Weigel Tuesday, September 25, 2018 6:00 PM City Hall, Room 128 7525 W. Greenfield Ave. REGULAR MEETING A. CALL TO ORDER The meeting was called to order by Chair Czaplewski at 6:00 p.m. B. ROLL CALL Present 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Weigel Others present: Keith P. Randolph, Eric G. Millard, Mykel A. Key, Ricky E. Sergeant, Juan M. Ortiz, Steven A. Braatz, Jr., City Clerk, Nicholas Cerwin, Assistant City Attorney and Ann Marie Neff, Secretary to the Committee. C. APPROVAL OF MINUTES 1. 2018-0748 Minutes (draft) of the License & Health regular meeting of August 28, 2018, recess meetings of September 4, 2018 and September 18, 2018. Attachments: 082818 LH Minutes (draft) 090418 LH recess Minutes (draft) 091818 LH recess Minutes (draft) A motion was made by Ald. Weigel, seconded by Ald. Roadt, to approve the minutes of the regular meeting of August 28, 2018 and recess meetings of September 4, 2018 and September 18, 2018. The motion carried unanimously. D. NEW AND PREVIOUS MATTERS 2. 2018-0730 Police Department Report involving Boosters West, 7731 W. Becher St., of Boosters West LLC, Keith P. Randolph, Agent, Incident Date: August 28, 2018. Appearance by Keith P. Randolph. Discussion ensued regarding the police report. The Committee questioned how long the patron was in the establishment and how many drinks he had in during that time. Mr. Randolph explained that the bartender stopped serving the patron and drove him home but the patron drove back to the bar. It is uncertain if the patron was under the influence of other substances. The Committee stated the bartender was very cooperative and was even able to supple the camera footage of the evening. Mr. Randolph stated his video system is very good and he has assisted the police department with several cases with the video he has been able to supply. A motion was made by Ald. Weigel, seconded by Ald. May, that this matter was Recommended to be Placed on File. Millard, Agent, d/b/a Red, White and Brews, for the premises located at 7127 W. National Ave. (new-existing location). Appearance by Eric G. Millard. A motion was made by Ald. Weigel, seconded by Ald. May, that this matter was Recommended for Approval subject to the necessary requirement(s). The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Weigel No: 0 4. 2018-0733 2018-2019 Operator’s License (bartender/sales clerk) application no. 19-503 of Angela M. Crisci. Nonappearance of Angela M. Crisci. Ms. Crisci did not contact the Clerk's Office. The Committee requested she be ordered to appear at the next scheduled License & Health meeting. This matter was Held 5. 2018-0737 2018-2019 Operator’s License (bartender/sales clerk) application no. 19-512 of Mykel A. Key. Appearance by Mykel A. Key. Discussion ensued regarding Ms. Key’s background report and her lack of disclosure for violations. Ms. Key admitted to driving to the meeting on suspended license. The Committee reminded Ms. Key that there are other transportation options she could use. A motion was made by Ald. Haass, seconded by Ald. Roadt, that this matter was Recommended for Denial based on the applicants substantial and repeated failure to comply with the state laws for having a Driver's License which substantially relates to the applicant’s inability to comply with State liquor laws and licensing requirements. Additionally, the applicant informed the committee that she had driven to the meeting with a suspended or revoked driver’s license which shows a lack to overcome her disregard for state licensing requirements or penalties. The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Weigel No: 0 6. 2018-0742 2018-2019 Operator’s License (bartender/sales clerk) application no. 19-514 of Steven M. Breiling. Nonappearance of Steven M. Breiling. Mr. Breiling did not contact the Clerk's Office. The Committee requested he be ordered to appear at the next scheduled License & Health meeting. Second nonappearance of Cyle Ann Kraft. Ms. Kraft did not contact the Clerk’s Office. The Committee Recommended denial based on two (2) nonappearances. A motion was made by Ald. Weigel, seconded by Ald. May, that this matter was Recommended for Denial based on two (2) nonappearances. The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Weigel No: 0 8. 2018-0634 2018-2019 Operator’s License (bartender/sales clerk) application no. 19-483 of Nicholas R. Greenhalgh. Second nonappearance of Nicholas R. Greenhalgh. Mr. Greenhalgh did not contact the Clerk’s Office. The Committee Recommended denial based on two (2) nonappearances. A motion was made by Ald. May, seconded by Ald. Roadt, that this matter was Recommended for Denial based on two (2) nonappearances. The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Weigel No: 0 9. 2018-0659 2018-2019 Class B Tavern License application no. 2608, Instrumental Music License application no. 2610, Dance Hall License application no. 2609, of Mario P. Morgese, d/b/a Weekends Bar & Hall, for the premises located at 1900 S. 60 St. (new-nonexisting location). A motion was made by Ald. Weigel, seconded by Ald. Haass, that this matter was Recommended for Denial based on history of violations at the premises. The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Weigel No: 0 E. MATTERS FOR DISCUSSION/ACTION 10. 2018-0688 Discussion regarding 2018-2019 Class B Tavern, Combination Class A Liquor, Class B Beer and Class C Wine Licenses not yet issued as of 10-23-18. Attachments: 2018-2019 as of 8/28/18 licenses not issued 2018-2019 as of 9/25/18 licenses not issued 2018-2019 as of 10/16/18 licenses not issued 1. Natty Oaks Pub & Eatery, 11505 W. National Ave., Joseph Lee Griese, Agent Nonappearance of Joseph Lee Griese. Mr. Griese did not contact the Clerk's Office. The Committee requested he be ordered to appear at the next scheduled License & Health meeting. 2. New Asian Supermarket, 10704 W. Oklahoma Ave., Jun Guo Xiao, Agent Nonappearance of Jun Guo Xiao. Mr. Xiao did not contact the Clerk's Office. The Network, 9541 W. Cleveland Ave., Jacob M. Silber, Agent Nonappearance of Jacob M. Silber. Mr. Silber met the requirements to have his Class B Tavern License issued. 4. Sarge’s Corner, 1979 S. 54 St., Ricky E. Sergeant, Agent Appearance by Ricky E. Sergeant. Mr. Sergeant commented he had called the WI Department of Revenue several times to get his Wisconsin Business Tax Registration Certificate sent to him. When asked about his home address, Mr. Sergeant asked that all future mailings be sent to the licensed establishment address. 5. Vani’s Kitchen, 10535 W. Greenfield Ave., Vigneshwar Bhadharla, Agent. Nonappearance of Vigneshwar Bhadharla. Mr. Bhadharla did not contact the Clerk's Office. The Committee requested he be ordered to appear at the next scheduled License & Health meeting. 6. Chilango Express, 7030 W. Lincoln Ave., Juan M. Ortiz, Agent Appearance by Juan M. Ortiz. Mr. Ortiz informed the Committee that the building is still being remodeled and is aiming for an opening date in sixty (60) days. The Committee asked Mr. Ortiz to report back if he is not open by then. This matter was Held 11. 2018-0761 Discussion and possible action on guidelines to address Class B establishments habitually serving or selling to intoxicated or bordering on intoxicated persons Discussion ensued regarding how often the police reports reference a party being extrememly intoxicated. This matter was Discussed and Consensus Given F. ADJOURNMENT A motion was made by Ald. Haass, seconded by Ald. May, to adjourn at 6:48 p.m. The motion carried unanimously.
