MINUTES OF COUNCIL STUDY MEETING – MAY 21, 2019 -1- THE WEST VALLEY CITY COUNCIL MET IN STUDY SESSION ON TUESDAY, MAY 21, 2019, AT 4:30 P.M. AT WEST VALLEY CITY HALL, MULTIPURPOSE ROOM, 3600 CONSTITUTION BOULEVARD, WEST VALLEY CITY, UTAH. THE MEETING WAS CALLED TO ORDER AND CONDUCTED BY MAYOR PRO-TEM BUHLER. There were no changes, corrections or deletions.  MINUTES OF COUNCIL STUDY MEETING – MAY 21, 2019 -2- Councilmember Nordfelt moved to approve the Minutes of the Study Meeting held May 14, 2019. Councilmember Huynh seconded the motion. A voice vote was taken, and all members voted in favor of the motion. REVIEW AGENDA FOR REGULAR CITY COUNCIL MEETING OF MAY 21, 2019 Upon inquiry by Mayor Pro-Tem Buhler, members of the Council had no further questions or concerns regarding items listed on the Agenda for the Regular City Council Meeting scheduled later this night. AWARDS, CEREMONIES AND PROCLAMATIONS SCHEDULED FOR MAY 28, 2019 A. PRESENTATION OF THE MAYOR'S STAR OF EXCELLENCE AWARDS TO STUDENTS OF GRANGER, HUNTER, CYPRUS, AND TAYLORSVILLE HIGH SCHOOLS Mayor Pro-Tem Buhler and the City Council will be presenting the Star of Excellence Awards to West Valley City students from Granger, Hunter, Cyprus and Taylorsville High Schools. Councilmember Lang recalled how the awards were presented last year. Councilmember Christensen inquired if any changes were made to the requirements to receive the award stating that the number of students had gone down from previous years. Tera Smith, Deputy City Recorder, stated that all requirements are the same. Mayor Pro-Tem Buhler, members of the Council agreed upon doing the same format as was done last year, with the students coming to the podium to state their name and which school they attend. Award certificates will be located on a table outside of the Council Chambers for students to pick-up. ORDINANCE 19-14: AMEND SECTION 16-6-101 OF THE WEST VALLEY CITY MUNICIPAL CODE TO ADOPT THE 2018 EDITION OF THE INTERNATIONAL FIRE CODE Carl Andreasen, Fire Department, presented proposed Ordinance 19-14 that would amend Section 16-6-101 of the West Valley City Municipal Code to adopt the 2018 edition of the International Fire Code. Written documentation previously provided to the City Council included information as follows: Every three years revised editions of the building and fire codes, which are adopted by the State of Utah as the minimal building standards for all buildings within our State, must be adopted by local municipalities to replace the older building and fire codes that are considered obsolete. The  MINUTES OF COUNCIL STUDY MEETING – MAY 21, 2019 -3- building and fire codes are living documents which are subject to revision at annual code development hearings in a national forum. The results of those hearings are published every three years in revised editions. In order to comply with the actions of the State Legislature, and current State law, it is necessary to replace the 2015 edition of the International Fire Code with the 2018 edition. Mayor Pro-Tem Buhler asked if it was routine to adopt the state changes. Carl replied yes. Councilmember Fitisemanu inquired if there were any significant updates or if everything was routine. Carl replied that everything is routine. Councilmember Christensen inquired if there was anything significant changes. Carl replied no. The City Council will consider Ordinance 19-14 at the Regular Council Meeting scheduled May 28, 2019 at 6:30 P.M. RESOLUTION 19-54: AUTHORIZE THE CITY TO ENTER INTO A REAL ESTATE PURCHASE AGREEMENT AND ACCEPT A WARRANTY DEED WITH AND FROM ROBERT AND SHELENE MITCHELL FOR PROPERTY LOCATED AT APPROXIMATELY 4059 SOUTH 6000 WEST Jason Erikson, Parks and Recreation, presented proposed Resolution 19-54 that would authorize the City to enter into a Real Estate Purchase Agreement and accept a Warranty Deed with and from Robert and Shelene Mitchell for property located at approximately 4059 South 6000 West. Written documentation previously provided to the City Council included information as follows: Property owner is willing to sell the 1.24 acres to the city. The property is located between West View Park and the sports field installed at the current end of Mountain View Corridor. Parks and Recreation would like to purchase the property and develop it into park property that would join West View Park to the new sports field. West Valley City assisted UDOT in the construction of the sports field located at the current end of Mountain View Corridor (4100 S and 5908 W) with the plan of obtaining at least one the adjacent properties to link the new field to existing West View Park. Salt Lake County will also be starting construction of phase 3 of the Utah and Salt Lake Canal Trail, which will be located on the south side of the canal and will run adjacent to the property located at 4059 S 6000 W and will join the shared use path along Mountain View corridor to the Utah and Salt Lake Canal Trail.  