ZONE CHANGE APPLICATIONS
Z-4-2021 Petition by GREG WILSON requesting a zone change from A (Agriculture,
minimum lot size ½ acre) to BRP (Business/Research Park). The property is located
at 1078 W Parkway Avenue on 0.1 acres. (Staff – Steve Pastorik at 801-963-3545

Discussion: Steve Pastorik explained that the subject property had come before the Commission
about a year ago requesting a rezone from A (Agriculture, minimum lot size ½ acre)
to BRP (Business/Research Park). Steve said the rezone was granted. Steve said the
owners have started to design this property and realized they would need more room
to fit their plan, so they are requesting an additional 15 feet be added to the
business/research park BRP zone. Steve explained that the subject property and the
property to the east have the same owner and there will still be a 25-foot setback
between the subject property, and the property to the east.
GENERAL PLAN/ZONE CHANGE APPLICATIONS
GPZ-12-2021 Petition by Petition by MARCO DIAZ requesting a General Plan change from
General Commercial to Medium Density Residential (7 to 12 units/acre) and a zone
change from C-2 (General Commercial) to RM (Multiple Unit Dwelling Residential).
The property is located at 4612 West 3500 South on 1 acre. (Staff – Steve Pastorik at

Discussion: Steve explained this proposal is for a townhome development. He stated the property
boundary goes out to the center of the 35th South. Steve said where this is already
improved a right-of-way dedication would be required. Steve stated that a large
amount of fill has been added to the property. This fill has raised the grade of the land
significantly. Steve presented a photo that showed the property next to a surrounding
fence, and they were almost the same height. Steve explained the applicant is
proposing to remove the fill to bring the property back to the original grade.
Steve stated the proposal is for three stories where the upper levels would project
over the ground level. Steve pointed out some concerns. The west side of the
property would be considered the rear setback and according to the ordinance the
setback should be twenty-four feet and the concept plan is showing fifteen feet and
this is a large reduction. Steve presented the submitted floor plans, one showing the
proposed materials and the other the proposed design. He said that he would prefer
the applicant provide one elevation or rendering showing both materials and design.
So, if the Commission feels this is a good use for the site Steve will request a new
rendering be submitted. Steve presented a slide depicting another option from staff.
Instead of having front-loaded townhomes, having them be alley-loaded and facing
the park. Steve said having the townhomes on one side will increase the setback.
Commissioner McEwen asked what the proposed setback is on the west side of the
subject property. Steve presented the concept plan once more and it shows the
setback being 10 feet.
Chair Meaders asked Steve if the alley-loaded townhomes that staff presented as an
option would have the same number of units as the front-loaded townhomes
proposed. Steve said that they would, he just wanted the Commission to see there are
other options.
SUBDIVISION APPLICATIONS
SMI-3-2021 Petition by GL HOME INVESTMENTS LLC is requesting preliminary approval for
the Cottages on Merry Subdivision. The subdivision consists of 5 lots on 1.23
acres. The proposed subdivision is located at approximately 3420 South Merry Lane
and is zoned R-1-8(Single Unit Dwelling Residential, minimum lot size 8,000 square

Discussion: Steve Lehman said the LDS Church owned the subject property prior to a subdivision
by meets and bounds, which severed the subject property off from the Church. Steve
explained that the subject property was used as a community garden and eventually
sold to the applicant.
Steve stated that there had been trees recently added along Merry Lane, the east side
of the property and staff would like them to remain if possible. He explained that
Marry Lane, the street on the east side of the property, is improved with a curb,
gutter, and sidewalk. However, Sunshine Drive, the road to the south of the property,
has a gutter system but no sidewalk. Steve presented the proposed plan for the
subdivision containing five lots. He said the applicant is requesting that lot 5 be a
flag lot. He stated this request is not a problem where that lot is located on the back
corner of the subject property. Steve explained the applicant would be required to
install improvements on Sunshine Drive and any improvements on Marry Lane that
are deficient, and lastly, some drainage issues.
CONDITIONAL USE APPLICATIONS
CA-4-2021 Petition by ALIGNED DATA CENTERS requesting a conditional use amendment
for a data center and outside storage. The property is located at 6368 W. Beagley
Road on 5.65 acres and is zoned M (Manufacturing). (Staff – Jody Knapp at 801-

Discussion: Jody Knapp explained the applicant purchased the subject property and they will be
using the building that currently exists there. Jody stated that the applicant intends to
put a data center at the subject location. She said the building is 98,000 square feet,
and the applicant will be occupying about two-thirds of the building at this time
because there is another company leasing the remainder of the building. Jody
pointed out that the applicant has an option to buy the lease out if they can relocate
them.
Jody explained that this application is coming before the Commission because of
their equipment yard located outside. She said this is a large building, and they will
be using lots of power that will produce heat. Inside, they will house hundreds of
server racks, and the equipment outside will cool down the equipment. Jody said
there would be a wrought iron fence along the employee area to the south. She stated
that a screening structure would be surrounding the outdoor equipment. The structure
base will be four feet of concrete with a 19-foot metal screen structure on top of that,
so more of a permanent fence.
Jody explained that the data center would be using a significant amount of power;
they will have their own power line connecting to the Rocky Mountain Power
substation. She said this would require easements, and the applicant has been
working closely with public works to accomplish that.
C-14-2021 Petition by PETERSEN STAGGS ARCHITECTS requesting a conditional use for a
multi-tenant retail center with drive-thru. The property is located at 2572 S. 5600 W.
(Winco Pad E) on 1.45 acres and is zoned C2 (General Commercial). (Staff – Jody

Discussion: Jody Knapp explained the subject property is within the 5600 West overlay zone. She
said this proposal does include a drive-thru, and the overlay zone is subject to drive-
thru and fast food standard restrictions. She explained there would be three tenants
occupying the building. Jody stated the applicant would be restricting a bit of
landscaping for the pad and adding in a different location, but the site's perimeter is
fully landscaped. Jody explained the plans are showing three fast-food tenants with a
drive-thru and having the drive-thru does not allow for more fast food tenants than
other tenants. Jody has been working with the applicant extensively over the last
three months. She has let the applicant know and is waiting to hear back from them
about how they will address this issue. She said they need to comply with the code,
and she will add this information to the staff report.
Jody stated the building does meet the building relief standards; however, not the
design standards. Jody believes they will add some color change to meet the design
standard and follow the existing development agreement for the property. Jody
pointed out that usually, they stagger the rooftops to comply with the design
standards, and the applicant's plans are not showing that. She said if the Commission
would like the roof changed, she will let the applicant know. Commissioner
Woodruff said that he would have them adjust the roof to meet the ordinance.
There being no further business, the meeting adjourned at 4:15 p.m.

well as any final application materials, will be available by 12:00 pm on Monday, June 21, 2021.
Testimonies for or against the proposed applications can be provided to the Planning Commission during the public
hearing or in writing prior to the hearing. If you wish to submit written comments, please be advised that this should
be provided to the Planning Staff member assigned to the application at least seven (7) days prior to the meeting to
enable the Planning Commission to properly consider the comments.
