WEST VALLEY CITY PLANNING COMMISSION Study Session May 18, 2011 The meeting was called to order at 3:38 p.m. by Chairman Brent Fuller at 3600 Constitution Boulevard, West Valley City, Utah. WEST VALLEY CITY PLANNING COMMISSION MEMBERS: Harold Woodruff, Brent Fuller, Jack Matheson, Phil Conder, and Joe Garcia ABSENT: Terri Mills, Barbara Thomas, and Imaan Bilic WEST VALLEY CITY PLANNING DIVISION STAFF: Steve Pastorik, Jody Knapp, and Nichole Camac WEST VALLEY CITY ADMINISTRATION: Claire Gillmor, Assistant City Attorney Planning Commission Study Session May 18, 2011 Page 2 ZONE TEXT APPLICATION ZT-1-2011 PETITION BY WEST VALLEY CITY REQUESTING A ZONE TEXT CHANGE FOR SEPERATION STANDARDS FOR ACCESSORY STRUCTURES. (STAFF- JODY KNAPP AT 801-963-3497) Discussion: Jody Knapp explained that when separation standards for accessory structures changed from 6 feet to 3 feet, people began coming up with creative ways to circumvent the intent of the ordinance. She stated that separation is measured from wall to post but since this is not clear in the ordinance, eaves and overhangs have overlapped in some cases. Jody stated that this change will simply clarify that no portion of the accessory building can be built closer than 3 feet to any portion of the principal building. Phil Conder asked what problem is being solved by defining this in the ordinance. Harold Woodruff commented that if awnings become enclosed structures and become an additional room, this would be a concern. Steve Pastorik added that it’s important to have separation between buildings in residential neighborhoods to allow people to utilize their backyards. He added that this is also necessary to help maintain and enforce zoning setbacks. Jody stated that it’s important to keep things as general as possible in the ordinance for enforcement purposes even though there are many different types of scenarios that could come into play. Staff and the Planning Commission discussed different problems that could arise as well as reasons why this would be an important definition to clarify in ordinance. CONDITIONAL USE APPLICATION C-13-2011 PETITION BY MOUNTAZAR ALTALIBI REQUESTING A CONDITIONAL USE AMENDMENT FOR A TOKEN TYME SMOKE SHOP. THE PROPERTY IS LOCATED AT 2101 W 3500 S ON .65 ACRES AND IS ZONED 'C-2' (GENERAL COMMERCIAL). (STAFF- JODY KNAPP AT 801-963-3297) Discussion: Jody Knapp explained that if any merchandise is sold other than tobacco products at a smoke shop it becomes a convenience store which is a conditional use. She explained that the applicant will be installing a couple of soda fridges. Harold asked how the hookah lounge is classified. Jody replied that it is define as a coffee shop type use. She added that hookah is not regulated by the clean air act because it contains no tobacco and is just water vapor. C-14-2011 PETITION BY KENT HATCH REQUESTING A CONDITIONAL USE AMENDMENT FOR AUTO SALES. THE PROPERTY IS LOCATED AT 1433 W 3500 S ON .42 ACRES AND IS ZONED 'M' (MANUFACTURING). (STAFF- JODY KNAPP AT 801-963-3497) Discussion: Jody explained that this site was previously used as an auto lube center and the applicant would now like sell cars. She explained that no more than 6 cars will be up for sale at a time and no car washing will be done on site. She stated that the front portion of the building will be the office and indicated where customer, employee, and display parking would be located. She stated that there is a landscaped area but the applicant will need to install some street trees. Joe Garcia asked if there will be any signage. Jody replied that there may be some on the building but the applicant hasn’t proposed anything as of yet.
