The meeting was called to order at 3:33 p.m. by Chair Meaders at 3600 Constitution Boulevard,
West Valley City, Utah.

ZONE CHANGE APPLICATIONS
Z-10-2018 PETITION BY ARCADIA PROPERTY HOLDINGS, LLC REQUESTING
A ZONE CHANGE FROM A (AGRICULTURE, MINIMUM LOT SIZE ½
ACRE) TO RE (RESIDENTIAL ESTATE). THE PROPERTY IS
LOCATED AT 3764 SOUTH 6400 WEST ON 5.43 ACRES. (STAFF –

Discussion: Steve Lehman said this subdivision includes 12 lots, 2.28 units per
acre. One surrounding lot will be removed to create a stub road. The homes are
large with a lot of movement, not your typical rambler. We are thinking of
creative ways to fit these large homes on the 1/3 acre lots. The applicant is
requesting two variances to the setback requirements as part of the development
agreement along with the zone change.

The applicant is requesting that the rear lot setback be averaged at 30’ with no
point closer than 20’. The front yard setback would be reduced to 25’ for homes
with side entry garages. The applicant is requesting that the 5-sided lots in the
cul-de-sac have an average 30’ setback as opposed to the standard 30’ setback.
One lot that will face 6400 West has only 86’ of frontage, a reduction of 14’. We
do not have a problem with this because it is over the 12,000 sq. ft. minimum.
There is a 4-5’ drop-off near the stub road where a retaining wall has already been
built. If Public Works requires a road connection here, soil will need to be
imported to bring it up to grade.

Discussion: Steve Lehman said this property has been farmed for many years
and is now eligible for development. There are older subdivisions to the west and
to the south. The development agreement will state that this subdivision will
comply with the provisions of the RE zone, however one exception will need to
be made. One lot cannot meet the minimum lot requirement of 12,000 sq. ft. due
to the placement of two stub roads. The average lot size is 15,000 sq. ft.
There is a remnant piece of property that will need to be deeded to and improved
by the homeowner to the north.

CHANGE TO AMEND SECTION 7-6-301 OF THE WEST VALLEY CITY
MUNICIPAL CODE TO ADD PROHIBITED USES TO THE DECKER
LAKE STATION OVERLAY ZONE. (STAFF – STEVE PASTORIK 801-

Discussion: Jody Knapp said we are looking at amending the uses allowed in the
Decker Lake Station Overlay Zone (DLSOZ) that was first enacted in 1996. The
DLSOZ corresponds with our entertainment designation in the General Plan. It is
about 97 acres; 79 acres are zoned General Commercial and about 18 acres are
zoned Manufacturing.
We are amending the DLSOZ to remove some uses that we feel are not
appropriate for the area, such as anything that has to do with animals, a detention
facility jail, truck repair, truck sales, heavy industrial, outside storage, towing and
impound, and salvage yards.

MUNICIPAL CODE TO ADD STANDARDS FOR SMALL WIRELESS
FACILITIES IN PUBLIC RIGHTS-OF-WAY. (STAFF - JODY KNAPP AT

Discussion: Jody Knapp showed some photos of some bumper antennas with a
small range (200-700’) that will fill gaps in cell coverage. We currently don’t
allow any type of cell equipment in our right-of-way. A bill (SB-189) was
approved by our Legislature that set forth regulations for deployment of cell
antennas in city rights-of way. Our city will be adopting these regulations and
adding permitting requirements, some design guidelines, definitions, and a new
permit type. Small wireless facility permits will be reviewed by staff and will not
come before the Planning Commission or City Council for approval.
