FEBRUARY 20, 2018 8026 COUNCIL OF THE BOROUGH OF WEST MIFFLIN met in regular session in the Municipal Building Council Chambers on Tuesday, February 20, 2018 at 6:30 p.m. prevailing time with President Scott Stephenson presiding. CITIZENS COMMENTS ON AGENDA ITEMS: Michael Krawec 1810 Homeville Road who owns Arcade X wanted to know about the amendment to the license fee for mechanical devices if it can be paid quarterly. Mr. Evashavik said the amount was to be made in full. APPROVAL OF MINUTES: Motion by Kostelnik, seconded by Marone that the Minutes of the December 19, 2017, the Minutes of Reorganization of January 2, 2018 and the Minutes of the January 16, 2018 be approved. Roll Call: Seven ayes, no nays. Motion carried. AGENDA ITEMS: A. A RESOLUTION OF THE BOROUGH OF WEST MIFFLIN AUTHORIZING THE FILING OF AN APPLICATION FOR FUNDS WITH THE REDEVELOPMENT AUTHORITY OF ALLEGHENY COUNTY (RAAC). GRANT REQUESTED FOR THE LOWER BULL RUN CULVERT REPLACEMENT, IN THE AMOUNT OF TWO HUNDRED SIX THOUSAND FIVE HUNDRED SIXTY THOUSAND DOLLARS ($206,560.00).____________ Motion by Kostelnik, seconded by Inglis that the Resolution be adopted. A RESOLUTION OF THE BOROUGH OF WEST MIFFLIN, APPROVING, ADOPTING AND PLACING INTO IMMEDIATE EFFECT THE EMERGENCY OPERATIONS PLAN OF THE BOROUGH OF WEST MIFFLIN AS MANDATED BY SECTION 7503 OF THE PENNSYLVANIA EMERGENCY MANAGEMENT SERVICES CODE.______________________________________ Motion by Kostelnik, seconded by Inglis that the Resolution be adopted. Motion by Kostelnik, seconded by Inglis to amend the Mechanical Device license fee schedule to add a maximum license fee of Ten Thousand Dollars ($10,000.00) per year for any establishment. Motion by Kostelnik, seconded by Inglis to approve the auctioning of Public Works Vehicles P-1 (Vin#1GCHK24U017309955) P-2 (Vin#1GCEK14X93Z258711) P-3 (Vin#1GCEK14X32Z56341), vehicles will be taken to Perryopolis Auto Auction. Motion by Kostelnik, seconded by Inglis to approve the purchase of two (2) 2018 Ford F250 4x4 SRW (Reg Cab Pick Up) at a total cost of Fifty Nine Thousand Eight Hundred Seventy-Six Dollars ($59, 876), purchase is under SHACOG Purchasing Bid. Motion by Kostelnik, seconded by Inglis to approve purchase of Lee Boy Model L250T Trailed Tack Distribution for the Public Works from Walsh Equipment at a cost of Twelve Thousand Six Hundred Forty Six Dollars ($12,646.00) COSTAR Contract #4400017938. Motion by Kostelnik, seconded by Inglis to approve the purchase and installation of IP Phone upgrade for the Public Works by Dagostino Electric Services, Inc. at a cost of Two Thousand Five Hundred Dollars ($2,500.00). Motion by Kostelnik, seconded by Inglis to approve Lease Agreement between the Borough and West Mifflin Baseball League for use of the Field at the Little League Complex. Motion by Kostelnik, seconded by Inglis to approve Lease Agreement between the Borough and West Mifflin League Youth Softball Association for the use of the Camden Field Complex. Motion by Kostelnik, seconded by Inglis to approve a four (4) year lease purchase agreement with First National Bank for the Lease/Purchase of a garage truck for Public Works at a rate of 3.3%, total amount to be financed One Hundred Ninety Nine Thousand Eight Hundred Fifty Dollars ($199,850.00). Anthony Mr. Anthony read the Community Development Report for the Month of January, 2018. Police…………………………………………………………………………..Chief Ken Davies  FEBRUARY 20, 2018 8028 Chief Davies read the Police Department Report for the Month of January, 2018. Mr. Marone asked Chief Davies where his Department stands on the new hires for the Police Department. Chief Davies said they are still in the process. There are 5 eligible so far. He added by the next meeting he will know more. Public Works………………………………………………………………………James Hess Mr. Hess read the Public Works Department Report for the month of January 2018. Recreation……………………………………………………………………Anthony DiCenzo Mr. DiCenzo reported on the following: a. The sold out Father/Daughter dance was again a success. He thanked all who helped out at the event. b. Selection for 2 possible Borough owned properties for the Community Gardens have been discussed. The Terrace Playground and the Glenn Street Playground. Upon Council’s approval, the committee will seek members of the community who are interested in spearheading this program. c. The Easter event will be held March 31, 2018 at the Community Park. More details to follow. d. Discussion is needed for the logistics of the park hours for the upcoming season. With the addition of the lights on the basketball court, the park will be open longer than it has in the past. We need to develop a different strategy moving forward. Marci Palko, a member of the Recreation Committee had some ideas for the Little Library Program. She is asking if the Soccer teams, Baseball Teams etc. can decorate the Libraries and she is also asking Council for permission to install them at the Community Park and the Softball Complex. She is also introducing a program called WM Rox. This is a program for children to paint river rocks, take them somewhere, whether on vacation or somewhere in the Borough, take a picture and post it on a Facebook page that Andy Quayle will develop. She thinks this will be fun and inexpensive for the kids to do. This will be introduced at the Sample West Mifflin Night at the Middle School. Mayor Kelly added that the Recreation Department has come a long way in the past few years. EMS…………………………………………………………………….Chief Todd Plunkett Chief Plunkett read the EMS Report for the Month of January 2018. Chief Plunkett reported he has received 2 grants earmarked for a new supervisor vehicle. He added his department has started the leave behind Narcan program.  