Case No. 2015-40 Recommendation: The Planning Commission recommends that the Mayor and City Council: A) Adopt “A resolution of the Mayor and City Council of the City of Westminster amending the City’s Handbook of Water Efficiency Landscape Measures.” and B) Adopt “An ordinance of the Mayor and City Council amending Title 17 (Zoning Code) of the Westminster Municipal Code related to landscape provisions: Chapter 17.310 Landscaping” dy BACKGROUND/DISCUSSION: BACKGROUND In 2006, Governor Schwarzeneggar signed Assembly Bill AB 1881 (Water Conservation in Landscaping Act of 2006), which required cities to adopt a Model Water Efficient Landscape Ordinance (MWELO) developed by the California Department of Water Resources (DWR). In response to the new law, cities throughout Orange County (including Westminster), local water agencies, the Building Industries Association (BIA), the Orange County Fire Authority), irrigation consultants and landscape architects worked together developed an ordinance which was adopted by Orange County cities including Westminster Since 2010, California has experienced a worsening drought. Governor Brown issued Drought Executive Order (B-19-25) on April 1, 2015, directing DWR to update the State’s Model Water Efficient Landscape Ordinance by July 15, 2015, to increase efficiency standards for new and existing landscape through more efficient irrigation systems, greywater use, onsite storm water capture and limiting the portion of landscaping that can be covered in turf. On September 9, 2015, the California Water Commission adopted revisions to the California Code of Regulations Title 23, Division 2, Chapter 2.7 Model Water Efficient Landscape Ordinance, with the Page 9 AGENDA January 13, 2016 requirement that cities adopt an ordinance being “at least as effective as” State Model Water Efficient Ordinance by February 1, 2016, when such ordinance is based upon a regional model ordinance. Similar to the effort in 2009, MWDOC, the Association of California Cities, Orange County (ACCOC), cities within the County (including Westminster) and other stakeholders, have worked to update the Orange County Model Ordinance to ensure compliance with the Governor’s executive order and the recent changes to the State’s MWELO. The new Orange County Model Ordinance includes the following changes: Project Size Applicability The size of landscapes subject to the requirements of the MWELO has been lowered from 2,500 square feet to 500 square feet. The size threshold applies to residential, commercial, industrial and institutional projects that require a permit, plan check or design review. To reduce the complexity and costs for the smaller landscapes now subject to the MWELO, the revised MWELO has a perspective compliance approach (proposed Appendix A of the Handbook of Water Efficiency Landscape Measures) for landscapes between 500 and 2,500 square feet. Landscapes within this size range can comply either through meeting the traditional MWELO approach or through the prescriptive approach as illustrated in the proposed Appendix A to the Handbook of Water Efficiency Landscape Measures. The size threshold for existing landscapes that are being rehabilitated has not changed, remaining at 2,500 square feet. Only rehabilitated landscapes that are associated with a building or landscape permit, plan check, or design review are subject to the MWELO provisions. These new thresholds are reflected in the proposed changes to Chapter 17.310 (Landscaping). Definitions The definition section in the MWELO has been expanded to clarify and update the technical terms related irrigation and water use efficiency. These new and modified definitions are shown in the proposed revisions to the Handbook of Water Page 10 AGENDA January 13, 2016 Efficiency Landscape Measures. Reduced Water Use and Water Use Calculations The new MWELO further reduces water use from the current 70 percent to 55 percent for residential uses and to 45 percent for non-residential uses. These changes, along with other changes to how water use information is calculated, is provided in the revised water efficient worksheet and water budget, as shown in the proposed revisions to the Handbook of Water Efficiency Landscape Measures. Irrigation Systems The new MWELO requires landscape areas with a width of less than 10-feet to be irrigated with a subsurface drip or similar technology that produces no over spray or runoff. This requirement is also shown in the proposed revisions to the Handbook of Water Efficiency Landscape Measures. Greywater Systems The new MWELO added a greywater section that stipulates that landscapes less than 2,500 square feet that are irrigated entirely with greywater or captured rainwater are subject only to the irrigation system requirements of Appendix A (Prescriptive Compliance option) as shown in the proposed revisions to the Handbook of Water Efficiency Landscape Measures. Reporting Executive Order B-29-15 and the new MWELO require that local agencies report on the implementation and enforcement of their local ordinances to DRW by March 1, 2016, when such local agencies are adopting a regional ordinance, such as the Orange County Model Ordinance. Annual reporting for all local agencies is due on January 31st, for all consecutive years. DISCUSSION The proposed amendments to City’s landscape provisions (Chapter 17.310 of the WMC) and Handbook of Water Efficiency Landscape