LL # 12 OF 2020 - CHAPTER 5-1 ARB
LL # 14 OF 2020 - CHAPTER 197-80.3 SPECIAL EXCEPTIONS
RESOLUTIONS:
1. Accept Minutes of Board of Trustees Meeting
RESOLVED, that the minutes of the Board of Trustees Meeting of November 5, 2020
and Special Meeting of November 18, 2020 are hereby accepted.
2. Accept Departmental reports
RESOLVED, that the Police Department, Building Inspector’s and Justice Court
reports for November 2020 and Treasurer’s Report for October 2020 are hereby
accepted.
3. Appoint 2021 Registrar, Deputy Registrar and Sub-Registrars
RESOLVED, that Clerk-Treasurer Elizabeth Lindtvit is hereby appointed as Registrar
of Vital Statistics for 2021 with an annual stipend of $350.00, and Deputy Treasurer
Jeannine Conte is appointed as Deputy Registrar for 2021 with an annual stipend of
$300.00, and Maureen Jones as Sub-Registrar for 2021 with annual stipend of
$200.00.
4. Adopt LL # 11 of 2020 Amend Chapter 197 Entitled "Zoning" Nonconforming
Uses
WHEREAS, a public hearing was held before the Village Trustees at the Municipal
Building, 165 Mill Road, Westhampton Beach, New York, on the 5th day of October
2020 to amend Chapter 197-29, entitled “Zoning,” Nonconforming Uses-of the Code of
the Village of Westhampton Beach; and
WHEREAS, the proposed action is classified as a Type II action under 6 NYCRR
617.5(c)(33) of the State Environmental Quality Review Act and its implementing regulations,
and therefore no further environmental review is required; and
WHEREAS, the Suffolk County Planning Commission, via correspondence dated November
18, 2020, determined the proposed amendment to be a matter of local determination.
NOW THEREFORE BE IT RESOLVED, that after due deliberation the Board of Trustees of
the Village of Westhampton Beach hereby adopts the Local Law as advertised; and be
it further
RESOLVED, the Village Clerk is hereby directed to enter said Local Law in the records
of the Village, and to give due notice of the adoption of said Local Law to the Secretary
of State.
5. Adopt LL # 13 of 2020 Amend Chapter 197-63 Entitled "Zoning" Site Plan
Procedure & Chapter 197-80.1 Special Exceptions-Additional Conditions
WHEREAS, a public hearing was held before the Village Trustees at the Municipal
Building, 165 Mill Road, Westhampton Beach, New York, on the 5th day of October
2020 to amend Chapter 197-63, entitled “Zoning,” Site Plan Procedure and Chapter
197-80.1 Special Exceptions Additional Conditions of the Code of the Village of
Westhampton Beach; and
WHEREAS, the proposed action is classified as a Type II action under 6 NYCRR
617.5(c)(33) of the State Environmental Quality Review Act and its implementing regulations,
and therefore no further environmental review is required; and
WHEREAS, the Suffolk County Planning Commission, via correspondence dated November
30, 2020, determined the proposed amendment to be a matter of local determination.
NOW THEREFORE BE IT RESOLVED, that after due deliberation the Board of Trustees of

6. Approve Warrant for December 2020
RESOLVED, that the warrant for December 2020 in the amount of $861,914.12 for
the General Fund and $31,184.48 for the Capital Fund is hereby approved.
7. Authorize Purchase of Sculpture
RESOLVED, that the Board of Trustees hereby authorizes the purchase of 1 Corten
Abstract Metal Sculpture currently installed at Glovers Lane Park from Domenico
Belli at a cost of $5,000.00 to be taken from G/L account T37 Parks Fund.
8. Accept Retirement
RESOLVED, that the Board of Trustees hereby regretfully accepts the retirement of
Trevor Gonce effective November 7, 2020.
9. Appoint Temporary Police Chief
RESOLVED, that Steven McManus is hereby appointed to the position of Temporary
Police Chief effective December 4, 2020 and continuing for 90 days with the salary to
be $10,000 more than the current annual salary for Sergeant.
10. Authorize Civil Service to Offer Testing
RESOLVED, that the Board of Trustees hereby authorizes the Mayor to provide the
Suffolk County Department of Civil Service the documents necessary for it to
administer a promotional examination for the title of Police Chief to be made
available to all candidates who have a minimum of 3 years competitive class status
as Sergeant, and to also administer an open competitive examination for the title of
Police Chief to be made available to all eligible candidates.
11. Authorize Mayor to Sign Memorandum of Agreement
RESOLVED, that the Board of Trustees hereby authorizes the Mayor to execute the
Memorandum of Agreement between the Village of Westhampton Beach and Bus
Patrol America LLC, authorizing Suffolk County and Bus Patrol America LLC to
implement the Stop Arm Camera Program within the Village’s jurisdiction and collect
on Stop Arm violations on the Village’s behalf, at no cost to the Village.
12. Authorize Unreserved Fund Balance Transfer
RESOLVED, that the Board of Trustees hereby approves the transfer of $250,000
from the 2019-2020 unreserved fund balance to increase the 2020-2021 H9900
Sewer District Capital Project.
13. Authorize Temporary Outdoor Food Pantry
RESOLVED, that the Board of Trustees hereby authorizes the temporary placement
of an outdoor food pantry on the Beach United Methodist Church property located at
41 Mill Road for the period of time that New York State Covid-related restrictions are
in place.
