This subdivision was recorded with the Salt Lake County Recorder’s Office in November 2015. The subdivision is located immediately to the north of the Riter Canal and west of 5600 West. ISSUES: The proposed plat amendment is being requested in order to establish a condominium for each of the 4 proposed buildings within the subdivision. The previously recorded plat separated lot 1B from the other property within the subdivision allowing the condominium development to take place. Commercial and Industrial condominiums are not uncommon. According to Mr. Maher, there are a variety of benefits associated with doing a commercial condominium project. For the property owner, it is primarily the ability to sell units as opposed to leasing them. For business owners it is the ability to predict occupancy costs without having to renegotiate their lease every few years. There is also a sense of pride in ownership that can help keep the entire project viable because of the interest each owner has in wanting the overall project to succeed. For these reasons, Mr. Maher would like to amend the subdivision plat. The existing lot is 1.5 acres in size. Dedication of 5600 West and Anna Caroline Drive was done as part of the original subdivision application. All conditions of approval related to the original plat are still in effect with this application. The subdivision is located within the 5600 West Overlay Zone. As such, future commercial and/or industrial uses will be subject to increased development standards. STAFF ALTERNATIVES: 1. Approve the amended CABCO 5600 West Subdivision Lot 1 Amended Subdivision plat subject to a resolution of staff concerns. 2. Continue the application for reasons determined in the Planning Commission meeting. Applicant: Adam Maher Discussion: Adam Maher said self-storage was the original intent of this development. The City wanted a retail overlay. While there is a lot of retail in the area, it is all for lease. Adam Maher said there is a special niche for owner-occupiers who do not want to lease. CABCO will fill this niche. West Valley City Planning Commission December 9, 2015 Page 3 Adam Maher’s first building lasted only one day on the market with a full price offer from a medical user. CABCO is the only game in town for someone who wants to own their own space. Each owner may want to change the plan a little bit to suit their needs. However, CABCO does not plan on creating more units or gross square footage than already shown on the plan. Commissioner Fuller pointed out that the original plan showed development west of Anna Caroline. Adam Maher affirmed that once there is access to that area, CABCO will develop a second phase across the street. Hopefully that happens quickly. Chair Thomas asked if there will be only commercial tenants, no industrial. Adam Maher answered that is correct. Adam Maher said an auto parts company, ACE Hardware, and various medical uses have all shown interest in the property. Motion: Commissioner Matheson motioned to approve S-26-2015. The subject property is located at 2850 South Redwood Road. It is bordered on the north by Community Nursing Services, the south by vacant land and the west by the Lake Pointe Office complex. ISSUES: The proposed subdivision will consist of 3 lots on just under 5 acres. The applicant is proposing to divide the property so that each existing building will sit on its own lot. During the study session, a question was asked about minimum lot size requirements in the C-3 zone. The minimum required is 1 acre, and building coverage cannot exceed 75% of the lot area. For the proposed subdivision, lot 1 will comprise 1.3 acres with the existing building covering approximately 33%. Lots 2 and 3 are approximately 1.7 acres in size West Valley City Planning Commission December 9, 2015 Page 4 with each existing building covering approximately 43%. The proposed subdivision will allow the land owner to sell each building independent of each other, which is the ultimate objective of this application. Access to the subdivision will be gained from Redwood Road. There are two existing access points at the north and south ends of the property. The subdivision will require a cross access easement over lot 1 in favor of lots 2 and 3 along with cross parking easements. The existing buildings are used for office, business and retail purposes. Landscaping is installed along the front and sides of the project and is in good condition. During the study session a question was also asked about Granger Hunter Improvement District requirements. After discussing this matter with GHID, staff learned that they are fine with the proposed subdivision, but will need documentation from the applicant as to how the water and sewer will be managed between the potential 3 lot owners. Staff understands that this will be addressed in the CCR’s that will be prepared for the subdivision. STAFF ALTERNATIVES: 1. Approve the Redwood Business Center Subdivision subject to staff a resolution of those items mentioned in the staff report. 