MINUTES OF COUNCIL REGULAR MEETING OCTOBER 5, 2021 -1- THE WEST VALLEY CITY COUNCIL MET IN REGULAR ELECTRONIC SESSION ON TUESDAY, OCTOBER 15, 2021, AT 6:30 P.M. IN THE COUNCIL CHAMBERS, WEST VALLEY CITY HALL, 3600 CONSTITUTION BOULEVARD, WEST VALLEY CITY, UTAH. THE MEETING WAS CALLED TO ORDER AND CONDUCTED BY MAYOR BIGELOW. THE MEETING WAS ALSO HELD ELECTRONICALLY VIA ZOOM. APPROVAL OF MINUTES OF REGULAR MEETING HELD SEPTEMBER 28, 2021 The Council considered the Minutes of the Regular Meeting held September 28, 2021. There were no changes, corrections, or deletions.  MINUTES OF COUNCIL REGULAR MEETING OCTOBER 5, 2021 -2- Councilmember Fitisemanu moved to approve the Minutes of the Regular Meeting held September 28, 2021. Councilmember Lang seconded the motion. A voice vote was taken, and all members voted in favor of the motion. COMMENT PERIOD A. PUBLIC COMMENTS Alan Naumann stated that he participated 2 years ago in regard to HB411. He stated that while clean energy may cost a little more money that most people would be willing to spend more to have clean air. He is asking the city to take a huge leap and take part. He mentioned that he has been in the solar power business for 12 years. He would like to invite the council to an event this Saturday regarding electric vehicles. The event will take place in the parking lot of city hall. Mr. Naumann also would like to see a sustainability department within the city. Kirk Lowe stated that this is the first time participating in a council meeting. He is concerned about the city’s stance on zero scaping in yards. He took an online class at Jordan Valley Water Conservator and was told that West Valley City is the only city that has not been out to take a tour or participate. Second, he is concerned about the lack of police presence on the westside of city, therefore would like to request more police patrolling in the neighborhoods. Darrell Curtis stated he lives close to Mountain View Corridor. He would like to have a 4-way stop sign put on Marsha Drive. He is also concerned about the engine brakes noise. He understands that this is not just a city issue, however a county issue as well. Would like to have better policing or cameras installed to record the sound so proof of the noise could be turned into the county due to it affecting the neighborhood. He mentioned signage stating engine brake noise enforced would even be helpful. He doesn’t want to move and doesn’t want this to drive people out of his neighborhood which he believes will happen if we don’t respond. Jim Vesock stated that we should get a seat at HB411. He stated that the last food truck event on Wednesday was very disappointing with less than 50 people in attendance. He mentioned that 2 of the 4 vendors left early due to lack of business. He would like to see Parks and Recreation do something better next year. He stated that city parks are not just used by West Valley City residents, but that people come from Magna, Draper, and West Jordan, therefore they need to be maintained. He stated that there is nothing worse than seeing sprinklers on when it is raining. He also recommended that we should insist our builders take some of the burden off the city financially. He attended the West Valley City Family Fitness Center VIP event. He believes that the fitness center is a crown jewel in the city therefore needs to be taken care of better. He is disappointed in the delay of timeline for some of the Parks and Recreation projects. Also has noticed that the men’s locker room at  MINUTES OF COUNCIL REGULAR MEETING OCTOBER 5, 2021 -3- the West Valley City Family Fitness Center has had a change in temperature going from 73 to now 62.5 degrees. B. CITY MANAGER COMMENTS Wayne Pyle, City Manager, had no comments. B. CITY COUNCIL COMMENTS Councilmember Lang stated that she sits on the Jordan Valley Water Conservator District Board. Mayor Bigelow also stated that he has been to their facility and gone on a tour, however not as a city function, but personally. He mentioned that city staff has become very well versed and have done analysis on the subject. He also stated that there are wise ways to have landscaping even during a drought. PUBLIC HEARINGS A. ACCEPT PUBLIC INPUT REGARDING RE-OPENING THE FY 2021-2022 BUDGET Mayor Bigelow informed a public hearing had been advertised for the Regular Council Meeting scheduled October 5, 2021, regarding re-opening