DATE 8848 COUNCIL OF THE BOROUGH OF WEST MIFFLIN met in regular session in the Municipal Building Council Chambers on January 16, 2024, at 6:30 p.m. prevailing time with President Scott Stephenson presiding. ROLL CALL: Topolnak Present Davis Present Santoro Present Inglis Present Kostelnik Present Moses Present Stephenson Present Seven members present. Mayor Kelly present. CITIZEN COMMENTS ON AGENDA ITEMS: APPROVAL OF MINUTES: Motion by Moses, seconded by Kostelnik that the minutes of the December 19, 2023, Council Meeting be approved. Roll Call Seven ayes, no nays. Motion carried. AGENDA ITEMS: A. Motion to approve Two Lot Consolidation Plan consisting of Lot and Blocks 180-S-271 & 180-S-275, subject to the corrections on the plan for the Brough Engineer. Motion by Topolnak, seconded by Kostelnik. Roll Call: Seven ayes, no nays. Motion carried. B. Motion to approve advertising Public Hearing for the Conditional Use Authorization to allow McCluskey Properties to operate a contractor’s yard to be located at 929 Lebanon Road. Motion by Moses, seconded by Davis. Roll Call: Seven ayes, no nays. Motion carried C. Motino to participate in the SHACOG 2024 Joint Police test. Test to be held Saturday May 4, 2023. Motion by Davis, seconded by Topolnak Roll Call: Seven ayes, no nays. Motion carried. D. Motion to approve the hiring of John Belback as part-time crossing guard, pending successful completion of background and clearance check. Motion by Santoro, seconded by Moses. Anthony Mr. Anthony read the Community Development Report for the Month of December 2023. Public Works……………………………………………………………….…Anthony DiCenzo Mr. DiCenzo read the Public Works Report for the Month of December 2023. EMS…………………………………………………………………………Chief Todd Plunkett Chief Plunkett read the EMS Report for the month of December 2023. REPORT OF THE MAYOR: Mayor Kelly asked Mr. Kamauf to read the Mayor’s report due to post-surgery complications. Mr. Kamauf stated that a resident reached out to Mayor Kelly regarding the vacant property on Fiedlity. Mr. Kamauf added that the property does not belong to the Borough, however the resident and the owner of the vacant property spoke and are working together to establish a Community Garden. REPORT OF THE SOLICITOR: Solicitor DiLucente read the Solicitor’s Report for the Month of December 2023. REPORT OF THE ENGINEER: Matt read the Engineer’s Report for the Month of December 2023. REPORT OF THE BOROUGH MANAGER: Mr. Kamauf read the Finance Report for the month of December 2023. PAYMENT OF BILLS: DATE 8850 Motion by Davis, seconded by Moses that all bills properly approved by the Finance Committee be paid. Roll Call: Seven ayes, no nays. Motion carried. NEW BUSINESS: CITIZENS COMMENTS: Elieen Straub 200 Castle Drive – Ms. Straub started by saying thank you to everyone who was involved in getting the dog kennel taken down. Ms. Straub said she is told there are more than nine dogs at her neighbors house and would like to know if they will be grandfathered in when the new ordinance is put into place. Solicitor DiLucente responded that he envisions two separate ordinances, one will be for pets and the other will be for nuisance. Solicitor DiLucente added that technically anybody with a pet would be grandfathered in, but on the other hand the nuisance ordinance will be used if needed for violations. Ms. Straub asked, “so that means someone can have 12 dogs as long as they’re not a nuisance?” Solicitor DiLucente replied yes, they would be grandfathered in, and if they are affecting individuals health and safety then the nuisance statute would be used. Ms. Straub said the last thing she wanted to talk about was the dog breeding business, has the issue been dropped? Mr. Stephenson asked if Mr. Anthony had any evidence of a dog breeding business. Mr. Anthony said he does not have evidence, and that the page that was found online stating he was a kennel or breeder no longer exists. Mayor Kelly mentioned the Facebook and Instagram page for the dog breeding business. Mr. Anthony said it is no longer online. ADJOURNMENT: Motion by Santoro, seconded by Moses that the Meeting be adjourned. Meeting adjourned at 7:41 pm prevailing time.
