AGENDA CITY OF WESTMINSTER Special Mayor and Common Council Meeting Monday, December 23, 2024, at 3:00 p.m. City Administration Building, 45 West Main Street, Westminster, MD 21157 1. CALL TO ORDER 2. BID A) Award of Bid to Conewago Enterprises, Inc., for Construction of the PUREWater Westminster Water Reuse Facility in the amount of $25,492,599.00. – City Administrator Imhulse 3. ADJOURNMENT PUREWater Westminster Project and To: Mayor and Common Council From: Sara Imhulse, City Administrator Date: December 20,2024 Re: Award of Bid – Construction of PUREWater Westminster Water Reuse Facility Background Westminster, like other cities across the United States, is experiencing increased, recurring drought conditions. In response, the city has been proactive in its water supply planning to ensure local water reliability now and for the future. One forward-thinking way the City is planning for the future is by launching PUREWater Westminster, which will use proven technology to construct an indirect potable water reuse facility to provide a safe, sustainable, and drought-resistant water source. The project was advertised on EMMA with a pre-bid meeting and bid due dates of November 7, 2024, and December 18, 2024, respectively. A total of five bids were received. Name Total Bid Amount Conewago Enterprises, Inc. $25,492,599.00 M2 Construction LLC $26,462,942.00 American Contracting and $27,495,000.00 Environmental Services W.M. Schlosser Company, Inc. $27,933,000.00 CPP Construction Company, Inc. $31,534,000.00 Conewago Contractors, Inc. was the lowest bidder. The City has an extensive and successful history of partnering with Conewago to complete Public Works projects. Examples include the original construction of the Water Reclamation Facility at its current location in the early 1970’s, the upgrade and expansion of the facility in the late 1980’s, the Biological Nutrient Removal (BNR) upgrade in the mid 2000’s, and the Water Treatment facility and Gesell well in the mid 2010’s. Recommendation City staff has reviewed and evaluated references and the proposal from Conewago Enterprises, Inc. in the total amount of $25,492,599.00 and finds it to be acceptable with regard to the City’s needs. Staff recommends that the Mayor and Common Council award the bid to Conewago Contractors, Inc. in total amount of $25,492,599.00, for construction of the PUREWater Westminster Water Reuse Facility. A) Bid Forms Bid Forms for all five bidders were evaluated. No math errors were found in the Bid Forms. However, there were written typos for the following: • M2 Construction, LLC Bid Item 5 was written as $2,500,00 instead of $2,500,000 • WM Schlosser Company, Inc. Contingent Item 14 was written as $8,000 instead of $8,600. Neither of these typos affect the overall total bid prices listed by each bidder. All five bidders have listed manufacturers that were specified for the Reverse Osmosis (RO), Granular Activated Carbon (GAC), and Ultraviolet (UV) systems. The apparent low bidder, Conewago Enterprises, Inc. has specified Biwater for the RO System, New Terra for the GAC System, and DeNora for the UV System. B) Addenda All bidders have acknowledged receiving Addenda Numbers 1 through 3 on their Bid Forms. C) Bid Price Evaluation The apparent low bidder is Conewago Enterprises, Inc. with a Total Base Bid Price of $24,140,379.00, which is approximately 27% above the Engineer’s Estimate. This can be attributed to the reduced labor force, delays in the supply chain as a result of the COVID-19 pandemic, and availability of materials. D) Required Forms All bidders submitted the required attachments with their bids as listed in the Instructions to Bidders. M2 Construction LLC did not sign the revised Equal Opportunity Employer Form or revised Affidavit of Public Contracting Eligibility Form included in Addendum No. 3. However, the original forms were included and signed. We assume City will check and confirm bond, insurance, and other requirements for all bidders. E) Bidders’ Qualifications All bidders completed and submitted their Experience Record and References forms by the December 4, 2024 due date. The City and WATEK have checked the experience and qualifications of the apparent low bidder and consider them qualified for successful completion of this project. In fact, Conewago Enterprises, Inc. was the contractor on two previous City projects where WATEK was the Engineer: Cranberry Water Treatment Plant and Addition of Membrane Filtration System at Gesell Well No. 12. Therefore, based on the above, we recommend awarding the contract to the apparent low bidder, Conewago Enterprises, Inc., who is considered well qualified to perform the work required under this contract.
