Motion carried. AGENDA ITEMS: A. AN ORDINANCE OF THE BOROUGH OF WEST MIFFLIN, A MUNICIPALITY OF THE COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA: AUTHORIZATION FOR THE BOROUGH TO INCUR NON-ELECTORAL DEBT IN AN AGGREGATE AMOUNT NOT IN EXCESS OF $8,300,000 BY ISSUANCE OF THE BOROUGH’S GENERAL OBLIGATION BONDS, REFUNDING SERIES OF 2016.___________________________________ Solicitor DiLucente opened the Public Hearing for comments or questions. Mr. DiLucente explained this is a bond refinancing and the reason behind this is because it’s a lower interest rate. Jim Jasinski 4100 Home Street asked about the plan for the refinancing and what will be the end result. Mr. Kamauf explained there will be no new debt structure and with the lower rate the Borough will be getting approximately $300,000.00 in return. Mr. Jasinski asked if there will be an additional extension of time on this debt to which Mr. Kamauf replied no. Hearing no additional comments or questions, Solicitor DiLucente closed the hearing. Motion by Marone, seconded by Olack to approve and award the bid from Vigliotti Landscape and Construction in the amount of Sixty-Nine Thousand Dollars ($69,000.00) for bid work at the West Mifflin Community Park Basketball Courts as recommended by the Borough Engineers, contingent on contractor approval from Allegheny County Department of Economic Development. Roll Call: Seven ayes, no nays. Motion carried. C. Motion by Kostelnik, seconded by Olack to approve and award the Borough’s 2016 Road Paving and Resurfacing Program Bid to Peter J. Motion carried.  MAY 17, 2016 7912 DEPARTMENTAL REPORTS: Community Development……………………………………………...……Walter B. Anthony Mr. Anthony read the Community Development Report for the month of April, 2016. Police……………………………………………………………………….….Chief Ken Davies Chief Davies read the Police Department Report for the month of April, 2016 Mr. Marone asked Chief Davies if residents of St. Agnes Lane could have speed bumps installed. Chief Davies replied only private, school and churches can have speed bumps. Borough roads cannot have speed bumps. Public Works…..........................James Hess Mr. Hess read the Public Works Department Report for the month of April, 2016. Mr. Stupar commended the Public Works Department especially on Shadyside Drive. Mr. Hess worked with the water company to address and fix the water runoff problem. Mr. Hess said he and Mr. Kamauf have been working on the 2016 LED Streetlight Program. Mr. Kamauf said the LED lights has had significant savings for the Borough. Mayor Kelly asked Mr. Hess where the asphalt making equipment is kept. Mr. Hess said it’s kept outside at the Public Works Building. Mayor Kelly wanted to know if anyone can go near the machine and for safety reasons, should there be some kind of barricade around it. Mr. Hess said asphalt is made between the hours of 2 a.m. and 6 a.m. This is on a timer. He said he will look for some sort of safety barricade. Mayor Kelly also wanted to know if someone removed all the plastic casing from electronics, can the plastics be put out for refuse. Mr. Hess said yes, but the electronic parts are not eligible for any electronic recycling. Mr. Hess also said the annual hard to recycle event will not be held at the County Airport this year but he is working with Century III Mall to have the event there. Recreation……………………………….………………………………….Anthony DiCenzo Mr. DiCenzo reported the following: The Borough along with Allegheny County will be hosting a Free Summer Lunch Program this summer at Emerson Elementary beginning June 13th through August 18th from the hours of 11 a.m.-1 p.m. Any resident under the age of 18 is eligible. The Summer Arts & Crafts Program will be held at the Community Park beginning June 13 th through August 19 th from 10am- 2pm. We will also have 3 additional playground monitors rotating amongst 6 of the neighborhood playgrounds throughout the Borough. These playgrounds are Bost, 5th Avenue, Castle Drive, Edgewater, Terrace and Fleetwood.  MAY 17, 2016 7913 Jump Start Sports will be running a week long summer camp for children ages 4-12 from June 20th-23rd at Emerson Elementary. For more information on how to register, visit the Recreation Department’s website. The West Mifflin Baseball and Youth Softball Leagues will be hosting a movie night Saturday, June 18th at 7pm at the Camden Complex. As in past years, the organization is asking if the Borough would be willing to pay for the movie. Community Day 2016 will be held on Saturday, September 10th from Noon-6pm at the County Airport. Vendor information is on the Recreation Department’s website. The fee for a booth or space is $75.00. Mr. Davis asked Mr. DiCenzo if more pictures of the Recreation’s events could be posted on the website. Mr. DiCenzo agreed he would be more diligent in the future. EMS…………………………………………………………………….…..Chief Todd Plunkett Chief Plunkett read the EMS Report for the month of April 2016. Chief Plunkett said his department was recognized with the Gold Award from the American Heart Association for cardiac care and CPR Training. Chief Plunkett was asked if the EMS Department has an off road vehicle for emergencies. He said they have a two seater side by side along with a trailer. This ATV is in conjunction with Allegheny County. Mayor Kelly asked Chief Plunkett if he has any information or update on the Zika virus. Chief Plunkett said he has not received anything direct from the Allegheny County Health Department. When he does, any information will be posted on the website. REPORT OF THE MAYOR: Mayor Kelly addressed the Public Safety Committee about the possibility of purchasing an off -road vehicle for emergencies and have training for this. Mr. Marone said right now we use other communities’ ATV’s for such situations. Mayor Kelly said the Borough should be able to use federal forfeiture funds for this purchase. It was agreed the Borough has a lot of off road areas. Mayor Kelly said he received a request from Jericho Road Ministries to use Terrace Park on July 30th from noon-7pm. The Ministries open this event to the public with music, games and food vendors. It was agreed the Borough permits this organization every year to use the park. Mayor Kelly said the official Grand Opening of the Golden Theater is this Wednesday at 6 p.m. He reported the ribbon cutting on Noah’s Arc at Kennywood Park will be held Wednesday, May 25th at 11:00 a.m.  