MINUTES OF COUNCIL STUDY MEETING – DECEMBER 14, 2021 -1- THE WEST VALLEY CITY COUNCIL MET IN ELECTRONIC STUDY SESSION ON TUESDAY, DECEMBER 14, 2021 AT 4:30 P.M. AT WEST VALLEY CITY HALL, MULTIPURPOSE ROOM, 3600 CONSTITUTION BOULEVARD, WEST VALLEY CITY, UTAH. THE MEETING WAS CALLED TO ORDER AND CONDUCTED BY MAYOR BIGELOW. THE MEETING WAS ALSO HELD ELECTRONICALLY VIA ZOOM. THE FOLLOWING MEMBERS WERE PRESENT: Ron Bigelow, Mayor Lars Nordfelt, Councilmember At-Large Don Christensen, Councilmember At-Large Tom Huynh, Councilmember District 1 (electronically) Steve Buhler, Councilmember District 2 Karen Lang, Councilmember District 3 Jake Fitisemanu, Councilmember District 4 STAFF PRESENT: Wayne T Pyle, City Manager Nichole Camac, City Recorder Nicole Cottle, Assistant City Manager/General Counsel Eric Bunderson, City Attorney Colleen Jacobs, Police Chief John Evans, Fire Chief Jim Welch, Finance Director Steve Pastorik, CED Director Layne Morris, CPD Director Dan Johnson, Public Works Director Nancy Day, Parks and Recreation Director John Flores, HR Director Sam Johnson, Strategic Communications Director Ken Cushing, IT APPROVAL OF MINUTES OF STUDY MEETING HELD DECEMBER 7, 2021 The Council considered the Minutes of the Study Meeting held December 7, 2021. There were no changes, corrections or deletions. Councilmember Nordfelt moved to approve the Minutes of the Study Meeting held December 7, 2021. Councilmember Lang seconded the motion.  MINUTES OF COUNCIL STUDY MEETING – DECEMBER 14, 2021 -2- A voice vote was taken and all members voted in favor of the motion. REVIEW AGENDAS FOR REGULAR CITY COUNCIL MEETING AND SPECIAL REDEVELOPMENT AGENCY MEETING OF DECEMBER 14, 2021 GPZ-15-2021 Steve Pastorik indicated that he spoke with the developer regarding adding curb, gutter, and sidewalk to the project. He stated that their preference would be to not add these improvements because it would require the removal of mature trees. Mayor Bigelow stated that he feels a solution could still be found that would allow for both options. Wayne noted that there are no sidewalks or improvements on this side of 5450 West. Councilmember Lang stated that this area is changing from agriculture to residential and as families move into these units, the need for sidewalks will become a higher priority. She indicated that she would rather have the developer install the improvements now and not have the City be responsible in the future. Councilmember Buhler noted that drainage will likely become an issue for neighboring property owners because runoff will have no where to go since there are no other improvements on this side of the street. Councilmember Lang stated that there are only about 4 trees that would be removed. Mayor Bigelow stated that he would be comfortable with a meandering sidewalk. Councilmember Lang noted that there are drainage solutions. GPZ-14-2021 Steve Pastorik indicated that the applicant has removed one unit and added an additional 16 parking stalls. Councilmember Lang stated that she likes this improvement but added that she would like 3200 West signed as no parking. Councilmember Nordfelt stated that the 3200 West is not wide enough for people to park on. Wayne added that if the issue arises, the City can sign streets as no parking at any time. Mayor Bigelow stated that tenants may end up using parking stalls as their parking spaces. Councilmember Christensen stated that the HOA would be responsible for enforcement. SMI-6-2021 – SMI-11-2021 Eric Bunderson stated that Legal has reviewed State statues and City ordinances and has found that the application is in compliance and is legal as detailed in the memo emailed to the City Council the previous day. Councilmember Lang stated that she is uncomfortable with the application because it needed an interpretation from Legal. She stated that she would not be comfortable moving forward with his until the language in the Code could be cleaned up. Mayor Bigelow stated that Valley Fair mall is like West Valley City’s downtown. He indicated that this is a walkable community and should be treated differently than other strip malls in other parts of the City. Councilmember Lang stated that the ordinance is not clear and she believes strip malls should be allowed on ½ acre lots. Wayne stated that the Council can discuss and change this policy moving forward if they would like but this application is separate from that discussion. He indicated that Legal has  MINUTES OF COUNCIL STUDY MEETING – DECEMBER 14, 2021 -3- reviewed and determined that these lots are legal and this is an administrative application. Councilmember Lang stated that she struggles with the interpretation. Councilmember Huynh agreed. Councilmember Buhler stated that the City’s Attorney has reviewed this application and has determined that it is legal. He indicated that since this is an administrative application, the applicant can sue the City if it is denied. He noted that the applicant will win that lawsuit and will use the meeting minutes and recording as evidence and that will result in a costly battle for taxpayers. Mayor Bigelow agreed and stated that the strip mall definition can be clarified but that would need to occur at a future date. RDA Meeting Wayne indicated that Karen Lang will