CALL TO ORDER The meeting was called to order by Chair Vitale at 6:05 p.m. B. ROLL CALL Present 5- Vitale, Grisham, Reinke, Roadt, and Stefanski Others present: Neal A. Steffek, Peter D. Bergland, Nicholas Cerwin, Assistant City Attorney, Rebecca Hammock, Assistant City Attorney, and Ann Marie Neff, Secretary to the Committee. C. The motion carried unanimously. C. HEARING Assistant City Attorney presented a stipulation agreed upon by Mr. Steffek. Additional questions were answered. At 6:11 p.m. a motion was made by Grisham, seconded by Steffanski, to convene in closed session. The motion carried unanimously. Upon conclusion of the closed session at 6:29 p.m., the License and Health Committee reconvened in open session. Steffek, Agent, for the premises located at 1902 S. 68 St., d/b/a The Drunk Uncle (2019-2020 Combination Class B Tavern License No. 2080) Attachments: Steffek LLC Summons and Complaint.final Affidavit of Service License and Health hearing guide Steffek 9-14-20 The License & Health Committee Recommended Approval of the 2020-2021 Class B Tavern License application and with the stipulation of a seven (7) day closure to be completed by December 31, 2020. A motion was made by Grisham, seconded by Stefanski, that this matter was Recommended to be Placed on File with the Approval of the Class B Tavern License and the stipulation of a seven (7) day closure to be completed by December 31, 2020. The motion carried by the following vote: Aye: 5- Vitale, Grisham, Reinke, Roadt, and Stefanski No: 0 D NEW AND PREVIOUS MATTERS 2020-0642 2020-2022 Operator’s License (bartender/sales clerk) application of Nicole J. Nowak Nonappearance of Nicole J. Nowak. Ms. Nowak responded to the letter mailed to her to allow her an appearance before the License & Health Committee. Ms. Nowak did not appear or contact the Clerk's Office regarding her absence to appeal the Committee's recommendation for denial on September 8, 2020 based on the applicant’s record having violations that are substantially related to the licensed activity. A motion was made by Grisham, seconded by Reinke, that this matter be Recommended for Denial. The motion carried unanimously. 2020-0639 2020-2022 Operator’s License (bartender/sales clerk) application of Sheila M. Dahms Nonappearance of Sheila M. Dahms. Ms. Dahms did not respond to the letter mailed to her to allow her a second appearance before the License & Health Committee to appeal the Committee's June 25, 2020 recommendation for denial based on the applicant's record having violations that are substantially related to the licensed activity. A motion was made by Grisham, seconded by Reinke, that this matter be Recommended for Denial. The motion carried unanimously. 2020-0641 2020-2022 Operator’s License (bartender/sales clerk) application of Peter D. Bergland Appearance by Peter D. Bergland. A motion was made by Roadt, seconded by Grisham, that this matter be Recommended For Approval. The motion carried unanimously. Bahr Nonappearance of Jamie L. Bahr. Jamie Bahr did not respond to the letter mailed to allow an appearance before the License & Health Committee to appeal the Committee's August 4, 2020 recommendation for denial based on the applicant's record having violations that are substantially related to the licensed activity. This matter was Recommended for Denial on a Block Vote. 2020-0643 2020-2022 Operator’s License (bartender/sales clerk) application of Cassandra L. Piotrowski Nonappearance of Cassandra L. Piotrowski. Ms. Piotrowski did not respond to the letter mailed to allow an appearance before the License & Health Committee to appeal the Committee's August 4, 2020 recommendation for denial based on the applicant's record having violations that are substantially related to the licensed activity. This matter was Recommended for Denial on a Block Vote. 2020-0644 2020-2022 Operator’s License (bartender/sales clerk) application of Sudeidy V. Roman Nonappearance of Sudeidy V. Roman. Sudeidy V. Roman did not respond to the letter mailed to allow an appearance before the License & Health Committee to appeal the Committee's August 4, 2020 recommendation for denial based on the applicant's record having violations that are substantially related to the licensed activity. This matter was Recommended for Denial on a Block Vote. Passed The Block Vote A motion was madeby Stefanski, seconded by Grisham, to approve all the actions on legistar file nos. 2020-0640, 2020-0643, and 2020-0644 on a Block Vote. The motion carried unanimously. 2020-0614 Police Department Report regarding tavern violations/calls for service for the month of August 2020 Attachments: August 2020 Tavern Report A motion was made by Grisham, seconded by Stefanski, that this matter be Recommended to be Placed on File. The motion carried unanimously. 2020-0646 Review of license applicant background checks for consideration of possible approval or denial License & Health Committee recommended approval of the following applicants for the next Common Council meeting. 2020-2021 Used Vehicle Dealer license application: Churchill, Kenneth D. A motion was made by Grisham, seconded by Roadt, that this matter be Recommended to be Placed on File. The motion carried unanimously. F. Should a quorum of Common Council members appear at this Committee meeting, a regular Common Council meeting may take place for the purposes of gathering information on an item listed on the Committee agenda. Should such a meeting occur, the date, time and location of the Common Council meeting will be that of the License & Health Committee as listed on the License & Health Committee agenda.
