MINUTES OF COUNCIL STUDY MEETING – OCTOBER 8, 2019 -1- THE WEST VALLEY CITY COUNCIL MET IN STUDY SESSION ON TUESDAY, OCTOBER 8, 2019, AT 4:30 P.M. AT WEST VALLEY CITY HALL, MULTIPURPOSE ROOM, 3600 CONSTITUTION BOULEVARD, WEST VALLEY CITY, UTAH. THE MEETING WAS CALLED TO ORDER AND CONDUCTED BY MAYOR BIGELOW. VIEW NEW FIRE ENGINES The Mayor and City Council went outside City Hall and toured 3 new Fire Engines.  MINUTES OF COUNCIL STUDY MEETING – OCTOBER 8, 2019 -2- APPROVAL OF MINUTES OF STUDY MEETING HELD OCTOBER 1, 2019 The Council considered the Minutes of the Study Meeting held October 1, 2019. There were no changes, corrections or deletions. Councilmember Fitisemanu moved to approve the Minutes of the Study Meeting held October 1, 2019. Councilmember Christensen seconded the motion. A voice vote was taken and all members voted in favor of the motion. REVIEW AGENDA FOR REGULAR CITY COUNCIL MEETING OF OCTOBER 8, 2019 Upon inquiry by Mayor Bigelow, members of the Council had no further questions or concerns regarding items listed on the Agenda for the Regular City Council Meeting scheduled later this night. PUBLIC HEARINGS SCHEDULED FOR OCTOBER 15, 2019 A. ACCEPT PUBLIC INPUT REGARDING APPLICATION S-6-2019, FILED BY KEVIN NEWMAN, REQUESTING FINAL PLAT APPROVAL FOR THE BAILEY ACRES SUBDIVISION LOCATED AT 3600 SOUTH 5600 WEST Mayor Bigelow informed a public hearing had been advertised for the Regular Council Meeting scheduled October 15, 2019, in order for the City Council to hear and consider public comments regarding application S-6-2019, filed by Kevin Newman, requesting Final Plat Approval for the Bailey Acres Subdivision located at 3600 South 5600 West. Proposed Ordinance 19-42 related to the proposal to be considered by the City Council subsequent to the public hearing, was discussed as follows: ACTION: ORDINANCE NO. 19-42, APPROVE THE AMENDMENT OF LOT 1 JONESDALE SUBDIVISION NO. 7 Steve Lehman, CED, discussed proposed Ordinance 19-42 that would approve the Amendment of Lot 1 Jonesdale Subdivision No. 7. Written documentation previously provided to the City Council included information as follows: Mr. Kevin Newman, representing the Bailey family, is requesting final plat approval for the Bailey Acres Subdivision and the amendment of lot 1 Jonesdale Subdivision No. 7. The developer is proposing to subdivide the existing parcel into 5 lots. Due to the configuration of the property, the  MINUTES OF COUNCIL STUDY MEETING – OCTOBER 8, 2019 -3- owner of lot 1 Jonesdale Subdivision No. 7, has asked that the property owner sell him approximately 4800 square feet to increase the size of his lot. The total lot count for the proposed subdivision will be 6 lots. Existing dwellings located on lots 1 and 6 will remain. Although zoned R-1-8, the average lot size has been calculated at approximately 11,720 square feet. Access to the subdivision will be gained from 5600 West (for the existing dwelling on lot 6) and from 5650 West and a private lane for the remainder of the lots. Public improvements exist on both 5600 West and 5650 West. The private lane will provide access to lots 4 and 5. A cross easement will be generated by the subdivision plat addressing access, utilities and maintenance responsibilities. The developer will be required to install a 6-foot solid masonry wall along 5600 West. It is anticipated that a post and panel wall will be the choice of wall used here. Between the wall and sidewalk along 5600 West exists a small gap. The developer will be required to install stamped colored concrete here to help reduce maintenance on the outside of the subdivision. Mayor Bigelow asked if the private lane is large enough to for a fire truck to access. Steve replied yes but noted that the Fire Department has stated that in the event of an emergency, crews would access the lots by foot. Mayor Bigelow clarified that lots could not be further subdivided. Steve replied no. Councilmember Buhler asked if the applicant is asking for anything in addition to standard approval. Steve replied that this is an administrative action. Mayor Bigelow asked why the masonry wall is required. Steve replied this is required per City ordinance. Mayor Bigelow asked who would be responsible for maintenance of the wall. Steve replied the property owner. Wayne noted that the City will often work with the property owner to remove graffiti or simply remove graffiti on its own. The City Council will consider Ordinance 19-38 at the Regular Council Meeting scheduled September 17, 2019 at 6:30 P.M. RESOLUTION 19-131: REQUEST THE RECERTIFICATION OF THE WEST VALLEY CITY JUSTICE COURT BY THE UTAH JUDICIAL COUNCIL AND THE JUSTICE COURTS STANDARDS COMMITTEE Eric Bunderson, City Attorney, presented proposed Resolution 19-131 that would recertify the West Valley City Justice Court by the Utah Judicial Council and the Justice Courts Standards Committee. Written documentation