Appoint Provisional Police Chief PUBLIC COMMENT Village of Westhampton Beach Board of Trustees Meeting Thursday, February 4, 2021 at 5:00 P.M. PLEDGE OF ALLEGIANCE RESOLUTIONS: 1. Accept minutes of Board of Trustees Meeting RESOLVED, that the minutes of the Board of Trustees Meeting of January 7, 2021 are hereby accepted. 2. Accept Departmental Reports RESOLVED, that the Treasurer’s reports for December 2020, Justice Court, Police Department’s and Building Inspector’s reports for January 2021, are hereby accepted. 3. Accept 2019–2020 Fiscal Year Annual Financial Statements RESOLVED, that the 2019–2020 Fiscal Year Annual Financial Statements prepared by Satty, Levine and Ciacco for the Village of Westhampton Beach are hereby accepted. 4. Approve Warrant for February 2021 RESOLVED, that the warrant for February 2021 in the amount of $220,119.76 for the General Fund and $54,007.40 for the Capital Fund is hereby approved. 5. Approve 2020–2021 Fiscal Year Budget Transfers RESOLVED, that 2020–2021 fiscal year budget transfers in the amount of $50,000.00 are hereby approved. 6. Authorize Purchase of Radios for Police Department RESOLVED, that the Board of Trustees hereby approves the purchase of 3 MCD 5000 Desktop Radios from Motorola Solutions an amount not to exceed $7,000.00 from NYS Contract # PT68722 to be taken from G/L account A3120.2 Police Equipment. 7. Authorize Employees to Attend Training WHEREAS, Fire Marshal Danielle Golden would benefit from further education and training in execution of the duties of the Village Fire Marshal, including classes on fire protective systems, equipment and inspections; and WHEREAS, the Fire Marshal at times requires the assistance of Code Enforcement Officer Nicholas VanVliet in commissioning and inspecting new and existing fire alarm and fire sprinkler systems, as a second person is often needed in these circumstances. NOW THEREFORE BE IT RESOLVED, Fire Marshal Danielle Golden and Code Enforcement Officer Nicholas VanVliet are hereby authorized to attend the Fire Sprinkler Systems & Fire Alarm Systems Workshops at the New York State Academy of Fire Science in Montour Falls, New York, from May 3 to May 6, 2021 at a cost of $402.00 ($201 each participant) for training classes including lodging, and $376.05 for mileage reimbursement from G/L account code A3620.415 Education & Training; and be it further RESOLVED, Fire Marshal Danielle Golden is hereby authorized to attend the Fire Inspector 1 training at the New York State Academy of Fire Science in Montour Falls, New York, from June 14 to June 18, 2021 at a cost of $216 for training classes including lodging and $376.05 for mileage reimbursement from G/L account code A3620.415 Education & Training; and be it further RESOLVED, Employees attending classes will be paid their normal hourly wage up to seven hours per day while in training attendance. 8. Authorize the Mayor to Sign Memorandum of Understanding WHEREAS, the Board of Trustees adopted Chapter 174 of the Code of the Village of Westhampton Beach (“Underground Utility Lines”) on September 6, 2018 after public hearing, and adopted amendments thereto on July 1, 2019, also after public hearing; and WHEREAS, pursuant to Section 174-5A of the Code, all utility lines within the Downtown Main Street Corridor of the Village were directed to be installed underground or relocated to the rear of the properties located in the corridor; and WHEREAS, pursuant to direction from the Village, the Long Island Power Authority (“LIPA”) and PSEG Long Island relocated the electric utility lines in the Downtown Main Street Corridor to the rear of the properties within the corridor or underground; and WHEREAS, the relocation and undergrounding of utility lines at the direction of a municipality such as the Village is governed by a tariff for LIPA duly adopted by the State of New York, which tariff provides for LIPA to recover the costs through a levelized surcharge applied to the kWh usage on the bills of ratepayers in the taxing jurisdiction over a twenty (20) year period; and WHEREAS, Section 174-5H of the Code authorizes collection of the costs in this manner; and WHEREAS, as required by the aforesaid tariff, the Village has agreed to enter into a Memorandum of Understanding with LIPA in form annexed. NOW, THEREFORE, be it RESOLVED, that the Mayor is hereby authorized to execute the Memorandum of Understanding with LIPA on behalf of the Incorporated Village of Westhampton Beach. 9. Schedule Public Hearing Community Law Enforcement Review Committee Report RESOLVED, that the Village Clerk-Treasurer is hereby directed to publish and post a Notice of Public Hearing to be held on Thursday March, 4, 2021 at 5:00 p.m. at the Village Hall on the Law Enforcement Review Committee Report. 10. Accept Bid Proposal - Local Waterfront Revitalization Program RESOLVED, that the bid proposal submitted by MJ Engineering as program consultant for the Local Waterfront Revitalization Program in the amount of $68,000.00 is hereby accepted. 11. Authorize Mayor to Sign Contracts RESOLVED, that the Board of Trustees hereby authorizes the Mayor to execute a contract with Thomas Novelli Contracting Corporation for the Phase 1 Collection and Conveyance System to S.C.S.D. No. 24 Contract G and Hinck Electrical Contractor Inc. for the Phase 1 Collection and Conveyance System to S.C.S.D. No. 24 Contract E. 12. Authorize Traffic Study-Glovers Lane WHEREAS, A resident of Glovers Lane, Westhampton Beach, NY 11978, has complained about a dangerous traffic condition on Glovers Lane, specifically that members of the public drive the wrong way on Glovers Lane, which is a one-way street; and WHEREAS, this resident's attorney filed a Notification of Defects under Chapter 114 of the Code of the Village of Westhampton Beach in connection with this alleged dangerous traffic condition; and WHEREAS, the Village has determined that it should study the traffic safety conditions on Glovers Lane; and WHEREAS, the Village engineer, Ronald Hill, P.E., is a principal of Dunn Engineering, a traffic engineering firm uniquely suited to conduct such a study. NOW, THEREFORE, be it RESOLVED, that Ronald Hill, P.E. of Dunn Engineering, Westhampton Beach, NY 11978, is hereby retained by the Board of Trustees of the Village of Westhampton Beach to inspect, study and analyze the traffic safety condition of Glovers Lane after reviewing the Notification of Defects submitted in connection therewith and on behalf of a resident, and report back to the Board with his recommendations. 13. Authorize Memorandum of Agreement with PBA RESOLVED, that the Board of Trustees hereby ratifies and approves the 2017-2023 Memorandum of Agreement with the Village PBA and authorizes the Mayor to execute the agreement. 14.Appoint Provisional Police Chief RESOLVED that the Board of Trustees hereby appoints Sgt. Steven McManus to be Provisional Police Chief effective this date and continuing until the administration and the results of the required Civil Service examination with the salary for Provisional Chief to be $10,000 more than the current annual salary for Temporary Chief.
