APPROVAL OF MINUTES 1. 2020-0152 Minutes (draft) of the License & Health regular meeting of January 28, 2020, recess meetings of February 4, 2020 and February 19, 2020 Attachments: 012820 LH Minutes (draft) 020420 LH recess Minutes (draft) 021920 LH recess Minutes (draft) A motion was made by Ald. Haass, seconded by Ald. Roadt, to approve the minutes of the regular meeting of January 28, 2020, recess meetings of February 4, 2020, and February 19, 2020. The motion carried unanimously. D. NEW AND PREVIOUS MATTERS 2. R-2020-0100 Resolution of the Common Council of the City of West Allis directing staff to prepare a plan for the future of the West Allis Senior Center by working with community partners and Commission on Aging Sponsors: Alderperson Czaplewski Mark Tiegs, Commission on Aging, spoke on behalf of all attendees for this matter, Mr. Tiegs read a proposed change to the Resolution and gave data and statistics on the Senior Center and its users. Carol Graham, gave a description of what a Stock Box is, what is commonly in the Stock Boxes, and the people that benefit from this service. This matter was Held. Rusniak, Agent, d/b/a The Crooked Crow, 1309 S. 60 St. (new-existing location) Appearance by Taylor P. Rusniak and Christopher J. Trudeau. Discussion ensued regarding experience Mr. Rusniak has had in running an alcohol business and what is still needed to finalize the purchase of the building. A motion was made by Ald. Weigel, seconded by Ald. Roadt, that this matter be Recommended for Approval subject to the necessary requirement(s). The motion carried unanimously. 4. 2020-0032 Police Department Report involving Mis Sueños, 7335 W. Greenfield Ave., of Mis Sueños, LLC, Deborah Ann Ramirez, Agent, Incident Date: December 14, 2019 Nonappearance by Deborah Ann Ramirez. Ald. Weigel stated he spoke with Ms. Ramirez regarding the incident and no appearance was required. A motion was made by Ald. Roadt, seconded by Ald. May, that this matter be Recommended to be Placed on File. The motion carried unanimously. 6. 2020-0132 2019-2021 Operator’s License (bartender/sales clerk) application of Salvatore M.J. D’Acquisto Appearance by Salvatore M.J. D’Acquisto. Discussion ensued regarding Mr. D’Acquisto's police report and his rehabilitation. A motion was made by Ald. Weigel, seconded by Ald. Roadt, that this matter be Recommended For Approval based upon competent evidence of rehabilitation. The motion carried unanimously. 8. 2020-0133 2019-2021 Operator’s License (bartender/sales clerk) application of Rebecca L. Maddison Appearance by Rebecca L. Maddison. Discussion ensued regarding Ms. Maddison's police report and her rehabilitation. A motion was made by Ald. Haass, seconded by Ald. May, that this matter be Recommended For Approval based upon competent evidence of rehabilitation. The motion carried unanimously. 9. 2020-0134 2019-2021 Operator’s License (bartender/sales clerk) application of Joseph P. Pape Appearance by Joseph P. Pape. Discussion ensued regarding Mr. Pape's police report and his rehabilitation. A motion was made by Ald. May, seconded by Ald. Haass, that this matter be Recommended For Approval based upon competent evidence of rehabilitation. The motion carried unanimously. 10. 2020-0131 2019-2021 Operator’s License (bartender/sales clerk) application of Joede K. Polezynski Appearance by Joede K. Polezynski. Discussion ensued regarding Mr. Polezynski's police report and his rehabilitation. A motion was made by Ald. May, seconded by Ald. Haass, that this matter be Recommended For Approval based upon competent evidence of rehabilitation. The motion carried unanimously. City of West Allis Page 2 Printed on 3/31/2020 License & Health Committee Meeting Minutes February 25, 2020 11. 2020-0044 Application for Transfer of License from Premises to Premises of 2019-2020 Combination Class A Liquor License of State Fair Liquor & Food, Inc., Pabitra Halder, Agent, d/b/a State Fair Liquor & Food Mart, from 1568 S. 81 St. to 2248 S. 108 St. Attachments: State Fair Liquor Transfer AFFIDAVIT OF PUBLICATION - 2020-0044 State Fair Liquor Transfer 0003993001 Appearance by Pabitra Halder. Mr. Halder was aware the Special Use was denied and therefore this transfer could not be approved. The Committee informed him if he found a suitable location they were not opposed to him transfering the license. This matter was Recommended to be Placed on File based on the Special Use Permit being denied. The motion carried unanimously. 