The West Haven Inland Wetlands Agency held a Regular Meeting on Tuesday, July 21, 2015 in
the Harriet North Room, 2nd Floor, City Hall, 355 Main Street, West Haven, CT at 6:30 P.M.
PRESENT: Commissioner Kane, Saldibar, Beecher, Perrone, Gilbane, ZEO Conniff and
Corporation Counsel Amendola. Absent was Commissioner Carr.
PLEDGE OF ALLEGANCE
MINUTES OF REGULAR MEETING: Commissioner Saldibar made a motion to approve the
meeting minutes of June 16, 2015, seconded by Commissioner Perrone and passed.
Continued:
85 Cooper Road: Application to add a 12’X 16’ sunroom and a 16’x16’deck to the existing
structure within the wetlands. Applicant: George Nash/ Owner: Philip Ruggiero IW #15-025.
George Nash, Clinton, CT, is the builder for this project. Commissioner Kane stated there was a
site visit done and even though it is close to the wetlands, if procedures are done such as silt
fencing and runoff control, he sees no problem. Commissioner Saldibar made a motion to
approve File #IW 15-0525 with conditions that silt fencing be installed and general inland
wetland conditions, seconded by Commissioner Gilbane and passed.
120-140 Fresh Meadow Road: Application to fill 0.25 acres of historic Wetlands for a
construction yard/ storage area Applicant/owner GC realty LLC Principal –Giancarlo Colonna
IW #15-026.
Attorney Timothy Lee stated this application is not to seek filling the historic wetlands. This
application is to notify the commission that there was prior work done and not done by the
current owner. There will be nothing done with the wetlands by the owner. The yard work
will continue and the crusher location is located on the plan and will be more than 100 ft. from
the wetlands. The stockpile area of crushed stone will be closer but will not encroach.
Commissioner Saldibar made a motion to approve File #IW 15-26 with the condition that there
be no encroachment on the wetlands, seconded by Commissioner Gilbane and passed.
New:
136 Ivy Street: An application to install an above ground pool in the inland regulated area
Applicant/owner Paul C Dinicola IW #15-028.
Paul Dinicola, applicant, is present tonight to obtain approval to install an above ground pool
with a cartridge filter. Commissioner Saldibar made a motion to approve File #IW 15-028,
seconded by Commissioner Beecher and passed.
20 Simos Lane: Application to install an above ground pool with in the regulated inland
wetland area Applicant Lydia Brown /Owner Allan Stephanie & Lydia Brown IW # 15-027.
Lydia Brown, applicant, is present tonight to get approval for an above ground pool with a
cartridge filter. Commissioner Saldibar made a motion to approve File #IW 15-027, seconded
by Commissioner Gilbane and passed.
15 Industry Dr: Proposed to build a parking area totaling 0.69 acres. The site contains
approximately 0.22 acres of wetlands located along the northern edge of the property, and 0.76
acres of upland review area, The existing wetland area will be enhanced with wetland plantings
as part of the proposed project, The construction of the parking area is proposed with the 100-
year flood hazard zone, and has been designed to increase the flood carrying capacity of the
property by 124 cubic yards. Applicant/Owner 15 Industry Drive, LLC IW #15-029.
Applicant was not present. Commissioner Kane stated the city engineer visited the site and it
was discovered that fill was dumped on this property with permission by the owner.
Commissioner Kane stated the issue with the sand pile has been cleared up so he suggests that it
be continued for further explanation and information. Corporation Counsel Amendola
suggested a letter be sent stating applicant’s presence is required at the next meeting.
Commissioner Saldibar made a motion to continue File IW #15-029 to next month’s meeting,
seconded by Commissioner Beecher and passed.
Spring St. – Attorney Amendola stated a meeting was held with the Laydon Industries, various
city officials and DEEP. The DEEP representative stated that there were some encroachments
into the tidal wetlands. Attorney Amendola informed the commission the Laydon is to provide
a survey showing piles and bins to DEEP. After review either authorization will be given or a
remediation program. The commission still has the authority to require the applicant to file a
coastal resource application as well as a modified site plan. Commissioner Kane questioned
why any members of the commission were not invited to this meeting. Attorney Amendola
suggested having a DEEP official attend an inland wetland meeting.

Commissioner Saldibar made a motion to adjourn, seconded by Commissioner Perrone and
passed.