2. Continue the application to address issues raised during the Planning Commission meeting. The purpose for the amended plat is to create an additional building lot within what is part of lot 1. The subject property is located at the corner of 6200 South and 5600 West and is zoned C-2. ISSUES: The West Valley Commercial Retail Center Subdivision was recorded with the Salt Lake County Recorder’s Office in August 2003. The original subdivision consisted of 5 lots. The proposed amended subdivision plat will amend lot 1 to create a new building lot. The newly created lot will be located in the northeast corner of lot 1 and just to the south of an existing retail building on lot 4. Access to this lot will be gained from both 6200 South and 5600 West. The original subdivision contained various easements for water/sewer, parking and access. While these easements are still applicable for the amended plat, the applicant is proposing to create new access easements from both 6200 South and 5600 West that were not defined on the original subdivision plat. The applicant will need to coordinate future site improvements and storm water drainage with the City Engineering Division. Parking spaces being eliminated to make way for the new lot will not negatively impact the overall parking requirement for the shopping center. There are approximately 965 existing parking stalls where 730 are required. STAFF ALTERNATIVES: 1. Approve the Amendment to lot 1 of the West Valley Commercial Retail Center Subdivision subject to a resolution of staff concerns noted in the analysis. 2. Applicant: Justin Petersen, Lochner Engineering 1245 East Brickyard Road Salt Lake City, UT Discussion: Justin Petersen is representing Utah Development of Facilities and Construction Management. Brud Dr. C-2 Zone (0.46 Acres) The applicant, Cade Cunningham, is requesting conditional use approval for a fast food with a drive-up restaurant for property located at 5675 W. Brud Drive. The property is zoned general commercial (C-2) and the West Valley City General Plan designates this area General Commercial. The surrounding zone is C-2 on all sides. The surrounding land uses include undeveloped commercial to the north, Walmart to the south, undeveloped retail pads to the west, and IHOP to the east. This parcel was developed in 2002 as a Tesoro gas station. The use was abandoned and removed in 2008. At this time, Mr. Cunningham would like to construct an El Pollo Loco fast food restaurant with drive-thru. The building will be 3,040 square feet and constructed of two-toned stucco with metal awning accents and a rock wainscot. The building architecture must comply with the Commercial Design Ordinance. This also includes providing pedestrian connections between this project and the adjacent uses and sidewalks. The parcel itself contains 27 parking spaces. The required parking for this use is 35 spaces however, there is a recorded shared access and parking agreement with the adjacent property so the parking is adequate for this use. This parcel has frontage along a High Image Arterial and when this site was originally developed the berming requirement along Brud Dr. (3100 S.) was modified due to the elevation of the lot and the adjacent road. A 4’ tall masonry wall with landscaping was installed instead of the berm. That wall and landscaping have since been removed and are no longer on site. Staff recommends that a 2’ masonry wall and landscape screening be installed as part of this project. This will also help screen the drive-thru area. There must also be a minimum of 5 trees along Brud Dr. and a minimum of 15% of the site must be landscaped. Signage will be located on the building and a monument sign is proposed for this site as well. The proposed signage must comply with all the requirements set forth in the West Valley City Sign Ordinance. Staff Alternatives: Approval, subject to the resolution of any issues raised at the public hearing, and the following conditions: 1. The site shall be developed per the approved plans and in accordance with the West Valley City Municipal Code. 2. The building and site design must comply with the Commercial Design Standards. The landscaping must be installed per the approved plans and in accordance with the Standards for Landscaping Along High Image Arterials. The berming requirement may be modified to include a 2’ tall screen wall with landscaping along the north side of the wall to provide additional screening. 4. There must be adequate parking provided for the proposed tenant mix. All shared parking and access agreements must be recorded and a copy of those agreements must be submitted to the City. 5. Signage must comply with the West Valley City Code. 6. All additional requirements of affected departments and agencies must be met. Continuance, to allow for the resolution of any issues raised at the public hearing. Applicant: Cade Cunningham 4139 South Colt Court Discussion: Cade Cunningham was present, representing Travis Cunningham from El Pollo Loco. He asked if the existing trees are enough to meet landscaping requirements. Jody Knapp said landscaping along high image arterials is one tree every 30 feet. There are four existing trees. She asked that shrubs be added along the wall as per the original plan. Cade Cunningham asked if only high density shrubbery could be placed on the property, in lieu of a wall. Chair Thomas said the wall blocks the lights from cars on the property from shining into traffic on 3100 South. Chair Thomas asked Cade Cunningham if he is aware of the landscaping requirements surrounding the monument sign. Cade answered yes. Motion: Commissioner Lovato motioned to approve C-61-2015 subject to the six requirements listed in the staff report. A 2’ screening wall is required. Commissioner Fuller seconded the motion. The zoning for the site is West Valley City Planning Commission December 9, 2015 Page 8 Manufacturing. Auto sales and service is a conditional use in this