MINUTES OF COUNCIL REGULAR MEETING JUNE 20, 2023 -1- THE WEST VALLEY CITY COUNCIL MET IN REGULAR ELECTRONIC SESSION ON TUESDAY, JUNE 20, 2023 AT 6:30 P.M. IN THE COUNCIL CHAMBERS, WEST VALLEY CITY HALL, 3600 CONSTITUTION BOULEVARD, WEST VALLEY CITY, UTAH. THE MEETING WAS CALLED TO ORDER AND CONDUCTED BY MAYOR KAREN LANG. APPROVAL OF MINUTES OF REGULAR MEETING HELD JUNE 13, 2023 The Council considered the Minutes of the Regular Meeting held June 13, 2023. There were no changes, corrections or deletions. Councilmember Nordfelt moved to approve the Minutes of the Regular Meeting held June 13, 2023. Councilmember Huynh seconded the motion.  MINUTES OF COUNCIL REGULAR MEETING JUNE 20, 2023 -2- A voice vote was taken and all members voted in favor of the motion. COMMENT PERIOD A. PUBLIC COMMENTS Bob Whipple requested information on how to obtain meeting attendance rosters for Councilmembers. He expressed concern about needing a light on 6000 West and 3500 South, irrigation problems, traffic, and construction of apartment buildings. Kirk Lowe stated that West Valley City has great golf courses and noted that they are run well. He expressed concern about speeding on King Estate Drive. Roger Day expressed concern about animal control taking his neighbors dog and then telling him that it wasn’t his business when he inquired. He noted that the officer also parked in the middle of the road and was rude. Mike Markham stated that the Council needs to decide on the Form of Government process before interviewing a City Manager because that wouldn’t be fair to a candidate who moves from across the Country for the job. Jim Vesock stated he would like the Form of Government to be placed on the upcoming ballot. He inquired what the status is on Code Enforcement changes. Elizabeth Weight thanked the Council for allowing public comment at every meeting. She indicated that she believes the Form of Government conversation needs to be in depth and Council should take the appropriate time to engage and educate residents. B. CITY MANAGER COMMENTS Nicole Cottle, Assistant City Manager, stated that the Code Enforcement process is in progress. She indicated that the Planning Commission is considering ordinance changes now and everything will come to the Council as one package in a few weeks. C. CITY COUNCIL COMMENTS Councilmember Huynh stated that Mayor Lang does a lot of work and the people of the City should have the opportunity to vote for the Form of Government. PUBLIC HEARINGS  MINUTES OF COUNCIL REGULAR MEETING JUNE 20, 2023 -3- A. ACCEPT PUBLIC INPUT REGARDING RE-OPENING THE FY 2022-2023 BUDGET Mayor Lang informed a public hearing had been advertised for the Regular Council Meeting scheduled June 20, 2023, in order for the City Council to hear and consider public comments regarding re-opening the FY 2022-2023 Budget. Proposed Ordinance 23-20 related to the proposal to be considered by the City Council subsequent to the public hearing, was discussed as follows: Written documentation previously provided to the City Council included information as follows: State Statute Title 10, Chapter 6, Utah Code Annotated 1953, as amended, allows the City to amend its budget during the year. The City holds public hearings on budget amendments on a quarterly basis each fiscal year. A Public Notice was posted June 8, 2023, in public view at City Hall, the Family Fitness Center and UCCC; also, posted on the Public Notice Website and West Valley City’s Website. Notice was given that a public hearing is to be held June 20, 2023, at 6:30 p.m., West Valley City Hall, 3600 Constitution Blvd., West Valley City, Utah. Mayor Lang opened the Public Hearing. There being no one to speak in favor or opposition, Mayor Lang closed the Public Hearing. ACTION: ORDINANCE NO. 23-20, AMEND THE BUDGET OF WEST VALLEY CITY FOR THE FISCAL YEAR BEGINNING JULY 1, 2022 AND ENDING JUNE 30, 2023 TO REFLECT CHANGES IN THE BUDGET FROM INCREASED REVENUES AND AUTHORIZE THE DISBURSEMENT OF FUNDS The City Council previously held a public hearing regarding proposed Ordinance 23-20 that would amend the Budget of West Valley City for the Fiscal Year Beginning July 1, 2022 and Ending June 30, 2023 to Reflect Changes in the Budget from Increased Revenues and Authorize the Disbursement of Funds. Upon inquiry by Mayor Lang there were no further questions from members of the City Council, and she called for a motion. Councilmember Nordfelt moved to approve Ordinance 23-20. Councilmember Christensen seconded the motion. ORDINANCE 23-22: AMEND SECTIONS 