Approve 2025 Beach Rates and Rules PUBLIC COMMENT Village of Westhampton Beach Board of Trustees Meeting Thursday, March 6, 2025, at 5 p.m. RESOLUTIONS: 1. Accept minutes of Board of Trustees Meeting RESOLVED, that the minutes of the Board of Trustees Meetings of February 6, 2025, are hereby accepted. 2. Accept Departmental Monthly Reports RESOLVED, that the Police Department’s, Building Inspector’s, and Treasurer’s February 2025 reports are hereby accepted. 3. Approve Warrant for February 2025 RESOLVED, that the warrants for February 2025 in the amount of $415,927.06 for the General Fund, $257,749.04 for the Capital Fund are hereby approved. 4. Approve Use of Village Property – St. Patrick’s Day Parade RESOLVED, that the Westhampton Beach St. Patrick’s Day Parade Committee is hereby authorized to conduct the Annual St. Patrick’s Day Parade on Mill Road to Main Street, subject to weather, on Saturday, March 15, 2025, from 1:00 a.m. to 3:00 p.m. subject to receipt of insurance documents. 5. Approve Use of Village Property – East End Little League RESOLVED, that East End Little League is hereby authorized to use the Great Lawn from March 15, 2025 through June 30, 2025, Monday through Friday from 4:00 p.m. to 7:00 p.m. and Saturdays from 9:00 a.m. to 12:00 p.m. for games and practices, and organizer will temporarily remove the fencing and equipment if requested by the Village. 6. Approve Use of Village Property – USPS District 3 RESOLVED, that the U.S. Power Squadron use of the Village Marina for the 2025 District 3 Annual District Rendezvous from Friday July 25, 2025, starting at 5:00 pm through Saturday July 26, 2024, subject to tent permit and fees is hereby authorized. 7. Authorize Payment of 2023/24 Assessment Roll Correction RESOLVED, that the Board of Trustees hereby authorizes refund payments of 2023/24 tax year property taxes in the amount of $10,957. to the property owners specified on the attached list as a settlement of Small Claims as ordered by the NYS Supreme Court. 8. Authorize Employees to attend Conference RESOLVED, that the Village Clerk-Treasurer and the Deputy Treasurer are hereby authorized to attend the New York State Governmental Finance Officers Association Conference in Albany, NY from April 1st – 4th, 2025. The cost is $250.00 each for the conference, $503 each for the hotel, $100 for gas and $250 each for food to be paid from G/L account code A1325.411 Education and Training 9. Authorize Police Officers to Attend Training RESOLVED, that 3 Police Officers are hereby authorized to attend the Bureau of Justice “Survive and Thrive” training from June 3-4, 2025. The cost for the hotel for 3 rooms, not to exceed $593, Meals and incidentals as per US GSA not to exceed $709 and Gas and tolls are not to exceed $100 to be paid from G/L account code A3120.415 Education and Training. 10. Authorize to Publish a Notice of Public Hearing RESOLVED, that the Village Clerk-Treasurer is hereby directed to publish and post a Notice of Public Hearing to be held on April 3, 2025, at 5:00PM at the Village Hall, regarding a proposed local law overriding the 2% tax cap as established in General Municipal Law Section 3-c. 11. Schedule Public Hearing on 2025–2026 Tentative Village Budget RESOLVED, that the Village Clerk-Treasurer is hereby directed to publish and post a Notice of Public Hearing to be held on April 3, 2025, at 5:00 p.m. at the Village Hall on the 2025–2026 Tentative Village Budget. 12. Authorize to Publish a Notice of Public Hearing RESOLVED, that the Village Clerk-Treasurer is hereby directed to publish and post a Notice of Public Hearing to be held on Thursday April 3, 2025, at 5:00 p.m. at the Village Hall for the Special Exception Application filed by Westhampton Beach Fire Department. 13. Authorize the Installation of Fiber by Optimum at the Chamber Building RESOLVED, that the Board of Trustees hereby authorizes the installation of fiberoptic cable by Optimum at the Chamber Building. 14. Authorize the Purchase of a ProLaser Speed Detector RESOLVED, that the Board of Trustees hereby authorizes the purchase of a ProLaser Speed Detector for the Police Department from Kustom Signals, INC. in the amount of $2,328.69 to be taken from G/L account A3120.2 Police Equipment. 