MINUTES OF COUNCIL STUDY MEETING – MAY 21, 2019 -4- West Valley City Parks and Recreation was contacted by Robert B Mitchell and Shelene S. Mitchell to determine if there was interest in purchasing the property from them. An appraisal of the property was obtained from Valbridge Property Advisors, and an offer of $350,000 was presented and accepted by the Mitchells. Mayor Pro-Tem Buhler inquired if more development would happen towards the south end. Wayne Pyle, City Manager, replied yes that the property has future potential. Mayor Pro-Tem Buhler inquired how we would integrate. Wayne stated by the traffic between the two and the use of programs. More will be decided in the future; however, the main function will be water retention. Mayor Pro-Tem Buhler inquired if the city approached seller. Jason replied that the seller approached the city. Councilmember Lang inquired if the space had enough room for lacrosse or rugby. Jason replied that it does. The City Council will consider Resolution 19-54 at the Regular Council Meeting scheduled May 28, 2019 at 6:30 P.M. RESOLUTION 19-55: AUTHORIZE THE PURCHASE OF A TYMCO 600 STREET SWEEPER FROM INTERMOUNTAIN SWEEPER Erik Brondum, Public Works, presented proposed Resolution 19-55 that would authorize the purchase of a Tymco 600 Street Sweeper from Intermountain Sweeper. Written documentation previously provided to the City Council included information as follows: Intermountain Sweeper submitted a proposal to the Public Works Department. The proposal qualifies under the provisions of the West Valley City Procurement Code 5-3-110, Procurement to Meet Existing Needs. The code allows the procurement of matching equipment when it is beneficial to operations and maintenance. The Fleet Manager and Operations Managers have negotiated the best price available. Intermountain Sweeper is the only authorized Tymco dealer in the state of Utah. Street sweepers are high maintenance vehicles. The current policy of replacing sweepers every four years has proven economical by avoiding high repair costs and recouping high trade-in values for the old sweepers. The street sweeper being replaced is a 2015 Tymco 600. The Public Works Department has used Tymco sweepers for many years, and has been pleased with the equipment performance, and the customer service received from Intermountain Sweeper, the local Tymco vendor. Mayor Pro-Tem Buhler verified that the equipment was brand new, but last years price.  MINUTES OF COUNCIL STUDY MEETING – MAY 21, 2019 -5- Erik replied yes. Mayor Pro-Tem Buhler inquired if there was no new development in street sweeper technology. Erik replied that there has not been. The City Council will consider Resolution 19-55 at the Regular Council Meeting scheduled May 28, 2019 at 6:30 P.M. RESOLUTION 19-56: APPROVE THE LICENSE FOR USE OF WEST VALLEY CITY RIGHT-OF-WAY AT APPROXIMATELY 3550 SOUTH MARKET STREET Dan Johnson, Public Works Department, presented proposed Resolution 19-56 that would approve the License for Use of West Valley City Right-of-Way at approximately 3550 South Market Street. Written documentation previously provided to the City Council included information as follows: With this agreement, West Valley Land Holdings, LLC (“WVLH”, the entity building the Office Tower) will be allowed to construct a pedestrian bridge over Market Street to connect the Fairbourne Station Parking Structure with the Office Tower. Parking for the Office Tower is located in the Parking Structure across Market Street. The plans submitted by WVLH for the Office Tower, include a pedestrian bridge connecting the office building to the parking. This agreement allows WVLH to construct the privately-owned bridge in the City right-of-way, at WVLH’s expense. WVLH is responsible for maintenance of the bridge and must remove the structure upon demand by the City. Mayor Pro-Tem Buhler inquired if this was the plan all