1-2-107(4)(K) AND 5(1) OF THE WEST VALLEY CITY MUNICIPAL CODE TO UPDATE THE TOURNAMENT FEES FOR THE WEST VALLEY CITY GOLF COURSES Nicole Cottle, Assistant City Manager, discussed proposed Ordinance 23-22 that would amend Sections 1-2-107(4)(k) and 5(1) of the West Valley City Municipal Code to Update the Tournament Fees for the West Valley City Golf Courses. Written documentation previously provided to the City Council included information as follows: The Parks and Recreation Department golf staff have researched tournament pricing at many public golf courses and compared these fees to their current rates. It was found that the current West Valley City rates are low in comparison. The proposed increase keeps the City’s golf tournament rates aligned with the market. The new rates and format outlined below will not start until the 2024 season. These rates continue to include green fees, carts, and merchandise. Weekday Rates: $65 per player *Weekend Rates: $11,000 course rental for up to 144 players (18 holes) $14,000 course rental for up to 220 players (27 holes) (Stonebridge GC) *Previously, weekend tournaments were set-up similar to weekday tournaments with a per player fee. This has changed in the market to prevent prime time reservations from tournaments with last minute changes. RESOLUTION 23-84: APPROVE AN INTERLOCAL AGREEMENT TO PARTICIPATE IN A CONSORTIUM TO RECEIVE HOME INVESTMENT PARTNERSHIP FUNDS Nicole Cottle, Assistant City Manager, proposed Resolution 23-84 that would approve an Interlocal Agreement to Participate in a Consortium to Receive Home Investment Partnership Funds. Written documentation previously provided to the City Council included information as follows: West Valley City is part of a county wide consortium of cities that receive Housing and Urban Development (HUD) HOME Investment Partnerships (HOME) funds through Salt Lake County. To participate in the Salt Lake County HOME Consortium and receive this funding we must have an interlocal agreement in place with Salt Lake County. The agreement is effective from October 1, 2023 until September 30, 2026. By itself, West Valley City does not qualify for federal HOME program funds through HUD. As part of a larger consortium of cities, however, we have succeeded in qualifying for these funds, with Salt Lake County as the receiving agency. After being notified of our HOME award each year, we will enter into a HOME program agreement with Salt Lake County to spend the funding, then invoice Salt Lake County for reimbursement of eligible expenses. The interlocal agreement details the relationship between West Valley City and Salt Lake County. This interlocal agreement is renewed every three years. CONSENT AGENDA A. RESOLUTION 23-85: AUTHORIZE THE CITY TO ABANDON AN EASEMENT AND A PORTION OF AN EASEMENT LOCATED AT 5456 SOUTH 5600 WEST Nicole Cottle, Assistant City Manager, discussed proposed Resolution 23-85 that would authorize the City to Abandon an Easement and a Portion of an Easement Located at 5456 South 5600 West. Written documentation previously provided to the City Council included information as follows: In 1986 a Storm Drain Retention Pond Easement was recorded in favor of Salt Lake County across property located at 5456 South 5600 West. In 1986 a second Storm Drain Retention Pond Easement was recorded in favor of Salt Lake County, a portion of which is over the area of the earlier easement. As the retention ponds have been modified and approved by West Valley City, the property owner has requested these easements be abandoned by West Valley City. Carpe Diem Auct, LLC is the owner of property located at 5456 South 5600 West, parcel 20-14-231-026, Lot 1 of the Carpe Diem Auctum Subdivision. The above referenced storm drain retention pond easements were recorded in favor of Salt Lake County prior to the Smith’s Annexation in 1995 by West Valley City. After the annexation of property, West Valley City became the successor in interest to Salt Lake County. As the easements are  MINUTES OF COUNCIL REGULAR MEETING JUNE 20, 2023 -7- no longer necessary, an Abandonment of a Portion of a Storm Drain Retention Pond Easement document and an Abandonment of Storm Drain Retention Pond Easement document have been prepared for approval by the West Valley City Council and execution by the mayor. Upon inquiry by Mayor Lang there were no further questions from members of the City Council, and she called for a motion. Councilmember Fitisemanu moved to approve Ordinance 23-16 Councilmember Nordfelt seconded the motion.