the FY 2021- 2022 Budget. Written documentation previously provided to the City Council included information as follows: State Statute Title 10, Chapter 6, Utah Code Annotated 1953, as amended, allows the City of West Valley to amend its budget during the year. The West Valley City holds public hearings on budget amendments on a quarterly basis each fiscal year. A Public Notice was posted September 23, 2021 in public view at City Hall, the Family Fitness Center and UCCC; also, posted on the Public Notice Website and West Valley City’s Website. Notice was given that a public hearing is to be held October 5, 2021 at 6:30 p.m., West Valley City Hall, 3600 Constitution Blvd., West Valley City, Utah. City staff recommends approval of the Ordinance amending the budget of West Valley City Corporation for the fiscal year beginning July 1, 2021 and ending June 30, 2022, to reflect changes in the budget from increased revenues and authorize the disbursement of funds. Mayor Bigelow opened the Public Hearing. Jim Vesock expressed gratitude for whom prepared the budget. He stated it was very informative and he appreciated the rollover information. He did look for clarification regarding the donations for the Veterans Memorial Project.  MINUTES OF COUNCIL REGULAR MEETING OCTOBER 5, 2021 -4- Mayor Bigelow closed the Public Hearing. ACTION: ORDINANCE NO. 21-58, AMEND THE BUDGET OF WEST VALLEY CITY FOR THE FISCAL YEAR BEGINNING JULY 1, 2021 AND ENDING JUNE 30, 2022 TO REFLECT CHANGES IN THE BUDGET FROM INCREASED REVENUES AND AUTHORIZE THE DISBURSEMENT OF FUNDS The City Council previously held a public hearing regarding proposed Ordinance Ordinance 21-58 that would amend the Budget of West Valley City for the Fiscal Year beginning July 1, 2021 and ending June 30, 2022 to reflect changes in the budget from increased revenues and authorize the disbursement of funds. Upon inquiry by Mayor Bigelow there were no further questions from members of the City Council, and he called for a motion. Councilmember Christensen moved to approve Ordinance 21-58. Councilmember Fitisemanu seconded the motion. A roll call vote was taken: Mr. Fitisemanu Yes Ms. Lang Yes Mr. Buhler Yes Mr. Huynh Yes Mr. Christensen Yes Mr. Nordfelt Yes Mayor Bigelow Yes Unanimous. CONSENT AGENDA A. RESOLUTION 21-175: AUTHORIZE THE CITY TO ENTER INTO A REAL ESTATE PURCHASE AGREEMENT AND ACCEPT A WARRANTY DEED, A PUBLIC UTILITY EASEMENT, AND A TEMPORARY CONSTRUCTION EASEMENT FOR PROPERTY LOCATED AT 4914 WEST 4700 SOUTH Mayor Bigelow discussed proposed Resolution 21-175 that would authorize the City to enter into a Real Estate Purchase Agreement and Accept a Warranty Deed, a Public Utility Easement, and a Temporary Construction Easement for Property Located at 4914 West 4700 South MINUTES OF COUNCIL REGULAR MEETING OCTOBER 5, 2021 -5- Written documentation previously provided to the City Council included information as follows: The Meng Chhour, Sreng Chhour, Ov Lim Chhour, Siv Meng Chhour and Eang Eng Heng parcel located at 4914 West 4700 South is one of several parcels affected by the 4700 South Reconstruction Project (4000 West to 5600 West). This project is being constructed in cooperation with Kearns Metro Township. This project will reconstruct the pavement, curb, gutter, sidewalk and decorative street lighting on both sides of 4700 South and 4715 South to improve safety and ride quality of 4700 South and 4715 South. Compensation for the purchase of the Warranty Deed, Perpetual Easement and a Temporary Construction Easement and improvements is $72,400.00 based upon the appraisal report prepared by Van Drimmelen & Associates, Inc. The project is being funded under the Surface Transportation Program (STP) with federal funds. Kearns Metro Township executed the Federal Aid Agreement with UDOT. West Valley City has signed an Interlocal Agreement with Kearns Metro Township. The city is responsible 6.77% of all project costs, including right of way, within West Valley City jurisdictional limits. The total value for the Warranty Deed, Perpetual Easement and a Temporary Construction Easement is $72,400.00, making the West Valley City share of the acquisition $4,901.48. Upon inquiry by Mayor Bigelow there were no further questions from members of the City Council, and he called for a motion. Councilmember Fitisemanu moved to approve the item on the Consent Agenda. Councilmember Nordfelt seconded the motion.