previously provided to the City Council included information as  MINUTES OF COUNCIL STUDY MEETING – OCTOBER 8, 2019 -4- follows: The West Valley City Justice Court operates under the authority of the Utah Code and the rules of the Utah Judicial Council and is certified by the Utah Judicial Council and the Justice Courts Standards Committee. Every four years the Justice Court must be recertified by these entities to ensure that the Justice Court is operating in compliance with the applicable laws and regulations. The City was recently notified by the Administrative Office of the Courts that the West Valley City Justice Court is due for recertification. This Resolution affirms the City’s willingness to continue to meet all necessary and reasonable requirements set forth by the Utah Code and the Utah Judicial Council for continued operation of the Justice Court for another four-year term The Mayor and Council verified that West Valley City judges must meet all Judicial guidelines. Eric replies yes. The City Council will consider Resolution 19-131 at the Regular Council Meeting scheduled October 15, 2019 at 6:30 P.M. RESOLUTION 19-132: APPROVE AGREEMENTS BETWEEN WEST VALLEY CITY AND SALT LAKE COUNTY TO PROVIDE "ZOO, ARTS, AND PARKS FUNDS" TO THE UTAH CULTURAL CELEBRATION CENTER AND TO THE HARMAN THEATRE Andrew Wallentine, Administration, presented proposed Resolution 19-132 that would approve agreements between West Valley City and Salt Lake County to provide "Zoo, Arts, and Parks Funds" to the Utah Cultural Celebration Center and to the Harman Theatre. Written documentation previously provided to the City Council included information as follows: The Utah Cultural Celebration Center will primarily use Zoo Arts and Parks (ZAP) funding for General Program Development in four designated areas: 1) educational programming and workshops, 2) festivals, celebrations, and concerts, 3) personnel, and 4) gallery exhibitions. With this new funding, the Cultural Center will be able to expand its community-based arts and cultural programming. The Center will also be able to reach a greater number of West Valley City and Salt Lake County residents of all ages and income levels who represent many cultural and ethnic groups.  MINUTES OF COUNCIL STUDY MEETING – OCTOBER 8, 2019 -5- The Cultural Center has become the preferred destination for many high quality and diverse cultural and arts events that reflect the interests of the community and enhance the image of West Valley City. The Cultural Center is poised to continue maximizing the benefits that will result from the yearly ZAP financial award. Over the next twelve months, the Center will develop community programming, continue to seek and expand diversified funding sources, and collaborate on opportunities for residents to experience quality multidisciplinary arts and cultural programming. The Harman Theatre will serve as an additional opportunity to achieve these goals and enhance the artistic and cultural life of the City. Mayor Bigelow noted that the City has a great program and indicated that there have been conversations to move to Tier 1 funding. The City Council will consider Resolution 19-132 at the Regular Council Meeting scheduled October 15, 2019 at 6:30 P.M. COMMUNICATIONS B. COUNCIL CALENDAR Mayor Bigelow referenced a Memorandum previously received from the City Manager that outlined upcoming meetings and events. Mayor Bigelow noted that the Springhill groundbreaking is tomorrow. Members of the City Council had no further questions regarding the Council Update. NEW BUSINESS A. POTENTIAL FUTURE AGENDA ITEMS Council Suggestions Nichole Camac, City Recorder, indicated that the Utah Cultural Celebration Center is looking for a judge for the Catrina Contest on November 2, 2019. Councilmember Fitisemanu and Councilmember Christensen volunteered. B. COUNCIL REPORTS COUNCILMEMBER FITISEMANU- UCCC EVENT Councilmember Fitisemanu stated that the First Lady of Micronesia will be visiting the Utah Cultural Celebration Center late tonight. He indicated that he will be attending the event with other community goers and she will be hosting a community forum.  MINUTES OF COUNCIL STUDY MEETING – OCTOBER 8, 2019 -6- MAYOR BIGELOW- JORDAN RIVER COMMISSION, 20th ANNIVERSARY FOR WEST VALLEY FAMILY FITNESS CENTER, WASATCH FRONT REGIONAL COUNCIL Mayor Bigelow indicated that he attended a Jordan River Commission meeting. He stated that the City is very involved and discussed butterflies, milkweed projects, grants, and projects to enhance the quality of the river. Mayor Bigelow stated that he attended the 20th Anniversary of the West Valley Family Fitness Center. He indicated that it was a great event with a good program and celebration. Mayor Bigelow also briefly discussed the Wasatch Regional Council meeting. MOTION TO ADJOURN Upon motion by Councilmember Christensen all voted in favor to adjourn.
