NOVEMBER 20, 2018 8068 COUNCIL OF THE BOROUGH OF WEST MIFFLIN met in regular session in the Municipal Building Council Chambers on November 20, 2018 at 6:40 p.m. prevailing time with President Scott Stephenson presiding. ROLL CALL: Kushner Present Inglis Absent Stupar Present Kostelnik Present Santoro Present Marone Present Stephenson Present Six members present, one absent (Inglis). Mayor Kelly present. CITIZEN COMMENTS ON AGENDA ITEMS: Jim Jasinski 4100 Home Street requested a synopsis on the storm water management ordinance. Solicitor DiLucente replied there is a new state rule stating nothing can be tied into the storm drain. Mr. Jasinski requested an address for Agenda item B. Mr. Kamauf replied it is a vacant lot on Duquesne Avenue. Mr. Jasinski questioned Agenda item D and what location the liquor license is being transferred from. Mr. Kamauf replied he does not have the location yet and will have it at the public hearing. Mr. Jasinski questioned which location is requesting a liquor license. Mr. Kamauf replied it was one of the Speedway locations. APPROVAL OF MINUTES: Motion by Marone, seconded by Kushner that the minutes of the October 16, 2018 Council Meeting be approved. Six ayes no nays, 1 absent (Inglis). Motion carried. AGENDA ITEMS: A. AN ORDINANCE OF THE BOROUGH OF WEST MIFFLIN RELATIVE TO THE STORM WATER MANAGEMENT (as required by Pennsylvania Storm Water Management Act.) Solicitor DiLucente opened the Public Hearing. Harry Thompson commented on houses downspouts draining into the street and questioned when that will be changed and where will the water go. Solicitor DiLucente commented going forward for new developments downspouts draining to the street will not be permitted.  NOVEMBER 20, 2018 8069 Mayor Kelly questioned if these pipes need to be into a line or on top of the ground. Mr. Anthony commented the Community Development Department gets a lot of water complaints and residents are told to create a gravel pit to drain water. Ms. Bennett commented now with the pipes not draining into storm drains there are going to be more issues with water draining and suggested a possible ordinance in the future requiring sump pumps with home sales. Mayor Kelly questioned if this is only new construction or for existing homes. Ms. Bennett commented this is for new homes or construction of existing homes. Solicitor DiLucente commented an ordinance could be put in place. Mr. Anthony commented when a home sells now, a dye test needs to be completed and the water issue could be checked and included at that time. Solicitor DiLucente closed the hearing. RESOLUTION OF COUNCIL OF THE BOROUGH OF WEST MIFFLIN APPROVING THAT THE ACQUISITION AND SUBSEQUENT DISPOSITION OF A PARCEL OF VACANT PROPERTY KNOWN AS LOT AND BLOCK NUMBER 181-G-135 WOULD BE IN ACCORD WITH THE COMPREHENSIVE PLAN OF THE MUNICIPALITY. Motion by Marone, seconded by Kushner Roll Call: Six ayes, no nays, 1 absent (Inglis). Motion carried. C. Motion by Marone, seconded by Stupar to approve the purchase of Human Resource Software from PowerDMS, at a cost of Three Thousand Two Hundred Fifty Dollars ($3250.00.) Roll Call: Six ayes no nays, 1 absent (Inglis). Motion carried. D. Motion by Marone, seconded by Kushner to approve the advertisement for Public Hearing for the Intermunicipal Transfer of a Restaurant Liquor License. Roll Call: Six ayes, no nays. Motion by Marone, seconded by Kushner to approve the Condemnation of the following properties: 429 Mellon Street, lot and block 306-K-098, 598 Grandview Avenue, lot and block number 305-E-086, 4751 Coal Road, lot and block 182-G-305, 74 Montclair Drive, lot and block 310-E-052. REPORT OF THE MAYOR: Mayor Kelly commented about funding for recreation and demolition and other avenues that can be taken. Mayor Kelly spoke to the Penguins foundation regarding getting some type of funding for deck hockey at the West Mifflin Community Park. REPORT OF THE SOLICITOR: Solicitor DiLucente read the report for the Month of October 2018. REPORT OF THE ENGINEER: Ms. Bennett reported the pre-construction meeting for the Lower Bull Run culvert replacement will take place in 1 week and a construction time frame will be given. Ms. Bennett reported Kansas Avenue Park is put on hold until there is a week of frozen or dry weather to install the turf. REPORT OF THE BOROUGH MANAGER: Mr. Kamauf read the Finance report for the Month of October 2018.  NOVEMBER 20, 2018 8071 PAYMENT OF BILLS: Motion by Kushner, seconded by Stupar that all bills properly approved by the Finance Committee be paid. Roll Call: Six ayes no nays, 1 absent (Inglis). Motion carried. NEW BUSINESS: Motion by Marone, seconded by Santoro to advertise to hire a replacement for the Assistant Office Manager. Roll Call: Six Six ayes no nays, 1 absent (Inglis). Motion carried. Motion by Marone, seconded by Santoro to approve renewal of the maintenance contract with the building control systems for the HVAC system in the Borough building for a fee of Forty Nine Hundred Dollars ($4900.00.) Roll Call: Six ayes no nays, 1 absent (Inglis). Motion carried. CITIZENS COMMENTS: Harry Thompson 6679 Adams Avenue questioned R & B Contracting allowing Tag Towing to move into the space and park towed cars in the property. Mr. Anthony questioned that any permit applications can be held until back taxes are paid. Solicitor DiLucente reported permits can be held, and a civil suit could be filed. Solicitor DiLucente commented he will pass recommendations to council on this matter but this should not be further discussed in front of public. Jim Jasinski 4100 Home Street questioned movement with Verizon in the area. Mayor Kelly commented Verizon has no intentions of bringing FIOS into the borough due to the cost to installation. Mr. Jasinski questioned borough employee contracts and if after hour work can be turned down. Mr. Kamauf commented there are words in the contract regarding this subject, and there are measures in place for a situation like this.