Measures include all of mandated revisions made to the MWELO, as reflected in the Orange County Model Ordinance. Proposed revisions to both documents Page 11 AGENDA January 13, 2016 are provided as Attachments A and B to the attached draft resolution and ordiance. In addition to the proposed amendments to Chapter 17.310 (Landscaping) related to the Executive Order B-29-15 and the new MWELO, staff believes that additional amendments to Chapter 17.310 (Landscaping) are necessary to clarify code requirements, achieve landscape water conservation, and ensure that changes that are otherwise not subject to the City’s landscape provisions (including the Water Efficiency Landscape Measures) are made in a way that is consistent with the City’s landscape requirements. These proposed additional changes are shown in Attachment A to the attached resolution and are discussed below: Changes to Turf or Groundcover The current code and proposed revisions associated with the MWELO, do not address situations where the only proposed change to an existing development is the replacement of turf or groundcover with other materials, such as decorative rock, pebbles or wood chips. For example, if an existing shopping center were to replace their turf areas with decorative rocks and make no other changes (including changes to the irrigation system), the City has no process for ensuring that such changes are consistent with Title 17 (Zoning Code). To address this issue, a new section (17.310.010(C)) is proposed that would require a Zoning Clearance when turf or groundcover is removed from an existing development and replaced with other materials, such as decorative rock, pebbles or wood chips. As discussed below, a separate proposed section would address changes to turf and groundcover for existing single-family homes. Landscape Maintenance The landscape maintenance section (17.310.020(A) (4) is proposed to be revised to include a provisions that all landscaped areas must be continuously maintained as approved by the City. Staff believes this provision will help to clarify the need for ongoing landscape maintenance. Groundcover Section 17.310.020(B)(2) is proposed to be revised Page 12 AGENDA January 13, 2016 to allow for pervious decorative materials, such as crushed rock, pebbles or woodchips to be used instead of turf and plants for groundcover. This proposed section will help to ensure that landscape areas use a minimal amount of irrigation water. However, this provision could result in landscape designs with significantly fewer plant materials. Modifications to Existing Single-Family Homes A new section 17.310.033 is proposed that would require a Zoning Clearance when more than 200 square-feet of landscape area of a single-family residential front or street side yard is removed and replaced with other landscaped materials (such as decorative rocks, pebbles, or wood chips). The new section would give the City an opportunity to review landscape changes in highly visible street facing front and side yards areas. Landscape Plan Requirements Section 17.310.030(A) is proposed to be revised by clarifying that the type of landscape plans required for new commercial and multi-family residential development (i.e. detailed planting plans and detailed irrigation plans) are not required for the removal of turf and groundcover, in situations where artificial turf is proposed, or for landscape changes to single-family homes. Artificial Turf Section 17.310.035 (Artificial Turf) has been revised to omit the reference to Development Review, Level I, as the code would require the more streamlined Zoning Clearance application process when artificial turf is proposed to replace existing turf or groundcover. For all new projects subject to the submission of full landscape and irrigation plans (all new development, excluding single-family homes), artificial turf is required to be shown on the project’s landscape plans. The current code does not require a landscape plan and building permit when artificial turf is added to a single-family home, however, the property owner of a single-family home is required to comply with the artificial turf standards. Additional Proposed Changes The landscape plan submittal requirements (Section 17.310.030(B)(2) includes th r e e proposed Page 13 AGENDA January 13, 2016 clarifications. Subsection 17.310.030(B)(2)(a) would be revised to clarify that landscape plans can be prepared by professionals licensed by the State to prepare such plans. Subsection 17.310.030(B)(2)(g) would be added to require that proposed decorative pervious materials be shown on landscape plans and subsection 17.310.030(B)(2)(p) would stipulate that improvements related water quality plans be shown on landscape plans. CONCLUSION The proposed zoning text amendment to Chapter 17.310 (Landscaping) of the WMC and proposed revisions to the City’s Handbook of Water Efficiency Landscape Measures, will ensure that the City is in full compliance with Executive Order B-29-15, the MWELO adopted by the DWR, and Orange County’s MWELO. The additional changes to Chapter 17.310 (Landscaping), as described above, will enhance the City’s efforts in achieving water conservation while also providing oversight as property owners throughout the City increasingly convert existing areas of turf and live groundcover to non-living forms of groundcover (i.e. decorative rocks, pebbles, and woodchips) as a means of conserving water. FINDINGS Section 17.620.030 of the City’s Zoning Ordinance (Title 17 of the Westminster Municipal Code) states that an amendment to the Title may be approved only if all of the following findings can be made in a positive manner. 