12. 2020-0147 Police Department Report regarding tavern violations/calls for service for the month of January 2020 A motion was made by Ald. May, seconded by Ald. Roadt, that this matter be Recommended to be Placed on File. The motion carried unanimously. 13. 2020-0148 Police Department Report involving The Spot, 6426 W. Greenfield Ave., Edward Bomback and Lonnie Bald, Partners, Incident Date: January 9, 2020 This matter was Recommended to be Placed on File on a Block Vote. 14. 2020-0149 Police Department Report involving El Sagitario BNC, 907 S. 84 St. of El Sagitario BNC LLC, Pascual Ramos, Agent, Incident Date: January 26, 2020 This matter was Recommended to be Placed on File on a Block Vote. 15. 2020-0150 Police Department Report involving Dingers, 6139 W. Beloit Rd., of Victory Hospitality Group, Steven P. Miick, Agent, Incident Date: January 3, 2020 This matter was Recommended to be Placed on File on a Block Vote. Kosidowski, Agent, Incident Date: December 29, 2019 The Committee requested Mr. Kosidowski be asked to appear at the next License & Health Committee meeting regarding this incident. This matter was Held. 17. 2020-0061 Police Department Report involving The Alibi, 6540 W. Grant St., Alibi Taverns LLC, Melissa M. Bayer, operator (bartender/sales clerk) 2019-2021 license no. 8381, Incident Date: December 29, 2019 A motion was made by Ald. May, seconded by Ald. The motion carried unanimously. 19. 2017-0753 Communication from Building Inspections and Neighborhood Services Department regarding an update on inspections for the Gun Range License renewal application for the premise located at 2465 S. 84 St. Attachments: Com. update on 2465 S. 84 St. This matter was Recommended to be Placed on File on a Block Vote. 20. 2019-0420 Communication from Assistant City Attorney regarding list of licensed/permitted businesses with delinquent personal property taxes: dated June 5, 2019 Attachments: CA comm re PPT Non-payment Ltr 2018 This matter was Recommended to be Placed on File on a Block Vote. Passed The Block Vote A motion was madeby Ald. May, seconded by Ald. Weigel, to approve all the actions on item nos. 19-20 on a Block Vote. The motion carried unanimously. 5. 2020-0128 2019-2021 Operator’s License (bartender/sales clerk) application of Julio A. Crespo, Jr. Nonappearance of Julio A. Crespo, Jr. Mr. Crespo did not respond to the letter mailed to him to allow him an appearance before the License & Health Committee to appeal the Committee's January 28, 2020 recommendation for denial. This matter was Recommended for Denial based on the record being substantially related to the licensed activity and the applicant's failure to provide competent evidence of rehabilitation on a Block Vote. 7. 2020-0129 2019-2021 Operator’s License (bartender/sales clerk) application of Ashley M. Kiel Nonappearance of Ashley M. Kiel. Ms. Kiel did not respond to the letter mailed to her to allow her an appearance before the License & Health Committee to appeal the Committee's January 28, 2020 recommendation for denial. This matter was Recommended for Denial based on the record being substantially related to the licensed activity and the applicant's failure to provide competent evidence of rehabilitation on a Block Vote. Passed The Block Vote A motion was madeby Ald. Haass, seconded by Ald. Roadt, to approve the actions on item nos. 5-7 on a Block Vote.The motion carried unanimously. E. The Committee asked City Attorney Decker to prepare a presentation. 22. 2019-0878 Discussion relative to general guidelines for reviewing license application background checks and the steps for approval or appearance Attachments: License Guidelines Discussion ensued regarding finalizing the criteria to be used when the City Clerk is referring license applications to the Committee for review. 23. 2020-0076 Review of license applicant background checks for consideration of possible approval or denial License & Health Committee recommended approval of the following applicants. St Louis, Jessica N. 24. 2020-0163 Discussion regarding rescheduling the March 24, 2020 regular License & Health Committee meeting Discussion ensued regarding moving the date of the next License & Health Committee meeting to Wednesday, March 11, 2020, at 6:00 pm in the Art Gallery. F. ADJOURNMENT A motion was made by Ald. Roadt, seconded by Ald. Haass, to adjourn at 7:57 p.m. The motion carried unanimously.
