The rear easement is proposed to be reduced from 10 feet to 6 feet, as shown in the attached diagram. Process State code requires the city council to hold a public hearing and adopt an ordinance when granting changes to public utility easements. Analysis • The applicant has obtained the necessary approvals and clearances from affected utilities. • The required public notice has been completed. • Staff have reviewed the request and do not foresee any negative impacts to the city by reducing the requested easements. • A public hearing is scheduled as part of tonight’s meeting prior to adoption of the proposed Ordinance. Background Dan and Stefanie Anjewierden have submitted a building permit application to construct a new addition to the south side (rear) of the existing home. The total footprint of the new addition (1650 sf) compared to the existing home/footprint (1860 sf) calculates to an 88.81% increase in footprint area. City staff made the determination that WBMC 15.08.50 is applicable in this instance, and specifically WMBC 15.08.050.A.2, which requires public improvements when the area of the new addition home/footprint is greater than 50%. The Anjewierden’s are aware of the requirement to construct public improvements as a condition of a building permit. Their request is attached below. Rationale in favor of granting the deferment request: 1. 1200 N should be designed as a larger project from 1100 west to the turnaround at the west end of 1200 N. There is no existing curb, sidewalk, storm water pipe on 1200 N to connect to. a. There is a large open ditch along their frontage that will need to be piped before curb and sidewalk can be installed. b. Project design would need to consider more than just the frontage of the Anjewierden property to design for curb, sidewalk, street widening, drainage, and utilities. Possible rational to deny the deferment request: 1. A deferment is an exception to the requirement. 2. Continuing to defer improvements delays the completion of full improvements in this area. 3. Calling deferment agreements due is often challenging for municipalities. Staff are supportive of granting this deferment. However, all parties should acknowledge that on- going infrastructure improvements and future connecting developments may warrant the construction of some or all of the deferred improvements in the not-so-distant future. Potential Motion: I make the motion that the city council finds that there are compelling reasons why the city’s interests are better served by deferring the construction of certain public improvements related to the residential property project at 1201 W 1200 N, and that the mayor is hereby authorized to execute the city’s standard Extension for Off-Site Improvements Agreement, subject to review by the city engineer and city attorney. 550 North 800 West, West Bountiful, UT 84087 (801) 292-4486 Request for deferral – Anjewierden Dear Kris Nilson, We are Dan and Stefanie Anjewierden. We live at 1201 W 1200 N and we are looking to add onto our home to continue to reside in West Bountiful. Our current home approx 2400 sqft between 2 levels and we are looking to add an attached garage, master suite, an additional main floor bathroom and a bonus room for our family. In making this large of an addition city code asks us to either make public improvements on the front of the property such as curb, sidewalk, and possibly a storm drain and/or other improvements. We are asking for permission to defer making these improvements at this time so we can keep the look of the neighborhood the same. None of our neighbors on 1200 N have these improvements made to their properties. 1200 N is also where the new West Bountiful shop is located and even it does not have these improvements as to fit in with the feel and look of the neighborhood. In conclusion we are asking for a deferral of installing these improvements at this time and ask that in doing so we may continue to obtain a building permit with the city for the addition to our home. Background In December of 1989, the city published a history book. Minutes from the time recount LeRue Hugoe reporting: “There are approximately 4,422 names in the book, 550 pages, and many pictures. Compiling this history has been a three-year project which incudes a summary of town minutes from 1948 through 1988 as well as a pioneer history written by Edith Deppe. Committee members on the project included: Streeper Wood, LeLand Argyle, Frank Hatch, Ellen Freestone, and Delbert Noble.” Initially, the city printed 1,500 copies at a cost of “between $15 and $20” per book. These original copies remained in supply for about 20 years, with the last remaining copies going out to the public in the early 2010s. Re-Print Options There is renewed interest in having the book available for public distribution. Solar Rectangular Rapid Flashing Beacon (RRFB) with Push Button Activation Staff has researched options related to flashing lights to alert drivers to pedestrians crossing the street. When used properly, the Federal Highway Administration (FHA) states that these beacons can increase motorists yielding rates up to 98%1. The FHA states that agencies: • Should reserve the use of RRFBs for locations with significant pedestrian safety issues, as over-use of RRFB treatments may diminish their effectiveness. • Should not use RRFBs for crosswalks across approaches controlled by YIELD signs, STOP signs, traffic control signals, or pedestrian hybrid beacons, except for the approach or egress from a roundabout. Recommendation: Based on the uniqueness of the nearby rail crossing, purchase a set of push button activated flashing beacons for the crosswalk on Pages Lane at 550 W for $2,499.98. This may require a General Fund budget amendment later in the year. 2. Study of 800 W 400 N Intersection In working to develop effective options for pedestrian safety improvements at this intersection, staff believes that the following data will be very useful: the number of vehicles traveling, the vehicles’ direction, time of day use by vehicles, vehicle compliance with the stop signs, number of pedestrians, time of day use by pedestrians. To capture this data, staff has consulted with traffic engineers at Horrocks Engineering, and they have the ability to set up a camera system to capture this date. Recommendation: Consider an intersection study for $6,400 (see attached proposal). Admittedly, this is a significant amount of money. To enhance pedestrian conspicuity and increase driver awareness at