15. Authorize the Upfitting of the New Police Vehicle RESOLVED, that the Board of Trustees hereby authorizes the upfitting of the new Police vehicle from Island Tech Services in the amount of $21,043.74 to be taken from G/L account A3120.2 Police Equipment. 16. Authorize Renewal of 2025 Outdoor Seating Permits WHEREAS, the Village has received applications to renew the Outdoor Tables, Chairs, Benches, Music and Dining Permits for 2025, and WHEREAS, after considering information supplied by the Suffolk County Department of Health Services, the Suffolk County Sewer Agency and the Village’s Building Administrator, the Board of Trustees determined Special Exception Permits should be issued for Outdoor Seating and Tables and Music, where there were no incidents or reports filed with the Police Department concerning said uses; now therefore be it RESOLVED, that the Board of Trustees hereby authorizes the placement of outdoor seating as shown on the submitted plans for the attached listed establishments, subject to all previous conditions and plans on file. 17. Authorize the Upgrade of LED Traffic Light and Camera RESOLVED, that the Board of Trustees hereby authorizes the upgrade of the LED Traffic Light and Camera at Sunset Avenue and Mill Road by Hinck Electrical in the amount of $14,955.82 for the LED Traffic Light Upgrade and $25,357.88 for the Camera to be taken from G/L account A5182.425 Traffic Light 18. Appoint Building Permits Examiner RESOLVED, that Alexandra Glasser is hereby appointed to the position of Building Permit Examiner at a semi-monthly salary of $2,500.00 effective March 10, 2025. 19. Adopt Local Law to Amend Chapter 178 – 25mph on Lilac Road WHEREAS, a public hearing was held before the Village Trustees at the Municipal Building, 165 Mill Road, Westhampton Beach, New York, on the 6th day of February 2025 to amend Chapter 178, entitled " Vehicles and Traffic," of the Code of the Village of Westhampton Beach; and WHEREAS, the Building & Zoning Department has found the proposed amendment to be a Type II action under 6 NYCRR 617.5 (c)(22) (SEQR) without the need for further environmental review. NOW THEREFORE BE IT RESOLVED, that after due deliberation the Board of Trustees of the Village of Westhampton Beach hereby adopts the Local Law as advertised; and be it further RESOLVED, the Village Clerk is hereby directed to enter said Local Law in the records of the Village, and to give due notice of the adoption of said Local Law to the Secretary of State. Chapter 178 Vehicles and Traffic Article VII Schedules §178-42 Schedule X: Speed Limits. Accept Performance Bond RESOLVED, that the Performance Bond received from First Dunes Development 496 LLC, in the amount of $60,000, is accepted as security for the performance of the development at 496 Dune Road, Westhampton Beach with satisfaction from the Village Planning Board. 21. Ratification of the MOA with the PBA RESOLVED, that the Board of Trustees hereby authorizes the ratification of the MOA with the PBA dated March 6, 2025. 22. Approve 2025 Beach Rates and Rules RESOLVED, that the attached Beach rates and rules for 2025 season are hereby approved. PUBLIC COMMENT 1. Parking Permit Stickers ("auto stickers") are required on all cars parked at Village Beaches. Auto stickers shall only be issued as follows: a. Westhampton Beach Resident Taxpayers A resident taxpayer may obtain a maximum of two (2) auto stickers. The first auto sticker shall be affixed to a vehicle either registered to or associated with (by, for example, auto rental contract) the property. The fee for the second auto sticker shall be $40.00 and the resident taxpayer shall designate the vehicle for the second auto sticker. Proof required: driver's license and vehicle registration. b. Westhampton Beach Year-Round Renters A year-round renter of residential property in the Village may obtain a maximum of one (1) auto sticker so long as no resident taxpayer auto stickers have been issued for the particular property. The auto sticker shall only be affixed to a vehicle either registered to or associated with (by, for example, auto rental contract) the renter or a member of the renter's household. Proof required: driver's license and vehicle registration with Westhampton Beach address. If driver's license and registration do not show Westhampton Beach address, one (1) winter utility bill in renter's name in addition to driver's license