MAY 17, 2016 7914 Mayor Kelly reminded everyone the annual Memorial Day Ceremony will take place Saturday, May 28th at Mitchell Paige Park beginning at 10:00 a.m. REPORT OF THE SOLICITOR: Solicitor DiLucente said most of his report was reserved for Executive Session. He said there was a lot of preparation in the Bond Ordinance Refinance. Advertising and the legal notice will be in the Tribune Review. Mr. DiLucente said he has been working on the UMPC lease, the 401A agreement with Met Life and a personnel matter. Mr. DiLucente wanted to clarify some information about the Bond Ordinance. He said this is a General Obligation Bond sold in $5000.00 increments opposed to the standard $10,000.00. This will be more attractive to buyers and is extremely secure. It is guaranteed money for an investor and profitable for the Borough. REPORT OF THE ENGINEER: Mr. Balewski said most of his report was covered in the Agenda Items. Mr. Balewski said he is in the middle of reviewing the Speedway Plan and should have that done by this week so the Planning Commission can move forward. REPORT OF THE BOROUGH MANAGER: Mr. Kamauf read the Finance Report for the month of April 2016. NEW BUSINESS: Motion by Marone, seconded by Olack to approve an animal control contract with Camo Kennel and True Companion pending solicitors’ approval. Roll Call: Seven ayes, no nays. Motion carried. Motion by Marone, seconded by Olack to approve the hiring of Jonathan Mattis for the Public Works Department pending background, criminal checks and physical testing. Motion carried. Motion by Olack, seconded by Stupar to approve participation in the 2016 SHACOG joint police testing. Roll Call: Seven ayes, no nays. Motion carried. CITIZENS COMMENTS: Dolores and Hugh O’Donnell 317 Lebanon Manor Drive wanted to know what and if any progress has been made about the farm animal situation in her neighborhood. Mr. Kamauf said this topic was discussed in length at the work session. Solicitor DiLucente said this will not be an easy ordinance to draft. As of now, there is only an ordinance on pigs and noise. He stressed that the new ordinance cannot be challengeable. This would have to be fair to all residents and could be a case by case basis. A lot has to be taken into consideration. This ordinance will probably take a few months to draft. Mr. Kamauf said the ordinance, once drafted, will be advertised and open for public discussion. Mrs. O’Donnell asked Mr. DiLucente if it’s legal for her neighbor is to have a video camera facing her back yard. Mr. DiLucente replied by saying he cannot give legal advice to the public and he is here to represent Council. Chief Davies said as long as the camera is not facing a window or her building, it is legal. Mrs. Kushner asked Mrs. O’Donnell if she has contacted the Health Department about the smell and animal feces from the next door neighbors’ animals. Mrs. O’ Donnell responded by saying no she hasn’t because she is afraid this neighbor may retaliate. Jeff O’Donnell, their son said this neighbor has multitudes of refuse weekly from his contractor work that he puts out for the garbage. This neighbor has accused the O’Donnells for reporting these incidents. Mr. Stephenson said this matter will be under further discussion. Jim Jasinski 4100 Home Street wanted to know why the Borough hired a paving company to finish the basketball courts when we have the equipment to pave. Mr. Kamauf responded by saying we did as much as we can. Our equipment is not capable for a perfect surface and this needs to be done by professionals. Mr. Hess added we have done the site preparation, the drain work and the fences. The basketball courts will need the top coat and the acrylic finish. This is what the paving company will complete. Mr. Jasinski wanted Council to explain the process of job applications. Mr. Stephenson explained we don’t throw out applications. The jobs in question were for Public Works which Mr. Stephenson said were posted in the Valley Mirror in addition to our website. Mr. Kamauf added that most of the applications received are for Public Works. Any specialty positions are advertised.  MAY 17, 2016 7916 Mr. Jasinski questioned how much the former realtors for the old Borough Building cost the Borough. Solicitor DiLucente said it cost nothing due to the fact that these realtors work on contingency fees. Mr. Jasinski addressed Mayor Kelly by asking if the Borough ever considered building a Library. Mayor Kelly said he has looked into this. He stated the State of Pennsylvania overseas these projects and unfortunately, funding has been cut. Start-up costs would be too expensive. Mr. Jasinksi ended by thanking Chief Davies and his department for keeping the Borough safe. Harry Thompson 6679 Adams Avenue said he believes the Borough should have gone with an auction company instead of a realtor in listing the old Borough Building for sale. Mr. Thompson said he disagreed with a previous comment by Mr. Anthony in regards to Linda Lane being a paper street. Mr. Anthony said that Linda Lane was a paper street that was never formally adopted by the Borough. Alan J. Kruszka 538 Edgewood Avenue asked Council if an alley behind Edgewood Avenue could be reopened so that residents can have a turnaround. He stated this was a safety issue because of an old truck and snowmobiles being parked there. Mr. Hess said he didn’t believe this was Borough property. Mr. Stephenson said Mr. Hess will come out to look at this and if it needs further research, the engineer will get involved. John Koczka 4333 Everlawn Street questioned Mr. Kamauf about nepotism in hiring in the Borough. Mr. Kamauf said Borough Council has a policy against nepotism. Mr. DiLucente said he reviewed the anti-nepotism policy. He stated this was limited to Borough Council Members who were elected as well as the Mayor. Mr. DiLucente said he understands Mr. Koczka concerns about familiar relations in regards to Mr. Kamauf. He stated the anti-nepotism policy would not in any way, shape or form be construed as a violation. Mr. DiLucente also stated this is not a law, it’s a policy.
