FEBRUARY 21, 2023 8300 COUNCIL OF THE BOROUGH OF WEST MIFFLIN met in regular session in the Municipal Building Council Chambers on February 21, 2023 at 6:32 p.m. prevailing time with President Scott Stephenson presiding. CITIZEN COMMENTS ON AGENDA ITEMS: No citizen comments. APPROVAL OF MINUTES: Motion by Kostelnik, seconded by Moses that the minutes of the January 17, 2023 Council Meeting be approved. Roll Call Seven ayes, no nays. Motion carried. AGENDA ITEMS: A. RESOLUTION OF THE BOROUGH OF WEST MIFFLIN, ALLEGHENY COUNTY, PENNSYLVANIA, AUTHORIZING THE PROPER DISPOSAL OF CERTAIN RECORDS IN COMPLIANCE WITH THE REQUIREMENTS OF THE RETENTION AND DISPOSITION SCHEDULE FOR RECORDS OF PENNSYLVANIA MUNICIPAL GOVERNMENTS. Motion by Davis, seconded by Kostelnik Roll Call: Seven ayes, no nays. Motion carried. B. RESOLUTION OF THE BOROUGH OF WEST MIFFLIN, ALLEGHENY COUNTY, PENNSYLVANIA, ADOPTING AN AMENDMENT TO THE ARTICLES OF INCORPORATION CHANGING THE NAME OF THE WEST MIFFLIN SANITARY SEWER AUTHORITY. Motion by Topolnak, seconded by Davis Roll Call: Seven ayes, no nays. Motion carried. C. Motion by Kostelnik, seconded by Moses to approve the proposal from Hosack, Specht, Muetzel & Wood LLP, for auditing services, yearly contract pricing as follows: 2022 - $20,600; 2023 - $21,200; 2024 - $21,850. Roll Call: Seven ayes, no nays Motion carried. D. Motion by Kostelnik, seconded by Inglis to approve advertising Public Hearing for Proposed Dumpster Ordinance. Roll Call: Seven ayes, no nays. Motion by Kostelnik, seconded by Davis to approve contract between the Borough of West Mifflin and Pittsburgh SMSA Limited Partnership d/b/a Verizon Wireless for communication equipment placement at 507 Dennison Drive. Roll Call: Seven ayes, no nays. Motion carried. F. Motion by Kostelnik, seconded by Inglis to approve participating in the Duquesne Light Company LED replacement program for LED lighting upgrades at 1020 Lebanon Road Building. The replacement will be 381 lights at a total cost of $46,684.87, of this the Borough cost will be $9,315.45. Roll Call: Seven ayes, no nays. Motion carried. G. Motion by Kostelnik, seconded by Moses to approve a Temporary Construction Access Easement Agreement, between the Borough of West Mifflin and the Peoples Natural Gas Company, LLC, for access to Parcel Number 244-E-050. Roll Call: Seven ayes, no nays. Motion carried. H. Motion by Moses, seconded by Kostelnik to table the Steel City Billboards application for a Conditional Use Authorization to construct a 10’ x 18’ Electronic Billboard at 347 Lebanon Road. The conditions of approval of this recommendation are the points outlined in Zoning Ordinance Chapter 290 under Section 68. Roll Call: Seven ayes, no nays. Motion carried. I. Motion by Davis, seconded by Topolnak to approve agreement between the Borough of West Mifflin and Borough of Homestead to allow Temporary Holding of Detained Persons, pending final approval and sign off from the Borough’s Insurance Provider. Mayor Kelly asked to table this motion for a month so he could further review this. Mr. Stephenson asked Council if anyone wanted to table this motion. Hearing no reply. Roll Call: Seven ayes, no nays. Motion carried. J. Motion by Moses, seconded by Santoro to appoint Craig McDivett as member of the Planning Commission, term to expire December 31, 2026. Roll Call: Seven ayes, no nays. Motion carried. K. Motion by Kostelnik, seconded by Davis to approve purchase of Karcher 3500 PSI Hot Water Pressure Washer from Knickerbocker Russell Co., Inc., at a cost of $7,302.96. Roll Call: Seven ayes, no nays. Motion by Kostelnik, seconded by Moses to approve the purchase of two (2) 2025 Mack GR42F single axel cab/chassis at a cost of $137,719.00 per vehicle, total cost of $275,438.00, under Co-Star Contract #025-E22-405.  