MINUTES OF COUNCIL STUDY MEETING – MAY 3, 2022 -1- THE WEST VALLEY CITY COUNCIL MET IN ELECTRONIC STUDY SESSION ON TUESDAY, MAY 3, 2022 AT 4:30 P.M. AT WEST VALLEY CITY HALL, MULTIPURPOSE ROOM, 3600 CONSTITUTION BOULEVARD, WEST VALLEY CITY, UTAH. THE MEETING WAS CALLED TO ORDER AND CONDUCTED BY MAYOR LANG. THE MEETING WAS ALSO HELD ELECTRONICALLY VIA ZOOM. There were no changes, corrections or deletions. Councilmember Huynh moved to approve the Minutes of the Study Meeting held April 26, 2022. Councilmember Christensen seconded the motion. MINUTES OF COUNCIL STUDY MEETING – MAY 3, 2022 -2- A voice vote was taken and all members voted in favor of the motion. REVIEW AGENDAS FOR REGULAR CITY COUNCIL, REDEVELOPMENT AGENCY, HOUSING AUTHORITY, AND MUNICIPAL BUILDING AUTHORITY MEETINGS OF MAY 3, 2022 Upon inquiry by Mayor Lang, members of the Council had no further questions or concerns regarding items listed on the Agenda for the Regular City Council, Redevelopment Agency, Housing Authority, and Municipal Building Authority meetings scheduled later this night. PUBLIC HEARINGS SCHEDULED FOR MAY 10, 2022 A. ACCEPT PUBLIC INPUT REGARDING APPLICATION Z-2-2022, FILED BY MOORE HOMES LC, REQUESTING A ZONE CHANGE FROM A (AGRICULTURE, MINIMUM LOT SIZE 1/2 ACRE) TO RM (MULTIPLE UNIT DWELLING RESIDENTIAL) AND R-1-10 (SINGLE UNIT DWELLING RESIDENTIAL) FOR PROPERTY LOCATED AT 4590 SOUTH 5600 WEST Mayor Lang informed a public hearing had been advertised for the Regular Council Meeting scheduled May 3, 2022, in order for the City Council to hear and consider public comments regarding application Z-2-2022, Filed by Moore Homes LC, requesting a Zone Change from A (Agriculture, Minimum Lot Size 1/2 Acre) to RM (Multiple Unit Dwelling Residential) and R-1-10 (Single Unit Dwelling Residential) for Property Located at 4590 South 5600 West. Proposed Ordinance 22-17 and Resolution 22-72 related to the proposal to be considered by the City Council subsequent to the public hearing, was discussed as follows: ACTION: ORDINANCE NO. 22-17, AMEND THE ZONING MAP TO SHOW A CHANGE OF ZONE FOR PROPERTY LOCATED AT 4590 SOUTH 5600 WEST FROM A (AGRICULTURE, MINIMUM LOT SIZE 1/2 ACRE) TO RM (MULTIPLE UNIT DWELLING RESIDENTIAL) AND R- 1-10 (SINGLE UNIT DWELLING RESIDENTIAL, MINIMUM LOT SIZE 10,000 SQUARE FEET) Steve Pastorik, CED Director, discussed proposed Ordinance 22-17 that would amend the Zoning Map to Show a Change of Zone for Property Located at 4590 South 5600 West from A (Agriculture, Minimum Lot Size 1/2 Acre) to RM (Multiple Unit Dwelling Residential) and R-1-10 (Single Unit Dwelling Residential, Minimum Lot Size 10,000 Square Feet). Written documentation previously provided to the City Council included information as follows: MINUTES OF COUNCIL STUDY MEETING – MAY 3, 2022 -3- The applicant’s concept plan includes an 86-unit, 2 story townhome development on 9 acres, 2 single unit dwelling lots and a cul-de-sac on 1 acre, and a 1-acre City park. The density of the townhome portion of the project is 8.6 units/acre including the 1-acre park and 9.6 units/acre excluding the 1-acre park. The attached concept plan and development agreement provide details on the proposed project. By way of background, a zone change request submitted by DR Horton on this same property was denied by the City Council back in 2020. The table below compares this latest proposal from Moore Homes LC with the DR Horton proposal that was denied. Townhome Interiors Not addressed Commitments to interior finishes and energy saving features Density of 12 units/acre 8.6 units/acre Townhomes City Park Not included 1 Acre ACTION: RESOLUTION NO. 22-72, AUTHORIZE THE CITY TO ENTER INTO A DEVELOPMENT AGREEMENT WITH MOORE HOMES, LC FOR APPROXIMATELY 10.97 ACRES OF PROPERTY LOCATED AT APPROXIMATELY 4590 SOUTH 5600 WEST Steve Pastorik, CED Director, discussed proposed Resolution 22-72 that would authorize the City