2006). Appearance by Diane M. and Rick Krueger. Ms. Krueger stated that this has been the only violation this past year. Lt. Novy stated that the employees at this location are very cooperative. A motion was made by Ald. Sengstock, seconded by Ald. Dobrowski, that this matter be Recommended to be Placed on File.