FEBRUARY 20, 2018 8029 REPORT OF THE MAYOR: Mayor Kelly said he has been working with David Marshall and Chief Davies on issues that he couldn’t discuss at this time. REPORT OF THE SOLICITOR: Mr. Evashavik reported he has received a request from the West Mifflin School Board’s solicitor of a petition to exonerate and strike a Municipal Lien on a certain property. He is asking if Council is willing to consent to this property which is on Irwin Run Road. The School District currently owned the property which was acquired from the Borough in 1985. Currently, there is a tax lien of $4500 on the property. This was filed in 1966. With penalty and interest the total comes to $20,600.00. The School District wants to sell this property to a private owner which would get it back on the tax rolls. It was determined that the property parcel is 244-F-175 which would be the soccer field. Mr. Evashavik asked Council to make a motion. Motion by Marone, seconded by Kostelnik to exonerate and strike a Municipal Tax Lien on parcel 244-F-175 Irwin Run Road. Roll Call: Seven ayes, no nays. Motion carried. REPORT OF THE ENGINEER: Ms. Bennett said after reviewing the current project specifications, the structural engineer determined that the culvert on Lower Bull Run Road could not be rehabilitated and should be replaced. Currently new plans and specs are being completed along with a PA DEP GP-11 Permit. She estimated it will take about two months for the DEP permit. After that, it should take about one month to install. Mr. Kamauf suggested a motion to advertise a bid for the project. Motion by Marone, seconded by Kostelnik to advertise a bid for the Lower Bull Run Road Project. Roll Call: Seven ayes, no nays. Motion carried. REPORT OF THE BOROUGH MANAGER: Mr. Kamauf said he will forward the full Financial Report to Council. The audit is scheduled to begin March 19th. Mr. Kamauf said he has been appointed to the Allegheny County Airport Master Plan Update Technical Advisory Committee. PAYMENT OF BILLS: Motion by Kushner, seconded by Stupar that all bills properly approved by the Finance Committee be paid. Roll Call: Seven ayes, no nays. Motion carried.  FEBRUARY 20, 2018 8030 NEW BUSINESS: Mr. Marone made a comment about a call he received from a resident about a hillside coming into her property. Mr. Hess made the trip and placed sandbags around as a temporary fix. Mr. Hess determined the cause was from mine water coming from the upper property. Mr. Marone said the resident was very appreciative of the help from Mr. Hess. Motion by Kostelnik, seconded by Inglis for the hiring of Robert Devey for the Public Works Department pending successful completion of a physical, drug and alcohol testing and background check. Roll Call: Seven ayes, no nays. Motion carried. CITIZENS COMMENTS: Harry Thompson 6679 Adams Avenue asked why so many restoration trucks are at the old Borough Building. Mr. Kamauf said the damage to the building is under control and now we are waiting for the insurance claims, that’s why the trucks are still there. Stephen Marecic 2829 Skyline Drive said that last July he received a phone call from Mayor Kelly about his property at 1800 Pennsylvania Avenue. He reported that the Mayor said his building has rats and he needs to clean up the property. He said the Mayor also said he was going to make an example out of him by coming the following Sunday and will make sure the property is cleaned. Mr. Marecic said his building is full of antiques and old furniture and is not a food source to attract rats. He said the building is located next to a pizza shop and Dollar General and this is probably the source of the rat problem. He also said he was cited by the Borough but missed the court date and was fined. He also said Allegheny County Health Department came out because of a complaint of tires. He said these are not his tires but he got rid of them. Mayor Kelly asked why it has taken so long for him to address this problem. Mayor Kelly said the complaint was in July and now it’s the end of February. The Mayor said he asked him to clean up the property and he understands the rat problem was taken care of. Mr. Hess added that he had baited the source. Mr. Marecic said the alley behind the property is now paved and a dumpster sits in the middle of it. He wanted to know if it’s legal to have a dumpster located on a Borough road. Bob Kremer 1804 Highland Avenue added his comments to the dumpster in question. He said this dumpster is 5 feet from his property and is an eyesore. He also said he believed the rats were coming from the pizza shop and has had dead rats in a pond that is located in his back yard. He said he has a one year old daughter and this can certainly be a health hazard. Mr. Stephenson said he thought this was taken care of and will certainly be looked at and inspect the rest of the businesses. Dave Marshall 2220 Reuben Drive as West Mifflin School Board President he said he is forming a committee with Mayor Kelly, Chief Plunkett, Chief Davies, Judge Olasz, Jeremy  FEBRUARY 20, 2018 8031 Stillwagon and the Fire chief of Homeville Volunteer Fire Co. to have a public forum for all citizens to come with suggestions on improving the community.