FEBRUARY 21, 2023 8302 DEPARTMENTAL REPORTS: Community Development…………………………………………………...Walter B. Anthony Mr. Anthony read the Community Development Report for the Month of January 2023. Police……………………………………………………………..…...Chief Gregory McCulloch Chief McCulloch read the Police Report for the Month of January 2023. Mayor Kelly asked why he was not notified when the Borough Manager, Solicitor and Council were notified regarding Agenda Item I. Mr. Davis replied it was brought to Council’s attention by a Council member from Homestead. Mayor Kelly replied when he spoke with the Chief of Homestead today, he was told he was working with Chief McCulloch for several months. Mayor Kelly asked the Borough Manager why he was not given a copy of anything. Mr. Kamauf replied it was not intentional and he forwarded the contract to the Solicitor to review. Mr. Kamauf also sent the contract to the Insurance to review. Mayor Kelly stated there are items that can lead to a liability for us that were not included on the contract. Solicitor DiLucente commented this is final approval to sign off from the insurance company. Solicitor DiLucente stated Homestead and West Mifflin each must have 1 million dollars in coverage. Solicitor DiLucente stated the agreement will run from 2023 – 2024. There is a $30,000 fee and $2,500 per month. Solicitor Dilucente stated anytime as asked the Solicitors review and make changes or suggestions. Mayor Kelly stated he understands but he asked why he was not awarded the opportunity to be included. Public Works……………………………………………………………….…Anthony DiCenzo Mr. DiCenzo read the Public Works Report for the Month of January 2023. Ms. Santoro asked Mr. DiCenzo’s thoughts on Castle Drive. Mr. DiCenzo replied he can add the road to the list.  FEBRUARY 21, 2023 8303 EMS…………………………………………………………………………Chief Todd Plunkett Chief Plunkett read the EMS Report for the month of January 2023. REPORT OF THE MAYOR: Mayor Kelly stated he does not have anything to report but he has updated the Borough Manager with businesses he has been working with. Mayor Kelly asked which Council Member replied to his question earlier about the temporary holding agreement. Mayor Kelly also asked which Homestead Council member reached out. Mr. Davis stated Dewayne Schultz. REPORT OF THE SOLICITOR: Solicitor DiLucente reported he does not have anything to report. REPORT OF THE ENGINEER: Mr. Elyes reported North Rock has started the Duquesne Avenue Culvert Replacement. Mr. Elyes reported the 2023 road resurfacing project list will be narrowed down. REPORT OF THE BOROUGH MANAGER: Mr. Kamauf read the Finance Report for the month of January 2023. Mr. Kamauf reported the 2022 Audit will begin on March 13, 2023. Mr. Inglis reported the Father Daughter Dance was successful and the most popular event the Borough of West Mifflin holds. PAYMENT OF BILLS: Motion by Moses, seconded by Kostelnik that all bills properly approved by the Finance Committee be paid. Roll Call: Seven ayes, no nays. Motion carried. NEW BUSINESS: Motion by Moses, seconded by Kostelnik to amend the agenda removing Item H from the Agenda. Roll Call: Seven ayes, no nays. Motion carried.  FEBRUARY 21, 2023 8304 Motion by Moses, seconded by Kostelnik to advertise for a Public Hearing to be held at the March 21, 2023 Council Meeting on the Steel City Billboards application for conditional use to construct a 10’ x 18’ Electronic Billboard.