to Enter into a Development Agreement with Moore Homes, LC for Approximately 10.97 Acres of Property Located at Approximately 4590 South 5600 West Written documentation previously provided to the City Council included information as follows: MINUTES OF COUNCIL STUDY MEETING – MAY 3, 2022 -4- Randy Moore has submitted a zone change application (Z-2-2022) on 10.97 acres to change the zoning from A (Agriculture, minimum lot size ½ acre) to RM (Multiple Unit Dwelling Residential) and R-1-10 (Single Unit Dwelling Residential, minimum lot size 10,000 square feet). The Planning Commission recommended approval of the zone change subject to a development agreement. The proposed development agreement addresses the following topics:  Maximum number of townhome units  Minimum townhome unit sizes  Architecture  Interior finishes  Amenities  One-acre of property to be dedicated as a City park  Standards for the two new single unit dwellings  Multi-unit residential design standards from City Code Councilmember Christensen stated that there was concern several years ago on the previous proposal from residents about a multi-family development at this location. Steve replied that some of the issues brought up by residents were addressed which include units being further from the fence, addition of a park, increased size of units and basements, etc. Councilmember Nordfelt asked what type of fences would be installed. Steve replied the applicant is proposing a pre-cast wall along 5600 West which also includes small strip of landscaping. He noted that the fencing next to residential is proposed as vinyl. Councilmember Harmon asked what the small private street in the southeast corner of the proposal is. Steve replied that this is a private drive along an easement for Dominion Energy to access their property. Councilmember Nordfelt asked how often the train goes through this area. Steve replied the answers have varied but residents living nearest this proposal have stated it’s daily. Mayor Lang asked if there is enough open space proposed in the project without the park option. Steve replied yes. Councilmember Whetstone asked what the density per acre for this project is. Steve replied concept 1 (with the park) is 8.3 units/acre and concept 2 (without the park) would be 9.1 units/acre. Councilmember Harmon stated that the City doesn’t have many large parcels left and he’d like to see those go toward RE or RS zones. Steve replied that this property would not be eligible for RS due to its size. Councilmember Nordfelt asked when the Council would vote on this item. Steve replied that this was noticed prior to the Council’s request for a three-week process so it would be considered by the Council next week on May 10, 2022. Councilmember Harmon asked if a traffic study has been MINUTES OF COUNCIL STUDY MEETING – MAY 3, 2022 -5- conducted. Steve replied no. Councilmember Nordfelt stated that he doesn’t see traffic being a concern at this location. Councilmember Whetstone agreed and noted that Mountain View Corridor has helped with traffic on 5600 West. The City Council will consider Ordinance 22-17 and Resolution 22-72 at the Regular Council Meeting scheduled May 10, 2022 at 6:30 P.M. ORDINANCE 22-20: AMEND SECTIONS 1-2-102 AND 1-2-107 OF THE WEST VALLEY CITY MUNICIPAL CODE TO UPDATE CERTAIN PARKS AND RECREATION FEES Nancy Day, Parks and Recreation Director, presented proposed Ordinance 22-20 that would amend Sections 1-2-102 and 1-2-107 of the West Valley City Municipal Code to Update Certain Parks and Recreation Fees. Written documentation previously provided to the City Council included information as follows: The Parks and Recreation Department has a variety of fees for services that may require small changes at times based upon costs associated with providing these services and programs. Department staff work to efficiently monitor these fees and determine if