There were no changes, corrections or deletions.  MINUTES OF COUNCIL STUDY MEETING – NOVEMBER 15, 2022 -2- Councilmember Huynh moved to approve the Minutes of the Study Meeting held November 1, 2022. Councilmember Nordfelt seconded the motion. A voice vote was taken and all members voted in favor of the motion. REVIEW AGENDA FOR REGULAR CITY COUNCIL MEETING OF NOVEMBER 15, 2022 Upon inquiry by Mayor Lang, members of the Council had no further questions or concerns regarding items listed on the Agenda for the Regular City Council meeting scheduled later this night. PROCLAMATIONS A. PROCLAMATION DECLARING NOVEMBER 26, 2022 AS SMALL BUSINESS SATURDAY Mayor Lang stated that the Council will pass a Proclamation Declaring November 26, 2022 as Small Business Saturday in West Valley City at the Regular City Council Meeting scheduled November 22, 2022. PUBLIC HEARINGS SCHEDULED FOR NOVEMBER 22, 2022 A. ACCEPT PUBLIC COMMENT REGARDING APPLICATION SA-4-2022, FILED BY PAUL SNYDER, REQUESTING FINAL PLAT APPROVAL FOR THE JMYL WEST VALLEY SUBDIVISION-LOTS 5 AND 6 AMENDED LOCATED AT 1814 WEST 4100 SOUTH Mayor Lang informed a public hearing had been advertised for the Regular Council Meeting scheduled November 22, 2022, in order for the City Council to hear and consider public comments regarding application SA-4-2022, filed by Paul Snyder, requesting Final Plat Approval for the JMYL West Valley Subdivision-Lots 5 and 6 Amended located at 1814 West 4100 South Proposed Ordinance 22-41 related to the proposal to be considered by the City Council subsequent to the public hearing, was discussed as follows: ACTION: ORDINANCE NO. 22-41, APPROVE THE AMENDMENT OF LOTS 5 AND 6 OF THE JMYL WEST VALLEY SUBDIVISION Steve Lehman, CED, discussed proposed Ordinance 22-41 that would approve the Amendment of Lots 5 and 6 of the JMYL West Valley Subdivision. Written documentation previously provided to the City Council included information as follows: Paul Snyder, is requesting a plat amendment for lots 5 and 6 of the JMYL West Valley Subdivision. Said subdivision was recorded with the Salt Lake  MINUTES OF COUNCIL STUDY MEETING – NOVEMBER 15, 2022 -3- County Recorder’s Office in January 2019. The original subdivision plat consisted of 7 lots on 13.5 acres. This application will amend lots 5 and 6 to consolidate them into 1 lot. The new lot will be developed as a future restaurant. The amended subdivision will consolidate two existing lots to create one lot approximately 1 acre in size. All previous reviews and conditions of the original subdivision still apply. This property will gain access from existing cross access and parking easements internal to the overall project. Site improvements will be addressed as part of the Conditional Use application. The amended plat simply combines two lots to create one lot with easements and other applicable information. The City Council will consider Ordinances 22-41 at the Regular Council Meeting scheduled November 22, 2022 at 6:30 P.M. RESOLUTION 22-155: APPROVE AN AGREEMENT WITH MODERN DISPLAY SERVICE, INC. TO PROVIDE PARADE FLOAT SERVICES Sam Johnson, Public Relations, presented proposed Resolution 22-155 that would approve an agreement with Modern Display Service, Inc. to Provide Parade Float Services Written documentation previously provided to the City Council included information as follows: In January 2020, WVC Council approved contracting out with Modern Display to build a float for Summer 2020. The pandemic started shortly after that decision. The float was stored for 2 years during the pandemic. In early 2022, WVC City Manager and City Council approved to move forward on having the WVC float, first in a over a decade, finished and ready to be used in parades. The float was in used in WestFest, Magna 4th of July parade and Days of ’47 parade. The float included many volunteers, the mayor was on the float, during each parade. Modern Display is a leader in putting together floats and this work on this first float met expectations and was well received.  3 year contract includes the following:  Work on a new concept each year  Build out a new float using the same car and platform  Deconstructing the float each year  Storage of the Float. $51,000 3-year contract ($17,000 annually)  MINUTES OF COUNCIL STUDY MEETING – NOVEMBER 15, 2022 -4- Wayne Pyle stated that there is a one-year option as well but the price would not be locked in for future years and there would be an additional $2,000 for storage. The City Council will consider Resolution 22-155 at the Regular Council Meeting scheduled November 22, 2022 at 6:30 P.M. CONSIDER APPLICATION SMI-9-2022, FILED BY BRENT MALILI, REQUESTING FINAL PLAT APPROVAL FOR THE CARPE DIEM AUCTUM SUBDIVISION- PHASE 2 FOR PROPERTY LOCATED AT 5520 SOUTH 5600 WEST Steve Lehman, CED, presented proposed application SMI-9-2022, Filed by Brent Malili, Requesting Final Plat Approval for the Carpe Diem Auctum Subdivision- Phase 2 for Property Located at 5520 South 5600 West. Written documentation previously provided to the City Council included information as follows: Brent Malili is requesting final approval for the second phase of the Carpe Diem Auctum Subdivision. The subdivision is located immediately to the south of phase 1 and is being submitted to create two lots for future commercial uses in the C-2 zone. The proposed subdivision will consist of 2 lots on 2 acres. Lot 1 is approximately 1.3 acres in size while lot 2 is approximately .70 acres in size. The C-2 Zone requires a minimum lot size of 20,000 square feet. Access to the subdivision will be gained from 5600 West. A shared access drive coming in from 5600 West will be located and shared with both phase 1 to the north and phase 2 to the south of the drive. The applicant has received approval from UDOT and West Valley City for this location. Public improvements exist along the west side of 5600 West including curb, gutter, a stamped concrete