Village of Westhampton Beach Board of Trustees Meeting Thursday, September 5, 2024, at 5 p.m. PLEDGE OF ALLEGIANCE PUBLIC HEARINGS: Local Law # 4 of 2024 – Chapter 143 Entitled Special Events & Use of Village Property RESOLUTIONS: 1. Adopt LL #4 of 2024 PUBLIC COMMENT EXECUTIVE SESSION - CONTRACTUAL Village of Westhampton Beach Board of Trustees Meeting Thursday, September 5, 2024, at 5 p.m. PLEDGE OF ALLEGIANCE PUBLIC HEARINGS: Local Law # 4 of 2024 – Chapter 143 Entitled Special Events & Use of Village Property RESOLUTIONS: 1. Accept minutes of Board of Trustees Meeting RESOLVED, that the minutes of the Board of Trustees Meetings of August 1st and August 21, 2024, are hereby accepted. 2. Accept Departmental Monthly Reports RESOLVED, that the Justice Court, Police Department’s and Building Inspector’s reports and Treasurer’s report for July 2024 are hereby accepted. 3. Approve Warrant for August 2024 RESOLVED, that the warrants for August 2024 in the amount of $430,320.57 for the General Fund and $496,531.59 for the Capital Fund and $655,444.07 for Trust and Agency Fund are hereby approved. 4. Schedule a Public Hearing RESOLVED, that the Village Clerk-Treasurer is hereby directed to publish and post a Notice of Public Hearing to be held on Thursday October 3, 2024, at 5:00 p.m. at the Village Hall for a Local Law to amend Chapter 77 of Village Code entitled “Dropoff Bins”. 5. Schedule a Public Hearing RESOLVED, that the Village Clerk-Treasurer is hereby directed to publish and post a Notice of Public Hearing to be held on Thursday October 3, 2024, at 5:00 p.m. at the Village Hall for a Local Law to amend Chapter 196 of Village Code entitled “Outdoor Tables, Chairs and Benches and Outdoor Music”. 6. Amend Use of Village Property – Veteran Memorial RESOLVED, that the Village Board authorizes the amendment of the August 1, 2024 resolution to read that there will be two WWII memorial stones in the Military Appreciation Park at the Village Marina each to be 4’ wide, 42” above grade and 18” deep of highly polished black granite with up to 60 veteran names from the Town of Southampton, project to be dedicated on August 15, 2025. 7. Authorize Waiver to SLA WHEREAS, the Village Board has received an application from the Greater Westhampton Chamber of Commerce to have a Fall Festival on Main Street on Saturday October 12, 2024, the perimeters which are set forth on the map submitted with the application and, WHEREAS, the Chamber of Commerce has asked the Village Board to waive the Village code chapter 54 Section 1-A to allow open containers within the perimeters, and to assist the Chamber and its participants with an application to the State Liquor Authority to authorize open container alcoholic beverages for this particular event on that day, now therefore be it; RESOLVED, that the Village of Westhampton Beach agrees to waive the provisions of the open container law as set forth in Chapter 54 Section 1A, and the Mayor is authorized to prepare and sign a “Container Letter” as quoted by the SLA confirming that the Village of Westhampton Beach authorizes and approves the use of open containers for this particular event within the perimeters. 8. Appoint Conservation Advisory Council Members RESOLVED, that Jim Badzik and Patricia Schaefer are hereby appointed to the Conservation Advisory Council for a two-year term to end June 30, 2026. 9. Authorize Payment for Grant Development Services RESOLVED, that the Board of Trustees hereby authorizes the payment to Mesiano Consulting in the amount of $7,200.00 for the Grant Developing Services for the month of July, to be taken from G/L account A1350.4 Grants Contractual. 10. Authorize Payment of 2023/2024 Assessment Roll Correction RESOLVED, the Board of Trustees hereby authorizes refund payments of 2024/25 tax year property taxes in the amount of $1,424.90 to the property owners specified on the attached list as a settlement of Small Claims as ordered by the NYS Supreme Court. 11. Authorize Change Order for Sewer System Construction RESOLVED, that the Board of Trustees hereby approves change order # 3 (E-CO-03) for Hink Electrical Contractor Inc. Contract E in the amount of $3,522.94 for the change of the existing 125A 3P Breaker at the North Pump Station and for a new 110A 3P breaker in the power panel. 12. Appoint Probational Seasonal Police Officer RESOLVED, that Joseph Procopio is hereby appointed to the position of Seasonal Police Officer at an hourly rate of $32.50, to be funded from G/L account A3120.104 Seasonal Part Time, effective September 14, 2024, in accordance with Suffolk County Department of Civil Service rules and procedures pending completion and graduation from the Suffolk County Police Academy. 13. Adopt LL #4 of 2024 Chapter 143 Entitled Special Events & Use of Village Property WHEREAS, this Board has advertised a local law enacting the addition of Chapter 143 (Special Events and Use of Village Property) to the Village Code; and WHEREAS, the proposed Local Law, Chapter 143, sets forth, in one place, standards, conditions and permit requirements for special events on private and Village property. WHEREAS, a public hearing was held on September 5, 2024; and WHEREAS, all persons present at the meeting have had an opportunity to speak on behalf of or in opposition to the proposed Local Law, or any part thereof; and WHEREAS, the Village Board has determined that said action is classified as an Unlisted action pursuant to the New York State Environmental Quality Review Act ("SEQRA") and a short form environmental assessment has been prepared and a determination made that such action will not have any significant adverse effect on the environment. NOW, THEREFORE, BE IT RESOLVED, that a determination is hereby made by this Board that the proposed addition of Chapter 143 (Special Events and Use of Village Property) to the Village Code will not have a significant adverse effect on the environment and a negative declaration pursuant to SEQRA is hereby issued; and be it further RESOLVED, that after due deliberation the Board of Trustees of the Village of Westhampton Beach is hereby adopting said Local Law as Local Law No. 4 of 2024, as advertised and attached; and be it further RESOLVED, that the Village Clerk is directed: to enter said Local Law in the records of the Village; and to give due notice of the adoption of said Local Law to the Secretary of State.
