City of West Allis Meeting Minutes License & Health Committee Alderperson Vincent Vitale, Chair Alderperson Suzzette Grisham, Vice-Chair Alderpersons: Rosalie L. Reinke, Daniel J. Roadt, and Tracy Stefanski Monday, October 26, 2020 6:00 PM Room 128 7525 W. Greenfield Ave. SPECIAL MEETING - HEARINGS A. CALL TO ORDER The meeting was called to order by Chair Vitale at 6:00 p.m. B. ROLL CALL Present 4- Vitale, Grisham, Reinke, and Roadt Excused 1- Stefanski Others present: David Zarate, Atty. Brad Dagen, Henry Bruno, Patricia Zarate, Tina M. Minto, Officer Jacob Kaye, Claudia Martorano, Officer Jesse Maxwell, Nicholas Cerwin, Assistant City Attorney, Rebecca Hammock, Assistant City Attorney, and Ann Marie Neff, Secretary to the Committee. C. APPROVAL OF MINUTES 2020-0743 Minutes (draft) of the License & Health Committee special meeting of September 22, 2020, recess meetings of October 6, 2020, and October 20, 2020 A motion was made by Grisham, seconded by Reinke, that this matter be Approved. The motion carried unanimously. D. HEARING & CLOSED SESSION In the matter of Z's Bar, LLC. Appearance by David Zarate, Patricia Zarate, Henry Bruno, and Atty. Brad Dagen. Atty. Dagen informed the Committee and Attys. Cerwin and Hammock that his client denies some of the allegations in the Complaint. The Committee asked questions to clarify the issues being contested. Ald. Reinke made a motion, seconded by Ald. Grisham, to go into closed session after the next hearing (legislative file no. 2020-0537), In the matter of MINTOT, LLC. A Hearing was conducted with the following: Tina M. Minto, Claudia Martorano, Officer Jacob Kaye, Officer Jesse Maxwell, Assistant City Attorney, Nicholas Cerwin, Assistant City Attorney Rebecca Hammock, and members of the License & Health Committee. During the complainant’s presentation for the hearing, testimony was provided by Claudia Martorano, Officer Jacob Kaye, Officer Jesse Maxwell, and Tina M. Minto. During the licensee’s presentation for the hearing, testimony was provided by Tina M. Minto. Tina M. Minto did not call or request any additional witnesses to present testimony. City of West Allis Page 1 Printed on 12/9/2020 License & Health Committee Meeting Minutes October 26, 2020 A motion was made by Roadt, seconded by Grisham, to convene in closed session at 8:00 p.m. The motion carried unanimously. Upon conclusion of the closed session at 8:30 p.m., the License & Health Committee reconvened in open session to consider its public agenda. E. NEW AND PREVIOUS MATTERS 2020-0536 Summons and Complaint in the matter of the complaint against Z’s Bar, LLC, David Zarate, Agent, for the premises located at 6309 W. National Ave., d/b/a Z’s Bar (2020-2021 Class B Tavern License No. 2256) The Committee advised Atty. Dagen and Mr. Zarate that a Hearing will be scheduled in the matter of the Complaint against Z's Bar LLC so that all parties will have a chance to be heard. This matter was Held. 2020-0537 Summons and Complaint in the matter of the complaint against MINTOT LLC, Tina M. Minto, Agent, for the premises located at 5906 W. Burnham St., d/b/a TNT Sportz Bar (2020-2021 Class B Tavern License No. 2478) A motion was made by Grisham, seconded by Roadt that the allegations in the complaint are true. The Committee directs the City Attorney to prepare Findings of Fact and Committee Recommendation for a suspension of ten (10) days, beginning 6:00 a.m. December 2, 2020, thru 6:00 a.m. December 18, 2020. The motion carried by the following vote: Aye: 4 - Vitale, Grisham, Reinke, and Roadt No: 0 This matter was Held. 2020-0742 Review of license applicant background checks for consideration of possible approval or denial License & Health Committee recommended approval of the following applicants. Operator’s (bartender/sales clerk) License applications 2019-2021: Mattice, Anthony A. Sepulveda, Cecilia K. License & Health Committee recommended denial of the following applicants. The Clerk's Office was directed to send a letter allowing the applicant an opportunity to appear before the License & Health Committee to show competent evidence of rehabilitation. 2020-2022 Operator (bartender/sales clerk) Licenses: Brzezinski, Matthew D. Liban, Samantha M. Schluenz, Erica J. Reyes, Rebecca L. 2020-2021 Food Peddler Permit: Meyo Xique, Isaac City of West Allis Page 2 Printed on 12/9/2020 License & Health Committee Meeting Minutes October 26, 2020 A motion was made by Grisham, seconded by Reinke, to approve the recommendations of the License & Health Committee. The motion carried unanimously. F. ADJOURNMENT The meeting adjourned at 8:38 p.m. All meetings of the {bdName} are public meetings. In order for the general public to make comments at the committee meetings, the individual(s) must be scheduled (as an appearance) with the chair of the committee or the appropriate staff contact; otherwise, the meeting of the committee is a working session for the committee itself, and discussion by those in attendance is limited to committee members, the mayor, other alderpersons, staff and others that may be a party to the matter being discussed. ADJOURNMENT City of West Allis Common Council members may attend the above License & Health Committee meeting for information gathering purposes. Should a quorum of Common Council members appear at this Committee meeting, a regular Common Council meeting may take place for the purposes of gathering information on an item listed on the Committee agenda. Should such a meeting occur, the date, time and location of the Common Council meeting will be that of the License & Health Committee as listed on the License & Health Committee agenda.