changes need to be made. Due to the quantity of these type of fees, a change was approved which authorized the City Manager to review and approve certain fees for community and recreational services based on several conditions. This is found in the Consolidated Fee Schedule under section 1-2-107 (7) entitled Community and Recreational Services Fees. The Parks and Recreation Department would like to include several additional fees within this section. These include:  Family Fitness Center: o Childcare Fees o Kidz Kamp Program Fees o Kindergarten Kamp Fees o Afterschool Kamp Fees  Golf Courses: o Green Fees o Cart Fees o Club Rental Fees o Driving Range Ball Bucket Fees o Tournament Fees o Player Pass Fees  UCCC: MINUTES OF COUNCIL STUDY MEETING – MAY 3, 2022 -6- o Rental Fees Councilmember Christensen asked why park user fees were left in the proposal. Nancy replied that staff left some of the fees that they felt Council would like to review. Mayor Lang asked if there is a fee to utilize the football fields. Nancy replied that these are usually reserved by contract with third party groups and are not part of the fee schedule. Mayor Lang asked if the users of the fields are West Valley City residents. Nancy replied that there may be some crossover but the youth sports are tied to school district boundaries. Councilmember Whetstone asked if this proposal to allow the City Manager the option of reviewing and raising these fees is because they are common and less unique. Nancy replied yes. The City Council will consider Ordinance 22-20 at the Regular Council Meeting scheduled May 10, 2022 at 6:30 P.M. COMMUNICATIONS A. BUDGET/PROGRAM MOD UPDATE Wayne Pyle, City Manager, stated that there have been no changes. He indicated that there are different variables that could change in the coming weeks that will not impact the bottom line. Mr. Pyle noted that program mod proposals can be adjusted between now and the adoption of the final budget as well. Mayor Lang asked how much the proposed tax increase will be. Wayne replied around 9% which equates to $5 a month or around $60 a year. Councilmember Whetstone asked if there could be a small discretionary fund balance for each councilmember to utilize in their district. Wayne replied that there are funds available but these can be divided or modified as well if the Council wishes. The Mayor and Council discussed and agreed that any Councilmember could bring a proposal to the Council as a whole for consideration. The Mayor and Council had no further questions or concerns. B. COUNCIL CALENDAR Mayor Lang referenced a Memorandum previously received from the City Manager that outlined upcoming meetings and events. Members of the City Council had no further questions regarding the Council Update. NEW BUSINESS A. POTENTIAL FUTURE AGENDA ITEMS Councilmember Huynh questioned when the KPI discussion would occur. Mayor Lang replied that she is working on compiling the information sent. MINUTES OF COUNCIL STUDY MEETING – MAY 3, 2022 -7- Councilmember Huynh stated that he would like to review the Maverik Center financial statement. Councilmember Harmon asked for information on how the Olympic Committee meeting went. Wayne replied that he met with several representatives at the Maverik Center and the facility and possible planning was discussed at length. He detailed the conversation and possible options moving forward. B. COUNCIL REPORTS MAYOR LANG- TREE PLANTING Mayor Lang stated that she attended the Arbor Day tree planting. She indicated that there were many unique, fun trees being added and stated that it might be fun to add a plaque that details what each tree is. MOTION FOR CLOSED SESSION Councilmember Christensen moved to adjourn and reconvene in a Closed Session for discussion of pending litigation. Councilmember Harmon seconded the motion. A voice vote was taken and all members voted in favor of the motion.