along stating he was not aware of a license requirement in the code. Dan replied that an easement was the best way to proceed. Councilmember Lang inquired why the bridge was not straight across from building to building. Dan replied that it was an architectural decision. Mayor Pro-Tem Buhler inquired if the license would need to be perpetual, revoked or renewed. Dan replied that it will need to renew and that the staff was currently working on an update for next weeks meeting to reflect this change. Councilmember Lang inquired if the land holding company would carry the insurance. Dan replied yes. Mayor Pro-Tem Buhler inquired if the bridge was enclosed. Dan replied that it is not. The City Council will consider Resolution 19-56 at the Regular Council Meeting scheduled May 28, 2019 at 6:30 P.M. COMMUNICATIONS A. 4100 SOUTH RECONSTRUCTION PROJECT UPDATE MINUTES OF COUNCIL STUDY MEETING – MAY 21, 2019 -6- Dan Johnson, Public Works, stated that they have presented to council many times before regarding construction on 4100 South, however they wanted to meet with council one more time to go over the public involvement plan. Dan replied that roads have provisions and one side of the street will always be open. Mayor Pro-Tem Buhler stated that he hadn’t heard much especially since the project is staring in a week. Dan replied that they have had traffic managed, but now will be taking the two lanes down to one lane. Councilmember Christensen inquired how west of 5600 West and 3500 South will be impacted. Dan replied that UDOT has restrictions on lanes and 3500 South will not be as impacted as 4100. Katie also wanted to thank Sam Johnson for the social media advertising and stated that an article would be printed in the Valley Journal. Katie also stated that she would be leaving cards that included the hotline phone number, email and website for information regarding the reconstruction project. Councilmember Fitisemanu inquired if Spanish translation was available. Katie replied that they do have that available. Mayor Pro-Tem Buhler thanked Katie for her presentation and asked if Wayne Pyle, City Manager, had any further comments. Wayne also thanked Katie for the presentation and stated that he did have any further comments. B. COUNCIL CALENDAR Mayor Pro-Tem Buhler referenced a Memorandum previously received from the City Manager that outlined upcoming meetings and events. Mayor Pro-Tem Buhler stated that many events are coming up. Members of the City Council had no further questions regarding the Council Update. NEW BUSINESS A. POTENTIAL FUTURE AGENDA ITEMS Council Suggestions Councilmember Fitisemanu inquired if a simplified version of the sign ordinance for future candidates running for office could be made available. He stated that the ordinance is a little hard to follow and when he was campaigning it took the assistance of city staff break down the code. Wayne Pyle, City Manager, stated that he would work with Nichole Camac, City Recorder, on this and report back next week.  MINUTES OF COUNCIL STUDY MEETING – MAY 21, 2019 -8- B. COUNCIL REPORTS COUNCILMEMBER CHRISTENSEN – HILLTOP GOSPEL CHOIR, WESTERN GROWTH COALITION Councilmember Christensen stated that he attended the Hilltop Gospel Choir Concert last Friday at the Trinity United Methodist Church. He stated that he also attended the Western Growth Coalition meeting on Monday. They would like to focus on transportation, transportation infrastructure and affordable housing. He stated that the goals seemed like ChamberWest. MAYOR PRO-TEM BUHLER – CROSSING GUARDS BANQUET, ESQR (EMPLOYER SUPPORT OF THE GUARD AND RESERVE) AWARDS BANQUET Mayor Pro-Tem Buhler attended the Crossing Guards Banquet. He was told that there was a limited invitation list due to outgrowing the golf courses that the event is held at. Mayor Pro-Tem Buhler also attended this year’s ESGR Awards Banquet. West Valley City was presented the Pro Patria award for 2019. Wayne Pyle, City Manager, stated that we should know this week the city won the Freedom Award. Mayor Pro-Tem Buhler requested that if the city does win to include the award on a future agenda. COUNCILMEMBER LANG – CROSSING GUARDS BANQUET Councilmember Lang attended the Crossing Guards Banquet. She stated that the event had many school principals and coordinators. And that one was presented with an award. MOTION TO ADJOURN Upon motion by Councilmember Huynh all voted in favor to adjourn.
