West Burlington Planning and Zoning Commission Meeting Minutes Wednesday, July 30, 2025 The West Burlington Planning and Zoning Commission met on Wednesday, July 30, 2025, at 5:30 p.m. at West Burlington City Hall, 122 Broadway Street, West Burlington, Iowa, with Chairman Karen Dewey presiding. MEMBERS PRESENT: Blake Ruther, Karen Dewey, Kathy Newberry, Joe Rector, Mike Davis, Sandy Lee, and Mary Storch MEMBERS ABSENT: ALSO PRESENT: City Clerk Kelly Fry CALL TO ORDER ROLL CALL PERFECTING & APPROVAL OF AGENDA Moved by Davis, seconded by Ruther, to approve the agenda as presented. Motion carried by the following votes: Ayes: Ruther, Dewey, Newberry, Rector, Davis, Lee, and Storch PERFECTING & APPROVAL OF MINUTES Consider approval of minutes from the Planning and Zoning meeting on April 17, 2025 NEW BUSINESS Consider Waiving the Preliminary and approving the Final Plat for First Addition to Schrock Subdivision The Planning and Zoning Commission reviewed a Final Plat for the proposed First Addition to Schrock Subdivision. This subdivision realigns and combines 3 of the existing lots at the end of Derek Lincoln Dr. The subdivision creates two lots. Lot 1 has the existing restaurant and Lot 2 will have all of the mini- storage units on one lot. The subdivider is asking that the Preliminary Plat requirements be waived for this simple replatting of lots. There were no objections to waiving the Preliminary Plat. The Commission found the final plat to be in accordance with the subdivision code regulations. Moved by Ruther, seconded by Lee, to recommend that City Council waive the Preliminary requirements and approve the Final Plat for First Addition to Schrock Subdivision. Motion carried by the following votes: Ayes: Ruther, Dewey, Newberry, Rector, Davis, Lee, and Storch Consider a request from M.J. Daly Construction to rezone Lots 104 and 105 Van Weiss Estates 2nd Sub from R-4 (Multi-Family Residential) to B-2 (General Business) The Commission received a formal request from MJ Daly Construction Co., Inc. to rezone the following parcels in the West Burlington Van Weiss States 2nd Subdivision from R-4 (Multi-Family Residential) to B-2 (General Business): Page 1 of 3 Page 2 of 7 Agenda Item #1. •WEST BURLINGTON VAN WEISS ESTATES 2ND SUB LT: S-30' OF E PT WALDON ST •WEST BURLINGTON VAN WEISS ESTATES 2ND SUB LT: 104 •WEST BURLINGTON VAN WEISS ESTATES 2ND SUB LT: 105 •WEST BURLINGTON VAN WEISS ESTATES 2ND SUB LT: 106 EXC N-PT & LOT 107 SE COR & N30' E PT WALDEN ST VAN WEISS EST 2ND PLATTING MJ Daly Construction Co. intends to develop the rezoned area into “Contractor Condos”—a type of commercial space that includes both office areas and storage facilities tailored for contractors. These units are designed to support small businesses by providing a centralized location for administrative work and secure storage for tools, equipment, and materials. The Commission considered the surrounding zoning, which consists of B-2 (General Business) to the south and I-1 (Industrial) across the street to the east. There would be one parcel to the north that is currently zoned R-4. The property at 707 W. Burlington Ave. has a single-family home on the lot. The Commission agreed they should consider including the remaining parcel in the rezoning. This would not affect the way the lot is used or taxed and would be appropriate to avoid a potential spot zoning situation. Moved by Rector, seconded by Storch, to set a public hearing date of August 14, 2025, at 5:30 p.m. to consider rezoning the following parcels in the West Burlington Van Weiss Estates 2nd Subdivision from R-4 (Multi-Family Residential) to B-2 (General Business):  WEST BURLINGTON VAN WEISS ESTATES 2ND SUB LT: S-30' OF E PT WALDON ST  WEST BURLINGTON VAN WEISS ESTATES 2ND SUB LT: 104  WEST BURLINGTON VAN WEISS ESTATES 2ND SUB LT: 105  WEST BURLINGTON VAN WEISS ESTATES 2ND SUB LT: 106 EXC N-PT & LOT 107 SE COR & N30' E PT WALDEN ST VAN WEISS EST 2ND PLATTING Motion carried by the following votes: Ayes: Ruther, Dewey, Rector, Davis, Lee, and Storch Abstained: Newberry Consider the Preliminary Plat for Autumn Hills Subdivision The Planning and Zoning Commission reviewed a Preliminary Plat for the proposed Autumn Hills Subdivision. This proposed subdivision would be located on Autumn Lane and consists of six (6) lots that will be used for single-family residential development. As part of the development, City water and sewer services will need to be extended to serve the proposed lots. The Public Works Department has reviewed the proposed construction plans for the extension of utilities along Autumn Lane. Moved by Storch, seconded by Dewey, to recommend that the City Council approve the Preliminary Plat and Preliminary Construction Plans for Autumn Hills Subdivison. Motion carried by the following votes: Ayes: Ruther, Dewey, Newberry, Rector, Davis, Lee, and Storch Discuss possible subdivision outside West Burlington city limits The Commission reviewed a sketch of a large subdivision located just outside of the city limits on N. Gear Ave. The developer is in the preliminary stages of the subdivision and is considering the possibility of voluntarily annexing into the city limits. MEMORANDUM To: Planning and Zoning Commission From: Kelly Fry, City Clerk Date: August 7, 2025 Subject: Public Hearing to Rezone Parcels Van Weiss Estates 2nd Subdivision The Planning and Zoning Commission will hold a public hearing on: Date: Thursday, August 14, 2025 Time: 5:30 p.m. Location: West Burlington City Hall, Council Chambers 122 Broadway Street, West Burlington, IA 52655 The purpose of the hearing is to consider a request from MJ Daly Construction Co., Inc. to rezone three vacant parcels in the Van Weiss Estates 2nd Subdivision from R-4 (Multi-Family Residential) to B-2 (General Business). These parcels include: • PARCEL# 10-36-328-018, DESCRIBED AS WEST BURLINGTON VAN WEISS ESTATES 2ND SUB LT: S-30' OF E PT WALDON ST • PARCEL#10-36-328-005, DESCRIBED AS WEST BURLINGTON VAN WEISS ESTATES 2ND SUB LT: 104 • PARCEL#10-36-328-006, DESCRIBED AS WEST BURLINGTON VAN WEISS ESTATES 2ND SUB LT: 105 To avoid spot zoning, the Commission agreed to include a fourth parcel in this area—PARCEL# 10- 36-328-002, DESCRIBED AS WEST BURLINGTON VAN WEISS ESTATES 2ND SUB LT: 106 EXC N-PT & LOT 107 SE COR & N30' E PT WALDEN ST VAN WEISS EST 2ND PLATTING (707 W. Burlington Avenue) —which is currently developed with a single-family residence and also zoned R-4. This proposed rezoning will not affect the current use or property taxes of the single-family home. The rezoning would allow for future development of any use that is listed as a permitted use in a B-2 zoning district. The intent is to align zones with future development plans while maintaining consistency in the area. The Public Hearing Notice has been published in the Des Moines County News and adjoining property owners have been notified. No comments on the rezoning have been received at this time. Zoning Map of Proposed Area: The map shows the parcels proposed for rezoning (marked in blue), currently zoned R-4, as well as the surrounding zoning classifications. Yellow indicates residential zones, red indicates business zones, and purple indicates institutional zones.
