City Planner Stephen Hotchkiss, Zoning Enforcement/ Inland Wetlands MEETING MINUTES OF ZONING BOARD OF APPEALS JANUARY 17, 2024 The West Haven Zoning Board of Appeals held Public Hearings and a Regular meeting on Wednesday, January 17, 2024, in the Harriet North Room, Second Floor, City Hall, 355 Main Street, West Haven, CT at 6:30 P.M. PRESENT: Commissioners Clifford, Wise, Carol Porto, Coscia, Zentarski, Caple, Deleo, and ZEO Hotchkiss. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: Commissioner Porto made a motion to approve the minutes for the Regular Meeting and Public Hearings of November 15, 2023, seconded by Commissioner Wise and passed. PUBLIC HEARING: 51 Carlson Road: A request for a side yard variance to permit 9’ where 15’ is required to construct a 18’x 36’ addition to the rear of the existing structure in a Single Family Detached Residence (R2) zone pursuant to Article 2 Table 11.1 of the City of West Haven Zoning Regulations. Owner: Thomas & Charlene Reilly/Applicant: Thomas DeLucia. File # 001-24 V Applicants would like to add an addition to the house to the rear of the house. This is makes it less conforming. Mailings were submitted to the file. Mr. Hotchkiss read comments into the record from the Town Engineer and Building Official. Three calls were made to speak in favor and three calls were made to speak in opposition to this application. 47 Lucey Avenue: A request for a side yard variance to permit 6’ where 15’ is required to construct a new 3,538sf single family dwelling with attached garage in a Single Family Detached Residence (R2) zone pursuant to Article 2 Table 11.1 of the City of West Haven Zoning Regulations. Owner/Applicant: Robert Turcotte. File # 002-24 V 1 Applicants stated the existing house is going to be demolished and would like to build a new house approximately 3,538 sq. ft. with a two-car garage. Mailings were submitted to the file. Comments were read into the record from the Building Official and Town Engineer. Three calls were made to speak in favor and three calls were made to speak in opposition to this application. 128 Spring Street: Variances are requested to permit an existing structure currently under construction in a One-Two-Three Family Residence (R3) zone. A rear yard setback of 4’4” exists where 6’is required, existing roof height of 18’8” where maximum allowed height is 15’, and a loft height of 9’4” exists where a maximum of 6’6” is allowed pursuant to Sections 2.2, 10.42, 88, 90 and Table 12.1, of the City of West Haven Zoning Regulations. Owner /Applicant: Mitch Jansen. File # 003-24 V Attorney Vincent Amendola, West Haven, CT., is representing the applicant. He stated the house was built in 1919 and the garage was built in 1939. The owner purchased the house is 2016 and renovated the home. This is a double lot of about 80’. The existing roof height is 18’ 8” where 15 ft is required. Attorney Amendola is not sure what the height of the previous roof was. He does not have any definitive information on the height. The loft/second floor addition will be for storage even though it is above the 6’6” height. There will be no plumbing or living area. The garage is 20’ x 35’. Mailings were submitted to the file. Under Article 2 Table 12.1 of the City of West Haven Zoning Regulations. Owner: Steve Roberts/Applicant: Troy Kovalik. File # 004-24 V Charles Moyer, Milford, Ct., is representing the owner and the applicant. The house has been inherited and the daughter is currently living there. The owner would like to live there. Owner: Patrico Palomeque/Applicant: Sandra Lopez. File # 005-24 V Letter was read into the record asking for a continuance to the February meeting. 109 Seaview Avenue- Parcel A: An application for a one-time lot split into two (2) lots. Variances are requested to allow for a lot size of 8,124sf where 16,000 sf is required and frontage of 50’ where 80’ is required in the R2 (Single Family Detached Residence) zone pursuant to Section 11, 90.1, 90.2, and 90.3 of the City of West Haven Zoning Regulation. Owner: G & L Development LLC/Applicant: Anthony Cordone. File # 006-24 V Anthony Cordone, West Haven, is representing G & L Development. The owner would like to split the existing lot into two lots. There is an existing house on the property. If approved, a drainage system will be installed due to flooding in that area. Mr. Hotchkiss read comments into the record from the Town Engineer. Three calls were made to speak in favor and three calls were made to speak in opposition to this application. Richard Koziel, 24 Albion Ave., stated he is in favor because there is always flooding especially with the installation of the drainage system. Mr. Cordone stated this drainage will alleviate the problem. Albion Avenue- Parcel B: Variances are requested to allow for a lot size of 8,124sf where 16,000sf is required, lot frontage of 74.7’ where 80’ is required, and a lot depth which will be in the 30th percentile where 75% is required in the R2 (Single Family Detached Residence) zone pursuant to Section 11 and Section 47.2: 90.1, 90.2, and 90.3 of the City of West Haven Zoning Regulation. Owner: G & L Development LLC/Applicant: Anthony Cordone. File # 007-24 V Anthony Cordone, West Haven, is representing G & L Development, is proposing a 52’ x 32’ house. The property was not a through lot because Albion Subdivision did not exist. Seaview Avenue property owners split lots after subdivision was constructed. The front yard setback will conform with the neighborhood pattern. Sidewalks and curbs will be provided as well as a 3 drainage system which has been approved by the city engineer. File # 003-24 V Commissioner Coscia made a motion to approve File #003-24V with the conditions: no plumbing in the garage, no living space and all inspections/permits need to be applied for, seconded by Commissioner Wise. File # 004-24 V Commissioner Coscia made a motion to approve File #004-24V, seconded by Commissioner Porto. Roll call was called. File #004-24 approved 5 – 0. File #006-24 approved 5 – 0. Deliberation on Public Hearing: Albion Avenue, Parcel B. File # 007-24 V Commissioner made a motion to approve File #007-24V with the following conditions: drainage system proposed referenced in the Town Engineer letter signed off and approved by the Town Engineer and construction should be completed within one year after the start of construction, seconded by Commissioner Porto. Roll call was called. File #007-24 approved with conditions. 5 – 0.