zone. The surrounding areas are all zoned Manufacturing. The General Plan designated this area as Light Manufacturing. The front half of the parcel was developed in 1971 as a machine shop. In 1975, the back half of the parcel was developed. Tool Design has operated at the site since 1975. Tool Design will be leasing the south part of the building to Kaufman Car Sales and Express Tractor Trailer Service. Kaufman Car Sales is owned by Sied Diglisic and Express Tractor Trailer Service is owned by Larry Hutchings. They will be located next to each other and each business will occupy 2,100 square feet of the building for a total of 4,200 square feet. The building is 31,000 square feet. Kaufaman Car Sales plans on having an inventory of 6-8 cars and they will be stored inside the building. The cars will be shown by appointment between 12-5 p.m. Monday-Friday. The owner is the only employee at the business. Express Tractor Trailer Service works on diesel pickup trucks, small box trucks and cars. They plan on working on three vehicles per week. The operating hours for Express tractor Trailer is 9-5 p.m. Monday-Friday. The service provided by Express Tractor Trailer Service are: brakes, turbos, shocks and engine repair. There will be no body work or painting conducted at the site. Repairing of vehicles will only be allowed inside the building. The site has the required landscaping and the landscaping is maintained. The site does have some outside storage which is allowed. The whole site is fenced and screened for outside storage and the site is completely paved. The fence does have some broken slats that need to be replaced. There are currently 20 parking spaces which was sufficient for the existing business. With adding auto sales and auto repair to the site, the applicant will need to add eight more parking spaces. The eight new parking stalls need to be striped and must follow the approved site plan. All parking stalls need to remain clear of outside storage and must be used for customer and employee parking. The applicant will be using the building as it is currently configured. When signage is added, a sign permit must be obtained and all signage must meet the West Valley City Sign Ordinance. Applicant: Seid Diglisic 2061 West 2300 South Motion: Commissioner Matheson motioned to approve C-62-2015 subject to the nine conditions listed in the staff report, with two spelling corrections. Redwood Rd. C-2 Zone (.71 Acres) Verizon Wireless is requesting a conditional use for the construction of a roof mounted small cell antenna at 2851 S. Redwood Rd. This property is zoned C-2, General Commercial and the West Valley City General Plan designates this area as Mixed Use. The surrounding zones include General Commercial (C-2) to the north and south, R-1-6 to the east and Manufacturing to the west across Redwood Road. The surrounding uses include vacant property to the north, single family residential to the east, a restaurant and tire service center to the south and the US Army Recruiting Station to the west across Redwood Road. Verizon Wireless would like to install one roof mounted 2’ canister antenna on top of the existing building at the Car Care Center. The equipment is 4’ tall as measured from the top of the parapet wall (6’ from roof deck). The antenna is set back 11’-3” from the exterior wall on the north and west side of the building. This location complies with the standards set forth is section 7-23-206 of the WVC Municipal Code. Verizon Wireless has proposed to paint the antenna to match the building. They request to not add any screen type structure around the antenna and feel that the screening will be more visually intrusive than the antenna alone. The equipment cabinet will be located on top of the building and will be completely screened behind the existing parapet wall. A generator is not proposed for this site. Staff Alternatives: • Approval, subject to the resolution of any issues raised at the public hearing and the following conditions: 1. The antenna shall be painted to match the colors of the existing building and be installed per the approved plans and in accordance with Chapter 7-23 of the WVC Municipal Code. 2. The equipment cabinet shall be located on top of the roof and screened behind the existing parapet wall. 3. Must comply with all other relevant requirements set forth from applicable department and agencies. • Continuance, to allow for the resolution of any issues raised at the public hearing. Applicant: Pete Simmons 5710 South Green Street Salt Lake City, UT West Valley City Planning Commission December 9, 2015 Page 10 Discussion: Pete Simmons said this is the fourth cell antenna Verizon will place within the City. Three more cell antennas will come before the Planning Commission in the future. Verizon’s RF Engineers have worked with the City to shorten the design of the antenna so most of it can be hidden behind the parapet wall. Commissioner Matheson asked if the weight of the cabinet will necessitate an add load calculation for the roof. Pete Simmons confirmed that Verizon does structural calculations as part of the building permit application that will be submitted. Chair Thomas asked if there has been a problem with vandalism of equipment on the ground. Pete Simons said they have not yet been installed, so we will have to see. The zoning for this area is Manufacturing (M) and all auto related uses are listed as a conditional use in this zone. The surrounding properties are zoned M and are mostly