and registration. c. Seasonal Renters in Westhampton Beach A seasonal renter of residential property in the Village may obtain a maximum of one (1) auto sticker for the duration of the seasonal rental. The auto sticker shall only be affixed to a vehicle either registered to or associated with (by, for example, auto rental contract) the renter or a member of the renter's household. Proof required: driver's license and vehicle registration and current Village rental permit. d. Village Employee and Non-Resident Member of Fire Department, Ambulance, etc. A Village employee or non-resident member or employee of the Westhampton Beach Fire Department, Ambulance or other volunteer emergency service may obtain a maximum of two (2) auto stickers. The fee for the second auto sticker shall be $40.00. The auto stickers shall only be affixed to vehicles either registered to or associated with (by, for example, auto rental contract) to the employee, the member or employee of the voluntary emergency service organization, or to a member of his or her household. Proof required: driver's license, vehicle registration proof of employment or membership. e. Owners of Occupied Commercial Property The owner of occupied commercial property may obtain a maximum of two (2) auto stickers. The fee for the second auto sticker shall be $40.00. One or both auto stickers can be designated to the tenant or tenants of the particular commercial property. Proof required: driver's license, vehicle registration, copy of Village tax bill showing building ownership and copy of lease if auto sticker is being issued to a tenant. f. Year-Round Resident Taxpayer of Westhampton, Remsenburg, Speonk, Quiogue A year-round resident taxpayer of Westhampton, Remsenburg, Speonk or Quiogue may obtain one (1) auto sticker for a fee of $650.00. Veterans shall receive a ten (10%) percent discount. The auto sticker shall only be affixed to a vehicle either registered or associated with (by car rental, for example) the year-round resident taxpayer of Westhampton, Remsenburg, Speonk or Quiogue or to a member of his or her household. Proof required: driver's license and vehicle registration and for non-resident taxpayer: proof of ownership, for others: driver's license and vehicle registration showing Westhampton, Remsenburg, Speonk or Quiogue address. g. Seasonal Renter in Westhampton, Remsenburg, Speonk, or Quiogue A seasonal renter in Westhampton, Remsenburg, Speonk or Quiogue may obtain one (1) auto sticker for a fee of $975.00. The auto sticker shall only be affixed to a vehicle either registered or associated with (by, for example, auto rental contract) the seasonal renter or to a member of his or her household. Proof required: driver's license, vehicle registration, Town tax bill and letter from property owner. Note: All auto stickers shall be affixed to the appropriate vehicle by Village staff. 2. Beach Passes and Guests a. Resident Taxpayers, Village Employees and Non-Resident Members of Fire Department, Ambulance, etc. and Owners of Occupied Commercial Property A maximum of four (4) Beach Passes regardless of whether one (1) or two (2) auto stickers are issued for the particular property. Guests are limited to four per Beach Pass. There is no fee for guests. b. Year-Round Village Renter A maximum of four (4) Beach Passes. Guests are limited to four per Beach Pass. There is no fee for guests. c. Non-Resident Taxpayer, Year-Round Resident of Westhampton, Remsenburg, Speonk or Quiogue, Seasonal Renter in Westhampton Beach, Seasonal Renter in Westhampton, Remsenburg, Speonk or Quiogue A maximum of`four (4) Beach Passes, with a $3.00 fee for each photo-ID card. Guests are limited to two (2) per Beach Pass on weekends and holidays. There is no limit on the number of guests per Beach Pass on weekdays. The fee for each guest is $10.00 per day. d. Westhampton Beach Students, Grades 6-12 One Beach Pass issued to the student for a fee of $10.00 No guests are permitted. Proof required: Westhampton Beach School ID e. Hotel and Bed and Breakfast Patrons One daily Beach Pass per patron for a fee of $10.00 per day per patron. No guests are permitted. Proof required: hotel pass. Parking pass eligibility for each property and additional eligibility is non- cumulative with other eligibility (for example Village employee, Fire Dept.
