INLAND WETLANDS AND WATERCOURSES AGENCY MINUTES OCTOBER 16, 2018 The West Haven Inland Wetlands Agency held a Public Hearing and a Regular Meeting on Tuesday, October 16, 2018 in the Harriet North Room, 2nd Floor, City Hall, and 355 Main Street, West Haven, CT at 6:30 P.M. PRESENT: Commissioners Kane, Beecher, Perrone, Carr and Assistant City Planner Killeen. Absent was Commissioner Gilbane. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: Commissioner Beecher made a motion to approve the meeting minutes of September 18, 2018, seconded by Commissioner Perrone and approved Acceptance: 693 and 697 Forest Road: The applicant is applying to construct a maintenance building to support Yale University athletic facilities. No work or activity is proposed in the wetlands or watercourse area. Some cutting and filling, storm water, and sewer features will be added in the upland review area, but the project will not adversely impact any wetland or watercourse. Attorney Joseph Hammer, Day, Pitney Law Firm, stated this application is to construct an athletic maintenance facility to support the adjoining existing fields. No work or activity will be done in the wetland area. Commissioner Beecher made a motion to accept 693 and 697 Forest Rd and to be heard at next month’s meeting, seconded by Commissioner Perrone and passed. For Approval: 55 Railroad Avenue: The Applicant requests to construct 4,320 sq ft. of additional parking area (approx. 15 to 20 spaces). The project was previously approved by the Inland Agency but the permit has expired. All work is within the upper inland review area. In the LM (Light Manufacturing) district. Owner/ Applicant: 55 Railroad Ave. File # 007-18 IW Carl Bellinghaus, representative for KX Technologies, stated the application is to add 15 parking spots to expand the parking lot. The area will be paved and pitched toward the rear into a culvert that flows into a storm drain. The construction will not be near the wetland. Commissioner Kane suggests protecting the wetland area during construction. Commissioner Beecher made a motion to approve File #007-18 IW with the conditions that were imposed on the original approval, File #IW 09-01, which are as follows: 1. A bi-annual inspection of the bio-filter and swale every six months for the first three years and after that an annual inspection and report shall be filed with the commission. Said report will address all of the components on the site management plan and the owner of record will be responsible to make the annual reports to the City of West Haven. 2. Applicant shall install visual screening along the property line, PS & PS1, 30 days from the date of this meeting, accommodating suggestions from the abutting property owners. Planning and Development staff to approve the screening plan. 1 Seconded by Commissioner Perrone and passed. Candace Dunn, 16 Voss Rd., stated 55 Railroad Avenue didn’t finish their project as it was originally approved in 2009, and they didn’t complete the landscaping or the drainage improvements. Commissioner Kane stated the original conditions are still imposed and he will make sure staff enforces those conditions. STAFF REPORTS: Italian American Club – Commissioner Kane asked about the dumping issue since this issue has been in the corporate counsel’s office and no progress has been given. Mr. Killeen agreed to follow-up with the Attorney Tiernan and ZEO Conniff when she returned next week. Commissioner Kane asked to be part of that meeting. Lake Phipps dumping – Commissioner Kane investigated and found that it came from behind Sears. DEEP is involved and debris will be tested. Fresh Meadow Rd – DEEP made a complaint against Colona Industries regarding the removal of a drain pipe. Commissioners are concerned about previous approvals with conditions and how to investigate whether these conditions have been met.