office/warehouse and light manufacturing type uses. The West Valley City General Plan anticipates Light Manufacturing for this area. Sicarios Collision Repair will provide auto collision and auto body repair. The scope of work will include: auto body dent repair, replacement of parts, parts fabrication, frame repair, light welding, painting, buffing and detail work. No mechanical work will be performed at the site. They will be open from 8 am – 7 pm, Monday – Friday and 10 am – 5 pm on Saturday. They plan on having four full- time employees and may add a fifth employee in the second year and plan on working on five to a maximum of eight automobiles at a time. Sicarios Collision Repair occupies 5,000 square feet of a 10,000 square foot building. They will be occupying the east half of the building. The building is setback behind another 10,000 square foot building off of 2200 South. The shop has two large overhead doors and two service bays. There will be a paint booth located in the shop area, and all repairs will be conducted inside. There is a fenced storage West Valley City Planning Commission December 9, 2015 Page 11 area that is paved south of the building that the applicant would like to use for storage of cars and parts. This area is not visible from the street and the Manufacturing zone allows for outside storage. The business has 15 parking stalls to the north and east of the building. No junk or inoperable vehicles will be stored in parking areas. These vehicles must be stored inside the building or areas shown on the approved site plan. When signage is added, a sign permit must be obtained and all signage would be required to meet the West Valley City Sign Ordinance. Staff Alternatives: Approval, subject to the resolution of any concerns raised at the public hearing and meeting the requirements of all affected departments and agencies, as well as the following: 1. The approved use is for an auto body shop. Some light mechanical and no engine work will be conducted at the site. 2. All auto body work performed shall be conducted within the building and shall not be conducted outside or in any parking areas. 3. The site is to be well-maintained and free of garbage or trash. 4. Outside storage shall only be allowed in areas shown on the approved site plan. 5. Parking shall conform to City Ordinance. All 15 parking stalls need to be striped. 6. All requirements of affected departments and agencies must be met including the West Valley City Fire Department. 7. All signage shall comply with the West Valley Sign Ordinance, including all temporary signs. 8. This approval is subject to review upon a valid complaint. Continuance, to allow for the resolutions of any issues raised at the public hearing. Applicant: Cameron Carpenter, Commerce Commercial Real Estate 2187 West 2200 South Discussion: Cameron Carpenter was present, representing Chris Martinez, the business owner. Commissioner Lovato asked if requirement #1 on the staff report should be amended to include light mechanical. Cameron Carpenter said he specified no mechanical because he wanted to convey there won’t be any engine work done, such as tune ups or transmissions. Motion: Commissioner Tupou motioned to approve C-64-2015 subject to the eight conditions listed in the staff report, amending #1 to say light mechanical in lieu of no mechanical, and one spelling correction. Roll call vote: Commissioner Fuller Yes Commissioner Lovato Yes Commissioner Matheson Yes Commissioner Meaders Yes Commissioner Tupou Yes Chairman Thomas Yes Commissioner Winters Yes West Valley City Planning Commission December 9, 2015 Page 12 Unanimous-C-64-2015- Approved C-65-2015 Lodestone Park Monument Sign 6252 W 6200 S A Zone (53.82 Acres) The applicant, Angelo Calacino with Salt Lake County Parks & Recreation, is requesting conditional use approval for a monument sign with bonus sign height and area. The zoning for the property is A, Agriculture. The surrounding zoning is single family residential, manufacturing and agriculture. The property is bordered by single family homes located in Kearns to the north and east, the Diamond Summit Subdivision to the south, and the Mountain View Corridor to the West. Salt Lake County Parks & Recreation is proposing to construct a monument sign for a new regional park. The sign for Lodestone Park would be located next to the main entrance of the park on 6200 South. The park has about 1,800 feet of frontage along this road, which per Title 11, would allow up to 9 monument signs. In an agricultural zone a monument sign is limited to 5 feet in height and 50 sq. ft. in sign area. The County has standard signage they install at their regional parks, and their proposed sign would be 8 ½ feet tall. The area of the sign containing signage is about 65 sq. ft. Bonus sign height and area can be granted by the Planning Commission through the Conditional Use process. 11-4-11(1)(g) An applicant may submit an alternative sign plan or design for unique and special circumstances, provided such sign(s) achieves the intent of the above standards and this Ordinance. Staff believes the proposed sign meets the intent of the sign ordinance. Rather than having multiple signs, 5’ tall and 50 sq. ft., along 6200 South, which would be allowed per the code without any special approval from the Planning Commission, Salt Lake County is proposing to have one, larger sign. Title 11 requires that the setback for monument signs be at least equal to the sign height. The 8 ½ foot tall Lodestone Park sign will be setback about 20 feet from the property line. It will be located in a large landscaped area, much larger than the 130 sq. ft. area that would be required by ordinance. The landscaping will include a variety of trees, shrubs, perennials and ground cover. Staff Alternatives: Approval, subject to the resolution of any concerns raised at the public hearing, as well as the following conditions: 1. The sign shall be constructed per the approved sign and landscape plans. 