Weigel Wednesday, March 11, 2020 6:00 PM City Hall, Art Gallery 7525 W. Greenfield Ave. SPECIAL MEETING A. CALL TO ORDER The meeting was called to order by Chair Czaplewski at 6:00 p.m. B. ROLL CALL Present 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Weigel Others present: Alexandrea C. Jackson, Karen M. Fischer, Dannielle E. Klinter, Nicholas Cerwin, Assistant City Attorney and Ann Marie Neff, Secretary to the Committee. C. APPROVAL OF MINUTES 1. 2020-0197 Minutes (draft) of the License & Health regular meeting of February 25, 2020, and recess meeting of March 3, 2020 Attachments: 030320 LH recess Minutes (draft) A motion was made by Ald. Roadt, seconded by Ald. May, to approve the minutes of the regular meeting of February 25, 2020, and recess meeting of March 3, 2020. The motion carried unanimously. D. NEW AND PREVIOUS MATTERS 2. 2020-0034 Police Department Report involving The Alibi, 6540 W. Grant St., Alibi Taverns LLC, Patrick R. Kosidowski, Agent, Incident Date: December 29, 2019 Nonappearance by Patrick R. Kosidowski. Mr. Kosidowski did not contact the Clerk's Office. A motion was made by Ald. Weigel, seconded by Ald. Roadt, that this matter be Referred to the City Attorney for Summons and Complaint. The motion carried unanimously. 3. 2020-0198 2019-2020 Adult-Oriented Establishment Operator Permit application of Alexandrea C. Jackson Appearance by Alexandrea C. Jackson. Discussion ensued regarding Ms. Jackson's police report and her rehabilitation. A motion was made by Ald. Haass, seconded by Ald. May, that this matter be Recommended For Approval based upon competent evidence of rehabilitation. The motion carried unanimously. Fischer Appearance by Karen M. Fischer. Discussion ensued regarding Ms. Fischer's police report and her rehabilitation. A motion was made by Ald. Haass, seconded by Ald. May, that this matter be Recommended For Approval based upon competent evidence of rehabilitation. The motion carried unanimously. 5. 2020-0200 2019-2021 Operator’s License (bartender/sales clerk) application of Melissa J. Hernke Nonappearance of Melissa J. Hernke. Ms. Hernke contacted the Clerk's Office. Upon closer review it was discovered Ms. Hernke had already appeared regarding the items of concern in the police report. A motion was made by Ald. Haass, seconded by Ald. Weigel, that this matter be Recommended For Approval. The motion carried unanimously. 6. 2020-0201 2019-2021 Operator’s License (bartender/sales clerk) application of Dannielle E. Klinter Appearance by Dannielle E. Klinter. Discussion ensued regarding Ms. Klinter's police report and rehabilitation and steps to have her Driver's License reinstated. Ms. Klinter admitted to the Committee that she drove to the meeting with a revoked Driver's License. A motion was made by Ald. Haass, seconded by Ald. Czaplewski for approval. The motion failed by the following vote: Aye: 2 - Ald. Czaplewski, and Ald. Haass No: 1 - Ald. May, Ald. Roadt, and Ald. Weigel A motion was made by Ald. Weigel, seconded by Ald. Roadt, that this matter be Recommended for Denial based on the applicant's failure to provide competent evidence of rehabilitation by driving with a revoked driver's license. The motion carried by the following vote: Aye: 3- Ald. Roadt, Ald. May, and Ald. Weigel No: 2- Ald. Czaplewski, and Ald. Haass 7. 2020-0202 2019-2021 Operator’s License (bartender/sales clerk) application of Jennifer M. Munson Nonappearance of Jennifer M. Munson. Ms. Munson contacted the Clerk's Office. Upon closer review it was discovered Ms. Munson had already appeared regarding the items of concern in the police report. A motion was made by Ald. Haass, seconded by Ald. Roadt, that this matter be Recommended For Approval. The motion carried unanimously. Ott Nonappearance of Shelby L. Ott. Ms. Ott did not respond to the letter mailed to her to allow her an appearance before the License & Health Committee to appeal the Committee's February 25, 2020 recommendation for denial. A motion was made by Ald. Haass, seconded by Ald. May, that this matter be Recommended for Denial based upon the record being substantially related to the licensed activity and the applicant's failure to provide competent evidence of rehabilitation. The motion carried unanimously. 9. 2020-0204 2019-2021 Operator’s License (bartender/sales clerk) application of Jessica N. St. Louis Nonappearance of Jessica N. St. Louis. Ms. St. Louis contacted the Clerk's Office. The Committee requested she be ordered to appear at the next scheduled License & Health Committee meeting. This matter was held. 10. 2019-0954 Summons and Complaint in the matter of the complaint against Lele’s Whiskey Corner, LLC, Erwin Magritz, Agent, for the premises located at 1309 S. 60 St., d/b/a Remedy Bar (2019-2020 Combination Class B Alcohol License No. 1733) Attachments: S&C Lele's Whiskey Corner, Remedy Bar (Erwin Magritz) This matter was Recommended to be Placed on File on a Block Vote. 11. 2019-0578 Police Department Report involving Remedy Bar, 1309 S. 60 St., of LeLe's Whiskey Corner, LLC, Erwin C. Magritz, Agent, Incident Date: July 11, 2019 This matter was Recommended to be Placed on File on a Block Vote. 12. 2019-0579 Police Department Report involving Remedy Bar, 1309 S. 60 St., of LeLe's Whiskey Corner, LLC, Erwin C. Magritz, Agent, Incident Date: July 19, 2019 This matter was Recommended to be Placed on File on a Block Vote. 13. 2019-0751 Police Department Report relative to the September 8, 2019 Tavern compliance checks involving eleven (11) West Allis businesses, resulting in two (2) violations, Lele’s Whiskey Corner, LLC, Erwin Magritz, Agent, d/b/a Remedy Bar, premises located at 1309 S. 60 St. This matter was Recommended to be Placed on File on a Block Vote. 14. 2019-0948 Police Department Report involving Remedy Bar, 1309 S. 60 St., of LeLe's Whiskey Corner, LLC, Erwin C. Magritz, Agent, Incident Date: November 20, 2019 This matter was Recommended to be Placed on File on a Block Vote. Passed The Block Vote A motion was madeby Ald. Haass, seconded by Ald. May, to approve the actions on item nos. 10-14 on a Block Vote. The motion carried unanimously. MATTERS FOR DISCUSSION/ACTION 15. 2020-0205 Review of license applicant background checks for consideration of possible approval or denial License & Health Committee recommended approval of the following applicants. Operator's (bartender/sales clerk) License applications 2019-2021: Torres, Maritsa License & Health Committee recommended denial of the following applicants. The Clerk's Office was directed to send a letter allowing the applicant an opportunity to appear before the License & Health Committee to show competent evidence of rehabilitation. Operator’s (bartender/sales clerk) License applications 2019-2021: Dombrowski, Dean R. Gonzalez, Teresa M. Halstead, Samantha N. Rivera, Nicole A. Discussed and Consensus Given. F. ADJOURNMENT A motion was made by Ald. May, seconded by Ald. Roadt, to adjourn at 6:45 p.m. The motion carried unanimously.
