Petition #2970-Joseph Eadeh/Salem Abdelnour, 38743 Belliveau To consider the request of Joseph Eadeh/Salem Abdelnour, for a side yard setback variance from Ordinance 248, in order to construct a single-family home on a parcel located at 022-99-0047-701, 38743 Belliveau. “Section 110-7.4.2(b) states “the side yard abutting a street shall not be less than twenty (20) feet, when there is a common rear yard.” In the case of a rear yard abutting a side yard of an adjacent lot, the side yard abutting a street shall not be less than the adjoining front yard. Side yards between dwellings shall be alternated so as to provide a minimum of fifteen (15) feet between dwellings. The parcel south of 38743 Belliveau is considered the “side yard of an adjacent lot” under Sec. 110.7.4.2(b), which is roughly 137 feet from the property line from Grace Road. Section 110.7.4.2(b) requires that the subject property side yard be “not less than” the “adjoining front yard,” which it currently appears to be in the proposed site plan.” 2.
