City Planner Stephen Hotchkiss Zoning Enforcement/ Inland Wetlands MEETING MINUTES OF ZONING BOARD OF APPEALS SEPTEMBER 21, 2022 The West Haven Zoning Board of Appeals held a Public Hearing and Regular Meeting on Wednesday September 21, 2022 in the Harriet North Room, Second Floor, City Hall, 355 Main Street, West Haven, CT at 7:15 P.M. PRESENT: Commissioners Clifford, Coscia, Rivera, Porto, DeLeo, Caple, ZEO Hotchkiss, and Assistant City Planner Conniff. Absent were Commissioners Wise and Zentarski. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: Commissioner Porto made a motion to approve the Regular Meeting and Public Hearings of August 16, 2022, seconded by Commissioner Caple and passed. CONTINUED: 12 Baldwin Street: An application for a Special use exception for short-term rentals. The applicant should demonstrate the requirements that are expected for short-term rental. Under Article 1 section 2 and table 39.1 of the City of West Havens Zoning Regulations. Owner / Applicant Kim & Jeff Ambroise File# 017-22 SUE A letter was received from Altschuler & Alschuler was read into the record stating the application is being withdrawn. Commissioner Clifford stated a cease and desist is in effect with a $100 a day fine. If the applicants continue to rent, Corporation Counsel will file this with the court. Deliberation on Public Hearing Item: 12 Baldwin Street File # 17-22 SUE Withdrawn New: PUBLIC HEARING: 32 Blohm Street: An Application to remove two storage sheds and replace with a two-car garage. A variance for a side yard setback to permit 2’6” where 6 ft. are required, a front yard setback to permit 34’6” where 35 is required and lot coverage of 37.92% where 35% is allowed. 1 In the R2 (Single Family Detached Residence) district under section 11.1and 10.4.2, of the City of West Haven Zoning Regulations. Owner/ Applicant Michael Peacht. File # 19-22 V Attorney Vincent Falcone, West Haven, is representing the applicants tonight. This premise has been owned since 1993 by the applicants. There are two storage sheds which exist but will be removed. The placement of the garage will be the same distance from the property line fence which separates the applicant’s property to his neighborhood’s property on Third Ave. Ext. The variances are being asked for because of the lot shape, it is a corner lot and changes in the regulations since the property was developed. Attorney Falcone submitted exhibits showing the shape of the lot showing a hardship to the property, photos of the property and where the proposed garage will exist. Attorney Falcone explained that side and rear yards detached garages are permitted, however, not in a front lot. But this lot has two front yards since it is a corner lot. Mailings were submitted to file. Comment from City Engineer Quadhir was read into the record. Three calls were made to speak in favor and three calls were made to speak in opposition to this application. Deliberation on Public Hearing Item: 32 Blohm Street File # 19-22 V Commissioner Coscia made a motion to approve File #19-22, seconded by Commissioner Rivera. Roll call was called. File #19-22 approved 5 – 0. REGULAR MEETING ADJOURNMENT: 7:38 P.M. Commissioner Coscia made a motion to adjourn, seconded by Commissioner Rivera and passed. 2
