Municipal Building Council Chambers on Tuesday, March 18, 2025 at 6:30 p.m. prevailing time with President Scott Stephenson presiding. CITIZEN COMMENTS ON AGENDA ITEMS: There were no Citizen Comments on Agenda Items. Public Hearing for Inter-Municipal Liquor License Transfer request from R&H PGH LLC. Motion by Kostelnik, seconded by Topolnak that the Inter-Municipal Liquor License Transfer be approved. Roll Call: Seven ayes, zero nays. Motion carried. APPROVAL OF MINUTES: Motion by Kostelnik, seconded by Topolnak that the minutes of the February 18, 2025 Council Meeting be approved. Roll Call Seven ayes, no nays. Motion carried. AGENDA ITEMS: A. ORDINANCE OF THE BOROUGH OF WEST MIFFLIN, ALLEGHENY COUNTY, PENNSYLVANIA, RELATIVE TO THE ADMINISTRATION OF ITS RETIREMENT SYSTEM FOR NON-UNIFORMED EMPLOYEES, TO ADOPT A SEPERATE PLAN DOCUMENT FOR UNREPRESENTED EMPLOYEES FORMERLY PARTICIPATING IN THE BOROUGH’S EXISTING NON-UNIFORMED DEFINED BENEFIT PLAN. RESOLUTION OF COUNCIL OF THE BOROUGH OF WEST MIFFLIN APPROVING THAT THE ACUQISITION AND SUBSEQUENT DISPOSITION OF A PARCEL OF VACANT PROPERTY KNOWN AS LOT AND BLOCK NUMBER 181-  March 18, 2025 8900 H-257 (3716 Greensprings Ave.) WOULD BE IN ACCORD WITH THE COMPREHENSIVE PLAN OF THE MUNICIPALITY. Motion by Davis, seconded by Santoro. Roll Call: Seven ayes, zero nays. Motion carried. C. Motion to approve Consolidation of 3 parcels. Parcel #239-B99, 239-R-8 & 238-R-22. Motion to approve preliminary and final site plan request from Alstom Transportation, allowing construction of a 60’ x 160’ warehouse at 1501 Lebanon Church Road Motion by Davis, seconded by Moses. Motion to approve the change order application for the West Mifflin Pickle Ball Court Paving project, from Pete J. Caruso & Sons, Inc, net change order is $5,169.33. Total cost of project $47,325.98. REPORT OF THE MAYOR: Mayor Kelly thanked District Attorney Zappala and Chief McCullouch for their efforts with Monview Heights. REPORT OF THE SOLICITOR: Solicitor DiLucente read the report for February 2025. REPORT OF THE ENGINEER: Mr. Creagh read the Engineer’s report for February 2025. REPORT OF THE BOROUGH MANAGER: Mr. Kamauf read the Finance Report for the month of February 2025. PAYMENT OF BILLS: Motion by Davis, seconded by Santoro that all bills properly approved by the Finance Committee be paid. Roll Call: Seven ayes, no nays. Motion carried. NEW BUSINESS: No new business for the month of March 2025. CITIZENS COMMENTS: John McClaren Jr 1200 River Road – Mr. McClaren wanted to address rumors that his towing company was offered a contract with the borough and that he did not want it. Mr. McClaren said that this is not true at all and no one person came to him and offered. Mark Yuhas 1016 Dana Drive – Mr. Yuhas asked who will own the property once Century III mall is torn down. Solicitor DiLucente replied that this is still in litigation so the question cannot be answered.  March 18, 2025 8902 Mr. Yuhas asked if Monview Heights will be torn down or repaired as it is such an eye sore. Mr. Davis responded that it is different agencies. Mr. Yuhas said a realtor told his son they are having trouble selling houses in our zip code and it hurt to hear. Mr. Yuhas added that our surrounding communities have recreation centers and libraries, and the newly proposed Recreation Center is a good idea for our Borough. Eileen Straub 200 Castle Drive – Ms. Straub asked if Mr. Anthony was able to get on the property to measure the dog kennel yet. Mr. Anthony responded no he has not, and the permit is still valid so the Borough cannot take any actions against the owner. Ms. Straub asked if Mr. Anthony sent a letter to the owner to request access. Mr. Anthony responded that he sent the letter last month and the owner responded with his work hours and his availability is outside of the Code Enforcement hours. Ms. Straub asked if someone from Code Enforcement is available to work in the evening hours. Mr. Topolnak stated that something needs to be done about this. Mr. Moses asked when the permit is expiring. Mr. Anthony replied that he applied in October 2024 so it is coming up on the expiration date. Solicitor DiLucente stated that Mr. Anthony could go to the Magistrate after the permit period is up. Caroline Vanay – Ms. Vanay asked when the permitting started because it is coming up on two years that this dog problem has been going on. Ms. Vanay said she is living in fear of the dogs next door. Mr. Stephenson agrees that while there is a legal process, something needs to be done because no person wants to live next door to this. Chief McCullouch said that the Police Department gets no calls regarding dogs. Ms. Straub said that her neighbors may be scared to call the police.  March 18, 2025 8903 Mayor Kelly asked if anyone from the Borough has reached out to Allegheny County for assistance with the issue. Mr. Anthony replied that he is not aware. Chief McCulloch stated that until they receive complaints, it would be harassment to keep showing up to the dog owner’s house. Mr. Stephenson asked for clarification on when the permit expires. Mr. Anthony is going to check and let council members know. Jim Jasinski 4100 Home Street – Mr. Jasinksi asked if Hoffman Blvd will be getting paved or is the Borough waiting for the Turnpike to be completed. Mr. Kamauf replied that the Borough is looking at options. Mr. Jasinski suggested to the Council Members to offer Mr. Kamauf a 5- or 10-year contract to thank him for all his hard work. Mr. Jasinski said Mr. Kamauf has been on top of things through all the turmoil over the years. Mr. Stephenson replied that everyone is appreciative of Mr. Kamauf’s hard work.