1. The proposed amendment ensures and maintains internal consistency with the goals, policies, and strategies of all elements of the General Plan and will not create any inconsistencies with this Title, in the case of a Zoning Code amendment: The proposed amendment updates the City’s landscape standards and regulations found in Title 17, for the purpose of conserving irrigation water and ensuring that changes made to existing landscapes are in compliance with the City’s landscaping standards. As such, the proposed Page 14 AGENDA January 13, 2016 amendment to Title 17 is consistent with Westminster General Plan policy IVB1-2, which calls upon the City to encourage water conservation practices. In addition, since the proposed amendments regarding water efficient landscapes are mandated by the State, as expressed in the State’s Model Water Efficient Landscape Ordinance, the proposed amendment would ensure consistency between Title 17 and applicable State regulations. 2. The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the City; and The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the City because its adoption will result in the conservation of a natural resources (water) as it relates to landscape irrigation, plants and materials used for landscaping, and the process for reviewing new and rehabilitated landscape designs. 3. The proposed amendment is in compliance with the provisions of CEQA. Class 7, Section 15307 of the CEQA Guidelines, exempts actions taken to assure the maintenance, restoration, enhancement, or protection of a natural resource, such as water. Because the adoption of the proposed zoning text amendment will result in the conservation of a natural resources (water) as it relates to landscape irrigation, plants and materials used for landscaping, and the process for reviewing new and rehabilitated landscape designs, it is therefore exempt from CEQA and in compliance with the provisions of CEQA. PLANNING COMMISSION On December 16, 2015, the Planning Commission held a public hearing, considered the proposed revisions to Chapter 17.310 and the City’s Handbook of Water Efficiency Landscape Measures and voted to recommend that the Mayor and City Council adopt the subject ordinance and resolution. No one spoke in favor or opposition. COMMISSION AND COMMITTEE ITEMS Page 17 AGENDA January 13, 2016 7.1. 15-302 Request for Parking Restrictions on the East Side of La Pat Place between the Driveways at 13956 La Pat Place and 6551 Westminster Boulevard - T.C. 78-112 Recommendation: The Traffic Commission recommends that the Mayor and City Council Adopt a Resolution entitled, “A Resolution of the Mayor and City Council of the City of Westminster Providing for No Parking or Stopping at a Certain Location on the East Side of La Pat Place, North of Westminster Boulevard”. BACKGROUND/DISCUSSION: Staff presented this item at the Traffic Commission’s meeting of November 10, 2015. Staff received a request from Mr. Mark Schley (13956 La Pat Place and 6551 Westminster Boulevard), to install parking restrictions on the east side of La Pat Place between the driveways at 13956 La Pat Place and 6551 Westminster Boulevard, for a distance of 12 feet. Mr. Schley’s driveways are regularly blocked by vehicles and he believes that there is not enough room to safely perform a left or right turn maneuver from La Pat Place into his driveways. Chairman Cruz opened the Public Hearing. Mark Schley, 243 East 20th Street, Costa Mesa, the owner of the property, spoke in favor of the proposed restrictions. He stated that tow trucks have trouble getting in and out of the property if there is a vehicle parked in the subject area. He also stated that the average vehicle is 16 feet long, and the area in question is 12 feet long, therefore, the vehicle is always encroaching into the driveway. Joseph Dinh, 13767 and 13955 La Pat Place, spoke against the proposed parking restrictions. He stated that parking is very impacted in the area and the one parking space is greatly needed. He suggested that the gate on the property be widened to allow greater maneuverability and that if vehicles block the driveways, they should be ticketed. The Commission discussed the background of the parking restrictions, stating that they were removed once on both sides of the streets due to a high crime rate and accident rate. The parking was restored on Page 18 AGENDA January 13, 2016 the east side to help alleviate the impacted parking in the area. Chairman Cruz stated that any vehicle parked at the subject area would block either driveway. Staff’s recommendation was to approve the installation of parking restrictions on the east side of La Pat Place between the driveways at 13956 La Pat Place and 6551 Westminster Boulevard, for a distance of 12 feet. No one spoke on the subject parking restrictions. Commissioner Glew moved to approve staff’s recommendation to install parking restrictions on the east side of La Pat Place between the driveways at 13956 La Pat Place and 6551 Westminster Boulevard, for a distance of 12 feet. The motion was seconded by Chairman D. Nguyen. The motion was carried by a 4-0 vote, with Vice Chairman Robbins being absent.