2. A building permit must be issued for the sign. Continuance, for reasons determined at the hearing. Applicant: Angelo Calacino 2001 South State Street Salt Lake City, UT West Valley City Planning Commission December 9, 2015 Page 13 Discussion: Angelo Calacino explained that the County has developed a new sign standard for all County parks. This sign will be classified for regional parks of which Lodestone Park is one of many. The County is hoping to have the sign in place when Phase II of the park is completed sometime within June of next year. Looking at an aerial view of the property, Angelo showed where some park features are currently under construction. These include a large pavilion and restroom, a destination playground with a mining theme (because the copper mine is visible from the park), pickle ball, tennis, and basketball courts to the south. A perimeter path will tie into the Mountain View Corridor Chair Thomas asked if it is the County’s intent that children play on the sign. Angelo Calacino said most likely children will play on the sign. The sign will be constructed of concrete and metal, almost “bomb proof”. Chair Thomas said the sign is almost inviting for children to play on, and she doesn’t mind that. However, she is concerned about the planting around the sign being trampled. Angelo Calacino said the County must deal with tree breakage, tagging of equipment, and burning of signs. Chair Thomas looks forward to seeing the new sign. M Zone (3.55 total acres) The applicant, Sean McElreath, representing Adrenaline Automotive, requests a conditional use for auto sales at 2698 S Redwood Rd. The zoning for the site is Manufacturing. Auto sales is a conditional use in this zone. The surrounding uses include Redwood Elementary School to the north, commercial development across Redwood Road to the east, commercial and office uses to the south and light industrial to the west. The General Plan designated this area as Commercial/Light Manufacturing. The site was developed in 1999 as part of the Business Village West Commercial Condominiums. An active Condominium Owners Association maintains the entire property. The landscaping on the site is as per plan and well maintained. Adrenaline Automotive is a small used car dealership specializing in purchasing specific vehicles per the customer’s request. The customer tells the business what car they want and they go out and buy it and sell it to the customer. They also do some internet sales and vehicles will be shown by appointment. West Valley City Planning Commission December 9, 2015 Page 14 Adrenaline Automotive plans on having 2-4 vehicles at one time and they will all be stored inside the building. The business will be approved for auto sales only. There will be no repair, detailing or washing of vehicles at the site. The applicant intends to occupy unit N in the west building. The space is 2,000 square feet. The applicant intends to use the space as it is currently configured. The Building Department has no issues with cars behind stored inside the warehouse. Adrenaline Automotive has the five parking spaces required for auto sales. When signage is added, a sign permit must be obtained and all signage would be required to meet the West Valley City Sign Ordinance. Staff Alternatives: Approval, subject to the resolution of any concerns raised at the public hearing and meeting the requirements of all affected departments and agencies, as well as the following: 1. The approved use is for Auto Sales only. There will be no repair, detailing and washing of vehicles at the site. This approval is for unit N. 2. The site shall be well-maintained and free of garbage or trash. 3. All vehicles must be stored inside the warehouse. There shall be no outside storage or outside display of vehicles. 4. Parking shall conform to the City Ordinance. 5. All signage shall comply with the West Valley City Sign Ordinance, including all temporary signs. 6. All requirements of affected departments and agencies must be met. 7. This use is subject to review upon a valid complaint. Approved Chair Thomas, this being her last day serving on the Planning Commission, thanked Commissioners for their professionalism and dedication shown to the citizenry. This is proven by the time they spend researching and attending meetings. She appreciates and lauds Commissioners for making the City better. Chair Thomas said City staff goes above and beyond when answering questions, concerns, or complaints. City staff are patient in explaining ordinances and dealing with citizenry. Steve Pastorik is trustworthy and has a wonderful department that often goes unnoticed by the City. Planning and economic development is behind the scenes, yet is at the heart of what we do within the City. Steve Pastorik and his staff are doing a tremendous job! Steve Pastorik, on behalf of City staff, thanked Chair Thomas for her many years of dedicated service to the City. She served 13 years on the Planning Commission and 12 years on the City Council.