parkstrip and sidewalk. As there is only one access on 5600 West, a reciprocal access easement is planned across lot 1 in favor of lot 2 similar to what was done with the first phase to the north. The City Council will consider Application SMI-9-2022 at the Regular Council Meeting scheduled November 22, 2022 at 6:30 P.M. CONSENT AGENDA SCHEDULED FOR NOVEMBER 22, 2022 A. RESOLUTION 22-156: AUTHORIZE THE CITY TO ABANDON A PORTION OF A STORM DRAIN EASEMENT LOCATED AT 5530 SOUTH  MINUTES OF COUNCIL STUDY MEETING – NOVEMBER 15, 2022 -5- 5600 WEST Wayne Pyle, City Manager, discussed proposed Resolution 22-156 that would authorize the City to Abandon a Portion of a Storm Drain Easement Located at 5530 South 5600 West. Written documentation previously provided to the City Council included information as follows: In 1986 a Storm Drain Easement was recorded in favor of Salt Lake County across property located south of 5400 South on the west side of 5600 West. As there are no existing storm drain facilities located on property located within this specific easement on property located approximately 5530 South, the property owner has requested this easement be abandoned by West Valley City. LC Real Estate, LLC is the owner of property located at 5530 South 5600 West, parcel 20-14-231-022 and the site of the proposed Carpe Diem Auctum Subdivision No. 2 and UTA owns parcel 20-14-231-020. The above referenced storm drain easement was recorded in favor of Salt Lake County prior to the Smith’s Annexation in 1995 by West Valley City. After the annexation of property West Valley City became the successor in interest to Salt Lake County. As the easement is not necessary, an Abandonment of Storm Drain Easement document has been prepared for approval by the West Valley City Council and execution by the mayor. There is another 15-foot-wide Storm Drain Easement which runs slightly east and parallel with the easement being abandoned, that easement will remain. The City Council will consider items on the Consent Agenda at the Regular Council Meeting scheduled November 22, 2022 at 6:30 P.M. COMMUNICATIONS A. Mr. Packard stated that the City would currently qualify for County funds but adjustments would need to be made to qualify for the State funds available. Steve Pastorik, CED Director, provided a proposed ordinance that would eliminate landscaping in the parkstrip and reduce the percentage of allowable lawn in new development. This is summarized as follows: 7-16-104. ALL NEW RESIDENTIAL DEVELOPMENT. The following standards shall apply to all new residential Development: 1) Lawn shall be prohibited in Parkstrips and in areas less than eight feet in width. 2) No more than 35% of the Front and Side Yard landscaped area shall be lawn. Residential lots with less than 250 square feet in landscaped area shall be except from this standard. Councilmember Fitisemanu asked if the State would provide the grant money if residents decided to utilize this option. Steve replied yes. The Mayor and Council agreed to move forward with this ordinance change and asked staff to begin working it through the process. Councilmember Harmon asked if the City needs to specify what else residents can do aside from lawn. Steve replied alternative options are already listed in the Code. Mayor Lang asked if any modifications would need to be made to commercial landscaping. Steve replied this particular grant is intended for residents. Mayor Lang stated that she wouldn’t want City ordinances to restrict commercial businesses from obtaining breaks or grants for waterwise landscaping. Mayor Lang agreed and noted that staff has really stepped up and done amazing work to help the residents and volunteers. She noted that this program has been rewarding for everyone involved. Councilmember Fitisemanu stated that there was a lot of interest in other communities and asked what criteria is used to prioritize new areas. Craig replied that there is an executive team that identifies resources and what the volunteer base might look like. He indicated it happens from the ground up and communities in the City reach out and work to get it going. The Mayor and Council had no further questions or concerns. C. CODE ENFORCEMENT POLICY AND PROCEDURE Mayor Lang asked if the Council was prepared to discuss specific Code Enforcement policies. The Council replied not at this time. D. COUNCIL CALENDAR Mayor Lang referenced a Memorandum previously received from the City Manager that outlined upcoming meetings and events. Members of the City Council had no further questions regarding the Council Update. NEW BUSINESS A. POTENTIAL FUTURE AGENDA ITEMS N/A B. COUNCIL REPORTS COUNCILMEMBER CHRISTENSEN- MOSQUITO ABATEMENT DISTRICT Councilmember Christensen stated that he has attended Mosquito Abatement conferences. He indicated that he learned about cyber security and was pleased to hear that the City is already working on and aware of current threats. He noted that he was also surprised at how large some abatement districts are in other states. Councilmember Christensen encouraged the Council to visit the Utah Cultural Celebration Center to view the current exhibits. COUNCILMEMBER HUYNH- EVENT Councilmember Huynh stated that he attended an event with Councilmember Christensen.  MINUTES OF COUNCIL STUDY MEETING – NOVEMBER 15, 2022 -14- COUNCILMEMBER HARMON- ROLLING MEADOWS Councilmember Harmon stated that he attended the Rolling Meadows 50th Birthday Party. He indicated that staff was there as well and it was fun event. MAYOR LANG- TREE PROBLEM, OPEN HOUSE Mayor Lang stated that she received a letter of appreciation from a resident who was unable to maintain a tree. She indicated that stuff jumped in and helped with dumpsters, gutters, and roads. She stated that she was thankful for their work. Mayor Lang indicated that she attended an open house for a new company called Code that just moved to West Valley City from Singapore.