uncontrolled, marked crosswalks, transportation agencies can install a pedestrian actuated Rectangular Rapid Flashing Beacon (RRFB) to accompany a pedestrian warning sign. RRFBs consist of two, rectangular- shaped yellow indications, each with a light-emitting diode (LED)-array-based light source.1 RRFBs flash with an alternating high frequency when activated to enhance conspicuity of pedestrians at the crossing to drivers. Scope of Work Data Collection Horrocks plans to collect traffic data using traffic cameras and tube counters at specific intersections within the study area. The aim is to monitor the volume of pedestrians using the 800 West & 400 North intersection, the volume of vehicle turn-movements, and stop sign compliance at the intersection. Pedestrian and turn movement counts will be taken for three (3) days (two weekdays and one weekend day) for 12 hours (7:00 AM - 7:00 PM). The tube counters will average daily traffic (ADT) on 800 West and 400 North for one consecutive week from midnight to midnight, subject to weather conditions and when school is in session. Final Deliverable Horrocks will provide a memo incorporating all traffic analyses and recommendations, including figures, tables, and required text to represent correct standards. Enterprises Inc. Background The city has two concrete projects currently budgeted: 1. Miscellaneous concrete replacement (repair) work throughout the city was combined for project purposes. The majority of the expected work will be to remove and replace damaged concrete sidewalk that constitutes trip hazards. This was budgeted for in Class C Roads (General Fund). The budget is for $75,000, which is split between concrete replacement and grinding. 2. New concrete work at the city park. The project will install concrete path around the new playground area and fill in gaps to connect the parking lot, playground, volleyball court and east concrete path, from east to west. This was budgeted for in the RAP Fund as part of the playground replacement. Quotes Staff put together both projects and sought quotes from several concrete contractors in the area. M.Y. Cat 926 Wheel Loader - $185,450 Background: Prior to 2020, for several years the city would purchase a new loader with a promised “buy-back” after one year, with this buy-back amount being higher than the original price. Around 2021, the buy-back program was discontinued, and new loaders became much harder to order based on supply-chain challenges. This explains why the city has held on to a 2020 Cat 938 loader. Staff recommends selling or trading-in the 2020 Cat 938 to 1. capture its value and avoid future maintenance costs, and 2. to acquire a slightly smaller model that will match the city’s needs better. The 2020 loader was purchased for $169,25.00, and the trade-in offer from Wheeler CAT is $200,000. The city could potentially capture more value if we sold it independently or at auction. He asked about the possibility of placing a crosswalk near the city park on Pages 51 Lane. 52 53 Alan Malan – 772 W 1400 N – Expressed his concerns on Ordinance 492-24, which would be 54 discussed later in the meeting. 55 56 57 4. Ordinance #492-24 – An Ordinance Enacting Title 9.05 of West Bountiful Municipal 58 Code Related to Local Emergencies. 59 60 Chief Erekson presented the ordinance to the city council. He explained that the proposed 61 ordinance outlines the statutory powers for the mayor or the emergency interim successor to 62 declare a state of local emergency in accordance with the state code. He also explained that it 63 was drafted based on codes in cities such as Salt Lake and Provo. Discussion on whether this 64 ordinance would overstep the State’s code took place, but it was determined that it would not. 65 66 MOTION: James Ahlstrom made a motion adopt Ordinance #492-24 – An Ordinance 67 Enacting Title 9.05 of West Bountiful Municipal Code Related to Local 68 Emergencies with 1. a correction in the first paragraph of 9.05.010 to add 69 the word “in” before “accordance with Utah Code Ann. § 53-2a-208”, and 70 2. moving the severability section from the enacting ordinance to the 71 codified portion. Master Agreement with Utah Department of Transportation for FrontRunner Strategic 79 Double-Track Project. 80 81 Duane presented the agreement and explained that this project is planned to add an additional 82 rail track for FrontRunner from the Woods Cross Station headed north beyond 1600 N. He 83 explained that UDOT recognizes that West Bountiful has water lines crossing the tracks at 84 500 South, 400 North, and 1000 North. While these lines may be deep enough that they are 85 not impacted, UDOT wants an agreement in place so that their design work can plan for any 86 potential conflicts. Council member Ahlstrom asked if the double track addition was the 87 extent of the project. Duane said the double tracks is the only project that will take place 88 within city limits. It was clarified that the new line is expected to be east of existing lines and 89 at this point the city is not aware of potential impacts on existing homes or residents. 90 91 92 MOTION: Jenn Nielsen made a motion to authorize the mayor to execute the Master 93 Agreement between West Bountiful City and UDOT. Staff Reports 105 106 Police – Brandon Erekson: 107 • Chief Erekson gave an update on the school drop off issue. The school district and the church 108 are currently working on contracts between the two parties for a drop-off location in the 109 church parking lot. 110 • Crosswalk enforcement will be a priority in the near future. 111 Public Works – Steve Maughan 112 • Water service line inventory is almost complete. 113 • A concrete contract has gone out to bid for miscellaneous work. 114 • Small playground at the city park is out for bid as well. A temporary fence will be placed 115 around the playground while it is under construction. 116 • Seal coat next week. Residents will not be able to drive on certain roads for 24 hours. 117 • Steet sweeping is underway in preparation for the seal coat. 118 • Parks are short staffed due to the seasonal workers going back to school. 119 Engineering - Kris Nilsen: 120 • Working on projects for next spring which include 660 W and 1100 W. 121 • 6 building permits for the South Davis Sewer District are being reviewed. 122 Administration – Duane Huffman 123 • Duane has looked into getting a new microphone for the podium. 124 • It is time to register for the Utah League of Cities and Towns fall conference in Salt Lake 125 City. 126 127 8.