not be able to serve as Chair for the January 4, 2022 RDA meeting since she will be presiding as Mayor. He indicated that the Council will need to appoint a temporary Chair for that meeting so the official Chair and Vice-Chair for the 2022 year can be formally chosen. Bangerter Highway Resolution Mayor Bigelow noted that that the resolution for Bangerter Highway was updated with further detail on the Option 6 solution that was preferred by Council. Upon inquiry by Mayor Bigelow, members of the Council had no further questions or concerns regarding items listed on the Agendas for the Regular City Council and Special Redevelopment Agency meetings scheduled later this night. PUBLIC HEARINGS SCHEDULED FOR JANUARY 4, 2022 A. ACCEPT PUBLIC INPUT REGARDING RE-OPENING THE FY 2021-2022 BUDGET Mayor Bigelow informed a public hearing had been advertised for the Regular Council Meeting scheduled January 4, 2022, in order for the City Council to hear and consider public comments regarding Re-Opening the FY 2021-2022 Budget Proposed Ordinance 21-68 related to the proposal to be considered by the City Council subsequent to the public hearing, was discussed as follows: ACTION: ORDINANCE NO. 21-68, AMEND THE BUDGET OF WEST VALLEY CITY FOR THE FISCAL YEAR BEGINNING JULY 1, 2021 AND ENDING JUNE 30, 2022 TO REFLECT CHANGES IN THE BUDGET FROM INCREASED REVENUES AND AUTHORIZE THE DISBURSEMENT OF FUNDS Jim Welch, Finance Director, discussed proposed Ordinance 21-68 that would amend the Budget of West Valley City for the Fiscal Year Beginning July 1, 2021 and Ending June 30, 2022 to Reflect Changes in the Budget from Increased Revenues and Authorize the Disbursement of Funds.  MINUTES OF COUNCIL STUDY MEETING – DECEMBER 14, 2021 -4- Written documentation previously provided to the City Council included information as follows: State Statute Title 10, Chapter 6, Utah Code Annotated 1953, as amended, allows the City of West Valley to amend its budget during the year. The West Valley City holds public hearings on budget amendments on a quarterly basis each fiscal year. A Public Notice was posted December 9, 2021 in public view at City Hall, the Family Fitness Center and UCCC; also, posted on the Public Notice Website and West Valley City’s Website. Notice was given that a public hearing is to be held January 4, 2022 at 6:30 p.m., West Valley City Hall, 3600 Constitution Blvd., West Valley City, Utah The City Council will consider Ordinance 21-68 at the Regular Council Meeting scheduled January 4, 2022 at 6:30 P.M. CONSENT AGENDA SCHEDULED FOR JANUARY 4, 2022 A. RESOLUTION 21-215: AUTHORIZE THE CITY TO ENTER INTO A RIGHT OF WAY PURCHASE AGREEMENT AND ACCEPT A WARRANTY DEED AND A TEMPORARY CONSTRUCTION EASEMENT WITH AND FROM XIUMENG WU AND JIANAN XIAO FOR PROPERTY LOCATED AT 2554 SOUTH LAKE CREST DRIVE Mayor Bigelow discussed proposed Resolution 21-215 that would authorize the City to enter into a Right Of Way Purchase Agreement and Accept a Warranty Deed and a Temporary Construction Easement with and from Xiumeng Wu and Jianan Xiao for Property Located at 2554 South Lake Crest Drive Written documentation previously provided to the City Council included information as follows: The Xiumeng Wu and Jianan Xiao property is one of several properties affected by the required removal and replacement of pedestrian ramps to meet current ADA standards as part of the 2022 Pedestrian Ramp Project. As part of this project pedestrian ramps will be constructed at various locations throughout the city in locations where they do not currently exist and existing pedestrian ramps which do not comply with current ADA standards will be removed and replaced.  MINUTES OF COUNCIL STUDY MEETING – DECEMBER 14, 2021 -5- The Warranty Deed and the Temporary Construction Easement will facilitate construction of the pedestrian ramps. Compensation in the amount of $425.00 was negotiated based upon land values for properties in the area. Upon inquiry, there were no further questions or concerns expressed by members of the City Council. Nancy replied that the Brock property is owned by the City but the Crane and Conde properties are still in progress. The Mayor and Council had no further questions or concerns. B. COUNCIL CALENDAR Mayor Bigelow referenced a Memorandum previously received from the City Manager that outlined upcoming meetings and events. COUNCIL REPORTS Mayor Bigelow indicated that he, Councilmember Christensen, and Councilman Huynh attended the ribbon cutting event for Raising Cane.  MINUTES OF COUNCIL STUDY MEETING – DECEMBER 14, 2021 -10- C. REVIEW AGENDAS FOR THE ANNUAL REDEVELOPMENT AGENCY, HOUSING AUTHORITY, AND MUNICIPAL BUILDING AUTHORITY MEETINGS SCHEDULED JANUARY 4, 2022 Wayne Pyle indicated that the Annual Meetings for the Redevelopment Agency, Housing Authority, and Municipal Building Authority Meetings will be held January 4, 2022. He noted that the only items on all three agendas are approval of minutes and the election of the new Chair’s and Vice Chair’s. Mayor Bigelow indicated that this was both he and Councilmember Buhler’s final Study Meeting. He indicated that it has been a great experience and he has appreciated differing opinions and viewpoints over the years because it has added a great deal to the benefit of the City.
