SUBJECT: Maximum Levy Resolution
In 2019, Legislation passed that requires cities to hold two Public Hearings in connection with
the budget process. The first Public Hearing is to set the Maximum Levy. The second Public
Hearing will adopt the Budget for Fiscal Year 2022-2023.
The notice that was published assumes a Fiscal Year 2022-2023 levy rate of $9.72/$1,000 of
assessed value. Please note that the actual levy rate as budgeted for FY 2022-2023 is
$10.00/$1,000 which includes a .28 Debt Service Levy. However, this amount is not included at
this time until the debt is actually issued next week.
The State limits the amount of revenue a city can receive from year to year to 2% more than
what was received in the previous year. The city can exceed the 2% if a Resolution is passed by
a super majority of the council. Cities not needing to exceed the 2% threshold can approve the
resolution by simple majority.
This year the Maximum property tax dollars that can be collected from the current levies is
$1,747,587 at the $9.72/$1,000 rate. This is a decrease of 1.58%. However, the actual total
levy will generate $1,764,731 at the $10.00/$1,000 tax rate. This is an increase of 0.618
percent. As a reminder, we have discussed that this increase will be more than offset by the
proposed decrease in water rates.
This resolution does not set the levy rate for Fiscal Year 2022-2023, that will be done when
Council approves the final budget for Fiscal Year 2022-2023. This resolution just sets the
maximum property tax dollars that can be levied.

RESOLUTION APPROVING THE MAXIMUM TAX DOLLARS FROM
CERTAIN LEVIES FOR THE CITY’S PROPOSED
FISCAL YEAR 2022-2023 BUDGET
WHEREAS, the City Council of West Burlington, Iowa is preparing the annual
budget for the Fiscal Year 2022-2023; and
WHEREAS, the City Council of the City of West Burlington has considered the
proposed Fiscal Year 2022-2023 maximum property tax dollars for the affected levy total:
and
WHEREAS, a notice concerning the proposed city maximum property tax dollars
from certain levies was published as required and posted on the city web site and social
media accounts as required; and
WHEREAS, a public hearing concerning the city maximum property tax dollars
for the affected levy total was held at the City Council meeting on February 23, 2022, at
6:00 p.m.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
West Burlington, that the maximum property tax dollars for the affected tax levies for
Fiscal Year 2022-2023 shall not exceed $1,747,587 which does represent an increase of
greater than 102% from the maximum property tax dollars requested for FY22.

greater than 102% from the maximum property tax dollars requested for FY22.

RESOLUTION NO. 2022 -
A RESOLUTION SETTING A PUBLIC HEARING ON THE CITY’S PROPOSED
BUDGET FOR FISCAL YEAR 2022-2023
BE IT HEREBY RESOLVED, by the City Council of West Burlington, Iowa, that a Public Hearing will
be held at a Regular Meeting on March 16, 2022 at 6:00 p.m. The purpose of the hearing will be
to consider the proposed budget for Fiscal Year 2022-2023.
BE IT FURTHER RESOLVED that the Finance Manager is hereby directed to cause to be
published a notice of said hearing not be less than ten nor more than twenty days before the
hearing date as required by the Code of Iowa.
Council Member moved the foregoing Resolution be adopted.
Council Member seconded the motion to adopt. Members of the
City Council of the City of West Burlington, Iowa voted as follows to adopt the Resolution:
